1. Special Recognition —ECO Trails 2014 Trail Supporter of the Year Awards
Ellie Caryl, ECO Trails
Dick Cleveland, ECO Trail Committee Chairman stated that the awards were presented annually for
exceptional contributions to the regional trail system. Honored were the Town of Avon for the Preserve Trail,
Eagle Springs Golf Club for their support of the Wolcott to Edwards Trail, and the Eagle County Road and Bridge
and Engineering Departments for the Gypsum to Dotsero Trail.
Present were Jamie Malin and Lee Rimel of the Vail Valley Mountain Bike Association; Rich Carroll and
Virginia Egger from the Town of Avon; Ty Ryan,Kelley Miller, Gordon Adams and John Harris,of Eagle County;
and Peggy Jensen, Greta Blamire, Scott Schlosser,John Bailey, and Carl Walker of the ECO Trails Committee.
Mr. Cleveland thanked the board for their support and for taking the time to recognize everyone. Every
year they went through the difficult process of identifying groups that had contributed to recreation in the valley. It
was never an easy decision.

Mr. Lewis stated that this was the fourth supplementary request to the 2014 budget. He
summarized the requests which totaled$11,240,564.00.
Commissioner Chandler-Henry asked about the Health Insurance fund.
Mr. Lewis stated that the county was self-insured. Employees paid into the fund. There had been
some increases but there were enough in the reserves to keep costs down. The budgets and supplemental
requests could be viewed on the county website.

Mr. Lewis stated that the county took a conservative approach and stuck to the strategic priorities
when preparing the 2015 budget. Revenue was expected to increase$1.5 million. Other revenues were
rebounding slowly. The target was to hold expenses at current levels.
Chairman Ryan thanked the John Lewis and the Advisory Board for their work on the budget. She
believed the Risk Analysis was helpful when planning ahead.
Commissioner Chandler-Henry added her thanks. She believed the budget was something to be
proud of for 2015.

changed since 2008. The towns and districts were required to submit their mill levies to the county by
December 15th. The board would certify the mill levies on December 22nd.

I. EXECUTIVE SUMMARY:
Proposal Overview
The Applicant requests review of a Special Use Permit for an existing 400 square foot Accessory Dwelling Unit on
the parcel located at 529 Emma Road. Eagle County Land Use Regulations allow for an 1800 square foot
Accessory Dwelling Unit(ADU)as a"use by right"on legal,conforming lots.For a lot in the Resource zone
district to be conforming it must be 35 acres in size thus,this parcel is considered legal non-conforming. An ADU
on a non-conforming lot requires Special Use Permit review and approval by the Board of County Commissioners.
In this instance this ADU was installed absent Special Use Permit approval and is therefore currently considered a
zoning violation. In addition to its non-conforming lot size,the subject property is located within a designated
Regulatory Floodway(see map below) and therefore would not be permitted to expand. This Regulatory Floodway
designation was applied to the parcel in 2003 after the original building permit was approved. If the board were to
approve this application for Special Use the ADU would then be recognized as a legal unit. If the Board were to
deny the application the applicant would have only remedy and that would be to remove the 220 and gas hookup
for the stove and therefore not considered an ADU.

II. BACKGROUND
The original single family home was permitted in 1998 and completed a few years later due to delays in
construction. At the time of building permit application and Certificate of Occupancy(CO)the space above the
garage did not include a complete kitchen as a wet bar for a homeowners amenity. Sometime after CO the kitchen
was added by the former owners of the subject property. The applicant purchased the property in 2012 and
subsequently was made aware the ADU was never properly permitted. Once made aware the applicant promptly
applied for this Special Use Permit.
III. STAFF FINDINGS AND RECOMMENDATION
Effect of Special Use Permits
Pursuant to Section 5-250.E — Effect of Issuance of Special Use Permit, Eagle County Land Use Regulations,
Special Use permits are valid for three (3)years until the approved use is implemented. If the approved use is not
implemented within the three year time period, the permit expires. Upon implementation of the approved use

exception has been placed upon the permit by the Board of County Commissioners.

Special Uses are those uses that are not necessarily compatible with other uses allowed in a zone district,
but which may be determined compatible with the other uses allowed in the zone district based upon
individual review of their location, design, configuration,density and intensity of use, and the imposition of
appropriate conditions to ensure the compatibility of the use at a particular location with surrounding land
uses. All Special Uses shall meet the standards set forth in this Section.
Standards:
Section 5-250.B. The issuance of a Special Use Permit shall be dependent upon findings that there is competent
evidence that the proposed use as conditioned, fully complies with all the standards of this Section, this Division,
this Article, and these Land Use Regulations. The Planning Commission may recommend and the Board of County
Commissioners may attach any conditions deemed appropriate to ensure compliance with the following standards,
including conformity to a specific site plan,requirements to improve public facilities necessary to serve the Special
Use, and limitations on the operating characteristics of the use, or the location or duration of the Special Use
Permit.
Staff believes this proposal, as conditioned and based on representations made by the Applicant, meets all
applicable standards for a Special Use Permit, as well as those standards specific to Accessory Dwelling Units.
Staff is recommending approval with conditions.
Please note that a more detailed analysis of the Standards may be reviewed under Appendix `A' of
this staff report.
Section 5-250 B—Standards:
1. Consistent with Comprehensive Plan. The proposed Special Use shall be in substantial conformance
with the Eagle County Comprehensive Plan, Area Community Plans and any applicable ancillary County
adopted documents pertaining to natural resource protection, affordable housing, or infrastructure

2. Compatibility. The Special Use is generally compatible with the existing and currently permissible future
uses of adjacent land and other substantially impacted land, services, or infrastructure improvements.

The current use is residential in an area dominated by and contemplated for residential use.The additional
fact that this ADU has existed within the structure since the early 2000's without conflict helps to
demonstrate compatability with surrounding uses.
3. Zone Districts Standards. The proposed Special Use shall comply with the standards of the zone district in
which it is located and any standards applicable to the particular use, as identified in Section 3-310, Review
Standards Applicable to Particular Residential, Agricultural and Resource Uses and Section 3-330, Review
Standards Applicable to Particular Commercial and Industrial Uses.
Section 3-310 allows for Accessory Dwelling Units up to 1800 square feet in the Resource zone
district.The request is for approval of an 400 square foot ADU.
4. Design Minimizes Adverse Impact. The design of the proposed Special Use shall reasonably avoid
adverse impacts, including visual impacts of the proposed use on adjacent lands including trash, traffic,
service delivery, parking and loading, odors, noise, glare, and vibration, or otherwise create a nuisance.

The property is located within a designated Regulatory Floodway (see map below) and therefore
would not be permitted to expand. This Regulatory Floodway designation was applied to the
parcel in 2003 after the original building permit was approved. Approval of this Special Use will
not further compromise the floodway.
5. Design Minimizes Environmental Impact. The proposed Special Use shall minimize environmental
impacts and shall not cause significant deterioration of water and air resources, wildlife habitat, scenic
resources, and other natural resources.
Staff believes this proposal minimizes environmental impacts. In this instance the residence is
already within the floodway. The ADU cantined within the structure will not further the
environmental impact.
6. Impact on Public Facilities. The proposed Special Use shall be adequately served by public facilities
and services, including roads, pedestrian paths, potable water and wastewater facilities, parks, schools,
police and fire protection, and emergency medical services.
Staff belives that the applicant has demonstrated that this ADU can be adequately served by public
facilities and services including; roads, paths, potable water, wastewater, police, fire and
emergency services.

are not attuned with the immediate adjacent and nearby neighborhood properties; and the proposed uses are not in
compliance with the Eagle County Land Use Regulations and/or the Comprehensive Plan.
1) Except as otherwise modified by this development permit, all material representations made by the
Applicant in this application and in any public meeting shall be adhered to and considered conditions of

2) Applicant shall obtain any and all permits (plumbing, electrical and mechanical)required legalize the

DISCUSSION:
Mr. Hanagan presented the application. The applicant was requesting a Special Use Permit for a 400 sq. ft.
Accessory dwelling unit(ADU). The lot size was non-conforthing so:required a Special Use Permit review. The
request was unique because the unit had already been built illegally between 2003 and 2012. The regulations
allowed for an 1800 square foot ADU. Compatibility wise,the proposal conformed to the Resource Zone Districts.
The ADU was attached to the karage and could not be sold separately. Staff believed that any impacts from
development were not a concern. The proposal met the 75ft stream set back but the home was within the
floodplain.
Mr. Schroeder explained that residential dwelling units were not allowed within the floodway. A new
flood study came out and adopted by the county in 2000s. The applicant hired an engineer who had done some
research on the property and found that the building pad had been elevated before the home was built. Federal
Emergency Management Association had an elevation certificate process that if applicable would remove the
structure from the floodway and floodplain. The applicant had followed through with the paperwork and as a result
another condition was added to the approval to insure that the paperwork was followed through with FEMA.
Mr. Hanagan stated that the Emma Caucus was the only referral agency that responded to the notice and
was not for or against the proposal; however they were concerned with conformance of current setback
requirements. There were no letters of opposition or letters of support from the adjacent neighbors. Staff believed
that the standards for a special use permit had been met. He read the three suggested conditions.
1. Except as otherwise modified by this development permit, all material representations made by the
Applicant in this application and in any public meeting shall be adhered to and considered conditions of
approval.
2. Applicant shall obtain any and all permits(plumbing, electrical and mechanical)required legalize the
ADU.
3. The applicant shall provide Eagle County a FEMA accepted letter of map amendment and certified
elevation certificate.

Commissioner Chandler-Henry wondered if there was any feedback from the Fire Department.
Mr.Hanagan stated he heard nothing from the Fire Department.
Commissioner Chandler-Henry asked about the language related to expansion of non-conformities.
Mr.Hanagan stated that non-conforming structures, if destroyed by more than 50%, could not be rebuilt.
Staff believed that if a denial were to take place the applicant would be required to remove the stove in the kitchen
and the space would become a use by right.
Terrell Knight stated that he was pleased to hear about the new information related to the elevation of the
property. He agreed with the conditions as presented.
Commissioner Chandler-Henry thanked Mr.Knight and the applicant for bringing things up to
conformance. She believed the file was in order and agreed with the staff's recommendations
Chairman Ryan concurred with the comments made by Commissioner Chandler-Henry.
Commissioner Chandler-Henry moved to approve file no.ZS-5016 Emma Road Special Use Permit with
conditions.
Chairman Ryan seconded the motion. Of the two voting Commissioners,the vote was declared unanimous.
