HomeMy WebLinkAboutMinutes 02/13/18 PUBLIC HEARING February 13, 2018 Present: Kathy Chandler-Henry Chairman Jillian Ryan Commissioner Jeanne McQueeney Commissioner Mike Nugent Deputy County Manager Kelley Collier Deputy County Manager Bryan Treu Interim County Manager Holly Strablizky Assistant County Attorney Kathy Scriver Deputy Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Commissioner Updates Commissioner Ryan stated that the County Commissioners were still working on the healthcare issue and the high cost of health insurance for those on the individual market. The commissioners would be meeting with the interim director of the Division of Insurance to discuss strategies being proposed in legislation this session. Potentially these could bring down rates depending on implementation. The board would provide an update next week. Commissioner McQueeney gave a shout out to those who attended Project Funway and the Education Foundation of Eagle County for funding schools. The event was well attended, and it was inspiring to see the people in the community support students in the public school system. Chairman Chandler-Henry gave out a shout to all the Colorado Olympians and Eagle County Olympians. There were six athletes from Eagle County representing the United States at the Olympics. There were another five representing other countries at the Olympics,and there were at least nine people working on wench cats, coaching teams,and ice making. Consent Agenda 1. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Constituent Input Chairman Chandler-Henry opened constituent input. Joanne Rock spoke about the Dotsero bus shelter. She also stated shespoke to many people that hoped to see a shelter near Corky's Gas Station in Eagle. She touched on the issue of healthcare, Christmas trees being used for habitat in ponds and streams,pothole potlucks, and coordinating rummage sales. Business Items 1. Resolution 2018-013 Amendment to 2018 Meeting Resolution Rhea Silverkorn,Administration Executive Summary: This amendment to the 2018 Meeting Resolution will adjust BoCC meeting days in late Feb/early March and also add Christmas Eve as a holiday. Commissioner McQueeney moved to approve the resolution amending the 2018 Meeting Resolution. Commissioner Ryan seconded the motion. The vote was declared unanimous. State of the County Executive Summary: Join Eagle County officials for the annual State of the County. There will be remarks from Commissioners, video highlights from 2017 and release of the county's annual report. I. Welcome—Chairman Chandler-Henry a. Commissioner Ryan seconded the motion. The vote was declared unanimous. Work Session 1. Board of Health Commissioner Ryan moved to adjourn as the Eagle County Board of Health and reconvene as the Eagle County Board of County Commissioners. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Planning Files 1. LUR-7166 Marijuana Land Use Regulation Amendment Damian Peduto, Community Development Executive Summary: The purpose of the Land Use Regulation Amendment is to modify Article 3, Section 3- 330(I)in order to eliminate duplicity for medical and retail marijuana business hours regulation; and in order to reduce the maximum allowable cultivation requirements for marijuana per residence,to coincide directly with the twelve(12)plant limit as set forth in C.R.S. 18-18-406(3)(a)(II)(a). Mr.Peduto summarized the proposal. The amendments had been reviewed and approved by the Roaring Fork Regional Planning Commission and the Eagle County Planning Commission. Ms. Strablinzky explained the basis for changing the number of plants. The county wanted the public to know that if the board chose to adopt the amendments the county would be deferring to Stated Statutes,making anything over 12 plants a potential felony. Commissioner McQueeney asked if existing license holders had been notified. Mr.Treu stated that it would not affect license holders. It was for caregivers and home-grow operations. Mr. Peduto stated that the recreational business owners were fairly well aware of the business items. Chairman Chandler-Henry requested that the Communication Department publish something in the newspaper. She wondered if it was worth noting in the Land Use Regulations that the number of plants reverts to State Statutes. Chairman Chandler-Henry opened and closed public comment, as there was none. Commissioner McQueeney moved to approve the resolution amending the Eagle County Land Use Regulations pertaining to medical and retail marijuana business regulations.
