COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2016- 61 t
A RESOLUTION PROVIDING FOR THE SUBMISSION TO THE REGISTERED,
QUALIFIED ELECTORS OF EAGLE COUNTY, COLORADO, A QUESTION
AUTHORIZING THE LEVY OF A SALES TAX OF THREE TENTHS OF ONE
PERCENT (.3%) FOR THE PURPOSE OF PROVIDING AND IMPROVING THE
QUALITY, AVAILABILITY, AND AFFORDABILITY OF HOUSING IN EAGLE
COUNTY, SAID QUESTION TO BE SUBMITTED AT THE ELECTION TO BE HELD
NOVEMBER 8, 2016; PRESCRIBING THE FORM OF BALLOT QUESTION FOR
SUBMISSION AT SAID ELECTION, AND PROVIDING FOR CERTIFICATION OF
THE ELECTION QUESTION TO THE COUNTY CLERK AND RECORDER.
WHEREAS, pursuant to Section 30-11-107(1)(d) C.R.S., the Eagle County Board of
County Commissioners (hereinafter"Board") is authorized to apportion and order the levying of
taxes as provided by law; and
WHEREAS, the Board wishes to submit to the registered, qualified electors of Eagle
County, at the general election to be held on November 8, 2016 (the "Election"), a question
authorizing a tax increase of three tenths of one percent for the purpose of providing and
improving the quality, availability, and affordability of housing opportunities; and
WHEREAS, Eagle County leaders and other stakeholders in the community have long
recognized the need for and value of affordable housing. In its current Strategic Plan, Eagle
County identifies "encourage more affordable housing choices, including types and price levels"
as a critical objective under the identified goal of making Eagle County a "great place to live for
all"; and
WHEREAS, a recent housing needs assessment indicated that 4,466 housing units are
currently needed in Eagle County to house the workforce, and a total of 11,960 housing units
will be needed by 2025, and
WHEREAS, families who pay more than thirty percent (30%) of their income for
housing are considered cost burdened and may have difficulty affording necessities such as food,
clothing, transportation and medical care. Based on 2010-2014 averages, over fifty percent
(50%) of owners with a mortgage and over forty-six percent (46%) of renters in Eagle County
are cost burdened; and
WHEREAS, in the 2016 Workforce Survey, sixty-nine (69%) of employers indicated
that the lack of affordable housing was negatively affecting their ability to hire employees. This
is the highest response to this question in the 9 years the survey has been co•+ ; .u' OR■

WHEREAS, recent polling shows that ninety-five percent (95%) of voters polled
thought finding an affordable place to live is a problem and seventy-four percent (74%)believe it
to be a big problem. Sixty-four percent (64%) of voters polled indicated they would support a
sales tax increase to fund affordable housing purposes; and
WHEREAS, Article X, Section 20 of the Colorado Constitution requires voter approval
for, among other things, any new tax, tax rate increase, and for collecting, retaining and
expending certain moneys above established limits; and
WHEREAS, this election shall be conducted by the Eagle County Clerk and Recorder in
accordance with the"Uniform Election Code of 1992,"Articles 1 to 13 of Title 1, C.R.S.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
Section 1. Certification of Question to Clerk and Recorder for Election. The following
question is hereby certified to the Eagle County Clerk and Recorder and shall be presented at the
election to be held on Tuesday, November 8, 2016. Such notices as are required by Article X,
Section 20 of the Colorado Constitution shall be provided by the Clerk and Recorder.
Section 2. Form of Ballot Question. At the Election there shall be submitted to a vote of
the registered qualified electors of the County the following question:
"SHALL EAGLE COUNTY'S TAXES BE INCREASED $5,400,000 ANNUALLY
COMMENCING IN 2017, AND BY WHATEVER ADDITIONAL AMOUNTS ARE RAISED
ANNUALLY THEREAFTER FOR A PERIOD OF TWENTY YEARS, FROM A THREE
TENTHS OF ONE PERCENT (.3%) SALES TAX WITHIN EAGLE COUNTY TO BE USED
FOR HOUSING PURPOSES SUCH AS:
• PROVIDING AND IMPROVING THE QUALITY, AVAILABILITY, AND
AFFORDABILITY OF HOUSING IN EAGLE COUNTY
• PROVIDING DOWN PAYMENT ASSISTANCE LOANS FOR HOME
OWNERSHIP
• ACQUIRING LAND FOR FUTURE HOUSING UNITS AFFORDABLE TO
THE WORKFORCE
• INVESTING IN PRIVATE/PUBLIC PARTNERSHIPS FOR THE PROVISION
OF WORKFORCE AND AFFORDABLE HOUSING
• RELATED HOUSING PROGRAMS AND SERVICES;
AND, AS A VOTER-APPROVED REVENUE CHANGE, SHALL THE PROCEEDS OF
SUCH TAX AND INVESTMENT INCOME THEREON BE COLLECTED AND SPENT BY
THE COUNTY WITHOUT REGARD TO ANY SPENDING, REVENUE-RAISING OR
OTHER LIMITATION CONTAINED WITHIN ARTICLE X, SECTION 20 OF THE
COLORADO CONSTITUTION, OR ANY OTHER LAW AS IT CURRENTLY EXISTS OR
AS IT MAY BE AMENDED IN THE FUTURE AND WITHOUT LIMITING IN ANY YEAR
THE AMOUNT OF OTHER REVENUES THAT MAY BE COLLECTED AND SPENT BY
THE COUNTY?

Section 3. Severability. If any part, section, paragraph, clause or provision of this
Resolution shall be adjudged to be invalid or unenforceable, the invalidity orunenforceability of
such section, paragraph, clause, or provision shall not affect the remaining sections, paragraphs,
clauses or provisions of this Resolution, it being the intention that the various parts hereof are
severable.
Section 4. Actions. The officers and employees of Eagle County are authorized and
directed to take all action necessary or appropriate to effectuate the provisions of this Resolution.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held the 30th day of August, 2016.
