COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 2022 -054
FOURTH AMENDMENT TO THE RESOLUTION ADOPTING A SCHEDULE OF
AIRLINE RATES AND CHARGES FOR THE EAGLE COUNTY REGIONAL
AIRPORT
WHEREAS, by Resolution No. 2020-23, dated March 17, 2020, the Board of County
Commissioners for Eagle County, Colorado ("BoCC") established a schedule of airline rates and
charges for the Eagle County Regional Airport;
WHEREAS, said rates and charges structure was to become effective on May 1, 2020;
WHEREAS, by the First Amendment dated May 12, 2020, due to the coronavirus pandemic and
its attendant impacts on the airline industry, the BoCC extended the effective date of the new
rates and charges structure to August 1, 2020;
WHEREAS, by the Second Amendment dated December 29, 2020, effective as of August 1,
2020, nun pro tunc, the BoCC again extended the effective date of the new rates and charges
structure to January 1, 2022, due to similar pandemic concerns;
WHEREAS, by the Third Amendment dated December 7, 2021, the BoCC again extended the
effective date of the new rates and charges structure to July 1, 2022, due to similar concerns; and
WHEREAS, for the same reasons, the BoCC is now desirous of again extending the effective
date of the new rates and charges structure to January 1, 2023.
NOW, THEREFORE,be it resolved by the Board of County Commissioners of the
County of Eagle, State of Colorado:
THAT, Section 2.1 of Resolution No. 2020-23 shall be deleted in its entirety and replaced with
the following effective upon the execution of this Fourth Amendment:
"Section 2. Effective Date
2.1. This Resolution shall take effect on January 1, 2023."
That, until the new rates and charges take effect, all existing agreements with airlines shall
remain in place pursuant to the terms and conditions of the same.

That, except as expressly altered, modified and changed in this Fourth Amendment, all terms
and provisions of Resolution No. 2020-23 shall remain in full force and effect, and hereby are
ratified and confirmed in all respects as of the date hereof.
That, if any conflict exists between the provisions of this Fourth Amendment and Resolution
No. 2020-23, the provisions of this Fourth Amendment shall control.
MOVED,READ,AND ADOPTED,by the Board of County Commissioners of the County of
Eagle, State of Colorado, at its regular meeting held the 5th day of July, 2022, effective as of
July 1, 2022, nun pro tunc.
