HomeMy WebLinkAboutR22-013 WJWJ Ranch Amended Final Plat Approval Eagle County, CO 202202118 DocuSign Envelope ID:50A533D5-4460-4125-98A3-D153C9612232 Regina O'Brien 02/08/2022 Pgs: 5 04:55:13 PM REC: $0.00 DOC: $0.00 Commissioner LS c.11 e_Cr moved adoption of the following Resolution: BOARD OF EAGLE COUNTY COMMISSIONERS COUNTY OF EAGLE,STATE OF COLORADO RESOLUTION NO.2022 - 0i 3 APPROVAL OF THE FINAL PLAT FOR THE WJWJ RANCH,FORMERLY EMMA FARMS SUBDIVISION,AMENDED FINAL PLAT Eagle County File No.AFP-009120-2020 • WHEREAS, on or about October 7, 2020, the County of Eagle,State of Colorado accepted an application submitted by WJWJ RANCH HOLDINGS, LLC (the "Applicant"), for approval of an amended final plat for 401 and 501 Hooks Lane, file number AFP-009120-2021 (the "Amended Final Plat"). The Amended Final Plat removes restrictive plat notes tied to the Emma Farms Subdivision (the "Subdivision) located at 401 and 501 Hooks Lane (the "Property")and renames it as the WJWJ Ranch. The subject properties,401 and 501 Hooks Lane,and Open Space Parcel A and Open Space Parcel B, respectively, (the "Property"), are 105.545 acres in total, legally described in Exhibit A;and WHEREAS, pursuant to Section 5-290.B.3 and Section 5-290.G.3 of the Eagle County Land Use Regulations (the "ECLUR"), the Amended Final Plat (the "AFP") application is the appropriate process to remove restrictive plat notes and change the name;and WHEREAS, in accordance ECLUR Section 5-210.E - Notice of Public Hearings, notice of the Amended Final.Plat was mailed to all owners of property adjacent to the Property concerning the subject matter of the application and setting forth the dates and times of meetings for consideration of the application by the Board; and notice of Final Plat was posted at the Property setting forth the dates and times of meetings for consideration of the application by the Board; and notice in newspaper was given on June 24,2021; and WHEREAS, at its regular public hearing held on July 13, 2021, the Board considered the Amended Final Plat, the statements and concerns of the Applicant, the Eagle County Community Development Department,Engineering staff,and other interested persons. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle,State of Colorado: THAT, based on the evidence, testimony, exhibits, and study of the Comprehensive Plan for the unincorporated areas of Eagle County,comments of the Eagle County Department of Community Development, comments of public officials and agencies, and comments from all interested parties, the Board finds as follows: THAT, proper public notice was provided as required by law for the hearing before the 1 DocuSign Envelope ID:50A533D5-4460-4125-98A3-D153C9612232 Board; and THAT, this AFP DOES conform with the requirements and standards set forth in ECLUR, Section 5-290.G.3 -Standards for Amended Final Plat and ECLUR,Section 5-290.0-Procedure as set forth below: 1. Adjacent Property. Pursuant to Section 5-290.G.3.a, the AFP has no adverse impact on adjacent property owners. The AFP removes plat notes related to water supply for fire protection and emergency vehicle access originally intended for denser development, and changes the name. The removal of plat notes did not increase density, revise the use of the land,increase traffic,or alter building envelopes or developmental area. 2. Final Plat Consistency. Pursuant to Section 5-290.G.3.b, the AFP is not inconsistent with the existing Final Plat for the Emma Farms Subdivision. The AFP includes all relevant encumbrances on the Property and incorporates all applicable plat notes from the existing Amended Final Plat. The AFP is consistent with the overall intent of the existing Amended Final Plat,to plat two (2) single family residential lots and two (2) open space parcels. 3. Conformance with Final Plat Requirements. Pursuant to Section 5-290.G.3.c, the proposed AFP complies with all of the Final Plat Requirements,including proof of adequate water supply, wastewater facilities, access, zoning, fire protection,school land dedication or • fees,site plans,avoidance of hazards,and conformance with applicable agreements. 4. Improvement Agreements. Pursuant to Section 5-290.G.3.d, AFPs must be reviewed for the adequacy of applicable improvements agreements and/or off-site road improvements agreements. The public improvements required in the existing Final Plat were determined to be unnecessary based upon the existing improvements and development rights, and the Subdivision Improvements Agreement for Emma Farms was terminated through Resolution 2021-042, recorded at Reception Number 202201010. The remaining needs for fire suppression are addressed with new plat notes. 5. Restrictive Plat Note Alteration. Pursuant to Section 5-290.G.3.e, the proposed AFP must meet certain criteria in order to remove restrictive plat notes. This AFP removes restrictive plat notes that are associated with development rights that no longer exist for the property, therefore the AFP complies with Criteria (1), "That the area for which the amendment is requested has changed or is changing to such a degree that it is in the public interest to encourage a new use or density in the area': THAT, pursuant to Section 5-290.G.3 of the ECLUR, the AFP DOES conform with ALL applicable conditions of approval;and THAT,the application for the AFP be and is hereby APPROVED;and THAT, the Board directs the Department of Community Development to provide a copy of this Resolution to the Applicant;and THAT, the Board hereby finds, determines and declares that this Resolution is necessary for 2 DocuSign Envelope ID:50A533D5-4460-4125-98A3-D153C9612232 the health,safety,and welfare of the citizens of Eagle County.
