APPROVAL OF THE FINAL PLAT FOR THE CORDILLERA SUBDIVISION FILING:34 BLOCK: 5
LOT: 14
Eagle County File No.AFP-009128-2020
WHEREAS, on or about December 22, 2020,the County of Eagle,State of Colorado,accepted
for filing an application submitted by Curt and Jane Tudor (the "Applicant") for an amendment to
the final plat for 663 Granite Springs Trail, file number AFP-009128-2020, (the "Amended Final
Plat") to amend the building envelope. The subject property, 663 Granite Springs Trail (the
"Property"),is 6.605 acres in total,legally described in Exhibit A.and
WHEREAS, pursuant to Section 5-290.B.3 and Section 5-290.G.3 of the Eagle County Land
Use Regulations (the "ECLUR") and Section 1.10.1 of the the Cordillera Subdivision Eleventh
Amended and Restated Planned Unit Development Control Document (the "PUD Guide"), the
Amended Final Plat (the "AFP") application is the appropriate process to amend the building
envelope; and
WHEREAS, pursuant to Section 4-450 of the ECLUR, the Property is located within a
Ridgeline Protection Area; and
WHEREAS, in accordance with ECLUR Section 5-210.E - Notice of Public Hearings,notice of
the AFP was mailed to all owners of property adjacent to the Property concerning the subject
matter of the application and setting forth the dates and times of meetings for consideration of the
application by the Board; and notice of Final Plat was posted at the Property setting forth the dates
and times of meetings for consideration of the application by the Board; and notice in newspaper
was given on April 1, 2021;and
WHEREAS, at its public hearing held on April 27,2021,the Board considered the proposed
AFP, associated plans, the statements and concerns of the Applicant, the Eagle County Community
Development Department,Engineering staff,other interested persons,and;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County
of Eagle,State of Colorado:
THAT, based on the evidence, testimony, exhibits, and study of the Comprehensive Plan for
the unincorporated areas of Eagle County,comments of the Eagle County Department of Community
Development, comments of public officials and agencies, and comments from all interested parties,

the Board finds as follows:
THAT, proper public notice was provided as required by law for the hearing before the
Board; and
THAT, the AFP was reviewed for conformance with ECLUR Section 4-450-Ridgeline
Protection,and found to meet the requirements of that Section;and
THAT, the AFP DOES conform with the requirements and standards set forth in ECLUR,
Section 5-290.G.3 -Standards for Amended Final Plat and ECLUR,Section 5-290.0-Procedure as set
forth below:
1. Adjacent Property. Pursuant to Section 5-290.G.3.a, the AFP will not have an adverse
impact on adjacent property owners. Based on the existing conditions of the Property and
mitigation measures, visual impacts to adjacent property owners are minimized with the
adjustment of the building envelope and proposed deck.
2. Final Plat Consistency. Pursuant to Section 5-290.G.3.b, the AFP is not inconsistent with
the intent of the Final Plat for the Cordillera Subdivision,Filing No.34.The AFP includes all
encumbrances on the Property and has incorporated the applicable plat notes from the
existing Final Plat. No encumbrances or plat notes restrict the building envelope
adjustment. The AFP is consistent with the overall intent of the existing Final Plat:to plat 59
lots with associated easements in the PUD.
3. Conformance with Final Plat Requirements. Pursuant to Section 5-290.G.3.c, the AFP
conforms to the Final Plat Requirements, including proof of adequate water supply,
wastewater facilities, access, zoning, fire protection, school land dedication or fees, site
plans,avoidance of hazards,and conformance with applicable agreements.
4. Improvement Agreement. Pursuant to Section 5-290.G.3.d, the AFP does not include
public improvements or public improvements agreements.Accordingly, this standard is not
applicable.
5. Restrictive Plat Note Alteration. Pursuant to Section 5-290.G.3.e, the AFP does not alter
any existing restrictive plat notes.Thus,this standard is not applicable.
THAT, the Board considered compliance with the Cordillera Subdivision PUD Control
Document in their review of the proposal;and
THAT,this application for an Amended Final Plat is hereby approved;and
THAT, the Board directs the Department of Community Development to provide a copy of
this Resolution to the Applicant;and
THAT, the Board hereby finds, determines and declares that this Resolution is necessary for

the health,safety,and welfare of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of
Eagle, State of Colorado, on this 8th day of March , 2022, nunc pro tunc April
27, 2021.
