Ken Whitehead stated that due to the recent decline in revenue he was requesting that they downsize their existing compactor. Downsizing would save a significant amount of money on fuel, maintenance and replacement cost. Pending board approval they projected in 2013 there would be $180,000- 200,000 savings. He hoped to auction the old compactor for $200,000. The cost of the new compactor was $367,333. 23 08/07/2012 Eva Wilson spoke about item F. The project would replace the sidewalks and parking lot at the Golden Eagle Senior Center. The entire pavement structure would be replaced. The work was expected to take up to 7 weeks. There would be two traffic controllers and B & B staff would be on site to assist residents needing to cross the road. Sean Hanagan spoke about item G. This was the first Special Use Permit for a distillery home business. The micro - distillery would make hard liquor; the alcohol would then be sold to retailers, bars, and restaurants. There would be no onsite tastings. Commissioner Stavney moved to approve the Consent Agenda, Items A -G. Commissioner Fisher seconded the motion. The vote was declared unanimous. Citizen Input Chairman Runyon opened and closed citizen Input, as there was none. Pro Cycling Challenge Update Adam Lueck, Vail Valley Foundation Event Organizer Mr. Lueck spoke about the USA Pro Cycling Challenge being held on August 23` The Stage 4 fmish would take place in Beaver Creek. State patrol would be involved in any road closures. All of the Beaver Creek parking structures would be closed to spectator parking. The finish line would be just below the Beaver Creek chapel. The estimated finish time was 3:30 -3:50 pm. If there were any emergency situations during the race, the race would be neutralized. They would do everything possible to insure public safety. The nature of the event necessitated a large organizing committee. Chairman Runyon wondered how long Highway 24 would remain closed. Mr. Lueck stated that the Highway 24 closures would be staggered. There was also a festival component to the race that would begin at 11 am. There would be an art contest, kids' activities, and a free concert from 5 -6:30 pm. Anyone interested in volunteering could go to www.ussprochallenge.com. There would be live coverage on NBC from 2 -4 pm. He believed that the area would receive some nice coverage. The reconfiguration would create lot 3. The district allowed for moderate density, residential development within the county center. There was one adjacent homeowner that expressed opposition. Brad Crawford was present on behalf of the applicant. He stated that the property owners; Tom & Bethel McLain had owned the property since 1968. The main purpose of the subdivision was to accommodate family. The McLain's currently live on lot 2. Chairman Runyon opened and closed public comment, as there was none. Mr. Treu stated that there were 3 staff findings that were considered and satisfied in the staff report. There were 5 others in the land use code, not included in the staff report that also needed to be satisfied. Mr. Hanagan stated that the requirements were considered and the applicant had met those requirements. Commissioner Stavney expressed concern for similar type subdivisions to keep squeezing tighter and tighter but believed this was an exception due to the family component. Commissioner Fisher noted that the lots were the larger compared to those in the rest in the subdivision. She wondered if the adjacent homeowner that opposed the request rented the unit adjacent to the property. Mr. Crawford stated that this was the case. They were willing to work with this neighbor by putting in some trees in if the file were approved. Commissioner Stavney moved that the Board of County Commissioners approve File No. SMA -3357 and authorize the Chairman to sign the plat. Commissioner Fisher seconded the motion. (See attached) Colorado Parks and Wildlife — Letter response dated May 14, 2012, offering comments that the impact to wildlife will be negelible. (See Attached) B. STAFF DISCUSSION: Section 4 -600 of the ECLUR defines the purpose of improvement standards as the minimum design criteria and standards for infrastructure development in unincorporated Eagle County. The criteria and standards are intended to protect and promote the public health, safety and welfare of the residents and visitors of Eagle County. The applicant is proposing to access his lot for the purpose of constructing a single family residence. Area Map The parcel to the west of the applicant is the White/Morris parcel, which recently went through the conservation subdivision process to create three lots, two of which contain single family residences, and a third "conservation" lot. There is another parcel on the east side of the applicant, which is currently undeveloped. This property has an access easement through the applicant's parcel. After the road spills as it turns to the east, it accesses 5 buildable parcels (one parcel is the unbuildable conservation parcel from the White/Morris subdivision). Prior to the White/Morris conservation subdivision, the road accessed 4 parcels, where the applicant's parcel was the third. Due to the White/Morris conservation subdivision, it was determined that this would be the fourth user of the road split, and therefore a variance from improvement standards application was determined to be necessary. 1. Dual Access. ECLUR Section 4 620.J.1.h: With the exception of properties proposed to be served from the public roadway system by driveways or by urban cul -de -sacs, two (2) points of ingress / egress to the public roadway system shall be provided, such that in the event a road within the subdivision becomes impassable, all properties will continue to have access to a public roadway system. Both points of access should be open available for daily use. In the event that this is not possible, and at a minimum, there shall be provided a secondary emergency point of ingress / egress equipped with emergency breakaway barriers capable of accommodating emergency response vehicles commonly operated by the Local Fire Authority Having Jurisdiction for all new development or redevelopment. Secondary emergency access points must be kept free of obstruction, and must be maintained to assure year round use. Depending upon the length of the road, the wildfire hazard rating, the number of units proposed, the topography and the recommendation of the Local Fire Authority Having Jurisdiction, the Board of County Commissioners may, at their discretion, grant a variance from this required improvement standard. The following conditions represent a hardship to the Applicant if a variance to the Dual Access requirement is not granted: 1. The only way to meet the dual access would be to construct another bridge over the Frying Pan River. 2. The main bridge was recently widened in 2007 -2008 by the White/Morris parcel to 16' and improved structurally to accommodate emergency vehicles. 2. Emergency Vehicle Turnaround Areas. ECLUR Section 4- 620.D.10.d: 27 08/07/2012 Emergency vehicle turnaround areas shall be required on rural cul -de -sacs at the initial 1, 000 foot mark and at 1, 000 foot intervals for the remaining length of road. The Local Fire Authority Having Jurisdiction may recommend an alternative spacing plan for the turnaround areas. The turnaround areas shall be constructed in accordance with Section 4- 620.D.11, Vehicle Turnarounds. Adequate existing turnarounds exist along the access road to the applicant's parcel. A distance of approximately 1,300 feet exists from Frying Pan Road to the applicant's parcel, and there are existing turnarounds at driveways at approximately 450 feet and 1,100 feet from Frying Pan Road. 3. Road Design Standards. ECLUR Section 4 -620: The proposed road is estimated to carry less than 100 vehicle trips per day. This volume corresponds to the Eagle County Rural Minor Collector, Type VI standard. This road type consists of 9 feet wide gravel surface driving lanes with 2 feet wide gravel shoulders. Previous developments in the area have improved sections of the road and reinforced and widened the bridge to allow for two -way traffic. B — Regrade this area, trading off some of the upper flat in order to lessen grade. Also add topping of roadbase as needed. Applicant's Proposed Improvements Of the above mentioned improvements from the applicant, the engineering department supports both of these improvements and feels that these would be reasonable for mitigating the life safety and welfare for both residents and emergency responders to the applicant's parcel. Eagle County Comprehensive Plan As the proposed variance is for an existing access road accessing existing parcels, there is no direct impact per the comprehensive plan. C. STAFF FINDINGS: 28 08/07/2012 Section 4 -600 of the ECLUR defines the purpose of improvement standards as the minimum design criteria and standards for infrastructure development in unincorporated Eagle County. The criteria and standards are intended to protect and promote the public health, safety and welfare of the residents and visitors of Eagle County. Further, Section 4- 610.A.2 of the ECLUR states: Standards Are Not Inflexible. These design criteria and standards provide a certain level of performance, however, they are not inflexible. If an alternate design, procedure, or material can be show to provide performance and /or environmental sensitivity which reflects community values equal to or better than that established by these standards, said alternative may be recommended for approval by the County Engineer. In evaluating the proposed alternate the County Engineer shall follow the procedures in Section 5 -260. G., Variance From Improvement Standards. The County Engineer's evaluation shall consider whether the alternative will provide for an equivalent level of public safety and whether the alternative will be equally durable so that normally anticipated user and maintenance costs will not be increased. However, we must also consider that the Board of County Commissioners has adopted Resolution No. 2009 -115 in response to numerous and substantial public safety concerns recommending strict enforcement of the ECLUR Improvement Standards with the opportunity for the applicant to appeal to the board for a Variance to these Standards. Regarding the applicant's proposed improvements, here are comments for each of the proposed improvement areas: Area A — Cut into bank to add more turning radius — This area has a steep slope on the south side of the roadway, and larger vehicles leaving the site driving to the north have difficulty aligning with the bridge without backing up and realigning. Widening the south side will give vehicles the ability to navigate the turn easier. Given that the south side slope is steep and rocky, the amount of widening that is necessary to gain additional roadway width should be balanced with the condition to not incur any type of structural slope stabilization, as the native bedrock is the best form of stabilization, and the added cost of constructing any type of structural slope stabilization would not realize further benefits for its cost. Additionally, any type of mechanical stabilization for the slope may actually be worse than the native bedrock slopes, which offer more stability. Therefore, the engineering department feels that the additional widening that can be realized without causing the slopes to be retained by mechanical means to be a reasonable and acceptable method for gaining additional roadway width. Area B — Regrade the road area to the southwest of the bridge — This area has been identified by the fire department as not having suitable roadbase and having steep slopes, which cause traction problems for emergency vehicles especially during the winter months. By regrading and removing some of the steeper portions of the road, as well as providing a better roadbase, this area will function better and minimize the traction issues. Additionally, having better traction in this area, especially as vehicles are leaving the site and approaching the bridge will allow the vehicles to approach the bridge easier to negotiate the left hand turn over the bridge. The Basalt FPD did note that they had an incident last winter where an ambulance lost traction and hit the guard rail in this area. Lessening the grade would improve this situation and minimize this risk. The engineering department feels that the regrading and resurfacing of this section of road will provide an acceptable benefit and allow emergency vehicles to better access the site. It is the opinion of the Engineering Department that if the BoCC finds that a Variance to Improvement Standards is justified, the sub - standard geometric features of the proposed road can be mitigated. Board of County Commissioners Findings The Board of County Commissioners must make the following finding in order to approve or deny this file: (ECLUR 5- 260.G.2.) 29 08/07/2012 Findings for Variance from Improvement Standards Request In determining whether to approve, approve with conditions, or disapprove the application for Variance from Improvement Standards, the Board of County Commissioners shall balance the hardships to the applicant of not granting the Variance against the adverse impact on the health, safety, and welfare of persons affected, and the adverse impact on the lands affected. In approving or approving with conditions that are necessary to ensure compliance with the terms of this Subsection, these Regulations, and the Comprehensive Plan. D. BOARD OF COUNTY COMMISSIONERS OPTIONS: 1. Approve the [VARIANCE] request without conditions if it is determined that the petition will not adversely affect the public health, safety, and welfare and the proposed use is attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 2. Deny the [VARIANCE] request if it is determined that the petition will adversely affect the public health, safety, and welfare and/or the proposed use is not attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is not in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 3. Table the [VARIANCE] request if additional information is required to fully evaluate the petition. Give specific direction to the petitioner and staff. 4. Approve the [VARIANCE] request with conditions and/or performance standards if it is determined that certain conditions and/or performance standards are necessary to ensure public, health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). SUGGESTED CONDITIONS: 1. Except as otherwise modified by these conditions, all- material representations of the Applicant in this application and all public meetings shall be adhered to and considered conditions of approval. 2. A grading permit will need to be issued to authorize the proposed work as shown above in the Applicant's Proposed Improvements. The grading permit will need to be designed by a professional engineer. 3. The turn radius widening, as mentioned in the Applicant's Proposed Improvements above, shall have a turning analysis performed demonstrating that a fire engine can appropriately navigate the turn. The extent of the widening shall be to not compromise the native bedrock and cause the slope to have to be retained by mechanical means. 4. A detail shall be included on the grading permit plan that shows a typical road cross section to be constructed and the amount of road base and base course to be added to the area to the west of the bridge. 5. At the completion of the grading permit, the applicant's engineer of record shall submit a signed and sealed letter certifying that the improvements have been constructed per the plans and specifications in the grading permit. DISCUSSION: Mr. Schroeder stated that the applicant was seeking a variance from improvement standards on the access road to his parcel. He wished to build a single - family home. The applicant had been very involved with working 30 08/07/2012 with staff and the fire department prior to the purchase of the property. He presented a vicinity map, area map, and site photos. He spoke about the dual access, road design, and emergency vehicle turn around standards. The only way the applicant could meet the dual access standard would be to construct another bridge over the Frying Pan River, which would be costly for the applicant if the variance for dual access were not granted. The White/Morris parcel owners recently improved the main bridge in 2007 -2008 as part of their special use permit. There were adequate existing turnarounds on the access road. The applicant would improve sections of the road in accordance with comments provided by the Basalt & Rural Fire Protections District. The Fire Department supported the variance and felt the traffic flow on the road fell into a very low volume roads category. They also felt that much of the required safety improvements had already been completed by the White/Morris project. The Engineering Department indicated that if the board found that a variance to improvement standards was justified, the sub- standard geometric features of the proposed road could be mediated. He read the proposed conditions and stated that the first half of no. 3 had already been met. Julian Nihill thanked Mr. Schroeder for his time spent. He currently lived in Mexico City in a high -rise apartment. He missed the outdoors and wished to build a simple home in nature and off the grid. The property was lovely and he wished to keep it that way. He believed that they had worked through all the details and he supported the conditions. Grafton Smith of Grafton Smith Planning stated that there was limited development ability on the property and now the fire department had vehicles that required much less turning radius. Mr. Schroeder had been very helpful and he may move to Eagle County now. Commissioner Fisher asked about the construction phase and the size of the equipment used. Mr. Schroeder stated that being that the road was narrow, this was something that had to be taken into consideration. The neighbors knew each other well and would be kept informed of the construction times. Commissioner Stavney believed that any fire and life safety issues had been dealt with and it fit the space. Chairman Runyon opened and closed public comment, as there was none. Chairman Runyon was pleased that Mr. Nihill had done his due diligence before purchasing the property and appreciated that he would step up and make these improvements. Commissioner Fisher moved to approve file no. VIS -3692 Nihill Residence with the 5 conditions as presented. Commissioner Stavney seconded the motion. The vote was declared unanimous.
