HomeMy WebLinkAboutR21-091 Approval of the Crown Mountain Park & Rec District Improvments Eagle County, CO 202125978 DocuSign Envelope ID:62087F0C-DOAC-421F-BB78-1FAAB58AE7EC Regina O'Brien 11/18/2021 Pgs: 7 10:43:44 AM REC: $0.00 DOC: $0.00 Commissioner Chandler-Henry moved adoption of the following Resolution: BOARD OF EAGLE COUNTY COMMISSIONERS COUNTY OF EAGLE,STATE OF COLORADO RESOLUTION NO.2021-091 RESOLUTION FOR THE APPROVAL OF THE BATHROOM AND SHADE STRUCTURE FOR CROWN MOUNTAIN PARK AND RECREATION DISTRICT Eagle County File No.LR-9155-2021 WHEREAS, on or about March 29,2021,the County of Eagle,State of Colorado,accepted for filing an application("Application")submitted by Crown Mountain Park and Recreation District(the "Applicant") for design review approval for the construction of a combined bathroom and shade structure (the "Proposal"), located on land leased by Crown Mountain Recreation District from Eagle County,known as Crown Mountain Park(the"Property"),and; WHEREAS, the Property is located within the Crown Mountain Park Planned Unit Development (the "PUD"),which contains 119.5 acres, as shown on the final plat recorded with the Eagle County Clerk and Recorder's Office at Reception Number 200819851,and; WHEREAS, the Proposal is located in the northwestern portion of the above described Property,with a total footprint of approximately 40-feet by 24-feet as shown in Exhibit A-Site Plan, attached hereto and incorporated herein by this reference,and; WHEREAS, the Crown Mountain Park PUD Guide (the "PUD Guide") attached hereto as Fxhihit B and incorporated herein by this reference, is the governing zoning document for the Property. The PUD Guide acknowledges that future development will take place in the PUD that is not yet designed or detailed. As such,the PUD Guide outlines a process to review applications for • development within the PUD through what is called a design review. The PUD Guide includes provisions for reviewing development applications in Exhibit A of the PUD Guide,and; WHEREAS,the Application was processed by Eagle County as a Limited Review application because the Eagle County Land Use Regulations(the"ECLURs")do not contain a specific process for design reviews,and; WHEREAS, in accordance with ECLUR, Section 5-210.E - Notice of Public Hearings, notice was posted at the Proposal site and notice of the Application was mailed to all owners of property adjacent to the Property setting forth the dates and times of meetings for consideration of the Application by the Roaring Fork Valley Regional Planning Commission(the"Planning Commission") and the Board of County Commissioners of the County of Eagle(the"Board");and WHEREAS, at its public hearing held on June 17, 2021, the Planning Commission, based upon its findings,recommended approval of the Application,and; 1 DocuSign Envelope ID:62087F0C-DOAC-421F-BB78-1FAAB58AE7EC WHEREAS, at its regular public hearing of July 6, 2021, the Board considered the Application; associated plans; and the statements and concerns of the Applicant,the Eagle County Community Development staff, and other interested persons; and the recommendation of the Planning Commission;and WHEREAS,based on the evidence,testimony, exhibits,and study of the PUD Guide,as well as the comments of the Eagle County Department of Community Development,recommendation of the Planning Commission,and comments from all interested parties,the Board,finds as follows: 1. THAT,proper publication and public notice was provided as required by the ECLURs and state law for the hearings before the Planning Commission and the Board. 2. THAT,the Application complies with the standards in the Crown Mountain Park PUD Guide,Exhibit C,as set forth below: A. Consistent with the PUD Guide. Pursuant to Exhibit B, the Application is in substantial compliance with the PUD Guide review standards, including permitted uses, site location, site circulation and access, setbacks, exterior finish and materials,exterior lighting,parking, landscaping,signs,and refuse and storage. Permitted Uses. "Concessions and Restrooms" are listed as number 18 on the list of uses by right within the PUD. Therefore, the Board finds that the Application is consistent with the permitted uses in the PUD Guide. Site Location. The PUD Guide contains a site plan that it states is for illustrative purposes only. This site plan does not show any areas specifically designated for restrooms, though restrooms are permitted as a use by right. These restrooms are primarily meant to serve the BMX track and tennis courts in the western section of the Property,both of which are located in accordance with the site plan contained in the PUD Guide. Since the restroom/shade structure is auxiliary to the existing BMX track and tennis courts, the Board finds that the Application is consistent with the site location requirements in the PUD Guide. Site Circulation and Access. The restroom/shade structure is an additional amenity for the BMX track and tennis courts and is not anticipated to generate additional traffic to Crown Mountain Park.At the end of Eagle County Drive,there is a rope gate that can be unclipped by staff of the Crown Mountain Recreation District or by emergency services accessing the BMX track or the site of the restrooms. A pedestrian path is planned as part of the proposal to connect the existing parking area to the restrooms. This path will initially be constructed of compacted base course materials in compliance with the Americans with Disabilities Act and is planned to be paved with asphalt in 2022. Therefore, the Board finds that the Application is consistent with the site circulation and access requirements contained in the PUD Guide. Setbacks. The PUD Guide states that proposed buildings must be contained within the building envelopes shown on the site plan,however,the site plan is labelled as being for illustrative purposes only, it does not contain specific dimensions, and it does not show areas for all of the approved uses. The PUD Guide also contains 2 DocuSign Envelope ID:62087F0C-DOAC-421 F-BB78-1 FAAB58AE7EC setback limitations, which were applied to this Application in lieu of a specific • building envelope. The Board finds that the Application meets all setback requirements. Exterior Finishes and Materials. The PUD Guide contains standards concerned with various elements of the exterior design of the recreation facilities.It discusses topics ranging from the materials permitted for use in construction of the roof and exterior walls, the color and types of coating that may be utilized, and how the recreation center's main entrance shall be constructed. In accordance with the applicable design criteria, the proposed restroom structure will utilize metal and wood in its construction, use coating that will not cause glare or unnecessary heat gain,and will integrate the concepts for building entrances that are appropriate for a restroom context. The Board finds that the Application is consistent with the exterior finish, materials,and other exterior design elements contained in the PUD Guide. Exterior Lighting. The PUD Guide permits exterior lighting for signage and safety purposes only, and requires that all exterior lighting be"Dark Sky"fixtures,which it describes as fully shielded and downward facing. Exterior lighting is proposed over the stairways and entrances only, and makes use of shielded, downward facing lights. The Board finds the Application is in conformance with the exterior lighting standards contained in the PUD Guide. Lighting Plan. A final lighting plan must be submitted to the County as a part of the review process contained in the PUD Guide. The Application contains a plan for the exterior lighting described above.The Board finds that the lighting plan contained in the Application materials satisfies this requirement. Parking. The PUD Guide limits the total amount of parking in Crown Mountain Park to 254 spaces. The restroom/shade structure is adjacent to an existing gravel parking area containing 45 parking spaces and two ADAaccessible parking spaces, intended to primarily serve the BMX park. The restroom/shade structure is not anticipated to generate a need for additional parking and the total existing parking in Crown Mountain Park is below 254 spaces. The Board finds the Application conforms to the parking requirements contained in the PUD Guide. Landscaping. The PUD Guide requires the use of xeric grasses,plants, and trees for all landscaping, and prohibits the planting of fruit-bearing species due to concerns about bears.The Application contains no plans to alter landscaping.The landscaping plan consists of reseeding any grass that is disturbed by construction,to restore the sod to existing condition. The Board finds the Application meets the requirements contained in the PUD Guide. Signs. The PUD Guide requires that all signage conform to the ECLURs.There is no signage planned for the restroom/shade structure, outside of the address on the exterior of the building. The Board finds the Application meets the requirements contained in the PUD Guide. Refuse/Storage. The PUD Guide requires that any exterior storage have its visual impact mitigated and that it must not occupy parking spaces.The PUD Guide does not provide any guidance on refuse. Therefore,the PUD Guide defers to the ECLUR, 3 DocuSign Envelope ID:62087F0C-DOAC-421F-BB78-1FAAB58AE7EC which requires the use of wildlife-proof refuse containers per Section 4-410.C. - Wildlife Proof Refuse Proof Container/Enclosure Standards.The Application does not • contemplate any exterior storage, and the trash receptacles utilized will be bear proof.Therefore,the Board finds that this criteria is met. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle,State of Colorado: THAT this Application is hereby approved, subject to the following condition, and that violation of any condition shall be the basis for revocation of the approval pursuant to the ECLURs: 1. Except as otherwise modified by this development permit, all material representations made by the Applicant in this application and in public meetings shall be adhered to and considered conditions of approval. THAT,this Application shall be subject to review as provided for by the ECLURs. THAT, the Board directs the Department of Community Development to provide a copy of this Resolution to the Applicant. THAT,the Board hereby finds,determines and declares that this Resolution is necessary for the health,safety and welfare of the citizens of Eagle County.
