COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 20207039
FOURTH EXTENSION OF THE EAGLE COUNTY
COVID-19 LOCAL DISASTER EMERGENCY
WHEREAS, on March 6, 2020, Eagle County Public Health and Environment
("ECPHE")confirmed its first case of COVID-19 within the county. Since that time,
Eagle County has seen almost six hundred cases of the illness as well as eight fatalities to
date. Federal, state, and local authorities continue to take action to address the emergency;
and
WHEREAS,on March 6, 2020, pursuant to the authority delegated by the
Board of County Commissioners, the Eagle County Manager declared a local disaster
emergency because the cost and magnitude of responding to and recovering from the
impact of COVID-19 in the community is far in excess of the county's available
resources; and
WHEREAS, the Board has extended the local disaster emergency three times
previously, on March 10, April 7, and April 28, 2020 because the conditions that
spurred the declaration had not abated; and
WHEREAS, on May 25, 2020, the Director of ECPHE issued a public health
order providing authority and direction to individuals and businesses in Eagle County as
to Phase 2 of the Eagle County Plan for Sustaining Social Distance (the "Phase 2
Order"); and
WHEREAS, while the Phase 2 Order allows more activities to occur than
previous public health orders, significant restrictions on the activities of individuals and
businesses are still necessary to slow the spread of COVID-19 and protect community
resources affected by the presence of COVID-19 in Eagle County, and because ongoing
transmission of the virus continues to affect the health, safety, and welfare of the citizen
of Eagle County; and
WHEREAS, pursuant to C.R.S. § 24-33.5-709(1) "A local disaster may be
declared only by the principal executive officer of a political subdivision. It shall not be
continued or renewed in excess seven days except by or with the consent of the
governing board of the political subdivision;"and
WHEREAS, the conditions that spurred the County Manager to declare and the

Board to extend three times the local disaster emergency still continue to pose a serious
threat to the health and safety of the citizens of Eagle County; and
WHEREAS, "The effect of a declaration of local disaster emergency is to activate
the response and recovery aspects of any and all applicable local and interjurisdictional
disaster and emergency plans and to authorize the furnishing of aid and assistance under
such plans."C.R.S. § 24-33.5-709(2); and
WHEREAS, extending the local disaster emergency and continuing to operate
under Eagle County's emergency operations plan will allow a more effective response.
NOW,THEREFORE, BE IT RESOLVED by the Board of Commissioners of
Eagle County, Colorado:
THAT,the Eagle County Board of County Commissioners confirms, determines,
and declares that the presence and likelihood of additional cases of the COVID-19 virus
within Eagle County and the State or Colorado constitute a local disaster emergency that
warrants continuing the emergency response and furnishing aid and assistance to affected
portions of the community.
THAT,this Resolution supersedes Resolution 2020-35; however,the terms and
conditions set forth in Resolution 2020-21 and incorporated in Resolution 2020-35 that
address the roles of the Eagle County Public Health and its Director,the Sheriff of Eagle
County, the Eagle County Emergency Manager, and the Eagle County Manager as set forth
in Resolution 2020-21 remain in full force and effect.
THAT, until such time as county buildings are fully reopened:
1. All Eagle County buildings, excepting Eagle County courthouses, the Eagle
County Sheriffs Office, and any Sheriffs substations, will continue to
incrementally reopen to the public under established plans that ensure essential
governmental functions are preserved.
2. For Eagle County courthouses,the Eagle County Sheriffs Office, and any
Sheriffs substations, the Board continues to delegate the authority necessary for
the 5th Judicial District and the Sheriffs Office to each adopt policies and
restrictions for their offices or the buildings that house their offices to ensure the
public is provided access to their essential services while protecting critical
judicial and law enforcement functions.
THAT, the local disaster emergency related to COVID-19, and the terms and
conditions set forth in this Resolution will continue until June 20, 2020 unless sooner
amended, extended, or rescinded by the Board.
THAT,this Resolution and Declaration shall be promptly filed with the Eagle
County Clerk and Recorder and with the Office of Emergency Management.
THAT,this Resolution and Declaration is necessary for the public health, safety

and welfare of the citizens of the County of Eagle, State of Colorado.
