HomeMy WebLinkAboutR21-029 Termination of COVID-19 Local Disaster Emergency Declaration DocuSign Envelope ID:47EC6AE6-A978-4C1A-8242-85691718B0C6 McQueeney Commissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE,STATE OF COLORADO RESOLUTION NO.2021- 029 TERMINATION OF THE EAGLE COUNTY COVID-19 LOCAL DISASTER EMERGENCY DECLARATION WHEREAS, on March 6, 2020, Eagle County Public Health and Environment ("ECPHE") confirmed its first case of COVID-19 within the county. Since that time, Eagle County has seen over 5800 cases of the illness as well as 22 fatalities to date; and WHEREAS,on March 6, 2020,pursuant to the authority delegated by the Board of County Commissioners ("Board"),the Eagle County Manager declared a COVID-19 Local Disaster Emergency("Declaration") because the cost and magnitude of responding to and recovering from the impact of COVID-19 in the community is far in excess of the county's available resources; and WHEREAS,the Board has extended the Declaration six times previously, on March 10,April 7,April 28,May 26, June 30, and September 29, 2020 because the conditions that spurred the declaration had not abated; and WHEREAS, on April 16, 2021, the state executive orders devolved, transitioning control back to local public health agencies to implement appropriate orders based on conditions that exist within their respective jurisdictions; and WHEREAS,as vaccinations continue to be deployed and other key metrics of disease transmission are satisfactorily met, ECPHE anticipates the rescission of all local public health orders on May 18, 2021; and WHEREAS,the Board desires to terminate the Declaration concurrently with the rescission of local public health orders by ECPHE as the conditions that spurred the Declaration and six previous extensions no longer pose the same serious threat to the health and safety of the citizens of Eagle County; and WHEREAS, pursuant to C.R.S. § 24-33.5-709(2), "[a]ny order or proclamation ... terminating ... a local disaster emergency shall be given prompt and general publicity and shall be filed promptly with the county clear and recorder ... and with the office of emergency management;". NOW,THEREFORE, BE IT RESOLVED by the Board: Page 1 DocuSign Envelope ID:47EC6AE6-A978-4C1A-8242-85691718B0C6 THAT,the Board confirms, determines, and declares that the presence and likelihood of additional cases of the COVID-19 virus within Eagle County no longer warrant a declaration of a local disaster emergency. THAT,the Declaration and all attendant extensions thereof are hereby terminated upon the rescission of all local public health orders of ECPHE, currently anticipated to be May 18, 2021. This Declaration shall remain in full force and effect until all local public health orders are rescinded.
