RESOLUTION
WHEREAS, the County of Eagle and State of Colorado is
the owner of certain land in Section Thirty -five (35) and Thirty-
six (36), Township Five (5) South, Range Eighty -one (81) West of
the Sixth (6th) Principal Meridian, and as is more particularly
described in Book 69 at Page 311 and Book 72 at Pages 255 and 256,
and;
WHEREAS, there was a highway used by the public generally
for a great number of years traversing and crossing Section Thirty -
five (35) and Thirty-six (36) in Township Five (5) South, Range
Eighty-one (81) 'best of the Sixth (6th) Principal Meridian, Bagle
County, Colorado, and;
WHEREAS, there was a general dedication and grant of
roads over Public Domain as provided for in Section 4919, United
States Compiled Statutes, 1918, and;
WHEREAS, there has been a use of this highway since the
very early days and such use was generally recognized by the public,
and;
WHEREAS, more recently, the State Highway Department of the
State of Colorado and the United States Bureau of Public Roads have
changed the alignment of the highway for the purpose of correcting
curvature and other purposes and have designated the old State High-
way and Public Road as U. S. State Highway 24, and;
WHEREAS, the Town of Minturn, prior to the time of such
change of alignment, by and with the consent of the public authorities
and the knowledge of the public authorities, placed their water main
conveying domestic water by their public water works system from
Cross Creek in the County of Nagle to the Tom of Minturn, and for
such purpose used the public highway, and;
i.'HEREAS, the Town of Minturn has requested the County of
Eagle to convey to them for right of Quay purposes the land owned by

the County of Eagle and used by the Town of Minturn for their water
main.
BE IT, THEREFOEE, RESOLVED That the County of Eagle, by
Quit -Claim Deed, convey to the Town of Minturn an easement or right
of way fifteen (15) feet right angle width over the lands owned by
Eagle. County either through deed or by de- s4tr�, grant or use
under the laws of the United States and the State of Colorado cover-
ing roads or highways.
