RESOLUTION
WHEREAS, The New Jersey Zinc Company, a New Jersey
corporation, has agreed and will grant to the State of Colorado
certain rights of way for highway purposes as shown on the maps
of the Highway on file with the County Clerk and Recorder of
Eagle County, Colorado, and known as Colorado State Highway
Project No. F.A.P. 78 -(2) and Colorado State Highway Project
No. F.A.P. No. 182- A -(2), and;
WHEREAS, The New Jersey Zinc Company is requiring
only a nominal consideration for the granting of such Highway,
and;
WHEREAS, it is agreeable with the County of Eagle,
State of Colorado, who are required to obtain such rights of.
way, to.keep open what is known as a connecting highway-and-to
provide for proper approaches to the new highway being built
and to be built over what is commonly known as Battle Mountain,
Eagle County, Colorado, and over the properties owned by The New
Jersey Zinc Company, as more particularly set out in that certain
Agreement dated September 19, 1939, between the County of Eagle
and The New Jersey Zinc Company,
IT IS THEREFORE RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF EAGLE COUNTY, in regular meeting held this 6th
day of November A. D. 1939, that the County enter into an Agree-
ment with The New Jersey Zinc Company, said Agreement dated the
19th day of September, 1939, in regard to the above mentioned
connecting highway and the approaches thereto; said Agreement
being signed by the Vice President of The New Jersey Zinc Company
and attested by its Assistant Secretary and signed by the County
of Eagle by Alfred M. Sloss as Chairman of the Board of County
Commissioners and attested by Mae Cox, Clerk of the Board.
Duly read, considered, passed and approved this 6th
day of November A. D. 1939•
