HomeMy WebLinkAboutR19-087 Supporting County Regulation of the Mid-Continent Quarry, AKA the Tranfer Trail Mine Commissioner um...4 mt. - moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO 0 RESOLUTION NO.2019 - UUP RESOLUTION SUPPORTING COUNTY REGULATION OF THE MID-CONTINENT QUARRY,AKA THE TRANSFER TRAIL MINE WHEREAS, Rocky Mountain Resources ("RMR") owns a small limestone mine known as the Mid-Continent Quarry, aka the Transfer Trail Mine, overlooking the City of Glenwood Springs in Garfield County, Colorado (the "Mine"); and WHEREAS, RMR is seeking to significantly expand its mining operations without the requisite approvals by Garfield County; and WHEREAS,the proposed expansion could have negative impacts in Garfield County, including but not limited to increased truck traffic, impacts to the region's tourist economy, and impacts to the water and air quality of rural Coloradans; and WHEREAS, the Garfield County Board of County Commissioners has issued a Notice of Violation concluding that RMR is not operating the Mine in compliance with its applicable regulations and special use permit; and WHEREAS, RMR is claiming Garfield County does not have authority to enforce its regulations and special use permit; and WHEREAS,the claim by RMR that it is not subject to County regulations could have a negative impact throughout Colorado and limit the ability of all counties to protect residents from harmful environmental impacts of the extraction industry. NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Eagle County Board of County Commissioners ("Board") officially declares its support of Garfield County's local control of mining operations and opposes the Mine expansion without the requisite approval of Garfield County through a noticed hearing process where the impacts of the proposed expansion can be publicly vetted and addressed. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the residents of the County of Eagle, State of Colorado.
