HomeMy WebLinkAboutMinutes 09/18/18 PUBLIC HEARING September 18, 2018 Present: Kathy Chandler-Henry Chairman Jillian Ryan Commissioner Jeanne McQueeney Commissioner Jeff Shroll County Manager Bryan Treu County Attorney Beth Oliver Deputy County Attorney Kathy Scriver Deputy Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Commissioner Updates Commissioner McQueeney recognized Lilly Reynolds, a public health intern and high school junior at Eagle Valley High that helped over the summer. Ms. Reynolds was recognized by the Eagle River Youth Coalition on Saturday. She led the charge with the Town of Avon for their Tobacco 21 Initiative,raising the purchase age of tobacco products to 21 in 2019. Commissioner Ryan gave an update on the 87 units for sale at Fox Hollow in Edwards. She also provided an update on climate action and reducing greenhouse gas emissions. The county continued to advocate at the State Health Department and the Air Quality Control Commission on rule making for zero emission vehicles. Chairman Chandler-Henry provided an update on the county's goals to protect the natural environment. The county manager would be providing an update on the Motocross Park. Also,Hardscrabble Ranch management plan would be discussed tomorrow night. The Eagle River Watershed Council was coordinating an integrated management plan for those who were interested in stream issues. There was a group from the county working with the Sonoran Institute. Last week there was a seminar at the Colorado River District and a dire conversation about the higher water temperatures and low levels. - County Manger Updates Jeff Shroll provided an update on the new Dry Lake Motocross Park that opened in Gypsum.There were a number of partners,volunteers,and donors. Consent Agenda 1. State of Colorado,Colorado Aeronautical Board Division of Aeronautics Grant Agreement with Eagle County Kip Turner,Airport Mr.Turner stated that this particular grant would fund snow removal equipment used at the airport; all that was needed now was snow. 1 09/18/2018 Commissioner McQueeney moved to approve the Consent Agenda for September 18,2018,as presented. Commissioner Ryan seconded the motion. The vote was declared unanimous. Constituent Input Chairman Chandler-Henry opened and closed constituent input, as there was none. Commissioner Ryan moved to adjourn as the Eagle County Board of County Commissioners and re- convene as the Eagle County Housing and Development Authority. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Eagle County Housing and Development Authority 1. Agreement for Services Between Lake Creek Village LLC and Ceres Design&Arborscape,LLC DBA Ceres Landcare Daniel Murray,Housing Executive Summary: LCV along with Ceres are working to remove all Cottonwood Trees from the property. The trees themselves are a nuisance and they do not help the environment. They are known to take water from the grass and do not allow other plants to grow. The removal, stump grinding and the disposal will promote water conservation going forward for the property. Now that these trees are gone, the grass should grow stronger and we will be able to reduce our overall water use around the property. Lastly,we've had issues in heavy wind storms of these trees blowing over due to their size and structure. Mr.Murray stated that the plan with Ceres was to remove all the cottonwood trees form the Lake Creek Village property. There were over 80 trees that would be removed.The residents had been notified. Removal of the trees was to promote water conservation. Commissioner McQueeney moved to approve the agreement for the services between Lake Creek Village LLC and Ceres Design&Arborscape, LLC DBA Ceres Landcare. Commissioner Ryan seconded the motion. The vote was declared unanimous. 2. Eagle County Housing&Development Authority Housing update Kim Bell Williams,Housing Executive Summary: The Eagle County Housing&Development Authority shall provide updates on the Lake Creek Village Apartment project completion, annual update to the Administration Procedures of the Eagle County Affordable Housing Guidelines(action needed), down payment assistance program summaries to date, sales at The Valley Home Store, Eagle Ranch Apartment status update,progress on public-private partnerships with 6 West Apartments, Spring Creek Apartments and Fox Hollow, and 2019 Advisory Committee meeting dates. Kim Bell Williams, Housing Director, introduced the Housing team. Tori Franks -Real Estate& Development Manager,Daniel Murray-Portfolio Manager,William Wright-Maintenance Supervisor, and Matt Andrews—Property Manager. Mr.Murray stated that there were 270 units in Edwards at the Lake Creek Village Apartments. He spoke about the projects that were completed on the property over the year. He spoke about the Riverview Apartments. 2 09/18/2018 There were 72 units in Eagle Vail and a 5 to7 year waitlist. The building received new roofs and interior renovations were proposed for the upcoming year. Mr.Andrews spoke about the Golden Eagle& Seniors on Broadway properties. There were 50 units in Eagle and a 5 tol 0 year waitlist. There were no major projects proposed for the properties. Ms. Franks reviewed the Housing Guideline updates and administrative procedures. Ms. Bell Williams noted that the tables in the Housing Guidelines were all updated annually. Chairman Chandler-Henry did not believe the 1%transfer fee was a deterrent for second home owners. Commissioner McQueeney believed there should be a price cap on certain properties. Commissioner Ryan requested a review of other areas and how this issue was addressed for non-eligible buyers. Ms. Bell Williams reviewed the Down Payment Assistance program and CDOH Fund loans. Ms. Franks stated that there were 41 loans recorded this year. These loans assisted homebuyers in purchasing units in every community in Eagle County. This fund was still well funded. Since 2015 CDOH had provided 23 HFH loans. Elyse Howard,Development Director for Habitat for Humanity spoke. She believed the work being done in partnership with the county for families in the community was important. Without the Down Payment Assistance program, it would be difficult for some families to meet certain requirements and purchase a home. Commissioner Ryan thanked Habitat for Humanity for their partnership and making such great contributions. Ms. Frank spoke about the Employee Home Ownership Program. In 2018,two loans were approved. Ms. Bell Williams spoke about the program and asked for input from the board as to whether there were other areas this fund could be used. She spoke about the Valley Home Store,the partners, deed restricted resales, and the home buyer classes offered by the Home Store. Ms. Frank provided an update on the Miller Ranch sales. The average sale price was $324,458. She spoke about an upcoming development east of Castle Peak Senior Care Facility. The groundbreaking for the workforce housing was spring of 2019. Ms.Bell Williams reviewed the partnerships with 6 West Apartments, Spring Creek Apartments, and Fox Hollow and the potential for additional resident occupied units,deed restricted units and price-capped units. Commissioner McQueeney moved to adjourn as the Eagle County Housing Authority and re-convene as the Eagle County Board of County Commissioners. Commissioner Ryan seconded the motion. The vote was declared unanimous. Planning Files 1. ZS-7657 Bergstreser Gunsmith Home Occupation Kris Valdez,Planning and Richard Davies,Engineering Department Executive Summary: The Applicant is seeking approval to operate a gunsmith business as a home occupation on the property located at 4476 Sweetwater Road. Ms. Valdez presented the request.The applicant was seeking a gunsmith business on his property of less than 35 acres therefore a Special Use Permit is required. The proposal was in conformance with all the standards of approval. Staff recommended a conditional approval. Chairman Chandler-Henry asked the applicant if his business was up and running. Matt Bergstreser,the applicant, stated that he still had to wait for his federal permit which could take up to 120 days. Chairman Chandler-Henry opened and closed public comment, as there was none. Commissioner McQueeney moved to approve file no.ZS-7657 incorporating staff's findings and recommended conditions, as they meet the standards for approval of a Special Use Permit. 3 09/18/2018 Commissioner Ryan seconded the motion.
