Potente to Execute All Legal Documents Necessary for Effectuating the Rental and Sale of 1050 West Beaver Creek Boulevard, Sunridge Unit #D204, Avon, Colorado Alex Potente, Housing & Development Mr. Potente explained the situation. The county owned the property with the intent to resell it. Given the cost associated with the property it made sense to rent the property in the interim allowing the market to recover. The resolution would allow him to execute the rental and sales documents for the property. Chairman Fisher asked about the rental rate. Mr. Potente stated that the rental rate was $1000.00 Commissioner Stavney asked about the price point. Ms. Potente stated that the price was $199.00 Chairman Fisher asked about allowing early sales to employees. Kim Williams stated that they had a person ready to go. Commissioner Stavney moved to approve the resolution authorizing Alexander E. Potente to execute all legal documents necessary for effecting the rental and sale of 1050 West Beaver Creek Boulevard, Sunridge Unit #D 204, Avon, Colorado. Commissioner Runyon seconded the motion. The vote was declared unanimous. Resolution Modify and Adopt the Miller Ranch Housing Guidelines with Exhibit "A" Dated January 9, 2007 (Resolution No. 2007 -001) Alex Potente, Housing & Development Kim Williams presented the modifications to the guidelines. She explained that the original guidelines were approved in December of 2003. Since that time, there has been a second version approved in 2007 and this represented the third version to help make the operation function better. There were a few changes to appreciation and capital improvements. There were capital improvements approved for 10% for a 10 -year period. The proposal included changing this to 10% for a 5 year period. They were implementing a depreciation schedule for these improvements. They had been working on these revisions for the past 24 months. They held several community meetings and received good feedback from the property owner's association. The deed restriction would not change. Commissioner Stavney asked about the inspection part of the program. Ms. Williams explained that an inspection would be performed when a property was being sold. Mr. Potente indicated that Miller Ranch properties were 4 to 10 years old and it was important that the properties be well maintained. They want to provide incentives for people to provide upkeep for their properties. Miller Ranch was subsidized by taxpayer dollars and as such the county had an interest in making sure the properties were maintained. The properties are desirable and there was still good demand for the product. Chairman Fisher asked about the 3 different homeowner associations within Miller Ranch. She wondered about the exterior issues and larger repairs that were jointly shared. Ron Neville, Miller Ranch board member stated that of the 3 HOA's, he served on the property owners association which oversaw the entire development. The other 2 associations operated on separate budgets. Those budgets had a more extensive reserve set up for exterior improvements. Chairman Fisher asked Mr. Neville if he was comfortable with the reserves being created and the process for determining when and to what extent improvements may be required. Mr. Neville stated that they recently hired an outside company to perform a reserve study. Commissioner Stavney stated that if the product was not being maintained it reflected poorly on the county. Mr. Neville stated that there intent was keep Miller Ranch an affordable, family oriented community. As a board, they were very supportive of the process. Commissioner Runyon stated that this concept had been presented right after the 2007 amendments. He understood the situation and thanked Alex and Kim for doing this due diligence. Chairman Fisher opened public comment. 38 10/05/2010 Stacy Lake spoke to the board as a resident of Miller Ranch. He spoke about the capital improvement depreciation schedule. He wanted to finish his unfinished basement. 10% of his purchase price was less than the cost to finish his basement. He was concerned that there were many building materials not specifically mentioned in this depreciation schedule such as framing, plumbing, drywall, etc. He hoped these expenses would be included. Chairman Fisher wondered if Mr. Lake had brought these concerns up at the meetings. Mr. Lake indicated that he attended a couple meetings. Ms. Williams stated that it had been discussed that the structure of finishing a basement could be included in the base price. The structural parts could be included in the base price and the other items such as carpet would be depreciated. Commissioner Stavney understood Mr. Lake's concern and wondered about a slight revision to the document to clarify these issues. Ms. Williams stated that the language addressed structural finished space. Mr. Potente stated that it was staff's interpretation that the drywall, framing, internal plumbing, etc. were part of the base price. Commissioner Stavney suggested that staff insert some additional language making clear what did add to the value of the house. Chairman Fisher felt that the next 60 days after adoption would be the critical time for those who had already completed some improvements. She hoped that the language would be well spelled out for people like Mr. Lake who want to invest in their home. Mr. Potente suggested that page 11 have some descriptions added as a condition of approval. Chairman Fisher requested tabling to agreement to clean up the language. Commissioner Runyon moved to table the document to a later meeting. Commissioner Stavney seconded the motion. The vote was declared unanimous. First Amendment to Service Agreement between Funding Partners and Eagle County for the Administration of Eagle County Payment Assistance Programs Jill Klosterman, Housing & Development Ms. Klosterman spoke to the board. The amendment was an extension of the loan servicing agreement from 2005. Funding Partners did all of the loan servicing for the down payment assistant loan program. The amendment represented a 5 -year extension to the contract. Chairman Fisher opened and closed public input, as there was none. Some of the larger abatements were due to commercial properties, which had a larger tax rate. Chairman Fisher indicated that this was housekeeping. This year was different from previous periods as so many people appealed their assessed value. This had a direct impact on the general fund. STAFF DISCUSSION: Section 4 -600 of the ECLUR defines the purpose of improvement standards as the minimum design criteria and standards for infrastructure development in unincorporated Eagle County. The criteria and standards are intended to protect and promote the public health, safety and welfare of the residents and visitors of Eagle County. The Applicant is proposing a 19 lot 35 -acre residential development with an estimated average daily trip (ADT) generation of 245 vehicles per day (see No 4. of Alpine Engineering's referral response letter dated September 7, 2010). The proposed ADT corresponds with the Eagle County roadway functional classification of Rural Minor Collector, Type V. The ECLUR Improvement Standards set the geometric dimensions for the design of each classification of roadway. In order to achieve the desired design the applicant is requesting the following Variances from Improvement Standards: 1. Dual Access. ECLUR Section 4- 620.J.1.h: With the exception of properties proposed to be served from the public roadway system by driveways or by urban cul -de -sacs, two (2) points of ingress / egress to the public roadway system shall be provided, such that in the event a road within the subdivision becomes impassable, all properties will continue to have access to a public roadway system. Both points of access should be open available for daily use. In the event that this is not possible, and at a minimum, there shall be provided a secondary emergency point of ingress / egress equipped with emergency breakaway barriers capable of accommodating emergency response vehicles commonly operated by the Local Fire Authority Having Jurisdiction for all new development or redevelopment. Secondary emergency access points must be kept free of obstruction, and must be maintained to assure year round use. Depending upon the length of the road, the wildfire hazard rating, the number of units proposed, the topography and the recommendation of the Local Fire Authority Having Jurisdiction, the Board of County Commissioners may, at their discretion, grant a variance from this required improvement standard. The Applicant has cited the following conditions that they contend represent a hardship to the Applicant if a variance to the Dual Access requirement is not granted: 1. The limitation on access across National Forest System (NFS) lands to one access roadway. The property constitutes and in- holding within the White River National Forest and as such may be granted a permanent easement for year -round access to accommodate "reasonable use and . enjoyment" as required by the Alaskan National Interest Lands Conservation Act (ANILCA). A permanent easement, granted under this act and reviewed through NEPA, however, would allow only one point of entry and one access roadway, largely following existing Forest Service roads. 2. Limitation of access through adjoining private properties. There are no adjoining private lands through which a secondary access could be established that would not also necessitate access through NFS lands that are limited by the condition described in the previous paragraph. 3. The exceptional topographic conditions approaching and within the property. As contemplated specifically in Sections 5 -260 and 4 -620 of the ECLUR, access to the property is characterized by exceptional topographic conditions that make access design more challenging. Three cross - sections through the site (see Figures 4, 5 and 6 of the application) show the general character of the existing terrain. Even if a second access point could be established, the slope gradients between the property and the nearest access to the County Roadway System would make such access impractical for emergency use. 45 10/05/2010 4. The consideration of visual and environmental factors. The establishment of a permanent easement for access across the NFS requires careful consideration of a variety of visual and environmental resource parameters. Beyond the limitations identified above, a second access point would only increase the potential for visual or environmental impact. 2. Emergency Vehicle Turnaround Areas. ECLUR Section 4- 620.D.10.d: Emergency vehicle turnaround areas shall be required on rural cul -de -sacs at the initial 1,000 foot mark and at 1,000 foot intervals for the remaining length of road. The Local Fire Authority Having Jurisdiction may recommend an alternative spacing plan for the turnaround areas. The turnaround areas shall be constructed in accordance with Section 4- 620.D.11, Vehicle Turnarounds. The Applicant has proposed 14 Emergency Vehicle Turnarounds along the 5.32 mile roadway. These turnarounds are spaced at intervals between 945 -feet and 4,050 -feet. The Eagle River Fire Protection District (ERFPD) has reviewed the proposed turnaround plan and in a memorandum dated March 15, 2010 stated that the "turning movements depicted in the submittal appear to accommodate the department's ladder truck." 3. Road Design Standards. ECLUR Section 4 -620: The proposed road is estimated to carry an average of 245 vehicle trips per day. This volume corresponds to the Eagle County Rural Minor Collector, Type V standard. This road would have 10 -foot paved driving lanes with 3 -foot gravel shoulders on each side. The Applicant has requested variances to geometric road design standards as listed in the table below. In addition, they are requesting a variance from the maximum road speed. The ECLUR recommends a design speed for this type of road of 20mph. The Applicant is proposing a design speed of 30mph with adequate speed reduction signage where necessary. Through referral, the Engineering Department has also identified the spiral curve lengths and the distance between switchbacks as variances that would be required based on the proposed design. Alpine Engineering has committed to meet the minimum spiral curve lengths where possible and consider use of simple tangent curves at locations with little tangent deflection. In addition, Alpine Engineering has provided an alternate switchback design that provides the necessary stopping sight distance between curves. Eagle County Comprehensive Plan Section 3.7 of the Eagle County Comprehensive Plan, Wildlife Resources states as its Goal: Preserve and / or enhance the quality of wildlife habitat, and the vitality of wildlife populations in Eagle County. Section 3.7.2 Wildlife Concerns lists the following policies: a) The integrity, quality and interconnected nature of critical wildlife habitat in Eagle County should be preserved. b) The well -being of wildlife species of economic importance should be actively monitored and protected. c) The well -being of wildlife species of less economic importance and those on the rare and endangered species list should be actively monitored and protected. This section further lists elk, mule deer and sage grouse as species considered for protection. The Division of Wildlife in their referral response expressed their concern for the impacts of the Berlaimont Road on these species. Section 3.7.3 Development Impacts lists the following policies: 46 10/05/2010 d) Development in areas critical to the continued well being of Eagle County's wildlife populations should not be allowed. e) Where disturbances to wildlife habitat cannot be avoided, development should be required to fully mitigate potential negative impacts. Section 3.7.4 Habitat Protection at the Landscape Scale lists the following policies: f) Broad development patterns and the cumulative impacts of incremental development on wildlife habitat and wildlife populations should be accounted for in the decision making process. 3.7.5 Habitat Protection at the Site Scale lists the following policies: g) Wildlife friendly measures should be incorporated into the design of individual home sites and neighborhoods. h) Measures designed to protect wildlife from contact with human activities and disturbances should be implemented and enforced. i) Access to public lands and opportunities for public land recreation should be balanced with the need to preserve quality wildlife habitat. C. STAFF FINDINGS: Section 4 -600 of the ECLUR defines the purpose of improvement standards as the minimum design criteria and standards for infrastructure development in unincorporated Eagle County. The criteria and standards are intended to protect and promote the public health, safety, and welfare of the residents and visitors of Eagle County. Further, Section 4- 610.A.2 of the ECLUR states: Standards Are Not Inflexible. These design criteria and standards provide a certain level of performance, however, they are not inflexible. If an alternate design, procedure, or material can be show to provide performance and/or environmental sensitivity which reflects community values equal to or, better than that established by these standards, said alternative may be recommended for approval by the County Engineer. In evaluating the proposed alternate the County Engineer shall follow the procedures in Section 5- 260.G., Variance From Improvement Standards. The County Engineer's evaluation shall consider whether the alternative will provide for an equivalent level of public safety and whether the alternative will be equally durable so that normally anticipated user and maintenance costs will not be increased. However, we must also consider that the Board of County Commissioners has adopted Resolution. No. 2009 -115 in response to numerous and substantial public safety concerns recommending strict enforcement of the ECLUR Improvement Standards with the opportunity for the applicant to appeal to the board for a Variance to these Standards. The applicant has made an effort to follow the existing Forest Service roads and where possible an alignment that minimizes visual impacts to the I -70 corridor. However, a decision on these Variance requests must account for wildlife protection, wildfire protection and access for emergency services. It is the opinion of the Engineering Department that if the BoCC finds that a Variance to Improvement Standards is justified, the sub - standard geometric features of the proposed road can be mitigated. However, the impact of the road raises issues of wildlife impact and mitigation that the Engineering Department would rely on the Division of Wildlife to answer. Additionally, we would rely on the ERFPD for the sufficiency of the proposed emergency vehicle turnarounds and the necessity of Dual Access for the performance of Emergency Services to the development. Board of County Commissioners Findings The Board of County Commissioners must make the following finding in order to approve or deny this file: (ECLUR 5- 260.G.2.) 47 10/05/2010 Findings for Variance from Improvement Standards Request In determining whether to approve, approve with conditions, or disapprove the application for Variance from Improvement Standards, the Board of County Commissioners shall balance the hardships to the applicant of not granting the Variance against the adverse impact on the health, safety, and welfare of persons affected, and the adverse impact on the lands affected. In approving or approving with conditions that are necessary to ensure compliance with the terms of this Subsection, these Regulations, and the Comprehensive Plan. D. BOARD OF COUNTY COMMISSIONERS OPTIONS: 1. Approve the [VARIANCE] request without conditions if it is determined that the petition will not adversely affect the public health, safety, and welfare and the proposed use is attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 2. Deny the [VARIANCE] request if it is determined that the petition will adversely affect the public health, safety, and welfare and/or the proposed use is not attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is not in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 3. Table the [VARIANCE] request if additional information is required to fully evaluate the petition. Give specific direction to the petitioner and staff. 4. Approve the [VARIANCE] request with conditions and/or performance standards if it is determined that certain conditions and/or performance standards are necessary to ensure public, health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). DISCUSSION: Mr. Gerdes showed some maps and photos of the property location. He explained the request to subdivide the acreage into 19 residential lots. The applicant requested variances from the dual access requirements, emergency vehicle access and road improvement standards. He reviewed the various standards. The applicant cited 4 conditions of hardship to create the dual access. The applicant would also like a 30 mph road. Commissioner Stavney indicated that this location was across from the Edwards' medical center. Mr. Gerdes continued his comparison between the road design standards and what the applicant was proposing. He spoke about the wildfire elements that should also be incorporated in any approval. The upper part of the property was in a moderate wildfire rating zone. Commissioner Stavney wondered about including the comprehensive plan and whether they were technically connected. Mr. Morris stated that this was not a planning file. For purposes of today's request, there was only a request for variance to the road standards. Mr. Gerdes spoke about the impact of the road on current recreational opportunities. Commissioner Stavney asked if the road would be paved. Mr. Gerdes indicated it would be. He provided the commissioner's options. Andy Skillman and Tony Ryan spoke to the board. They introduced the landowner, Peter Lukosh, and shared his commitment to the community and this project. They own the property fee simple, and there was no lender. The landowner's representative included Michael English, Kent Sharp and Jason Marks as planners, and Alpine Engineering representatives Ken Sharp and Rob Lee. Rick Thompson, a certified wildlife biologist, was also present. He thanked county staff for their energy, time and support on the project. They requested withdrawal 48 10/05/2010 of the speed limit request, which would take the speed limit back to 20 mph. He provided some background. He stated that it was 600 acres of private property surrounded by the White River National Forest. There was no year - round access to the property. The land was zoned to allow 19 residential uses by right. The question of whether these homes should be built or not was not the question for this file. There was a constitutional right to access property. There were allowances for variances in cases of hardship. The Forest Service was the only adjoining land owner. They proposed using the existing road alignment. The proposal had been deemed adequate by the fire district. They believe the plans provided benefits to the county. He indicated that the hearing was the beginning of the process and they looked forward to working with the county in a constructive way. Chairman Fisher wondered if there were houses on the property. Mr. Skillman clarified that there were currently no homes on the property. Ken Sharp spoke to the board. He showed maps outlining the property, which was surrounded by Forest Service on all sides. He spoke about Alaska National Interest Lands Conservation Act (or ANILCA) and that it stated that the federal government was required to provide access to private land for reasonable use and enjoyment. The requirement of the Forest Service was for one access, not dual. • They projected a 9 -year phasing plan, which could provide 203 million dollars to the local and regional economy and could create about 1367 full time jobs. He clarified that the project was not seeking high- density residential development. Their desire was to provide necessary, reasonable and safe access in an aesthetically pleasing way. Presently there were summertime - motorized access to the property and non - motorized wintertime access. Commissioner Stavney asked about the existing alignment and the cut of the road. Rob Lee indicated that the proposed road would be wider. Mr. Sharp showed some photos from the other side of the valley. Rick Thompson, Wildlife Biologist stated that he worked on Mountain Star, Strawberry Park and Brett Star ranch to name a few. The impact analysis was consistent with the preliminary analysis provided to the Forest Service. The overall development would affect a wide variety of species. The biggest impact would be for deer and elk as the property and surrounding area is year round habitat. Severe winter ranges were important subsets of the overall winter range. Roads through occupied habitats could result in injury and road kill. Regardless of any access to the parcel, there would be impact to elk winter range. Mr. Sharp continued with discussions about geologic conditions. Chairman Fisher asked whether the proposal would be for paving the road with non - motorized use in winter months. Mr. Sharp stated this was correct. The gate would limit winter traffic. Commissioner Stavney clarified that this referred to public users of the road, not construction traffic. Mr. Sharp stated that they met with Eric Lovgren about the Wildfire protection plan. The project improved access to the area. Any access due to topographical issues would require a variance to the standards. Chairman Fisher asked about accessory dwelling units and whether they would be used for service personnel. Mr. Sharp deferred the question to staff to determine if there would be any accessory dwelling unit restrictions for use. Mr. Gerdes stated that because the nature of the development they had the right to develop ADUs. Commissioner Stavney believed that for the challenge of the terrain and road cuts, there was a lot of money and visual impact involved. He stated that 10 trips per day per unit was a standard count. However, did not take into account second home ownership or ADUs. The truth was that ADUs and second homes would add some trips. Mr. Gerdes stated that it did not seem reasonable to strictly apply the standard for every home being occupied everyday so they tried to come up with rational that seemed reasonable. Mr. Sharp stated that the utilities to the area would be buried. He explained the location of the proposed turnouts. He reiterated the variances being sought. Commissioner Runyon asked about the proposed road entering and exiting the property. Mr. Skillman stated there would be a process for the public to weigh in. The law includes only a requirement for one access. A secondary access could increase potential impacts. He spoke about the emergency turnaround areas being proposed every 1000 feet. The Fire Department could recommend alternative spacing. Chairman Fisher wondered if the Fire Department had made any additional recommendations. Mr. Lee stated that he'd met with the Fire Department to work out the turnaround locations given the topography. The Fire Department seemed comfortable with the spacing and development of the road. Chairman Fisher requested that this information be documented. 49 10/05/2010 Mr. Skillman spoke about public safety and health considerations. The applicant had met several times with Eagle River fire. They believe that granting these variances would not compromise safety and health. The county had applied the variance in other similar circumstances. Rick Thompson stated that the road construction effect would be limited to the activity and building of the road, berms, and retaining walls as opposed to the use of the road. Chairman Fisher wondered if the comments would take into account future development. Mr. Thompson spoke about deer and elk habitat mitigation. He spoke about minimizing habitat loss by utilizing existing road alignment. The variances being requested would minimize impacts to wildlife. There would be locally reduced habitat effectiveness, which would bring in restricted movements. Road construction would have a moderate effect on high quality winter habitat, but the road per se would have minimal impact. Single road vs. dual road would limit this impact. He spoke about spanning bridges and tunnels. He believed fencing would have great impacts on restricting habitat availability. Mr. Skillman stated that they believed the general public would benefit from this road and improvements. He agreed that developers should be held to high standards. He hoped that the board would consider their request and conclude that high standards had been met. Chairman Fisher asked how long the applicant had owned the property. Commissioner Runyon spoke about the property transfer between Spring Creek Ranch and the current owners. Presumably the property was owned previously by a sheep rancher who purchased it without the anticipation of building 19, 35 -acre lots. Mr. Skillman stated that he wasn't sure anyone could speak to the intentions of a prior owner. Commissioner Runyon wondered about why the strange shape was carved out of the Forest Service. Mr. Sharp said that they shape did resemble mining claims. Chairman Fisher opened public input. Dave Neely, District Ranger with the Forest Service spoke. He stated that the lands were lands owned by the public, but managed by the Forest Service. He spoke about the ANILCA, which required access to holdings, but the single point of access was driven by a number of factors. It was based on circumstances of each case and proposed uses did not dictate the form of access. Each case was particular to circumstance. The fact that there was already a gravel road access must be considered. Commissioner Stavney asked if case law did not require looking at future potential uses for road access. The Forest Service could determine that the current road and access was sufficient for current uses. Mr. Neely stated that they would be considering the current condition as well as the proposed uses. Commissioner Stavney stated that if the county granted the variances it acknowledged the proposed use and would steer the Forest Service in the same direction Mr. Neely stated that the board's decisions today would inform their evaluation of the alternatives. Commissioner Runyon wondered about the previous owner's request. He remembered public hearings about this request. Mr. Neely stated that he was not certain as this predated his experience. Bill Johnson spoke. He remembered the previous owners applying for easements and had open houses and it was determined that it would need to go to an environmental impact statement. The application for the easement went away and did not come to anything before the property was sold. There was also a third party that started the process and did not complete it. Commissioner Runyon remembered controversy about this. Mr. Johnson stated that through the public meeting and input it was decided that the Forest Service would pursue it, but no decision was made about the access. Mr. Morris wondered about the intermediate option, which was in the case of three residences the road standards were much less burdensome and expensive. He wondered if this situation had been considered by the Forest Service. Mr. Johnson stated that with three units their access would be a driveway permit instead of a road. The access would determine the reasonable use and enjoyment is of this property. Chairman Fisher wondered if three units were approved whether the Forest Service Rd. would be required to make the road accessible throughout the year or if a seasonal closure would remain in effect. Mr. Gerdes explained there would still be the same requirements for year -round access. 50 10/05/2010 Bill Andree, Division of Wildlife spoke to the board. He believed there was a large error. The land was not surrounded by forest service. The northeast corner was a State Land Board parcel. The Division of Wildlife currently held the recreational lease on the property. He showed the area. In the 1990s Gerald Ray obtained the land rights to delete 4 State Land Board parcels in Eagle County. At that point in time the plan was to develop both parcels totaling about 640 acres, and send a road up the east leg through the northeast corner back into the State Land Board parcel. It is possible that this landowner could purchase the parcel. He first saw a new gate in the location of the new gun range and in the winter, it would be a significant impact on wildlife. The potential for additional recreation would also affect wildlife. There was also a significant different between the forest service review and one by the county in terms of impact determination. This development would have a significant impact. This was considered the second largest deer migration corridor in the state. Once the snow needs to be plowed over the bank in high snow years it would create a fence. The county's mitigation plans were much different from the Forest Service plans. He wasn't sure how they came up with 50 recreational trips a day as the current use was much greater. With a paved road, everyone would drive up the road. He didn't' see discussions about water trucks needed for 19 units with ADUs. The more road cuts the more the snow will drift in. There was also no discussion about public parking, but he expected the public would park in the emergency turnouts. He talked about seasonal access. He preferred a speed limit of 20 mph. He was disappointed that they don't feel spanning bridges were effective. This was not just big game, but small mammals, fish and reptiles. This type of bridge would not have to be fenced. Mountain Star was required to put in spanning bridges. A moose was just killed at 15 miles per hour up at Piney Lake. Chairman Fisher read an excerpt from the DOW letter. Brian Redinger from Red Cliff and framing carpenter spoke. He felt the way the economy was going the work created would be helpful. He specialized in single - family home construction. Kevin Moriarty a resident at 407 Moonridge asked about the elevation change on the road. He wondered about drainage. He was concerned about the drainage and his backyard and the potential for flooding. Mr. Sharp stated that there would be drainage provided and the curbs would be elevated. Margie Stephens spoke. She lived in the area. They bought their property knowing that the road was dirt and closed in the winter. She had an issue with paving the road. She liked the quietness and the dirt road. She felt hardship for the Edwards' residents who liked to recreate. She acknowledged that a berm might be nice but she preferred seeing natural things. They had seen a lot of wildlife in that area in the years she'd lived in the area. Bill Anderson stated that he'd lived on Moonridge drive. He was concerned with 9 years of construction. This seems like a piece of land prime for an open space swap. He didn't understand how the Fire District signed off on this. There was a reason why the road was gated in the winter due to elk habitat. Boosting the economy was a very short-term solution to the economy. He expressed concern for drainage and traffic in the future. Chairman Fisher spoke about the memo from the Deputy Chief of the Fire Department, it did specifically support the variances. The implication that the Fire Department was in support was misleading. Commissioner Stavney concurred. Scott Davis, excavator spoke. He had worked on every major subdivision in the valley. He believed the board had to balance the rights of the property owner versus the perceived rights of the public. Currently the public was using the property and would continue to use it via the access inherent in the process. From a road building point of view and the balance of property owners and the public was well mitigated in the process. He believed there would be a balance between activity, fmancial gains and the rights of the property owners. Commissioner Stavney stated that most of the road was uphill from the existing dirt road and had drainage swale on the downside. Mr. Moriarty wondered who would maintain the culverts and drainage areas. Mr. Gerdes indicated that the property owner's association would maintain the roads, as they were private. AlitzaVagenknechtova lived in Singletree. She was afraid to walk the road due to the extreme activity on the road. There were many bikes, no emergency access and people were shooting guns. She welcomed any road improvements and saw this as an opportunity to provide better access. Chairman Fisher wondered how it would be different. The traffic would be the same only on a wider road. Ms. Vagenknechtova believed a road would provide better access for emergency vehicles. Ron Byrne spoke. He was on these properties many years ago. He felt everyone in the valley needed to look at a global basis. He believed there would be little economic development in the near future and urged the board to consider the development potential to help the economy while considering health, safety and feasibility. Eric Lovgren, wildfire specialist spoke. He spoke about emergency providers and the importance of dual access. On the surface, this would provide better access, and ladder trucks would not be used in this type of area as 51 10/05/2010 this type of landscape was typically addressed using air support during a fire. The homes would be built in areas with low combustion potential. He wanted to be sure anyone sent to fight such a fire would be safe. Without homes in this area there would be a different strategy. The owners had done everything they could to make the road meet the road standards, but without the road and homes there was a different need for fire suppression. Susie Davis spoke to the board. She felt that any type of development that was healthy should be considered for the local economy. Reducing unemployment by 5% was an enormous economic impact Commissioner Fisher stated that there had been a request by one of the commissioners to adjourn into executive session with the attorney to consult on the legal reasons for what the appropriate considerations for the board to take into account were and what was inappropriate. Chairman Fisher closed public comments. Mr. Skillman spoke about the surrounding land uses. The staff report indicated that the surrounding land was all Forest Service, and there was a State Land Board parcel that touched at a point, but there was no possibility of gaining access from that connection. Commissioner Stavney stated that the parcel did not attach to another major road in the county. It would be different if the parcel connected to I -70. Chairman Fisher asked about proposed roads within the development itself. Mr. Skillman stated there would be no way to access the property with authorization through the US forest service. Mr. Thompson stated that in the referral letter and comments today were primarily related to road use and future residential development to the property. He did not address future road use and residential effects were because they were not material to the decision today. With respect to spanning bridges, there was no opportunity for such a bridge. There was no topography to accommodate a spanning bridge that would be used by deer and elk. He spoke about Mountain Star road kill and the fact that the similar length and type of road. Over the last 17 years, there had only been one documented elk road kill and approximately 3 -4 deer killed on the road. Chairman Fisher asked that the applicant allow the file to be tabled. Commissioner Stavney stated that there has been a lot of testimony and conversation about topics not relevant to the request at hand. He was not terribly troubled by 19 units on this property. However, this development would have night sky impacts and would affect how people experience the dark hillside throughout the year. Commissioner Runyon moved to table the file to October 19, 2010. Commissioner Stavney seconded the motion. Commissioner Stavney read the letter as a weak level of support by the Fire District and suggested the applicant get a clearer indication of this support or opposition. Planning Files PDS -2313 Eagle River Meadows Scot Hunn, Planning NOTE: Tabled from 01/26/10, 03/30/10, 05/25/10, 06/08/10, 07/06/10 08/24/10 & 08/31/10 ACTION: The purpose for this Sketch Plan is for a mixed use Planned Unit Development, inclusive of residential, commercial, medical, and office uses. Proposal also includes active and passive recreational and open space uses. LOCATION: Former `B &B Gravel Mine" site generally situated along Hwy 6 Edwards, Colorado, NW 1/4, Section 5, Township 5, Range 82. 52 10/05/2010 REFERENCE: Staff Report in 8/24/2010 minutes DISCUSSION: Commissioner Fisher stated that the file had been tabled a number of times and at this hearing, the discussion would focus on the use of the entire property and development area. Mr. Hunn presented a letter to the board from an adjacent Brett Ranch property owner. He also presented a letter from Mr. Potente regarding the housing options. He reviewed prior meeting discussions. Today's hearing would cover options for development, affordable housing and density, concessions, and review of the suggested conditions of approval. The applicant had done some great work responding to the board's request to work through any implications of option B. Overall, the land plan had resulted in something that could meet the master plan conformance better. Option B would remove development from the northern parcel, land would be dedicated to Eagle County Housing and Development Authority and density would transfer to the southern parcels. Non- residential remained at 260,000 sq. ft. The total residential units on the south was 240; a reduction of 140 units overall. Commissioner Stavney asked about the mix in each of the phases on the south side and the idea of flex zoning. Mr. Badger reiterated that giving up the north was to satisfy the housing obligation. The question was whether affordable housing was really needed. The idea of the flex zoning was something that staff suggested. They came up with the phased approach where they could create some viability in the project and in time if there were a demand for housing, they had this mechanism to create the housing. They had to consider a reasonable approach and the design allowed for phasing. Chairman Stavney spoke about the open space option related to the north parcel. Chairman Fisher was in favor of open space option as the cost of development and infrastructure would be significant. Mr. Badger stated that the applicant's preference was option `A' for all the reasons he'd stated before. However, if the county were to acquire the north parcel, it would ultimately be up to the board to determine how it would be used. Chairman Fisher believed it would be a financial undertaking for the county to acquire the parcel. Until the proposal got to preliminary plan, these costs could not be identified. Mr. Badger stated that they had already identified the wetland boundaries and identified a mitigation plan. Grading plans and utilities were the most costly. There would be some moving parts. Mr. Potente stated that if the north side proved to be un- buildable it could be used as open space. There was likely some buildable land outside the floodplain. He understood this could take a while and would be a negotiated arrangement. Once the applicant developed the south there would be some affordable housing built which would offset some of the risk. If the property where to be proven to be unbuildable the property was still a nice open space area. There would still be some residential building stock within the development. It was a reasonable compromise given the risks. The county may not want to build anything soon. Commissioner Stavney believed that if the county chose option B then the exception question would not happen. However, if the board were to choose option A, it would be kicked back to the Planning and Zoning Commission because they would have to grant an exception. Mr. Morris stated than the approval of the development without the exception would be precarious at the preliminary plan level. Commissioner Runyon wondered what the housing requirement would be without the north parcel.. Mr. Potente stated that there would be more affordable housing. He believed that the proposal was not un- generous. Mr. Badger stated that there was an incentive to build affordable housing. If the market was good and there was a demand then the affordable piece would be required. They laid out the design to accommodate the density. However, in the current economy, they wanted to have some flexibility. Mr. Potente stated that it was hard to forecast a development of this size. He believed that if there were a demand for the affordable residential, there would be a demand for the market rate as well. 53 10/05/2010 Mr. Hunn spoke about the future considerations with the parking requirements, single means of access, and increase in building height. Overall, it was nominal. Commissioner Stavney believed that a second means of access was critical but suggested not taking the time to talk about parking and building height at this time. Mr. Badger presented a revised illustration of option B'. He explained the matrix. He was concerned about the residential parking; however there would be no reductions for shared parking. He believed the parking could be easily phased. He met with Chief Moore and he had no concerns for the single access. Commissioner Stavney asked about the variance from the road standards, specifically dual access related to emergency services and if this was the only one. Ben Gerdes, county engineer stated that there would be a variance for on- street access as well. Mr. Badger reviewed the terms of option B'. The applicant believed that giving up the north would satisfy the housing requirement. Eagle County would consent to future possible annexation of the north parcel into a new metro district. They would not put a roadblock up and would allow public trails, fishing, and pedestrian connection to adjoin the properties. Limiting development to just the south would require the applicant to increase density from 140 dwelling units to 240 dwelling units. Commissioner Runyon stated that he favored option `B'. Commissioner Stavney believed that the applicant had more work to do in the community and had to consider the Edwards' Community Plan. He wondered if the Edwards' Community Plan needed to be considered. Mr. Morris stated that it was more than a technical point but he was not prepared to say it was a deal killer. A revision of the Edwards' Community Area Plan that allowed for either plan or an exception to the existing plan would suffice to eliminate any legal uncertainty. Commissioner Stavney stated that he had warmed up to option `A'. He was somewhat disappointed with The Preserve due to the maintenance factor. He believed that this project would potentially add to the wetlands and there were benefits to the river access, and roundabout. He liked the idea of connections on both sides. He liked the linkage factor. He would like to take it to the next level. He did not want to leave development to future boards. Chairman Fisher believed that until the facts were known it was too early in the plan to dissect the proposal. She encouraged the applicant to move forward with option `A'. Mr. Badger wondered if the board and Planning Commission were to approve plan `A' and decided later they liked plan `B', would they need to go back to the Planning Commission. Mr. Morris stated that it was his view that the change from A to B would not require further review by the Planning Commission at the sketch plan level. Commissioner Stavney believed it was worth another go. He asked staff about the conditions. Mr. Hunn stated that condition 6 would need work or could be scratched. Condition 14 would require clearer definition, and condition number 28 would require an operational plan. Chairman Fisher requested another hearing to summarize the steps, and advertise it in a way that would provide an overview to the public. Commissioner Stavney stated that he was not prepared to comment on the conditions at this time. Chairman Fisher suggested that the next meeting be held late in the afternoon orearly in the evening. Commissioner Runyon did not approval of option `A'. He believed that in all the hearings the public clearing indicated that they were not in favor of developing the north parcel. Chairman Fisher expressed her concern with increased development on the south in option Commissioner Runyon encouraged more public meetings. Commissioner Stavney moved to table the file_PDS -2313 Eagle River Meadows PUD to October 19, 2010. Chairman Fisher seconded the motion. The motion passed by a vote of two to one with Commissioner Runyon voting against. Chairman Fisher reopened the meeting for public comment. 54 10/05/2010 Susan Miller mentioned speaking to Mr. Hunn. She believed that the taxpayers that supported the Eagle River Preserve should be taken into consideration. She believed development would change the ambiance of the preserve. She hoped the board would encourage the developer to come up with a plan `C' including low density housing near the preserve, donating the north side of the property for open space and the higher density along Hwy 6. She also encouraged a public parking area so people had access to the reserve. Chairman Fisher closed public comment.
