HomeMy WebLinkAboutR95-069 reconfirming resolution 80-39 for mining claims obtained by treasurer's deedcommissioner ~D~~.~ moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 95-~~ RECONFIRMING POLICY SET FORTH IN RESOLUTION NO. 80-39 CONCERNING MINING CLAIMS OBTAINED BY EAGLE COUNTY THROUGH TREASURER'S DEED WHEREAS, on July 22, 1980 the Board of Commissioners of Eagle County ("Board") adopted Resolution No. 80-39 which states in part: WHEREAS, the County of Eagle, Colorado, has obtained certain mining claims and/or proportionate interests in certain mining claims situate in the County of Eagle by conveyance to the County through Treasurer's Deeds; and WHEREAS, a majority of the lands within Eagle County are within the boundaries of national forest service lands; and WHEREAS, the economy of Eagle County in recent years has developed primarily as a resort and recreational center with heavy usage of the forest lands for such purposes including, but not limited to, camping, hiking, skiing, horseback riding, and similar uses; and WHEREAS, most of these mining claims acquired by Eagle County at tax sales are located within national forest service lands; and WHEREAS, any type of development and/or similar use of such mining claims within national forest service lands would interfere with the recreation and resort uses to which such lands are now being applied and would substantially impair the economy of the area and would be a financial burden upon the County and other special districts situate therein to provide essential and necessary services, i.e., sewer, water, access, etc. , to any such type of development and/or any other similar purpose to which such mining claims might be used; and WHEREAS, the Board has determined that it would be in the best interests of the public health and welfare of the citizens of Eagle county that such mining claims be retained and used for public purposes including open space and general recreation uses; and WHEREAS, those mining claims belonging to the County by Treasurer's Deed have demonstrated a clear public benefit in the provisions of quality outdoor recreation and wilderness experience. NOW THEREFORE, be it resolved by the Board of County Commisisoners, County of Eagle, Colorado: THAT, the Board hereby determines that those mining claims and/or those proportionate interests in mining claims belonging to the County by Treasurer's Deeds, as amended, are useful and necessary for present public open space and related recreational uses and that such mining claims are suitable for and intended for use in the promotion of the public health, welfare and for the conservation of natural resources. THAT, the Board, having made the determination in the paragraph next above and having applied such lands for such purposes, hereby withdraws from sale those mining claims currently owned by the County of Eagle. THAT, the Board may, by subsequent resolution, choose from time to time to exempt certain mining claims from the provisions of this Resolution and offer same for sale. WHEREAS, the Board desires to preserve open space within the Forest Service lands; and WHEREAS, the Board desires to reconfirm the polices as stated in said Resolution No. 80-39. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby reconfirms the policies as stated in Resolution No. 80-39. THAT, this Resolution is necessary for the health, safety and welfare of the County of Eagle, State of Colorado. f MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State Colorado, at its regular meeting held the 5~_ day of , 1995.
