HomeMy WebLinkAboutMinutes 09/15/20 PUBLIC HEARING September 15, 2020 Present: Kathy Chandler-Henry Chairman Matt Scherr Commissioner Jeanne McQueeney Commissioner Angelo Fernandez Deputy County Manager Regina O'Brien Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Commissioner Updates Commissioner McQueeny gave a shout out to the Attorney's office. They had been completing their normal work as well as writing resolutions and working on legislation. She appreciated these extra tasks they have been doing. Commissioner Scherr reminded everyone to go to GoVoteColorado.gov to ensure their physical and mailing addresses were current. He also reminded folks to get their flu shots.Flu shots were important this year to protect ourselves and our community. Commissioner Chandler-Henry reported on a visit to Spring Creek Apartments in Gypsum.There were 282 multi-family units at affordable prices. This was a great addition to the community.' People could go to the website or check in with the Eagle County Housing Department to get more information. County Manager Updates There were no updates COVID-19 Update Heath Harmon,Public Health Director,reviewed the key performance indicators for COVID-19. There have been 32 cases in the last 14 days. A little more than half came in the second week of that period indicating a slight uptick. The positivity rate was at 5%in the last 14 days,and 78%of the new cases could not report a known exposure. There had been two hospitalizations in the past 14 days. That number was relatively stable. Since Labor Day,there has been an increase. This was true in the county and in the state.The Governor would release a new state public"dial"that would resemble what we know as our fire danger dial. Schools were in their fourth week, and Mr.Harmon wanted to give a shout out to the teachers,kids, families who were adhering to COVID-19 policies. He reminded everyone to stick to the Five Commitments and masks;these precautions were critically important from now until the time vaccines would be available. Commissioner Chandler-Henry asked why the key performance indicators showed more cases in young people. Mr.Harmon stated that this was a trend in Eagle County and across the country and could be a result of the Labor Day weekend trend. 1 09/15/2020 Consent Agenda 1. Intergovernmental Agreement Between Eagle County and Town of Eagle for Pet Animal Sheltering and Field Services Nathan Lehnert,Animal Shelter& Services 2. Intergovernmental Agreement between Eagle County and the Town of Eagle Concerning the collection of Sales Taxes on the Sale of Cigarettes and Tobacco Products Jill Klosterman,Finance 3. Resolution 2020-069 Concerning Taxpayer Generated Abatement and Refund of Taxes-Request for Administrative Denial on R039266 Rhea Silverkorn/Brittany Thatcher,Administration/Assessor's Office 4.Memorandum of Understanding between Eagle County and Bureau of Land Management,Kremmling Field • Office Katherine King, Open Space Phillip Kirkman,Open Space Specialist provided an overview of the Memorandum of Understanding between Eagle County and the Bureau of Land Management. Commissioner McQueeney believed this was an excellent example of collaboration. Commissioner Scherr moved to approve the Consent Agenda for September 15,2020,as presented. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Constituent Input Chairman Chandler-Henry opened and closed constituent input,as there was none. Business Items 1. Resolution 2020-070 Declaring September as National Suicide Prevention Month in Eagle County Rhea Silverkorn,Administration Executive Summary: September is known around the United States as National Suicide Prevention Month and is intended to help promote awareness. Suicidal thoughts can affect anyone regardless of age,gender,race, orientation, income level,religion,or background. Suicide is the 10th leading cause of death among adults in the US, and the 2nd leading cause of death among people aged 10-24. Local organizations like SpeakUp ReachOut(SURO)and Eagle Valley Behavioral Health (EVBH)are on the front lines of a battle that many still refuse to discuss in public,as suicide and mental illness remain too taboo a topic to speak on. We encourage all residents to take the time to inquire as to the wellbeing of their family, friends,and neighbors and to genuinely convey their appreciation for their existence by any gesture they deem appropriate. 2 09/15/2020 Commissioner McQueeney moved to approve the resolution declaring September as National Suicide Prevention Month in Eagle County. Commissioner Scherr seconded the motion. The vote was declared unanimous. 2.Resolution 2020-071 Allowing Clerk&Recorder To Close For Non-Election Services on November 2 and 3, 2020 Regina O'Brien,Clerk&Recorder's Office Executive Summary: All Clerk& Recorder staff are highly involved, necessarily,in election-related functions such as helping voters, assisting election judges,couriering ballots,receiving and processing returned ballots,and working in the ballot scanning room. Given the unprecedented turnout anticipated for the 2020 General Election and to ensure the highest level of service to voters,there is a significant need to have all Clerk staff working in elections on both Monday,November 2 and Tuesday,November 3,2020. Motor Vehicle and Recording staff make every attempt to help people with emergency needs even when closed,and over 30 online motor vehicle services are still available. This resolution would authorize the Clerk's offices to be closed for non-election services on November 2,2020 and November 3,2020(Election Day). Commissioner McQueeney moved to approve the resolution allowing the Clerk&Recorder's Office to close for non-election services on November 2nd and 3rd,2020. Commissioner Scherr seconded the motion. The vote was declared unanimous. 3.Resolution 2020-072 Revoking Disaster-Emergency Declaration for Grizzly Creek Beth Oliver,Attorney's Office Executive Summary: On August 10,2020,the Grizzly Creek Fire began burning in Garfield County,Colorado. On August 13,2020,the County Manager declared a local disaster/emergency with respect to the Grizzly Creek Fire. Following the August 13,2020 declaration,due to extreme fire conditions,several other wildfires occurred in Eagle County,including the Rube Creek Fire,the Murphy Fire and the Camp Hale Fire,all requiring resources and response from Eagle County fire and emergency crews. On August 10th,2020 the County Manager declared a second local disaster/emergency due to the continued threats from the Grizzly Creek Fire as well as the multiple additional wildfires that had occurred in the County. Pursuant to C.R.S. 24-33.5-709(l),a local disaster may be declared only by the principal executive officer of a political subdivision and it cannot be continued or renewed in excess of seven days except by or with the consent of the governing board of the political subdivision. On August 25, 2020,the Board approved Resolution No. 2020-060,continuing the August 20,2020 declaration. Resolution 2020-060 and said declaration were effective until modified, superseded or revoked by further resolution. Due to the containment of the Grizzly Creek Fire and the other wildfires,and the corresponding reduction in the need for support for residents of the County, it is now appropriate to revoke the August 20,2020 Declaration. The purpose of the attached resolution is to revoke the August 20,2020 emergency declaration,effective as of September 15, 2020. Angelo Fernandez,Assistant Eagle County Manager, presented the resolution. He stated that the Grizzly Creek fire is over 90%o contained. 3 09/15/2020 Commissioner McQueeney moved to approve the resolution revoking Disaster- Emergency Declaration for Grizzly Creek. Commissioner Scherr seconded the motion. The vote was declared unanimous. 4.Resolution 2020-073 Supporting the Colorado River District's Ballot Measure in the November Election Rhea Silverkorn Administration Executive Summary: The resolution is in support of the Colorado River District's ballot question in the upcoming November election.The Colorado River District's revenues are declining due to reduced energy production and prices, impacts of the Gallagher Amendment and the revenue limitations in the Taxpayers Bill of Rights. The ballot question will ask if taxes should be increased by an amount up to$4,969,041 in 2021 (which increases amounts to approximately$1.90 in 2021 for every$100,000 in residential property value), and such amounts as are generated annually thereafter from an additional property tax levy of.248 mills(for a total mill levy of 0.5 mills)to enable the Colorado River District to protect and safeguard Western Colorado by: • Fighting to keep water on the Western Slope; • Protecting adequate water supplies for West Slope Farmers and Ranchers; • Protecting sustainable drinking water supplies for West Slope communities; and • Protecting fish,wildlife,and recreation by maintaining river levels and water quantity; We believe that the revenues that will be raised if the above ballot question is approved by the voters are critical to the Colorado River District being able to continue its mission and be a strong and effective advocate on issues and importance to water users on the Western Slope of Colorado. Commissioner Chandler-Henry spoke about the Colorado River District ballot measure. Commissioner McQueeney thanked Commissioner Chandler-Henry for her work on all things water for Eagle County. She believed water was critically important to Eagle County,and she believed this really needed to pass in all 15 counties. Commissioner Scherr believed that the Colorado River District was one of the most important districts people have never heard of. • Commissioner Chandler-Henry moved to approve the resolution supporting the Colorado River District ballot measure in the November Election. Commissioner Scherr seconded the motion. The vote was declared unanimous. 5.The Board of County Commissioners will meet as necessary to review and take action on any issues related to the COVID-19 Local Disaster Emergency. There was nothing in front of the board today. 4 09/15/2020 Work Session - Eagle County Room 1. Eagle River Watershed Council Annual Update Planning File - Eagle County Room I.TABLING: Willits Bend PUD Amendment- PDA-9101 The Willits Bend PUD Amendment(PDA-9101)applicant has requested the file be tabled to the November 10, 2020 BoCC hearing as the Roaring Fork Valley Regional Planning Commission hearings were tabled to September and October in order to finalize elements of the proposal. Colton Berck, Eagle County Associate Planner stated that the applicant wished to make some changes and requested a tabling. Commissioner McQueeny clarified that the applicant tabled the hearing. Mr. Berck confirmed. Commissioner McQueeney moved to table File no.PDA-9101,Willits Bend PUD Amendment to November 10,2020. Commissioner Scherr seconded the motion. The vote was declared unanimous.
