HomeMy WebLinkAboutR22-002 Extension of Local Disaster Emergency Declaration Re: 2021 COVID-19 DocuSign Envelope ID:556220AB-E187-4276-8987-6722C8C0FAE9 Commissioner Chandler-Henry moved adoption of the following resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2022- 002 EXTENSION OF THE EAGLE COUNTY, COLORADO LOCAL DISASTER EMERGENCY DECLARATION RE: 2021 COVID-19 WHEREAS, on March 6, 2020, Eagle County Public Health and Environment ("ECPHE") confirmed its first case of COVID-19 within the county. Since that time, Eagle County has seen more than 10,000 cases of the illness as well as 32 fatalities to date; and WHEREAS, on March 6, 2020,pursuant to the authority delegated by the Board of County Commissioners ("Board"), the Eagle County Manager declared a local disaster emergency because the cost and magnitude of responding to and recovering from the impact of COVID-19 in the community far exceeded the county's available resources; and WHEREAS,the Board extended the local disaster emergency six times, on March 10, April 7, April 28, May 26, June 20, and September 29, 2020 (collectively"Prior Declaration"), because the conditions that spurred the declaration had not abated; and WHEREAS, the Board rescinded the Prior Declaration on May 18, 2021, as conditions no longer posed the same serious threat to the health and safety of the citizens of Eagle County; and WHEREAS,new variants of COVID-19, including Delta and Omicron, have now become prevalent in Eagle County, necessitating a new emergency declaration. Due to the contagiousness of these new variants, coupled with the numerous travelers from around the world currently visiting the county, Eagle County is seeing and will continue to see cases of the virus and its transmission with the community; and WHEREAS,the volume of COVID-19 cases in Eagle County is causing serious impacts to county health and medical systems and has the potential to create significant disruption to public safety, transportation, education, business workforce, and other critical infrastructure sectors. WHEREAS, and as a result, on December 28, 2021, Eagle County Manager Jeff Shroll issued a Local Disaster Emergency Declaration re: 2021 COVID -19; and WHEREAS, C.R.S. 24-33.5-709(1)provides "[a] local disaster may be declared only by Eagle County, co 202200239 Regina O'Brien 01/05/2022 Pgs: 3 12:50:52 PM REC: $0.00 DOC: $0.00 DocuSign Envelope ID:556220AB-E187-4276-8987-6722C8C0FAE9 the principal executive officer of a political subdivision. It shall not be continued or renewed in excess of seven days except by or with the consent of the governing board of the political subdivision;" and WHEREAS, the conditions that spurred the County Manager to declare the local disaster emergency have not abated; and WHEREAS, "The effect of a declaration of local disaster emergency is to active the response and recovery aspects of any and all applicable local and interjurisdictional disaster emergency plans and to authorize the furnishing of aid and assistance under such plans." C.R.S. 24-33.5-709(2); and WHEREAS, defining clear roles for and direction to those responding to the local disaster emergency and operating under Eagle County's emergency operations plan will allow a more effective response. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Eagle County, Colorado: THAT, the Board confirms, determines, and declares that the presence and high likelihood of additional cases of the COVID-19 virus, inclusive of the Delta and Omicron variants, within Eagle County constitutes a local disaster emergency that warrants continuing the emergency response and furnishing aid and assistance to affected portions of the community. THAT, this Resolution and the local disaster emergency declaration will continue until otherwise amended or rescinded by this Board. THAT, the Board recognizes that ECPHE, by and through its director and in coordination with the Eagle County Board of Health, County Manager's Office, Emergency Management Office, and our local and statewide partners, is currently incident command for the response to COVID-19 within Eagle County. ECPHE has authority under state law to issue orders and guidance, and take other actions as necessary to protect the public health, safety, and welfare. The Board directs county staff to take such actions to effectuate the orders and guidance of ECPHE as necessary, in consultation with the Board where appropriate. Additionally, the Board directs the County Manager and Emergency Manager to continue working closely with our internal and external partners to ensure a coordinate and effective response throughout the county. THAT, this Resolution and Declaration shall be promptly filed with the Eagle County Clerk and Recorder and with the Office of Emergency Management.
