RESOLUTION NO.2021-b g�-
RESOLUTION AMENDING EAGLE COUNTY RESOLUTION NO.81-33 TO
ELIMINATE THE EAGLE COUNTY VENDOR FEE FOR SALES TAX COLLECTIONS
WHEREAS, on November 3, 1981, a majority of the eligible electors of Eagle County
approved a 1%countywide sales tax,as set forth in Eagle County Resolution 81-33; and
WHEREAS,on November 7, 1995, a majority of the eligible electors approved an
additional 0.5%sales tax to fund a mass transportation system in Eagle County, as set forth in
Eagle County Resolution 95-95; and
WHEREAS,both sales taxes(totaling 1.5%) are collected, administered and enforced by
the Colorado Department of Revenue("DOR"); and
WHEREAS,Eagle County Resolution 81-33 allowed vendors, at the time of making a
monthly return of the sales tax to the DOR,to subtract from the tax remitted a sum equal to 3.33%
of said tax as a"vendor fee"(hereinafter"Eagle County Vendor Fee"); and
WHEREAS,the state of Colorado also allows vendors with total taxable sales less than
$1 million per filing period,to retain a state sales-tax vendor fee; which allowable vendor fee has
recently been increased 3.33%to 4%,with a maximum of$1,000 per filing period(hereinafter the
"State Vendor Fee"); and
WHEREAS,on average there are over 5,000 Eagle County vendors that retain the 3.33%
Eagle County Vendor Fee,as well as the 4% State Vendor Fee; and
WHEREAS,the average Eagle County Vendor Fee retained by each vendor is between
$5 and$20 per month; and
WHEREAS,the DOR has developed new technology systems which make it easier and
more efficient for vendors to remit sales tax, and therefore the Board of County Commissioners of
Eagle County(the"Board")finds that duplicative vendor fees are no longer necessary; and
WHEREAS,the Board therefore desires to amend Eagle County Resolution 81-33 to
eliminate the Eagle County Vendor Fee.
NOW,THEREFORE,BE IT RESOLVED BY THE COMMISSIONERS OF THE
BOARD OF COUNTY COMMISSIONERS,COUNTY OF EAGLE,STATE OF
COLORADO:

THAT,by this Resolution the Board amends Resolution 81-33 by deletion of its Section
22,effective January 1,2022.
THAT,effective January 1,2022,the Eagle County Vendor Fee shall be eliminated,and
Eagle County vendors shall thereafter remit the full amount of all Eagle County sales taxes
collected to the DOR pursuant to the requirements of Eagle County Resolution 81-33 and Eagle
County Resolution 95-95.
THAT this Resolution is necessary for the health, safety and welfare of the people of
Eagle County,Colorado.
