AUTHORIZING ACQUISITION OF PROPERTY FOR USE AS ADDITIONAL RIGHT-
OF-WAY FOR EL JEBEL ROAD, EXEMPTING THE SUBDIVISION OF SAID
PROPERTY FROM SUBDIVISION REGULATIONS AND AUTHORIZING ANY OF
THE EAGLE COUNTY COMMISSIONERS TO EXECUTE ALL
DOCUMENTS NECESSARY TO EFFECTUATE THE CLOSING
OF THE CONVEYANCE OF THE PROPERTY
WHEREAS, the County of Eagle, State of Colorado (the"County")has negotiated the
acquisition of certain property from Crawford Properties, LLC ("Crawford"), for use as right-of-
way for purposes of widening and improving the County road known as El Jebel Road located in
Eagle County, Colorado ("El Jebel Road"); and
WHEREAS, Crawford has agreed to convey to the County portions of its property as
follows: (1)0.3755 acres(the"Property")in fees simple as more particularly described on Exhibit A,
attached hereto and incorporated herein,for use by the County as additional right-of-way for El Jebel
Road;(2)0.4697 acres in the form of permanent and slope easements,as more particularly described
on Exhibit B, attached hereto and incorporated herein for sidewalks, drainage and maintenance
(collectively the"Permanent Easement");and(3)0.5330 acres in the form of temporary easements,
as more particularly described on Exhibit C, attached hereto and incorporated herein for access,
grading and construction for the El Jebel Road improvements (collectively the "Temporary
Easement").
WHEREAS,Crawford has executed a Memorandum of Agreement("MOA")memorializing
the transaction and the donation by Crawford of the Property and said Permanent and Temporary
Easements. A copy of the MOA(without legal description exhibits)is attached hereto as Exhibit D
and incorporated herein by this reference; and
WHEREAS,the closing on the acquisition of the Property and the Easements is anticipated
to take place in November 2016; and

WHEREAS, the subdivision of the Property to be acquired by the County is in the best
interest of the County, and it is not within the purpose of either the Colorado subdivision statutes or
the Eagle County Subdivision Regulations; and
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of the County
of Eagle, State of Colorado:
THAT the Board hereby authorizes the acquisition of the Property for use as additional right-
of-way for El Jebel Road and acquisition of the Permanent Easement for sidewalks, drainage and
maintenance and the Temporary Easement for access,grading and construction for the El Jebel Road
improvements, as described herein and in the MOA attached hereto as Exhibit D.
THAT the Board authorizes any Commissioner to execute on its behalf any and all necessary
documents,instruments,papers or other forms necessary for the consummation of the acquisition of
the Property and the right-of-way and the Easements described herein and on the attached Exhibits A
-D. Such documents may include,but shall not be limited to,the Memorandum of Agreement,the
Permanent Easement, the Temporary Easement, closing authorization and instructions, settlement
statements, as well as any other necessary documents which in the opinion of staff are required or
desirable.
THAT the subdivision of the Property described at Exhibit A, and its conveyance to the
County pursuant to the herein described transaction, shall be and is hereby exempt from the Eagle
County Subdivision Regulations pursuant to C.R.S. 30-28-101(10)(d) and Section 5-270 A.1.a. of
the Eagle County Land Use Regulations.
THAT,the Board hereby finds,determines and declares that this Resolution is necessary for
the health, safety and welfare of the citizens of Eagle County.

of Eagle, State of Colorado, at its regular meeting held the day of , 2016.

REAL PROPERTY DONATION
Property owners whose real property is needed for a transportation improvement project may
donate all or any part of the property to Eagle County, Colorado, or may donate (waive receipt of)
all or any portion of just compensation due the owner for the property required for the project.
Where the property owner wishes to use the donation for a tax deduction;the owner should seek
advice from the Internal Revenue Service or a tax expert regarding the current rules for valuation.
It is the property owner's responsibility to ascertain the fair market value of the property for tax
purposes. Eagle County will pay the reasonable cost of an appraisal for tax purposes if the value
of the acquisition is estimated by Eagle County at$5,000 or more and an independent appraiser
prepares the appraisal.
If the property is contaminated, the costs to clean up such contamination will not exceed the
value of the property.
Donation of the property is made voluntarily and with full knowledge of the right to receive just
compensation. See the attached"Exhibits"which are incorporated herein.
The undersigned hereby releases Eagle County from obtaining an appraisal of the acquired
property, waives the right to receive an appraisal other than an appraisal for tax purposes as
described above, and waive the right to receive just compensation for the property. The
undersigned hereby agrees to execute the necessary conveyance instruments to transfer said
property free and clear of all liens and encumbrances.
