She introduced herself as a resident of Eagle and recently put her name in the hat for the District Court judgeship available in the 5th Judicial District. She presented her cover letter,resume and personal statement to the board. She spoke about her experience and looked forward to the opportunity to serve her community. She hoped to meet with the board and chat about her qualifications and hoped the board would offer their support. Chairman Fisher appreciated Ms.Kirsner Strablizky taking the time to introduce herself and putting her self forward. She hoped to meet with her in the future. Chairman Fisher closed citizen input. 6. Contract for Purchase and Sale of Land and Sale of Conservation Easement, Horn Ranch Property, Eagle County, Colorado Toby Sprunk, Open Space Mr. Sprunk stated that the project had been in the works for a long time. He first presented it to the Open Space Advisory Committee(OSAC)in October of 2011.He thanked former Commissioner Peter Runyon for attending the meeting as it was he who spearheaded the project. He spoke about the conservation values of the ranch. It was a historic ranch property that still produced hay and sheep. Under the terms of the project, 7,300 feet of the Eagle River would be protected; 5,900 feet would go into public ownership and 1,400 would be protected under the conservation easement. The property was one of the most visible properties in the county. There was potential for a trail connection for the Eagle Valley Regional trail(EVRT). Water rights would be tied to the land through a conservation easement. There was outstanding public fishing access potential. A 120 acre conservation easement would remain in private ownership. 328 acres would be deeded to the Eagle County Open Space. Eagle Valley Land Trust would hold two conservation easements. There were two public access agreements—EVRT and guided hikes to the stone quarry. The purchase price was$3,720,000. GOCO would award$600,000 to be reimbursed in 2014. Management costs would be low due to minimal planned improvements. He hoped to get a small parking area built in 2014 to provide access. There would be only one controlled access point. He presented the criteria and both staff and OSAC's recommendations were high. The project was unique and consistent with the purposes and intent of the Eagle County Mater Plan. Chairman Fisher applauded Mr. Sprunk for his diligence and his ability to work with the owner. Peter Runyon believed this was the first project to receive all"High"recommendations. He believed the community buffer aspect was important. He thanked the landowner,Magnus Lindholm for going ahead with the project. He believed the Open Space program was an extraordinary opportunity and hoped the community would support it in the future. Tom Edwards spoke. He believed the project was one that the Open Space fund was created for. It was a terrific scenic opportunity, conservation piece, and he encouraged approval. Bill Heicher spoke. He believed the project was a model of everything being done through the Open Space program. The property was on the valley floor and highly visible. Millions of people would view the property and the residents of the county had a great access opportunity. He spoke about Leonard Horn,the original land owner. This was a key piece,outstanding buffer,a historic property, and hoped the board would approve it. Ken Neubecker,Eagle River Blue Trail Coordinator spoke. He supported everything said about the property. He believed that this property was the jewel in the crown. Commissioner Chandler-Henry thanked Mr. Sprunk,the Open Space Advisory Committee,the Land Trust and everyone else that worked on the project so diligently. The property was a critical piece. Commissioner Ryan thanked the hard work of staff and Peter Runyon's vision. Chairman Fisher believed it was a great endeavor. She thanked Peter Runyon for his diligence in continuing the conversations. She believed it was a great opportunity for the community and property owner. She hoped that there would still be sheep and the community would be able to enjoy some of what had made it a historical and iconic location. Intergovernmental Agreement for Community Development Block Grant Business Loan Funds Jill Klosterman,Housing Ms.Klosterman stated that there were three documents before the board;the first was the contract with the State of Colorado Department of Local Affairs awarding a$580,000 grant for the program obtained through the efforts or the Northwest Colorado Council of Governments. The second document was an agreement between Eagle County and NWCOG that outlined the rules. Although, Eagle County 21 10/01/2013 was the recipient of the grant NWCOG would be reporting to the state. The third document was an intergovernmental agreement that Eagle County would be a participant in the program. Anita Cameron,Business Loan Officer for the Northwest Colorado Council of Governments explained that the loan fund was created for loans to businesses that would be creating new jobs. There was a new loan committee created with a representative from each of the 9 participating counties. Vail Valley Partnership was active in the economic development district. Ms.Klosterman stated that she was the representative for Eagle County. There would be very little impact as far as workload from the county. All the reports would be drafted by Ms. Cameron. Commissioner Chandler-Henry wondered how many businesses would benefit. Ms. Cameron stated that it would depend on the amount of the loans. If after the$500,000 was loaded they could ask for more and it would become an addendum to the contract. The following section referenced the comments of all responses to Eagle County prior to the date of this writing: Eagle County Engineering Department—Please refer to attached referral response letter dated September 13, 2013. Eagle County Wildfire Mitigation Department—Please refer to attached referral response letter dated September 9,2013. Eagle County Planning Department—Please refer to attached referral response letter dated September 9, 2013. Eagle River Fire Protection District—Please refer to attached referral response letter dated September 13, 2013. Colorado Parks and Wildlife—Please refer to attached referral response letter dated September 11, 2013. Colorado Geological Survey—Please refer to attached referral response letter dated September 13, 2013. Todd Williams-Please refer to attached Adjacent Property Owner response e-mail dated August 29, 2010. B. DISCUSSION: Section 4-600 of the ECLUR defines the purpose of improvement standards as the minimum design criteria and standards for infrastructure development in unincorporated Eagle County. The criteria and standards are intended to protect and promote the public health, safety and welfare of the residents and visitors of Eagle County. The Applicant is proposing a 19 lot 35-acre residential development with up to 9 ADU's generating 164 estimated average daily trips(ADT)per day with an additional 50 trips from recreational users totaling 214 average daily trips(see Appendix D: Traffic Analysis letter dated April 18,2013). The proposed ADT corresponds with the Eagle County roadway functional classification of Rural Minor Collector,Type V. The ECLUR Improvement Standards set the geometric dimensions for the design of each classification of roadway. In order to achieve the desired design the applicant is requesting the following Variances from Improvement Standards: 1. Dual Access.ECLUR Section 4-620.J.1.h: With the exception of properties proposed to be served from the public roadway system by driveways or by urban cul-de-sacs, two (2)points of ingress/egress to the public roadway system shall be provided, such that in the event a road within the subdivision becomes impassable, all properties will continue to have access to a public roadway system. Both points of access should be open available for daily use. In the event that this is not possible, and at a minimum, there shall be provided a secondary emergency point of ingress/egress equipped with emergency 28 10/01/2013 breakaway barriers capable of accommodating emergency response vehicles commonly operated by the Local Fire Authority Having Jurisdiction for all new development or redevelopment. Secondary emergency access points must be kept free of obstruction, and must be maintained to assure year round use. Depending upon the length of the road, the wildfire hazard rating,, the number of units proposed, the topography and the recommendation of the Local Fire Authority Having Jurisdiction, the Board of County Commissioners may, at their discretion, grant a variance from this required improvement standard. The Applicant has cited the following conditions that they contend represent a hardship to the Applicant if a variance to the Dual Access requirement is not granted: I. Land Ownership - though private property,Berlaimont Estates is surround by USFS property and has no direct access to the public roadway system. In addition, there is no adjacent private land available for through access. Any access will need to be through the USFS property and it is the USFS that will determine how this access is to occur. The USFS has indicated that they will only approve one access to the property. Accessing the property across the Forest Service lands will require analysis and approval under the National Environmental Policy Act (NEPA), which mandates that alternative modes of access be considered and evaluated based on potential impacts to the physical, biological and social environment. The Applicant has been coordinating with the White River National Forest,and has been directed to seek approval for access from the County before a NEPA analysis will be commenced. Upon approval of the present application,an application will be made to the USFS for access. 2. Topography - If dual access were required, steep slopes and varied terrain would require enormous retaining walls,significant site disturbance,and have much greater impact on Forest Service land,and as a result,would likely not be approved by the Forest Service. The road has been designed to minimize impact to the environment,while significant measures have been taken to ensure the safety and welfare of the future residents of Berlaimont Estates. 3. Visual and Environmental Factors - dual access would only increase visual disturbance. The proposed roadway has been been designed to limit visual disturbance. When possible, it copies the existing FSR roadbed,limiting visual impacts both from the 1-70 corridor as well as from the south slopes. 4. Wildlife - by following the existing roadbed when possible, the design prevents additional excessive disturbance of the existing wildlife habitat. Wildlife expert Rick Thompson has been part of the development team and provided expertise with strict focus on limiting the disturbance on wildlife. Referral responses identified some potential adverse impacts on the health, safety and welfare of persons affected, and the adverse impact on lands affected: In the referral response from the Colorado Geologic Survey they encouraged that the road design be required to design oversized drainage culverts to accommodate bulk debris and mudslides that could be mobilized in a large storm event, especially post-wildfire. The applicant has worked with Eagle County Wildfire Mitigation and Eagle River Fire Protection District to develop a wildfire mitigation plan aimed at providing the most protection for the community and those responding to an emergency. However, since no two wildfires are the same, it is difficult to day whether these steps completely excuse a lack of dual access. Colorado Parks and Wildlife have identified several significant issues related to wildlife impact. However; these issues relate to general impact of any improved access. In consideration of this Variance the BoCC should consider only impact caused by improvements necessary to meet the road standard to serve the proposed development over the improvement necessary for a driveway. 2. Emergency Vehicle Turnaround Areas.ECLUR Section 4-620.D.10.d: 29 10/01/2013 Emergency vehicle turnaround areas shall be required on rural cul-de-sacs at the initial 1,000 foot mark and at 1,000 foot intervals for the remaining length of road. The Local Fire Authority Having Jurisdiction may recommend an alternative spacing plan for the turnaround areas. The turnaround areas shall be constructed in accordance with Section 4-620.D.11, Vehicle Turnarounds. The Applicant has proposed 14 Emergency Vehicle Turnarounds along the 5.32 mile roadway. These turnarounds are spaced at intervals between 945-feet and 4,050-feet. The Eagle County Wildfire Mitigation Manager recommends that in areas where heavy wildfire fuels exist that either fuels reduction work be completed or that the ECLUR spacing of 1,000-feet be maintained. In their September 13,2013 e-mail the ERFPD concurs with this recommendation. 3.Road Design Standards.ECLUR Section 4-620: The proposed road is estimated to carry an average of 214 vehicle trips per day. This volume corresponds to the Eagle County Rural Minor Collector,Type V standard. This road would have 10-foot paved driving lanes with 3-foot gravel shoulders on each side. The Applicant has requested variances to geometric road design standards as listed in the"Summary of Variances from Roadway Standards"table on pages 15-17 of the application. The majority of these are for horizontal curves that do not meet the ECLUR minimum of a 273-foot radius for the Rural Minor Collector,Type V classification. The AASHTO Policy on Geometric Design of Highways and Streets standard for 20 mph design speed with 6% superelevation is a 81-ft radius. In the 2010 application Engineering Department identified the spiral curve lengths and the distance between switchbacks as variances that would be required based on the proposed design. The applicant committed to meet the minimum spiral curve lengths where possible and consider use of simple tangent curves at locations with little tangent deflection. In addition,Alpine Engineering provided an alternate switchback design that provides the necessary stopping sight distance between curves. The Engineering Department requests that these changes be incorporated into the current design. C. STAFF FINDINGS: Section 4-600 of the ECLUR defines the purpose of improvement standards as the minimum design criteria and standards for infrastructure development in unincorporated Eagle County. The criteria and standards are intended to protect and promote the public health, safety and welfare of the residents and visitors of Eagle County. Further, Section 4-610.A.2 of the ECLUR states: Standards Are Not Inflexible. These design criteria and standards provide a certain level of performance, however, they are not inflexible. If an alternate design,procedure, or material can be show to provide performance and/or environmental sensitivity which reflects community values equal to or better than that established by these standards, said alternative may be recommended for approval by the County Engineer. In evaluating the proposed alternate the County Engineer shall follow the procedures in Section 5-260.G., Variance From Improvement Standards. The County Engineer's evaluation shall consider whether the alternative will provide for an equivalent level of public safety and whether the alternative will be equally durable so that normally anticipated user and maintenance costs will not be increased. However,we must also consider that the Board of County Commissioners has adopted Resolution No. 2009-115 in response to numerous and substantial public safety concerns recommending strict enforcement of the ECLUR Improvement Standards with the opportunity for the applicant to appeal to the board for a Variance to these Standards. 30 10/01/2013 Dual Access Hardship: Applicant claims that there are excessive physical hardships in creating a secondary access to the property: 1. Any secondary access would be across USFS property. The USFS has indicated that they will only provide one access to the property. 2. Due to topography the secondary access would require retaining walls and significant site disturbance 3. The construction of a secondary access would increase visual disturbance 4. The secondary access would increase the impact on wildlife The Planning Department questioned the establishment of hardship in their referral response citing the fact that the land could be used for other beneficial uses. Adverse Impact: In the referral response from the Colorado Geologic Survey they encouraged that the road design be required to design oversized drainage culverts to accommodate bulk debris and mudslides that could be mobilized in a large storm event, especially post-wildfire. Road Design Standards It is the opinion of the Engineering Department that if the BoCC finds that a Variance to Improvement Standards is justified,the sub-standard geometric features of the proposed road can be mitigated. Board of County Commissioners Findings The Board of County Commissioners must make the following finding in order to approve or deny this file: (ECLUR 5-260.G.2.) In determining whether to approve, approve with conditions, or disapprove the application for Variance from Improvement Standards,the Board of County Commissioners shall balance the hardships to the applicant of not granting the Variance against the adverse impact on the health,safety, and welfare of persons affected,and the adverse impact on the lands affected. In approving or approving with conditions that are necessary to ensure compliance with the terms of this Subsection,these Regulations, and the Comprehensive Plan. D. BOARD OF COUNTY COMMISSIONERS OPTIONS: 1. Approve the [VARIANCE] request without conditions if it is determined that the petition will not adversely affect the public health, safety, and welfare and the proposed use is attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan(and/or other applicable master plans). 31 10/01/2013 2. Deny the [VARIANCE] request if it is determined that the petition will adversely affect the public health, safety, and welfare and/or the proposed use is not attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is not in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 3. Table the [VARIANCE] request if additional information is required to fully evaluate the petition. Give specific direction to the petitioner and staff. 4. Approve the [VARIANCE] request with conditions and/or performance standards if it is determined that certain conditions and/or performance standards are necessary to ensure public, health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). SUGGESTED CONDITIONS OF APPROVAL: The following suggested motion and conditions of approval are provided for the BoCC should they decide to make such a motion: I move to approve File VIS-4398; Variance to Improvement Standards for Dual Access, Emergency Vehicle Turnaround and Road Improvement Standards with the following conditions: 1. Except as otherwise modified by this Variance approval, all material representations made by the Applicant in this application and in public meeting shall be adhered to and considered conditions of approval. 2. The applicant shall incorporate the road improvement and construction recommendations provided by the Eagle County Wildfire Mitigation referral response dated September 9, 2013 3. The applicant shall provide a debris and mudslide analysis as part of a drainage study at the time of Grading Permit application to size all culverts and/or bridges designed for the access road. 4. The Applicant will be responsible for all applicable permitting necessary to develop the proposed lots including,but not limited to,building permits, grading permits, etc. 5. At the time of Grading Permit application the Applicant shall have approval from the USFS of the necessary easements for construction of the access road alternative presented in this Variance application prior to Grading Permit application. 6. Road design shall incorporate minimum spiral curve lengths where possible and consider use of simple tangent curves at locations with little tangent deflection. 7. Road Design shall include alternate switchback design(Alpine Engineering,2010)that provides the necessary stopping sight distance between curves *The applicant has provided several additional conditions of approval in Section VI., Conditions of Approval, of their application(page 24-25) for consideration by the BoCC. DISCUSSION: Ben Gerdes stated that the process was a stepping stone that would allow the applicant to ultimately get approval to build a road. Most of the road would be built on National Forest property. The property was 680 acre parcel that had been divided into 19, 35 acre lots. The current proposal was to develop 19 single family homes and 9 ADU's. The applicant was seeking variances from a number of standards in the land use regulations, the most significant was the dual access standard. The commissioners should balance the hardships to the applicant of not granting the variance against the adverse impact on the health, safety, and welfare of the persons affected and the adverse impact on the lands affected. Hardships were referred to as things physical in nature. If the applicant did not enter into the process they would still be allowed to build a driveway if they receive permission from the Forest Service. 32 10/01/2013 Ms. Ayres-Oliver stated that staff had received a good bit of public comment relating to the impacts of the development. The board was not here today to weigh in on the development of the parcels. The parcels were exempt from the county subdivision regulations as they were 35 acre parcels. The sole issue before the board was whether or not to grant the variance to the 3 improvement standards, the dual access, emergency turnaround, and variance to certain road improvement standards. The question was not whether to leave the road dirt versus paving it because under the driveway standards the applicant could pave the road. Based on the driveway standards they could construct 3 homes but would still be required to get a grading permit. Chairman Fisher was challenged by the layout of the parcels due to the steep terrain. Dominic Mauriello spoke about the local family that owned the property. Their intent was to build a home on the property and provide safe year-round access with limited environmental impacts through planning and mitigation. The proposed access was designed to mitigate concerns about health and safety versus paving two roads. The spacing for the emergency turn-around areas would provide spacing that reflected the topography. The property had been zoned since 1974. The property was remotely located. There was steep and difficult terrain. The applicant believed that not granting the variance would result in greater environment impacts and the owner would be deprived of reasonable access and use of the property. The owner purchased the property in 2008. They had a plan for wild land fire protection and wildlife mitigation. Berlaimont Estates was 680 acres, 19 units, and 9 ADUs were proposed and allowed by state statutes. He believed that the plan was consistant with the comprehensive plan and compatible with the future land use map. He showed the parcel layout and did not believe the shape of the parcel was important. Large parts of the property would be preserved with the clustered design. The property was a rolling hill type of development. He presented photos of the property. The environmental impacts had been addressed. It was possible that the Forest Service would not approve the road. The Alaska National Interest Lands Conservation Act of 1980 provided that the access to non-federal owned land shall be allowed across federal land. The property was homesteaded and deeded into private ownership in 1935. The property was divided into 35 acre parcels in 2011. Until 2009, Eagle County did not apply access standards to 35 acre subdivision. Tom Ragonetti, legal counsel for the applicant stated that in 1972 Colorado adopted senate bill 35 a uniform county subdivisions act. The act exempted subdivisions with parcels of 35-acres or greater from county subdivision regulations. The access regulation and the application of it should be created and applied in a reasonable manner to accommodate the creation and use of these types of subdivisions as legislature intended to be allowed. These types of subdivisions were in rural areas where there weren't existing road networks. The applicant and their consulting team had gone through extraordinary lengths to address the technical safety and requirements for accessing the development with a single access. He believed that if the board granted the variance it would not be creating a situation unknown in Eagle County. If the variance were not granted the applicant would unable to use their property for the purposes of the state exemption contemplated and for which the zoning grants them rights. Mr. Mauriello spoke about the road geometry and design. The length of the road was about 5.3 miles. A paved road surface was proposed for safe, year around access. They were not proposing to change the use of the road. The proposal would move the road onto Forest Service property and away from the backs of homes. They would be willing to work with the neighbors and correct and the drainage issues as well as landscaping. The applicant had proposed parking, reduced the density, addressed key wildfire concerns, and proposed some other restrictions on development to make it a safer development. The applicant hired Anchor Point Group to create a fire mitigation plan. Chris White, Anchor Point Group stated that they looked at the alternative methods of compliance to a single access fire wise community. They had interfaced with the fire protection district and the county. Rod Moraga, Anchor Point Group stated that they did several site visits to the area and looked at the fire environment. There were 3 major factors, fuels, weather, and topography. The area was rated low and moderate. There were not a lot of things that would lead them to have high concern about wildfire in this area. Mr. White stated that the intent was to reduce the risk of wildfire, build fire resistant homes and provide a strong defensible space around buildings. All homes would be constructed with engineer designed residential sprinkler systems. Two ponds with a 32 million gallon capacity would also be on the property. There would be a helipad location for increased fire and medical response. There would be two times the recommended defensible space around each home. They worked with the Eagle River Fire Protection District (ERFPD) and Eagle County Wildfire Mitigation Specialist to mitigate risks and both approved the Wildfire Mitigation Plan. It was his professional opinion was that he preferred to see 19 homes on the single access with all the mitigation and extra precautions than 3 homes on a driveway that wasn't required to have anything as substantial. 33 10/01/2013 Rick Thomson, Western Ecosystems Wildlife consultant spoke. He believed the impacts would be moderate. The proposed variances would reduce all of the potential adverse indirect and direct affects. Using the existing road would minimize the adverse effects. Commissioner Ryan asked Mr. Thomson what the current impacts of the dirt road were. Mr.Thomson stated that the road was not use during the winter months. Having just a single access would reduce the direct affects to habitat loss. Mr. Mauriello stated that the applicant was proposing as a condition adopting the fire mitigation plan proposed by Mr. White. An open space easement was being proposed with oversight by Eagle County. As part of the mitigation plan all homes were required to have fire suppression systems and strict construction standards. The HOA would address road upkeep,maintenance snow plowing and sewer maintenance requirements. Chairman Fisher asked if there would be shared horse facilities,barns or community shared recreation. Mr. Mauriello stated that there would only be one property that would be allowed to have more than 3 horses and stables. Commissioner Chandler-Henry wondered if the equestrian use would impact the road design. Mr. Gerdes stated that they just used standard trip generation rates. Mr. Mauriello stated that they believed the use of the land was consistent with the zoning. There were hardships which warranted the granting of the variance. Not allowing the variance would deprive the owner of use of property consistent with resource zoning and State Statutes. Chairman Fisher opened public input. Connie Irons spoke. She opened the Gas House restaurant in 1983. She supported development. She believed the applicants were good people and a nice family. She supported the proposal. Ron Byrne spoke. He expressed support for growth and development. He believed the applicant had a good team of professionals. Frank Mitchell, Edward s bike shop owner expressed opposition for the variance as the road was used for mountain biking. Bill Heicher spoke. He believed it was important to consider what the road variance would do if approved. He believed this was a real estate project. The current restrictions on the property now were not unreasonable and did not interfere with the use of the property. The property was homesteaded in 1935. The owners in 1935 had reasonable use of the property. There was better access to the property now than there was in the 30's. The hardships also related to the physical characteristics of the property not the personal circumstances of the owner. He believed the road improvements were intended for financial gain. The property was not unusable; the property had been used off and on for 78 years. The variance if approved would have some significant impacts on wildlife. Wildlife was a valuable resource; too valuable to be ignored. He wondered if the road would be open to the public year around. He wondered what the benefits were to Eagle County. He believed the impacts far outweighed any possible benefits. The owner bought the land knowing the condition of the property and the rules were in place then. A new development would be created beyond the suggested grown boundaries of the Edwards Community. Significant wildlife impacts would occur and the proposed 28 residential units would result in the development that was contrary to the county's comprehensive plan and associated land use regulations. The proposal was an attempt to maximize a financial prospect and was not in the best interest of the county, community,the land,or wildlife. Stephanie Guis agreed with Mr. Heicher's comments. She'd been hiking the trails for many years. She opposed the proposal. Todd Williams, Moonridge resident spoke. He believed the board had to consider the safety for the residents of the development and the nearby community. Debbie Noha spoke. She's lived in Eagle County since 1971. She believed the road was drivable in its current condition. Paving the road would take away from the biking and hiking. Alitza Vagenknechtova spoke about the property owner. The family had put a lot of work in the project and addressed all the issues. They planned on letting bikers and hikers access the property. The proposal would bring jobs into the community. She asked that the board approve the variance. Bill Andree, Local Wildlife Officer spoke. He believed the wildlife assessment, created in 2010 and was outdated and inadequate. The owners had access to their property and they did not need to go back into the forest and cause an impact to the state's wildlife and the public land. The applicant had enough land to build a road on their property. He agreed with Bill Heicher's comments. The development may be low density but was not low impact. Without the variance they still get 3 homes and there was currently reasonable access. Wildlife in Eagle 34 10/01/2013 County brought in over$38 million dollars. There was nothing in the report that addressed recreation impacts. The Forest Service did not look at wildlife at a local level; they looked at a regional level. The deer population was half of what it used to be. If Eagle County wanted to approve the variance the county needed to put on enough restrictions to protect wildlife. The area was considered the second largest migration corridor in the state of Colorado. Commissioner Ryan asked about the reasonable restrictions and if they existed. Mr. Andree believed there should be discussion about mag chloride use, speed enforcement, and preventing road kill. Commissioner Chandler-Henry wondered what the difference would be to the wildlife impact by the driveway standards versus a paved road. Mr.Andree did not believe the road needed to be paved. Mr. Gerdes stated that the driveway standard would not require a paved road. Mr. Andree believed the biggest difference was 3 homes versus 19. He did not believe that allowing a variance that went back on Forest Service land once they get to private land should be part of an agreement. He stated that he was speaking as an agency representative. Chairman Fisher closed public input. Ms. Ayres-Oliver stated that if the applicant wanted to construct a road that met driveway standards, they could do so and there wouldn't have to be any oversight by the board. The property owner could pave a road to access 3 parcels if the variance were not approved. Mr. Gerdes stated that they would have to go through the Forest Service to get an easement. Ms. Ayres-Oliver reiterated that a variance was a deviation from the Land Use Regulations that was based on special conditions. The board would have to balance the hardships to the applicant if the variances were not granted and the impact on the affected lands and people. Chairman Fisher wondered about the domestic animal component and transporting animals such as horses out in the event of a fire. Ms. Ayres-Oliver stated that the board could consider the number of units when considering the number of cars but not the development itself. Commissioner Chandler-Henry asked Mr. Mauriello about the topography of the road. Mr. Mauriello believed they proposed a road that was in the most reasonable location because it followed the existing road. A gate was installed because the owner was concerned with some activities going on up there. There were no plans to lock the gates. Commissioner Chandler-Henry asked if there was a wildlife mitigation plan. Rick Thomas stated that there was no specific wildlife mitigation plan because the wildlife report 2010 was focused on the variances and the effects of the variances. Mitigation for the larger project would be addressed in detail as part of any subsequent processes. The effects related to the variance were minimal. Chairman Fisher thought it would helpful to do a site visit but would not be able to attend as she would be away for a while. Mr.Mauriello believed a site visit could be scheduled between now and the next hearing. Mr. Gerdes stated that he would schedule a site visit. Commissioner Chandler-Henry moved to table the file until December 10, 2013. Commissioner Ryan seconded the motion. The vote was declared unanimous. 24.
