Mamie's Deck is a small restaurant building with outdoor grills and will be used as a lunch restaurant. It will be open during the winter ski season from early December to Aprill st, 7 days a week, 9 am - 4 pm. The distance between Zach's Cabin and Mamie's Deck is approximately 2,850 feet. Zach's Cabin currently has one optional premise (Arrowhead Alpine Club Yurt). This addition will change the current existing liquor boundary and is permitted by both the State and Local Liquor Code. STAFF FINDINGS: 1. The application is in order, all requirements have been met and all the necessary documents have been received. 2. Maps of the current and proposed Optional Premises are attached. 3. Proper posting was done on the premises on November 25,2009, and publication was made in the Eagle Valley Enterprise on November 26 and December 3,2009. 4. There have been no protests to this application filed in the County Clerk and Recorder's Office. 5. All fees have been paid. DISCUSSION: Ms. Scriver described the request. Tom Dunn and Eric Potorff and Bernie McManus were present for the applicants. Mr. Dunn, attorney for Beaver Creek Food services Inc. was also present on behalf of the applicant. Chairman Fisher stated that historically the establishment did a nice job managing their premises' and she was supportive of more optional premises on the mountain. Chairman Fisher opened and closed public comment, as there was none. Mr. Dunn indicated that the applicant felt there was a need for walk in, walk up place to get something to eat. He added that there was the possibility it would be used in the summer, as was the case with the other optional premIses. This file represented a formal transfer, but it was business as usual. She introduced Rudy Anderson, Patrick Tomberlaine, and Patrick Wilhelm. The alcohol management plan was the same as what was currently on file. Chairman Fisher asked if there was anything the applicants wanted to add. Mr. Anderson spoke about the different restaurants and their times of operation. He added there were many new activities going on as they were trying to make the operation viable year round. The proposed location is located in the Edwards Village Center, the location formally known as Sato Sushi. Cafe 163 will be open for breakfast and lunch, 7 days a week from 6:30 a.m. to 4:30 p.m. Alcoholic beverages will be primarily Bloody Marys, Mimosas, Beer, and assorted wines. Mr. Mueller is the owner of Sato Sushi in Edwards and has many years of experience in restaurant management. ESTABLISH NEIGHBORHOOD: The first order of business is to establish the neighborhood. Staff recommends that the definition ofthe "neighborhood" include the area within a two-mile radius from the proposed location (0105 Edwards Village Blvd.) including but not limited to Arrowhead, Homestead Subdivision, Singletree, Old Edwards Subdivision, and Riverwalk. MOTION: Stavney, Runyon, unanimous. I move that the Local Liquor Licensing Authority establish the neighborhood to include the area within a two-mile radius from the proposed location. LIQUOR AUTHORITY CONSIDERATIONS: 47 12/08/09 1. The board will consider the reasonable requirements of the neighborhood, the desires of the adult inhabitants of the neighborhood and whether the existing licenses are adequate to meet these needs and desires, per the Colorado Liquor Code, Section 12-347-301 (2) (a). 2. Whether the licensee shall possess and maintain possession of the premises for which the license is issued by ownership, lease, rental, or other arrangement for possession of such premises. 3. Whether the premises are within 500 feet of any public or parochial school or the campus of any college, university, or seminary. 4. Whether the fees have been paid. 5. Whether the applicants are of good moral character. STAFF FINDINGS: 1. The applicants have filed an application on forms provided by the state licensing authority and provided information as required by the state licensing authority. All applicable requirements have been met, all the proper forms have been provided, and all fees paid. 2. The applicants are 21 years of age and reported to be of good moral character. 3. Public notice has been given by the posting of a sign in a conspicuous place on the premises November 24, 2009 and publication in the Eagle Valley Enterprise on November 26 and December 3,2009. 4. The premises are not within 500 feet of a location for which, within 2 years preceding the application, a license of the same class was denied for the reason that the reasonable requirements of the neighborhood and the desires of the adult inhabitants were satisfied by existing outlets. 5. The premises are not within 500 feet of any public or parochial school or the campus of any college, university, or seminary. 6. The applicant has submitted proof of possession of premises. 7. Staffhas received no responses from the Eagle County Sheriffs Office, Community Development, Environmental Health Department, Building Official, Eagle County Treasurer, or Director of Road & Bridge. 8. The applicants have provided an alcohol management pIan. STAFF CONCLUSION: The applicant has met all the necessary requirements for a Hotel and Restaurant Liquor License and staff findings are positive. DISCUSSION: Ms. Scriver explained how the petition signatures were collected. Commissioner Stavney asked a few questions about number of signatures required. Chairman Fisher asked the applicants to share the plan for the restaurant. Eric Sandoval explained that they were serving breakfast and lunch along with cocktails, wine, and beer. They intended to serve lunch until 4:30 p.m. 48 12/08/09 Peter Mueller stated that they would eventually stay open for dinner they'd like the opportunity to serve during any hours they desire. Ms. Scriver stated that with a hotel and restaurant license they could serve liquor during the hours they chose. Mr. Sandoval stated that the breakfast menu would be available all day as well as offering things to go. They would try to encourage foot traffic. For lunch, they want to offer kabobs, falafel, salads, and different items. Chairman Fisher stated that both had been involved in various establishments and wondered if they were still working with X-Bar Fly. The applicants indicated that they would continue to be involved with X-Bar Fly Inc. Chairman Fisher opened and closed public comment, as there was none. Commissioner Stavney moved the Board find that there is a reasonable requirement and desire for the issuance of this license, therefore approve a Hotel and Restaurant Liquor License for Downtown Brown, LLC d/b/a Cafe 163 based on the testimony, petitions, and evidence submitted today and incorporating the stat! findings. Such license is to be issued upon the written findings and decision of this Board and upon a final inspection of the premises by the Clerk and Recorder's Office to determine that the applicant has complied with the site information provided today and as may be required by the Colorado Liquor Code. Commissioner Runyon seconded the motion. Chairman Fisher asked for the alcohol management plan. Ms. Scriver stated that she believed that the applicant had provided an alcohol management plan but it may not have been submitted as backup. Chairman Fisher asked for the motion to be modified pending review of the alcohol management pIan. The vote was declared unanimous. Commissioner Runyon moved to adjourn as the Eagle County Liquor Licensing Authority and re-convene as the Board of County Commissioners. Commissioner Stavney seconded the motion. The vote was declared unanimous. Citizen Input Chairman Fisher opened public input. John Bade spoke on behalf of the Golden Eagle and Minturn senior citizens. They were shocked that the chef was terminated. They have tried to find the reason for his termination, but were only told that the effort was to streamline programs. They suspected a personal issue. There had been a continuing problem in communication between Health and Human Services and the seniors. They liked Cheryl Thomas and would help when they could. They didn't feel that the personnel changes being made indicated a solid commitment. They asked that Rick Kangas be rehired. Chairman Fisher stated that the decision made about the cook at the senior center was a personnel discussion and should not be played out in a public venue, as that approach was inappropriate. The decision had been made and would not be changed. Suzanne Vitale was challenged with significant reorganization direction. All programs must be sustainable in the future. All departments had been asked to cut back to the basics. The senior programs were seeing a lesser impact than many other programs. The Golden Eagle Center was a wonderful meeting place, but the difference was that the facility was in Eagle in the middle of the assisted living facility and was owned by the apartments. On the other side from the county perspective was the issue of involvement in programs outside of county responsibility. None of the board was trying to mistreat the seniors. Reorganization was never easy or simple. She appreciated the letter but wished a phone call had preceded the presentation of the information in the letter. Commissioner Stavney stated that personnel streamlining had happened, but the decision to terminate the cook was a personnel decision that would have been made in any year. John Bade indicated that the senior's experience had been outstanding. They see no obvious reason for replacing him. 49 12/08/09 Chairman Fisher stated that she also was not aware of the details of the situation. The department director and the county manager made the decision based on the performance of the individual. This decision was between other players and was final. Commissioner Stavney stated that the seniors needed to know what was going on, staff at the senior center wasn't communicating effectively. He hoped that the seniors would gain trust with the county. Cuts to the senior programs were primarily efficiency cuts. He believed the board had been very careful not to cut the taxpayer supported senior programs. Mr. Bade spoke about the resolution of the use of the building. Their issue was with the chef and his replacement. Commissioner Runyon stated that the seniors were asking the board to change a basic policy of allowing directors and the county manager to make reasonable personnel decisions. The board did not believe they should be involved other than setting policy. He asked them to understand what they were asking the board to do. He also had faith in the staff to make these types of decisions. Mr. Bade agreed with the board's position on the issue and thanked the board for listening to their feedback. Chairman Fisher spoke about the newsletter and assured the seniors that it would not be eliminated. Madeleine Moos spoke about the Eagle River Station and the upcoming vote in January. She was concerned about the county services. Commissioner Stavney spoke about sales tax versus property tax and clarified that the county would get the sale tax revenues. Ms. Moos stated that she was concerned that it wouldn't cover the services that would be needed in the future. She foresaw closures and thought that the county would have supported existing businesses. Commissioner Runyon stated that there was a constant fight going on about this issue, but the board's hands were tied. He spoke about the Town of Avon and the declaration of blighted areas. The original legislation passed to address rundown parts of the cities, but the courts had taken the legislation and included other areas. Most of the districts bent over backwards to try to identify real future expenses that would be shared, but the reality was that there were many other expenses over these amounts. Town governments fought legislative change. Commissioner Stavney stated that the Eagle River Station was one of 80 special districts over which the board had no authority. Chairman Fisher clarified the voting rights for municipalities vs. county residents. The board was asked for their opinion on the issue. The two county employees who were also Town of Eagle trustees voted against sending the question to the voters. Chairman Fisher closed citizen input. Public Hearing - 2009 Budget John Lewis, Finance, and Various Department Directors Mr. Lewis gave a PowerPoint presentation of the budget draft. He stated it had been a long and arduous process. He thanked his staff for their hard work and thanked the departments for their efforts. He spoke about the process, goals, objectives, and results. Chairman Fisher clarified that this was a presentation. Mr. Lewis stated that the presentation would be on the county website for public review. After the initial direction was given for reasonable cuts, it was realized that these cuts were not sufficient to cover future reductions in revenues. He spoke about government expenditures and the fact that they included the purchase of assets. The debt on the justice center was revenue in 2008, but the expenditure occurred in 2009. He showed revenue vs. expenditure history back to 2005. During all of those years before 2009 revenues exceeded expenses, but in 2009 the situation was reversed. This had influenced the reserve fund. He spoke about the forecast assumptions for revenue. Commissioner Runyon asked for clarification about the assumptions. The reductions were based on the 2009 actual revenues in each category. Chairman Fisher asked about the property tax increase for 2010 and wondered if it would be based on the 2008 assessment. Mr. Lewis stated that the new valuation would not be completed until June of2010. The new valuations would take effect for 2010. It was anticipated that the future reduction in values would hit the budget in 2012. 50 12/08/09 Commissioner Runyon asked about the 11 % increase in property taxes and how much would be due to new construction. Mr. Lewis stated a very small amount. In the future new construction would be likely less than 1 %. He added his assumptions about expenditures for the years 2011 through 2013. He showed a chart with revenues vs. expenditures for 2009 through 2013. By 2013, there would be a 10 million dollar difference to the negative if expenses were not cut further. He showed the result on the fund balance if no further cuts were made. It was below the minimum compliance level of the Taxpayer's Bill of Rights. Overall, the fund balance was fairly stable since 2005. After the first round of budget creation, the situation would not have improved but would have deteriorated. He acknowledged the controversy about additional property tax collections. At the start of the year, there were 18 million dollars in reserve and during the year some assets were purchased, ECO was supported financially, general fund revenues decreased by several million, motor pool replacement funds and the cost of early retirement options decreased this reserve by around 7 million. He spoke about the steps taken to improve the five-year situation. More departmental cooperation, reorganization of departments, line item review, and early retirement were implemented. Due to the early retirement option, some strong long-term employees left the county. The reason these cuts weren't made earlier was that there would be some impact on services. He added detail about specific programs that were cut. Commissioner Stavney clarified that Road and Bridge cutbacks would not affect levels of service for road maintenance. What would be cut were some overlays, pavement, and new gravel on some roads for which the county had been ahead ofthe curve. Mr. Lewis continued highlighting additional solutions. The result of these changes had improved the situation, but there was still a problem in 2012 and 2013. Commissioner Stavney asked Mr. Lewis to speak about the reserve fund. Mr. Lewis stated that there were some important expenditures in 2009 that impacted the reserve. He wasn't sure if the reserve was high enough. Commissioner Runyon asked Mr. Lewis to clarify the difference between 2009 revenues vs. expenditures and the fact that much of this gap was due to asset purchases. Mr. Lewis stated again that there was a difference between government and private accounting in terms of the way assets were accounted. Commissioner Stavney indicated that keeping property tax mill levy rates stable would allow the minimum impact on county services in future years when property values decline. County departments were trying to provide reasonable services for a rapidly growing county. Chairman Fisher stated that at some point during the budget process the board did consider returning some of the excess property tax in 2011 and 2012, but after realizing that 70% of the refunds would go out of the county this approach was difficult to justify. Doing so would have jeopardized county revenues and services in the future. She believed the board's job was to be good stewards of the money they've been entrusted to spend. Mr. Lewis stated that with rebates, the average would be $39.00 per taxpayer and the administration ofthis refund would be quite complicated. Commissioner Stavney stated that many ideas were considered, but at the end of the day, many of the ideas were not legal. There were only two things that can be done; refunds or mill levy reductions. Commissioner Runyon stated that the board tried to get other taxing entities involved. Currently, taxpayers could put their homes in a deed restricted program and that was the level at which taxes would be assessed. However, this impacts potential future sales prices. The other program was a lien against property to pay for property taxes and this program was provided by the state through the treasurer's office. Mr. Lewis spoke about the current situation with the general fund. He spoke about mill levy concerns. He shared that the mill levy the county collected was the same as the mill levy for the Colorado Mountain College. He shared adjacent county comparisons. Without second homeowners, the amount per resident would be less. Eagle County residents were getting a great value. He spoke about all funds, which included the general fund, AiIport fund, Road and Bridge, ECO bus, Open Space, Landfill etc. Commissioner Stavney stated that close to 90% ofHHS funding was linked to grants. He showed graphs for the next five years. He shared aspects of each fund's performance. Chairman Fisher stated that motor pool was not just fleet vehicles, but also included heavy equipment for road maintenance and equipment used at the landfill. Mr. Lewis stated that replacing vehicles completely would cost 15 million. Commissioner Stavney acknowledged all the work that went into this year's budget. He also thanked many other departments across the board. 51 12/08/09 Mr. Lewis continued that economic revenues should be broadened and diversified, but also other ways to improve the revenue situation. Chairman Fisher thanked everyone for their efforts on this process. She didn't imagine the financial challenges when she ran for office. Commissioner Stavney stated that one major goal was to not be in a continuous state of upheaval. As the board goes through 2010, the assumptions for creating the budget would need to be reviewed. Commissioner Runyon thanked the finance director and Tom Hyatt and everyone involved in the process. He believed this was unprecedented in the county's history. Eagle County government is a great organization. He was convinced that people complain about the size of any organization. He believed Eagle County government is not bureaucratic but a good organization who responds well to the residents. Chairman Fisher opened public comment. Carlene Heckendorf spoke to the board. She spoke about cutting expenses for the county and the fact that cuttingjobs seemed to be the primary means of doing so. This approach meant that homes would be left vacant and people would need to leave the county. She suggested a head tax or occupational privilege tax paid by all workers in the county on a monthly basis. People generally agree that this could be very good. Per the 2008 statistics, the labor force was approximately 31,000 and Eagle County employees were 498. The additional gross revenue to the county would have been more than 3 million dollars. This would have eliminated the shortfall. She hoped that this would be seriously considered. Chairman Fisher stated that there had been discussions about increasing revenues. This type of tax could not be instituted without a vote of the people. She and Commissioner Runyon went to Colorado Counties, Inc. to change legislation and allow counties to collect business license fees. With this possibility, there were more options on the table. Ms. Heckendorf stated that she believed this approach would be received well. She discouraged selling water rights. Commissioner Stavney stated that it was the consensus of the board to not ask for any type of tax increase in this economic environment. He believed the next possible request for tax increase would be related to the ECO transit funding. Ms. Heckendorf stated that $5.75 a month to maintain county services and jobs was not too much. Commissioner Stavney spoke about the capital projects that won't be done in the foreseeable future because the CIP funds would be used to pay for debt service and provide relief to some departments. Chairman Fisher thanked everyone again with special thanks to the department directors. This wake up call had prompted many discussions about how best to go forward. The decisions that would make Eagle County strong were those made in conjunction with others up and down the valley. Mr. Montag added the thanks to the finance department for their hard work and presentation, and the department directors in their leadership to help get to a balanced budget. This was an ongoing process that would continue throughout each year. Chairman Fisher closed public comment and the hearing. Eagle County Housing & Development Authority Alex Potente, Housing & Development Agreement between Riverview Apartments Preservation LP and Dougherty Mortgage LLC Mr. Potente explained the request. He stated that this was a HUD certified lender. The Riverview transaction was about a 14 million dollar transaction, of which 6 million was in acquisition. There was approximately 6 million dollars in existing debt on the property at 6.25 interest rate plus some HUD fees. This is a FHA insured mortgage. This contract was with the lender and it specifies the amount of fees the lender was entitled to, interest rate, and timing of the closing ofthe loan with HUD, which would likely happen in late April. There 52 12/08/09 was a lot of work associated with this type of application. They would prepare a comparative analysis between this loan and a conventionalloan. There is no commitment to go through the HUD process if the conventional market were to change. Commissioner Stavney clarified that Mr. Potente was asking for permission to retain a HUD underwriter for Riverview. He wondered how Dougherty Mortgage was chosen. Mr. Potente stated that Dougherty was more than just a broker in the sense that they do the underwriting. He stated that they talked to a couple of different certified lenders and compared fees and also spoke to an outside consultant. There was a competitive process. PLANNING COMMISSION DELffiERATION SUMMARY & MOTION: The Eagle County Planning Commission met on October 7th, 2009 to hear the application for the Stump Family Conservation Subdivision. A site visit was planned and attended on the same day to give the planning commission an opportunity to view the parcel and plans for the subdivision. At the hearing the planning commission voted to table all three files in order to allow time for the applicant to make changes to the subdivision layout to better reflect the ECLUR definition of proper clustering as well as improving the contiguousness of the Agricultural conservation tract. Additionally the commission asked for more commitment from the applicant with regard to agricultural used on the parcel. The applicant was asked to give more specific use types and sizes for agricultural structures as well as commitments to the number and type of animals housed on the property. At the same time staff was asked to apply the Sustainable Community Index (SCI) to the Stump Family Conservation Subdivision. The applicant appeared again in front of the ECPC on November 4th, 2009 with the requested changes to the application. At the meeting the applicant was asked to add language to the Property Management Plan to strengthen "add teeth" to the pIan which would "require" the HOA to enforce the subdivision covenants. The Eagle County Planning Commission voted unanimously to approve all three files adding one additional condition to be placed on the files. The proposed condition required the applicant to incorporate strategies outlined in the response from Adam Palmer regarding SCI points. The condition requires a minimum of 40 points on the index. The current SCI score is 32 (Please refer to condition 3). 2. STAFF REPORT Zone Change: The purpose of this Section is to provide a means for changing the boundaries of the Official Zone District Map or any other map incorporated in these Regulations by reference, and for changing the text of these Land Use Regulations. Over 50% of the Stump parcel is directly bordered by RP zoning consisting of Bureau of Land Management lands. Resource Preservation (RP) zoning is intended to severely restrict development with the intent of preserving natural rural lands. The proposed Conservation subdivision would allow a density of one dwelling unit per 18.6 acres. Effective clustering of the building envelopes improves the appearance of density compatibility by giving the impression of lower density development and concentrating visual impacts in areas outside the view corridor. A true Conservation tract would be as contiguous as possible and lend to the impression of a lower density development. The Western and Northern surrounding parcels are residential and zoned Resource (R). Many of these are properties are non-conforming in that they are less than the minimum 35 acres in size. Dimensional limitations of the proposed zone district, when applied, should result in development that will be harmonious with the physical character of existing neighborhood(s} surrounding the subject property. As discussed in the section on page 5 of this staff report, some compatibility issues exists the land surrounding the proposed Conservation Subdivision. More than 50% of the property is bordered by BLM land designated as Resource Preservation (RP). This land designation is intended to preserve land area and severely limit development density. The proposed subdivision seeks to increase density beyond its currently allowed levels and create an abrupt transition from this low density BLM land and the subdivision. The remaining half of the property is adjacent to parcels of non conforming size and density. Many of these adjacent properties are smaller than required by the overlying zone district standards and therefore have greater density per acre than would be normally found within this Resource zone district. These properties are more compatible with the proposed density. Standard: Public Benefit. The Stump Family Conservation Subdivision seeks to dedicate a 49 acre tract ofland to be kept in an Agricultural Tract. The tract will be kept as open space in perpetuity. This open space attempts to preserve an area of agricultural land. Standard: Change of Circumstances. Does the proposal address or respond to a beneficial material change that has occurred to the immediate neighborhood or to the greater Eagle County community? Staff is not aware of any measureable change in the circumstances within the area of the proposed Conservation Subdivision. Standard: Adequate Infrastructure. Is the property subject to the proposal served by adequate roads, water, sewer and other public use facilities? The basic infrastructure needed to access this property currently exists. At which time ADU's are built on the property the applicant will be required to upgrade access to meet the Eagle Count Roadway Standards. Special Use Permit: A. NECESSARY FINDINGS: PROCESS INTENT ECLUR Section: 5-250 Special Use Permits Section Purpose: Special Uses are those uses that are not necessarily compatible with the other uses allowed in a zone district, but which may be determined compatible with the other uses allowed in the zone district based upon individual review of their location, design, configuration, density and intensity of use, and the imposition of appropriate conditions to ensure the compatibility of the use at a particular location with surrounding land uses. The issuance of a Special Use Permit shall be dependent upon findings that there is competent evidence that the proposed use as conditioned, fully complies with all the standards of this Section, this Division, this Article, and these Land Use Regulations. SUMMARY ANALYSIS: The Stump Family Conservation Subdivision is the first Conservation Subdivision proposed within Eagle County. As the first Conservation Subdivision in Eagle County the proposal will help to set a precedent for future Conservation Subdivision proposals. The primary component of the Stump Family request is a zone change to the exiting 56 acre parcel ofland created in 1982 by the subdivision of the "Shipley Parcel". The proposed zone change would Re- zone the property from Resource(R) to Resource Limited (RL). A rezone is needed for the applicant to meet the minimum acreage for the Conservation Subdivision. Without a successful Zone Change the proposal cannot move forward. Without a successful Zone Change approval the parcel would not meet minimum size requirements and thus not be allowed based on current Eagle County Land Use Regulations. The applicants do not possess enough acreage to meet the minimum for the Resource (R) zone district. Within the Resource zone district a minimum of70 acres is required to be eligible for a Conservation Subdivision while within the Resource Limited zone only 45 acres are required for Conservation Subdivision eligibility. A successful rezone to Resource Limited (RL) would allow the Stump Family to proceed. In addition to the Zone Change a Minor Type A Subdivision and a Special Use Permit are being applied for as part of this Conservation Subdivision application. These files are required within the Conservation Subdivision section of the Eagle County Land Use Regulations. Benefits: . The RO restrictions placed on the property help insure that the home within the subdivision would remain affordable for residents of Eagle County. 67 12/08/09 · The proposed subdivision places a 49-acre tract of land in a Conservation Tract that will remain in petpetuity. · The Conservation Subdivision proposal will help to preserve the historical agricultural use on the property. Disadvantaees: . An up-zone is required for the Applicant to qualify for the minimum acreage requirements for the parcel's zoning. In its current form, the locations of home sites and agricultural envelopes do not demonstrate the cluster development concept effectively. In its current form, the proposed Conservation Tract does not help to preserve the visual quality of the property to its fullest extent. Approve the Conservation Subdivision request with conditions and/or performance standards if it is determined that certain conditions and/or performance standards are necessary to ensure public, health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). SUGGESTED CONDITIONS: 1. All recommendations contained within the HP Geotech report dated September 30th 2008 shall be adhered to during the development of the subdivision. 2. Except as otherwise modified by this development permit, all-material representations made by the Applicant in this application and in public meeting shall be adhered to and considered conditions of approval. 3. Applicant must acquire a minimum of 40 points on the Eagle County Sustainable Community Index. 4. The Stump Family Subdivision is contingent upon the finalization of all associated documents, including but not limited to, the Agricultural Conservation Easement, and/or other agreements being prepared in conjunction with the Eagle County Attorney, and otherwise approved by County staff. The 68 12/08/09 Final Plat shall not be signed by the BoCC and recorded until all pertinent documents are recorded with the Eagle County Clerk and Recorder. DISCUSSION: Mr. Hanagan discussed the file and indicated that there were recent negotiations to achieve a higher sustainable index score. He indicated that agreement had been accomplished to bring the score from 32 to 40. He spoke about the addition of condition number four. Commissioner Stavney spoke about condition number four. He recognized that this is the board's first conservation easement. Mr. Morris stated that the process was not quite complete, but agreement in principal had been reached. The developer would grant to the homeowner's association an agricultural conservation easement to be monitored and enforced by the homeowner's association, with the condition that annual inspections and reports would be submitted to the county to insure conditions of the easement were being adhered to. ill the event that any correction action was necessary, the county would have the right to bring a court case to enforce them and recover attorney's fees. This would probably take until February to accomplish. Commissioner Stavney asked if this was normally done by a Land Trust. The fact that this was not the case in this situation was due to the up front costs to the family to enforce these provisions. Mr. Morris stated that the land trust would not likely be interested in taking on this type of easement. Jena Skinner Markowitz stated that she was pleased with the process and the owners hoped to keep it very positive.
