HomeMy WebLinkAboutMinutes 07/02/13 PUBLIC HEARING July 2, 2013 • Present: Jon Stavney Chairman Sara Fisher Commissioner Jill Ryan Commissioner Kathy Scriver Deputy Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Reception for Kathy Chandler-Henry and Jon Stavney Swearing-in Ceremony for Kathy Chandler-Henry The Honorable Judge R.Thomas Moorhead Judge Moorhead spoke about government in action for the good of the constituents of Eagle County and 5th Judicial District. He spoke about the recent remodel and expansion of the court facility on Chambers. He recently swore in Judge Patton, 6th position in the Judicial District, and believed it would not have happened without the expansion. He enjoyed visiting the county building and seeing government work. Judge Moorhead administered the oath. Ms. Chandler Henry spoke about county government and creating a bright and strong future for everyone in the community. She was honored and humbled to be present this day. She thanked Jon Stavney for all his work on behalf of the citizens of Eagle County and the good of the whole. She looked forward to working with Commissioner Fisher and Commissioner Ryan. Commissioner Fisher thanked Ms. Chandler-Henry for stepping into the role. She believed it was important to continue looking forward. She was excited and happy that Jon Stavney would continue to serve the community. Commissioner Ryan believed that Jon Stavney was a visionary for place making. He was champion and good at what he did. The Town of Eagle was lucky to have him. Gregg Philips spoke about the individuals that had contributed to the airport. He thanked Jon Stavney for his encouragement and support. Sharee presented Jon Stavney with a new nametag. Jon Stavney stated that he was proud to have been a part of the organization. He still felt a part of Eagle County and looked forward to continuing the good work. Mr. Montag spoke about Jon Stavney's performance on the basketball court. He put his heart and soul in whatever it was he did. The Town of Eagle would benefit. He recognized Ms. Chandler-Henry's mother, husband George and the Stavney family. Maryanne Stavney thanked the community for embracing her husband and family. Toby Sprunk thanked Jon Stavney for his leadership on property acquisitions. Peter Runyon stated that it had been a pleasure working with Jon Stavney and asked everyone to give him one last standing ovation because he did such an outstanding job. Diane Mitsch Bush, Colorado House District 26 spoke about her relationship with Jon Stavney; he was great to work with and knew every issue inside and out. Kathy Chandler-Henry had become a good friend and was a great person and no one worked harder than she. She believed that Ms. Chandler-Henry would do a great job. Resolution 2013-060 Approving the Second Amendment of Resolution No. 2013-001: Annual Appointments Resolution County Attorney's Office Representative Bryan Treu presented the resolution. He stated that Kathy Chandler Henry was replacing Jon Stavney in most positions. Sara Fisher would be the Chairwoman and Jill Ryan would be the Vice-Chair. He reviewed all other boards and department appointments. Commissioner Chandler—Henry moved to approve the Resolution Approving the Second Amendment of Resolution No. 2013-001: Annual Appointments Resolution. Commissioner Ryan seconded the motion. The vote was declared unanimous. Greg Schroeder,Engineering Commissioner Ryan asked Mr. Merry to speak about consumer protection in general. Mr.Merry explained that item 7 were services for sanitation inspections and that most of the workload was conducted with restaurants. The significant change in the contract included a change in the delivery of core services. They were still negotiating with the Town of Vail to cover personnel expenses related to doing these inspections for the Town. If the Town chose not to participate financially,the level of service would be proportionate to the contribution. Commissioner Ryan asked about the contract with the state and the cost. Mr.Merry stated that the level of funding was about$30,000 for the contract. They received revenues from licensing as well. This amount was approximately$50,000 -$75,000 per year. He indicated that the contract covered Day Care facilities as well. He believed that the Town of Vail should be concerned with their consumers to the degree that they contribute sufficiently to the cost of these protection services or inspections. Chairman Fisher asked that time spent on municipal inspections be documented. Mr.Montag added that the county should start thinking about gearing up for the event for that period of time. Some supplemental assistance may be necessary. Chairman Fisher spoke about other special events such as Farmer's Markets. Taylor Ryan spoke about the banner program in Eagle Vail. The banners on Highway 6 brightened up the area and brought attention to the business district along Highway 6. The banners were permitted through Colorado Department of Transportation and as such,the county must be included in the permit. 21 07/02/2013 Commissioner Ryan asked if the program was part of the engineering department or only due to the county needing to be involved per CDOT requirements. Mr. Ryan indicated that unincorporated communities needed to work through the county. Greg Schroeder spoke about the Stone Creek Flood hazard mitigation project. The county received a grant to give communities funds to fix problems before they become bigger problems. There were 15 homes within the regulatory flood plain and another 60 in the moderate flood plain area. The concept was to use the golf course fairway as an extra conveyance area. Proposed Land Use Designations Lot 3, per the existing PUD, is restricted to one single family residence, not to exceed 8,500 square feet. Due to changes in the housing market, the applicant believes there is higher demand for smaller, single family units, than there are for larger units. The following section references the comments of all agencies that submitted an official referral response to Eagle County prior to the date of this report: Eagle County Engineering Department—The Eagle County Engineering Department has no comment. Eagle County Environmental Health Department—The Eagle County Environmental Health Department has no comment. • Eagle County Eco Trails—Ellie Caryl has no comments regarding the McCoy Creek Cabins proposal. It appears the existing trail easement will not be modified or impaired by the proposal. Eagle County Cartographer Coordinator—Kenneth Sexton had no comments in regards to legal, ownership and purpose. Eagle River Fire Protection District—The Eagle River Fire Protection District has the following comments: "The access and water supply locations have been approved by the Eagle River Fire Protection District for the McCoy Creek Cabins PUD amendment. By increasing the number of houses on Lot 3 from one to two, will not affect the fire district's ability to access or water availability for firefighting purposes to this site." Eagle River Water and Sanitation District—The Eagle River Water and Sanitation District has provided two referral letters on the project.The first letter dated April 18,2013, stated: "In regards to the referral PDA-4172, ERWSD would like it to be known that the applicant will need to schedule a meeting with our construction review team to discuss the water and sewer services for the two proposed buildings.Both water and sewer services have been stubbed out for one building on this lot and using the one water and one sewer stub out to satisfy the needs of both of the proposed units would require a variance to be in place." The letter dated April 25,2013 stated: "In regards to the sewer service line at the last remaining lot at the McCoy Creek Cabins PUD, this sewer service ties into a private sewer main that runs all the way out to the ERWSD sewer main at Cresta Rd. Being that this whole system is private, if the owner of the parcel would like to use the one sewer service line for two separate homes,that is well within their right. As far as the 2"water service line goes, a variance request will need to be made and granted before this line could be used to serve the two homes. If you have any questions,please feel free to contact me." A follow up letter dated May 15,2013, from the Eagle River Water and Sanitation District, shows the applicant has received a variance to exempt the planned residences from the requirement of having a separate and independent water service connection to the water main. Colorado Department of Natural Resources Division of Water Resources—The Division of Water Resources provided the following comments in a letter dated April 22, 2013: "We have reviewed the above referenced proposal to amend the McCoy Creek Cabin PUD to allow for two cluster homes on Lot 3 in lieu of one single family home. The McCoy Creek Cabins PUD was originally adopted on May 13, 2008 and created three cluster lots on a 10 acre parcel. Lots 1 and 2 could have either one or two single family dwellings; Lot 3 was limited to one single family dwelling. Since the PUD was adopted, Lots 1 and 2 have been re-subdivided into Lots 1A, 1 B and Lots 2A, 2B that allowed one single family dwelling per lot. This office has no record of the McCoy Creek Cabin PUD on file. The PUD information available through the Eagle County website and this application does not provide information on a proposed water supply plan. However, per a conversation with Ms.Valdez on April 19, 2013 it is our understanding that this PUD utilizes Eagle River Water and Sanitation District; this is the proposed water and sewer provider for the PUD amendment as well. 24 07/02/2013 Pursuant to CRS 30-28-136(1)(h)(II), a municipality or quasi-municipality is required to file a report with the county and the State Engineer documenting the amount of water which can be supplied to the proposed development without causing injury to existing water rights. A report of this nature was not included. CRS 37-92-602(3)(b)(III),requires that the cumulative effect of all wells in a subdivision be considered when evaluating material injury to decreed water rights . Accordingly, if the parcel is subdivided,the presumption under CRS 37-92602(3)(b)(II)(A),that there will not be material injury to the vested water rights of others or to any other existing well from such well ,will no longer apply. This office does not have record of any water well permits within the PUD. However,the applicant should be aware that the lots within the McCoy Creek Cabins PUI) are not eligible for exempt well permits. Since insufficient information was provided,we cannot comment on the potential for injury to existing wal:er rights under the provisions of CRS 30-28136(1 )(h)(II)." Applicant Response to Eagle River Water and Sanitation and Colorado Department of Natural Resources Division of Water Resources: As a result of Bill Nutkins' meeting with Eagle River Water and Sanitation the following was determined: 1. The sewer line is private hence there is no action for Eagle River Water and Sanitation to take. 2. A variance for using the current single curb stop for the domestic water line is something Eagle River Water and Sanitation feels is acceptable and has been done in the past. The applicant will need to come off the end of the existing line with a"Y"and install separate shut-offs and meters for each house.The applicant will work with Julie Stuck, Customer Service,to get the proper paperwork submitted for the variance. 3. As for the State Colorado Department of Natural Resources Division of Water Resources,Tug Birk, Development Review Coordinator with Eagle River Water and Sanitation is going to look into this. Eagle River Water and Sanitation feels this is not within the State's review because the PUD is already in a PUD Water Zone District which has rights to water. Eagle River Water and Sanitation thought the State might be looking at this as a new subdivision outside of a current Water Zone District. SUMMARY ANALYSIS: The buildable square footage of the PUD is remaining the same, and one additional unit is being added to the PUD. Building envelopes are not changing and the requirement of adhering to the stewardship practices of McCoy Creek as outlined in the original PUD approval are still in place. Staff finds that all standards for a PUD Amendment have been met and that,as proposed,the revised PUD language for McCoy Creek Cabins, will place the appropriate controls on future development and ensure compatibility, continued trail access for Arrowhead residents, and continued protection of McCoy Creek. PLANNING COMMISSION COMMENTS: At their regularly scheduled meeting of June 5, 2013, the Eagle County Planning Commission provided the following comments: • A Planning Commissioner stated he was concerned about building on Lot 3 and the amount of square footage already approved, the amount of trees that needed to be removed and how two units and two driveways will fit on the property. • A Planning Commissioner stated that with two units there will be an increase in impervious materials, decks, sidewalks and impacts on vegetation. The 75 foot stream setback should be adhered to because it is sacred. • A Planning Commissioner stated that there should be a greater setback from McCoy Creek and the building envelope should be reduced. 25 07/02/2013 • A Planning Commissioner requested architectural drawings, as well as the opportunity to review the architectural guidelines from Arrowhead. The same Commissioner asked for a preliminary sketch layout of the two units proposed for Lot 3. • A Planning Commissioner stated that the applicant is not going to build a product that doesn't fit on the lot or a driveway that can't be accessed.The product wouldn't sell. • The Planning Commission voted on the following additional condition: Between points L9 and L11 the Building Envelope will be moved in eight(8) feet from the high water mark as shown on the Final Plat. o The motion passed 3-1. • The Planning Commission voted to approve the project with the additional condition. The motion passed 4- 0. Staff Response To The Recommended Condition: Engineering: The Engineering staff will review the driveway to ensure compatibility and concerns about the design would be addressed at building permit. Attorney: The Planning Commission cannot review a project based on private covenants, such as the Arrowhead Design Guidelines. Planning: The building envelope for Lot 3 is platted and approved. The original approval of McCoy Creek Cabins PUD went through extensive public hearings with testimony from wildlife and aquatic experts. The location of the platted building envelopes is the outcome of that expert testimony and public comments. The condition proposed by the Planning Commission would require the applicant to go through the Amended Final Plat process. Staff is not in support of this condition due to the previous deliberation and design process the project went through during the original approval. SUGGESTED FINDINGS: Staff suggests the application meets the following findings necessary for the approval of any PUD Amendment: (1) Modification. The modification, removal, or release IS consistent with the efficient development and preservation of the entire Planned Unit Development; (2) Adjacent Properties. The PUD Amendment DOES NOT effect, in a substantially adverse manner, either the enjoyment of land abutting upon or across a street from the Planned Unit Development or the public interest; (3) Benefit. The PUD Amendment IS NOT granted solely to confer a special benefit upon any person. BOARD OF COUNTY COMMISSIONER OPTIONS: 1. Approve the [PDA-41721 request without conditions if it is determined that the petition will not adversely affect the public health, safety, and welfare and the proposed use is attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 2. Deny the [PDA-41721 request if it is determined that the petition will adversely affect the public health, safety, and welfare and/or the proposed use is not attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is not in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 26 07/02/2013 3. Table the [PDA-4172] request if additional information is required to fully evaluate the petition. Give specific direction to the petitioner and staff. 4. Approve the [PDA-4172] request with conditions and/or performance standards if it is determined that certain conditions and/or performance standards are necessary to ensure public, health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan(and/or other applicable master plans). SUGGESTED CONDITION: 1. Except as otherwise modified by this development permit, all material representations made by the Applicant in this application and in public meeting shall be adhered to and considered conditions of approval. 2. Planning Commission suggested condition: Between points L9 and L11 the Building Envelope will be moved in eight(8)feet from the high water mark as shown on the Final Plat. APPENDIX A NECESSARY FINDINGS: PROCESS INTENT ECLUR Section: 5-240 F.3.m—Amendment to Preliminary Plan for PUD; Section Purpose: No substantial modification, removal, or release of the provisions of the plan shall be permitted except upon a finding by the County, following a public hearing called and held in accordance with the provisions of section 24-67-104(1)(e) Colorado Revised Statutes that; (1) Modification. The modification, removal, or release is consistent with the efficient development and preservation of the entire Planned Unit Development; This request is to amend the PUD to allow two (2) residences on Lot 3 where one (1) is provided for currently. The developer will maintain the overall square footage for the two (2)new cabins combined as per the existing allowable 8,500 square feet. (2) Adjacent Properties. The PUD Amendment does not effect, in a substantially adverse manner, either the enjoyment of land abutting upon or across a street from the Planned Unit Development or the public interest; The development is already under construction with two (2) units already completed. The existing development blends with the adjacent properties. (3) Benefit. The PUD Amendment is not granted solely to confer a special benefit upon any person. The developer believes this amendment will benefit the current owners and surrounding community by creating a more consistent overall development and meeting the needs of the current real estate environment allowing for smaller homes instead of a single large home. Standards: Section 5-240.F.3.e., Standards; Section 5-280.B.3.e Standards and Section 5-230.D Standards is used to evaluate a Sketch & Preliminary Plan for PUD (with subdivision) application. All standards that would be met at a Preliminary Plan level must addressed by 27 07/02/2013 the application materials. It must therefore be determined, based on submitted evidence, whether applicable standards have been met at this stage. If the information supplied is found to be sufficiently vague or if it is doubtful that the proposal would be able to meet a specific Standard, a negative finding must be made for that Standard. STANDARD: Unified ownership or control. [Section 5-240.F.3.e (1)] — The title to all land that is part of a PUD shall be owned or controlled by one (1)person. A person shall be considered to control all lands in the PUD either through ownership or by written consent of all owners of the land that they will be subject to the conditions and standards of the PUD. EXCEEDS MINIMUM STANDARDS X MEETS MINIMUM STANDARDS MEETS THE MAJORITY OF MINIMUM STANDARDS DOES NOT MEET MINIMUM STANDARDS The property within the PUD is owned by the original developer, Ron Reynolds and two homeowners. Staff has received letters of support for the PUD Amendment from the homeowners. STANDARD: Uses. [Section 5-240.F.3.e (2)] — The uses that may be developed in the PUD shall be those uses that are designated as uses that are allowed, allowed as a special use or allowed as a limited use in Table 3-300, "Residential,Agricultural and Resource Zone Districts Use Schedule" or Table 3-320, "Commercial and Industrial Zone Districts Use Schedule" for the zone district designation in effect for the property at the time of the application for PUD. Variations of these use designations may only be authorized pursuant to Section 5-240 F.3.f, Variations Authorized. The uses are not changing with the PUD Amendment. The only change is the number of units and the allowable square footage is not changing. EXCEEDS MINIMUM STANDARDS X MEETS MINIMUM STANDARDS MEETS THE MAJORITY OF MINIMUM STANDARDS DOES NOT MEET MINIMUM STANDARDS STANDARD: Dimensional Limitations. Variations of these dimensional limitations may only be authorized pursuant to Section 5-240 F.3.. , Variations Authorized, provided variations shall leave adequate distance between buildings for necessary access and fire protection, and ensure proper ventilation, light, air and snowmelt between buildings. Any structures built in the PUD will be located within the existing building envelopes. The location and shape of building envelopes are not changing with the PUD amendment. EXCEEDS MINIMUM STANDARDS X MEETS MINIMUM STANDARDS MEETS THE MAJORITY OF MINIMUM STANDARDS DOES NOT MEET MINIMUM STANDARDS STANDARD: Off-Street Parking and Loading. Variations from these standards may be authorized where the applicant demonstrates that the proposed landscaping provides sufficient buffering of uses from each other (both within the PUD and between the PUD and surrounding uses) to minimize noise, glare and other adverse impacts, creates attractive streetscapes and parking areas and is consistent with the character of the area. The developer will adhere to the landscaping standards established in the original PUD and are carry forward in this PUD Amendment. STANDARD: Signs. [Section 5-240.F.3.e (6)]—The sign standards applicable to the PUD shall be as specified in Article 4, Division 3, Sign Regulations, unless, as provided in Section 4-340 D., Signs Allowed in a Planned Unit Development (PUD), the applicant submits a comprehensive sign plan for the PUD that is determined to be suitable for the PUD and provides the minimum sign area necessary to direct users to and within the PUD. — Comprehensive Sign Plan Provided? Yes No While a comprehensive sign plan has not been submitted, entryway signage has already been installed during the construction of the units in Building Envelope#1. STANDARD: Adequate Facilities. [Section 5-240.F.3.e (7)] — The applicant shall demonstrate that the development proposed in the (Sketch) Preliminary Plan for PUD will be provided adequate facilities for potable water supply, sewage disposal, solid waste disposal, electrical supply, fire protection and roads and will be conveniently located in relation to schools,police and fire protection, and emergency medical services. All concerns listed by Eagle River Water and Sanitation have been addressed by the applicant. The Eagle River Fire Protection District has no issues with the addition of one unit. The PUD is already served by existing infrastructure. The developer has and continues to pay into the affordable housing fund as each additional unit is constructed. There is one payment remaining in the amount of$83,333 which is due prior to the issuance of any building permit on Lot 3,as negotiated by the Board of County Commissioners as part of the original PUD approval. EXCEEDS MINIMUM STANDARDS X MEETS MINIMUM STANDARDS MEETS THE MAJORITY OF MINIMUM STANDARDS DOES NOT MEET MINIMUM STANDARDS 29 07/02/2013 STANDARD: Improvements. [Section 5-240.F.3.e (8)] — The improvement standards applicable to the development shall be as specified in Article 4, Division 6, Improvement Standards. Provided, however, the development may deviate from the County's road standards, so the development achieves greater efficiency of infrastructure design and installation through clustered or compact forms of development or achieves greater sensitivity to environmental impacts, when the following minimum design principles are followed: (a) Safe, Efficient Access. The circulation system is designed to provide safe, convenient access to all areas of the proposed development using the minimum practical roadway length. Access shall be by a public right-of-way,private vehicular or pedestrian way or a commonly owned easement. No roadway alignment, either horizontal or vertical, shall be allowed that compromises one (1) or more of the minimum design standards of the American Association of State Highway Officials (AASHTO) for that functional classification of roadway. (b) Internal Pathways. Internal pathways shall be provided to form a logical, safe and convenient system for pedestrian access to dwelling units and common areas, with appropriate linkages off-site. (c) Emergency Vehicles. Roadways shall be designed to permit access by emergency vehicles to all lots or units. An access easement shall be granted for emergency vehicles and utility vehicles, as applicable, to use private roadways in the development for the purpose of providing emergency services and for installation, maintenance and repair of utilities. (d) Principal Access Points. Principal vehicular access points shall be designed to provide for smooth traffic flow, minimizing hazards to vehicular,pedestrian or bicycle traffic. Where a PUD abuts a major collector, arterial road or highway, direct access to such road or highway from individual lots, units or buildings shall not be permitted. Minor roads within the PUD shall not be directly connected with roads outside of the PUD, unless the County determines such connections are necessary to maintain the County's road network. (e) Snow Storage. Adequate areas shall be provided to store snow removed from the internal street network and from off-street parking areas. Safe, efficient access, internal pathways, emergency vehicle access, principal access points and snow storage were established with the construction of the first two units. [Section 5-240.F.3.e(9)] —The development proposed for the PUD shall be compatible with the character of surrounding land uses. The uses are not changing with the PUD Amendment. The only change is the number of units and the allowable square footage is not changing. [Section 5-240.F.3.e (10)] — The PUD shall be consistent with the Master Plan, including, but not limited to, the Future Land Use Map (FLUM). The consideration of the relevant master plans during sketch plan review is on a broad conceptual level, i.e, how a proposal compares to basic planning principles. As a development proposal moves from sketch plan to preliminary plan review, its conformance or lack thereof to aspects of the master plans may not necessarily remain static. EAGLE COUNTY COMPREHENSIVE PLAN, EDWARDS AREA COMMUNITY PLAN, AND EAGLE RIVER WATERSHED PLAN 30 07/02/2013 All standards of the Eagle County Comprehensive Plan, the Edwards Community Plan, and Eagle River Watershed Plan have been met through the original PUD approval. The one additional unit doesn't change the conformance of the PUD to either plan. The developer will comply with the McCoy Creek Cabins PUD Wildlife Mitigation Measures document in the original PUD. During the construction of the first two (2) units these standards were adhered to and Staff believes the developer will continue to adhere to these standards. She believed the request was fairly straightforward. The applicant was requesting to change lot 3 from one single family to two cluster homes not to exceed 8,500 square feet. All the standards had been met. The proposed changes were consistent with the intent of the original PUD. The Planning Commission expressed concerns about building on Lot 3 and the amount of square footage already approved. The Planning Commission believed there should be a greater setback from McCoy Creek. A Planning Commissioner requested architectural drawings, as well as the opportunity to review the architectural guidelines from Arrowhead. Bill Nutkins, the designer spoke about the applicant's goals to respond to the developer's desires. They would like to build two cluster homes. Commissioner Chandler-Henry asked about any traffic impacts the request may create. Taylor Ryan stated that the request would not affect the road usage. Commissioner Fisher believed the request made sense and was a positive change to the area. Mr.Nutkins asked the board to reconsider the condition placed on the file per the Planning Commission. Commissioner Ryan believed it was a straightforward file. Commissioner Ryan moved to approve PDA-4172, McCoy Creek Cabins PUD Amendment with one condition eliminating condition number 2.
