This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Commissioner Updates
Commissier McQueeney referenced the new COVID meter on the Eagle County website. She encouraged
people to follow the guidance so the county could move the meter into the blue and green. Her impression was that
people were checking it out but not changing their behavior. As winter comes along and people spend more time
indoors,it's going to be a struggle. This was the time to take action.
Commissioner Scherr reminded people to check their voter registrations and register to vote if they hadn't
done so already.
Commissioner Chandler-Henry thanked the Eagle County Attorney's office for doing a great job for the
county and acknowledged all of the cases they'd handled in the county and other counties throughout the state.
She also noted that last Saturday was National Public Lands Day.
County Manager Updates
Jeff Shroll thanked all the county's partners in the emergency service world. The crews have had very few
breaks in 2020. He asked Regina O'Brien if she'd like to speak about the upcoming election.
Regina O'Brien,Eagle County Clerk&Recorder,stated that currently she was well staffed with election
judges. She asked voters to help by checking or updating their voter registration. Ballots would be mailed on
October 9th. She encouraged voters to return their ballot in one of six Eagle County 24-hour ballot drop boxes
which opened the same day ballots were mailed. She provided an overview of upcoming election dates.
COVID-19 Update
Birch Barron,Emergency Management Director,stated that the county was currently in Risk Level 2, Safer
at Home,and was leveling off. There had been 42 cases in the past two weeks,and hospitalizations stayed at a low
level.This was not the case all around Eagle County.Neighboring counties were seeing increases,and Eagle
County was staying stable. However,this was not a reason to let your guard down. He encouraged folks to
continue to be vigilant and keep the protective bubble around us.There was a large cluster in Boulder County,and

increases across the state and in neighboring states. Some in the community had not been cooperative and that was
causing spread of the disease and shutting businesses down. Everyone was exhausted,but the path forward was
working together to beat COVID.
Consent Agenda
1.Resolution 2020-074 of Support for Receiving Grant Money for a Colorado Parks and Wildlife
Non-Motorized Planning Grant

2.Holy Cross Energy Right-of-Way Easement for the Brush Creek Road Pullouts

Holly Strablizky,Assistant County Attorney,requested that Item 2 be pulled from the Consent Agenda
for discussion.
Commissioner McQueeney moved to approve the Consent Agenda for September 29,2020,as presented.
Excluding Item 2.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Holy Cross Energy Right-of-Way Easement for the Brush Creek Road Pullouts
Holly Strablizky stated that the easement was on the county open space parcel and the land was subject to a
conservation easement held by the Eagle Valley Land Trust. Eagle Valley Land Trust had requested a slight
adjustment to the language and she had not had the chance to speak with someone from Holy Cross to approve the
tweek. She asked the board to approve the easement in a form similar to what was presented and to authorize the
chair to sign at that time.
Commissioner McQueeney asked what that change was.
Ms. Strablizky stated that it changed the wording from"consistent with the conservation easement"to
"consistent with the purpose of the conservation easement." She believed the language accomplished what the
Land Trust would like however,the Land Trust wondered whether Holy Cross would revise the language as
requested.
Commissioner Chandler-Henry asked if there was a time constraint.
Ms. Strablizky stated that there was a desire to start as soon as possible. She didn't anticipate a problem
with Holy Cross.
Commissioner Scherr moved to approve the Holy Cross Energy Right-of-way Easement for the Brush
Creek Road Pullouts in a format substantially similar to that presented and authorized the board chair to sign.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.

Chairman Chandler-Henry opened and closed constituent input,as there was none.

Business Items
1.Resolution 2020-075 in Support of Statewide Amendment B Regarding Gallagher Repeal,Eagle County
Ballot Issue 1A,Town of Eagle Ballot Issue 2B,Town of Avon Ballot Issue 2E,Town of Vail Ballot Issue 2G,
and Eagle Fire Protection District's Ballot Issue Regarding Gallagher Stabilization.

Executive Summary:This resolution is in support of statewide amendment B regarding Gallagher repeal,Eagle
County ballot issue 1A,Town of Eagle ballot issue 2B,Town of Avon ballot issue 2E,Town of Vail ballot issue
2G,and Eagle Fire Protection District's ballot issue regarding Gallagher stabilization.These measures are aimed
at preventing state-imposed cuts to county services due to the Gallagher Amendment.The measure would
authorize the board to adjust county mill levies for the sole purpose of maintaining existing revenues and service
levels, including emergency services,road repairs and snow removal,open space preservation and food
assistance.
Commissioner McQueeney stated that the state getting involved in this was interesting. In speaking with
county partners,she felt working together was really helpful. She appreciated the partnerships and ongoing work
on a complicated issue. County Manager Jeff Shroll had a lot to do with getting everyone together. She believed
that proceeding as individual towns, fire districts,and counties was the right direction to go.
Commissioner Scherr stated this was a technical,complex issue. This would help ensure we were stable
at the local level without having effects from other parts of the state.
Commissioner Chandler-Henry stated that these were simply good government measures. Colorado
Mountain College,the Eagle Valley Library District,and Gypsum Fire,among others,had already taken this
route. This was another in a line of self-rescue for revenue stabilization,so the county could continue to provide
the services that voters had asked for.
Commissioner Scherr moved to approve the resolution in Support of Statewide Amendment B Regarding
Gallagher Repeal,Eagle County Ballot Issue 1 A,Town of Eagle Ballot Issue 2B,Town of Avon Ballot Issue 2E,
Town of Vail Ballot Issue 2G,and Eagle Fire Protection-District's Ballot Issue Regarding Gallagher Stabilization.
Commissioner McQueeney seconded the motion. The vote was unanimous.
2.Resolution 2020-076 in Support of Statewide Proposition EE:Tobacco-Vape Tax Campaign on the Ballot

Executive Summary:This resolution is in support of Proposition EE on the November 2020 ballot for the
purpose of decreasing tobacco and nicotine use among youth and increasing funding of public education and
preschool in the State of Colorado. If passed,this initiative will improve public health and safety for our students,
help close the funding gap resulting from pandemic-related budget cuts and provide funding for universal
preschool education.
Commissioner McQueeney stated that this was an example of the state following the county.
Constituents across jurisdictions had spoken about the dangers of vaping. This was an opportunity to find some
funding for early childhood education. This would go towards rural schools and those affected by COVID,and
then it would transfer in 2023 to preschool for all four-year olds. This was good for our teenagers and for our
preschoolers.

Commissioner Chandler-Henry added that these were all proven investments in both teenagers and
preschoolers.
Commissioner McQueeney moved to approve the resolution in Support of Statewide Proposition EE:
Tobacco-Vape Tax Campaign on the Ballot.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
3.Resolution 2020-077 Sixth Extension of Eagle County COVID-19 Disaster Emergency Resolution

Executive Summary:This resolution will extend the Eagle County COVID-19 Disaster Emergency Resolution
Birch Barron, Emergency Management Director, stated that the declaration had been in place since
March,and this would extend the declaration to allow for state and federal support.
Commissioner Scherr stated that it was important because there may be more spikes in the future until
there was immunity.
Commissioner Scherr moved to approve the Sixth Extension of Eagle County COVID-19 Disaster
Emergency Resolution.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
4.The Board of County Commissioners will meet as necessary to review and take action on any issues related to
the COVID-19 Local Disaster Emergency.
There were no issues to review related to COVID-19.
Commissioner McQueenry moved to adjourn as the Board of County Commissioners and reconvene as
the Eagle County Board of Equalization.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
County Board of Equalization
1. Resolution 2020-078 Regarding Petitions to the Eagle County Board of Equalization-Request for
Administrative Denials

Executive Summary:Taxpayers who chose to appeal Eagle County Assessor's 2020 valuation(identified on the
list of CBOE appeals attached hereto as Exhibit"A")were set for hearing before the Board of County
Commissioners of Eagle County,organizes and convened as the County Board of Equalization for the purposes
of adjusting,equalizing, raising or lowering the valuation for assessment of real and personal property within this
county, fixed and made by the County Assessor for the year 2020. This resolution is to request administrative

denials at the request of the petitioner so the petitioners have the option of moving on to the next round of
appeals.
Rhea Silverkorn, Eagle County Administration, presented the resolution. There were two businesses that
chose to request administrative denials allowing them to move on to the next round of appeals.
Commissioner Scherr moved to approve the resolution regarding petitions to the Eagle County Board of
Equalization- Request for Administrative Denials.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
Commissioner McQueeney moved to adjourn as the Board Board of Equalization and reconvene as the
Eagle County Board of County Commissioners.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
