Executive Session
It was moved, seconded and unanimously agreed to go into Executive Session for the purpose of receiving

Red Cross Lease, and the River Run Apartments, all of which are appropriate topics for discussion pursuant to

Special Recognition - Bob Fiske
Natalie Duck, Animal Services
Ms. Duck recognized Bob Fiske as a special Eagle county citizen. A ft(w weeks ago Bob was walking his
dog in Big Hor,n Park and heard a woman calling for help for her dog. The woman's dog was floating lifeless
offshore in the creek. Mr. Fiske was able to resuscitate the dog and the animal made a complete recovery.
Mr. Fiske spoke about the incident.

National Association of Counties Achievement Awards
Chairman Pro-Tern Fisher spoke about these awards. She spoke about the three awards that were received
by the various departments.
Shaping the Future - Community Development
Adam Palmer of Community Development spoke to the board about the program. He stated that it is a
unique program in the state if not the country which mixes elected officials and citizens who. come together to
discuss and evaluate local issues. The program started in 2001 and has grown and developed ovef the years.
Commissioner Runyon stated that he took the second series of classes that were offered prior to taking
office. Anyone interested in affecting or understanding change in Eagle County is encouraged to take this series of
classes. He stated that in addition to Eagle County, in Colorado only Boulder and Adams County had received any
NACO awards.
Chainnan Pro-Tern Fisher stated that she also attended the classes and thought they were dynamic.
Mr. Palmer stated thatthe classes typically span several months beginning in the fall of each year. He gets
a lot out of the sessions. The syllabus for the fall will be available on the Eagle County website soon.
Chairman Pro-Tern Fisher recognized Commissioner Menconi for creating this program initially.
Eco-Build Efficient Building Program - Community Development
Keith Montag spoke about this program and thanked Adam for his leadership with the Eco-Build program.
This program was the brainchild of Adam. He created a unique program in the state. Building permits and
structures will hopefully be built more environmentally friendly and green. The county is also looking at adding
the commercial aspect to the program. Others in Community Development also help make this program work.
Mr. Palmer stated that they looked at other codes and tried to make something simple and usable for the
building community to use for the benefit of the county. Builders in Steamboat Springs have also adopted this code
for their future developments.
Commissioner Runyon asked Mr. Palmer about the number of points his home had achieved.
Mr. Palmer stated that they had exceeded the points by three fold.
Commissioner Runyon commended Mr. Palmer.

DISCUSSION:
Ms. Scriver distributed a revised management plan. She explained that the current plan has more
infonnation about the sponsor and their involvement with the event. There were concerns about the name used on
the marketing materials, but everything else is in .order.
Carlos Carvalho, Briga Productions, event manager has been a resident for several years. They have held
these events previously in Vail at the Dobson Arena. Many of the athletes are locals.
Chainnan Pro-Tern Fisher asked how many participants there would be.
Mr. Carvalho stated that there are 23 athletes and 6 are from this valley. They expect around 1500 people.
Their summer shows area little smaller than the winter shows. They will be providing wine, beer and alcohol.
Security will be handled by 5 people who are qualified to do so. In addition, he will be providing 12 people to
assist with security. .
Chairman Pro-Tern Fisher asked who would provide security and liquor service.
Mr. Carvalho stated that the servers were all tips trained.
Commissioner Runyon asked how long the event takes.
Mr. Carvalho stated that it takes around two and a half hours. The time depends on how long each round
takes.
Commissioner Runyon wondered. about similar ~vents.
Mr. Carvalho indicated that they have had three events in Eagle County.
Commissioner Runyon wondered about the prize money.
Mr. Carvalho indicated that more details about the licensing are available on their website.
Commissioner Runyon spoke about the layout. He noticed that there are three bars and a beer truck. He
wondered if this was too much emphasis on the alcohol component. He is concerned about going overboard.
Mr. Carvalho stated that there are two bars for 800 people and the beer truck will be the only place to get
beer. The number of bars accommodates the number of potential. attendees. They areconcemed about the alcohol.
They have received outstanding reports for their prior events from law enforcement.
Chairman Pro-Tern Fisher asked about the tables for the VIP area.
Mr Carvalho indicated that the tables seat 8 people and will be serving dinner as well for the sponsors.
They will also sell food to the public at the event.

Ms. Scriver indicated that she did not have concerns with the event.

the applicant provide evidence that these discussions have occurred and solutions detennined.

Commissioner Runyon stated that there would be people who would be upset if Eagle County were a
sponsor of this type of event. He didn't believe Eagle County would not want to appear to be sponsoring the event.

The applicant desires to construct, operate, and maintain a Low PowerTelecommunications Facility within the
boundaries of the Eagle County Landfill Special Use Pennit, on BLM lands. The facility, primarily for public
safety radio communications, is proposed to consist of a 40' tall communications tower on which two (2)
microwave dishes will be placed. Aconcrete pad will sit at the base of the tower for Eagle County (and a potential

safety radio communications on Interstate 70 in the Red Canyon area and on Highway 131 between Wolcott and

D. PLANNING COMMISSION DELmERATION SUMMARY & MOTION:
The Eagle County Planning Commission carefully considered this application on June 20th, 2007. The main
topic of discussion during the hearing pertained to the standard of utilizing stealth cellular technology
(camouflaging the installation using artificial trees in lieu of poles, etc.) as a standard for all installations,
including Eagle County telecommunication facilities.
Discussion:
The Planning Commission had no objection to the nature of the proposed Special Use Pennit for a new, co-
locatable telecommunications facility located at the Eagle County landfill; however, the majority of the
Commission was concerned about the design of the facility and the potential visual impacts that may occur
in its proposed fonn(lattice tower, 40' in height). Recent private, wireless communication providers
telecommunication facilities that have been approved by the Board of County Commissioners along the 1-
70 corridor have utilized stealth technologies, and were disguised as artificial trees. The majority of the
Commission would like all new telecommunication facilities to utilize stealth technologies as a standard
rule of thumb, including Eagle County facilities.
At least one Planning Commissioner, however, disagreed and did not necessarily support the idea of
conditioning all new telecommunication facilities to utilize stealth technologies. This Commissiofimember
recommended that the facility utilize whatever design that minimizes any potential visual impacts most
effectively, on a case by case basis (the Commissioner had experience working for telecommunications
companies in the past and in some instances, the proposed lattice tower design type had less of a visual
impact as the mass of the structure was less dense than a monotree would be).
As a result of the Planning Commission deliberations, a new condition was created. The new condition is as
follows:

Ultimately, the Planning Commission approved the application with one (1) additional condition.

equipment will be used by a second co-locator (mostlikely for cellular communications), a condition has
been created requiring an administrative review of any further installation on the site.to ensure that any
impacts are successfully mitigated. .
The tower, per this application will need to be painted the best color which will minimize the visual
impacts of the structure. Given that the location of the tower is not adjacent to 1-70 or Hwy 131~ Staff is not
requesting a stealth installation for this specific location; however, the Eagle County Planning Commission
has reservations of not utilizing neWer stealth technologies, such as disguising the tower as a artificial tree.
As such, new conditions (8 and 9) have been added to the Staffreport to ensure that this site mitigates the
facility to the greatest extent possible. At a minimum, by painting the equipment and tower, visibility of the
facility by travelers should be. insignificant.
This facility does not propose to emit any significant odors, noise, glare or vibrations.

C. SUMMARY ANALYSIS:
Benefits/Disadvantages.
Benefits:
This facility will greatly enhance public safety radio communications in an area that has
poor coverage by both emergency service providers and private, wireless
telecommunication providers.
Allowing a co-location at this site discourages the proliferation of additional
telecommunications facilities along the I-70/Hwy 131 corri~ors.
Disadvantages: There may be minor visual impacts from travelers (at a significant distance); however,
there are no residences in close proximity that wUI be affected by this proposal and this
facility is located in an appropriate location, next to the landfill.
D. PLANNING COMMISSION / BOARD OF COUNTY COMMISSIONERS OPTIONS:
1. Approve the [SPECIAL USE PERMIT] request without conditions if it is detennined that the
petition will not adversely affect the public health, safety, and welfare and the proposed use is attuned
with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in
compliance with both the Eagle. County Land Use Regulations and with the guidelines of the Eagle
County Comprehensive Plan (and/or other applicable master plans).
2. Deny the [SPECIAL USE PERMIT] request if it is determined that the petition will adversely affect
the public health, safety, and welfare and/or the proposed use is not attuned with the immediately
adjacent and nearby neighborhood properties and uses and the proposal is not in compliance with both
the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive

evaluate the petition. Give specific direction to the petitioner and staff.

health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent
and nearby neighborhood properties and uses and the proposal is. in compliance with both the Eagle
County Land Use Regulations and with the guidelines of the Eagle County Comprehensive .Plan

DISCUSSION:
lena Skinner Markowitz presented a PowerPoint slide show with details of the request. This site will f'Ill
gaps in public service radio communications in the Red Canyon area between Wolcott and Eagle and also on the
route to State Bridge on Highway 131. The majority of the fmdings are positive. The Planning commission was
concerned with cellular technology. They recommended conditions which are included below.
Chairman Pro-Tern Fisher asked about the cost to the county.
Barry Smith, Emergency Manager spoke and stated that all of the costs were already paid for other than any
additonal requinnents.
Chainnan Pro-Tern Fisher asked if there would be an opportunity for looking at alternative energy sources
to support this tower.
Mr. Smith stated that due to the nature of the 8oo-mega hertz this isn't advisable. The Bureau of Land
Management has asked Eagle County toremove the solar panels from another site due to the high amount of glare.
Commissioner Runyon wondered if the tower would break the skyline.
Ms. Skinner-Markowitz stated that they are trying to create the look of a tree. She indicated that there is
the potential of the skyline being broken by the tower.
Mr. Smith stated 'that the contractor has recommended acid washing the tower, which would eventually
fade to a blue green color.
Commissioner Runyon asked about the land being owned by BLM and whether this use is consistent with
the special use pennit currently in place.
Ms. Skinner-Markowitz indicated that this use would be consistent per the County Attorney's position.
Commissioner Runyon asked the county attorney to double check the applicability.
Mr. Smith stated that the BLM is aware of the plans for the site. He indicated that there had been
discussions with Cingular Wireless.
Chairman Pro-Tern Fisher asked if it would be feasible to include more than one cellular service provider.
Ms. Skinner Markowitz stated that each pfovider needs .10 feet and future service providers could ask for a
higher tower. She explained how the equipment that would be installed would be from existing inventory and
within a month, a visual inspection would be done. ~
Commissioner Runyon moved to approve File No. ZS-00155 Eagle County Emergency Services
Telecommunications Facility, incorporating staff findings and including the following conditions I through 9.
I. Except as otherwise modified by this Permit, all material representations made by the Applicant in this
application and in public meeting shall be adhered to and considered conditions of approval.
2. Comments from the Engineering Department in the memo dated June 12, 2007 must be adhered to and
incorporated as part of any required grading and/or building pennits.
3. The applicant must provide the Community Development Deparbnent with any updated or new
agreements, including but not limited to lease agreements, patents and/or easements from the property
owner (BLM).

4. This facilityllease area/equipment shelter must be designed to support a co-location from a second
carrier; the building should be designed to able to accommodate an additional provider, or the lease
area should be large enough to accommodate an additional (second) shelter.
5. If a co-locator wishes to install equipment on the tower, the co-locator must notify the Community
Development Director prior to the initial installation, and any subsequent alterations or modifications
of their equipment in the Telecommunications Facility thereafter. Notification shall include both a
written description and detailed plans showing equipment on the outside of the tower, as well as any
modifications to the equipment shelter. Any increase in the height of the tower, or expansion of the
equipment shelter beyond the existing lease area, will necessitate a new Special UsePennit.
6. Any additional landscaping or materials used for erosion control purposes shall be maintained
consistently for at least two years and periodically after that to ensure proper health and longevity. Any
dead materials shall be removed and/or replaced immediately upon discovery.
7. This tower shall not be. illuminated unless required by the FAA. Further, exterior lighting on shelters is
limited to flush mounted, down-cast, motion sensor lighting.
8. This facility should be camouflaged to the best extent possible, using non-reflective materials.
9. A visual assessment shall be completed within one month of the facility installation to establish ifany
further mitigation is necessary for the site.
Chairman Pro-Tern Fisher seconded the motion. Of the two voting commissioners, the vote was declared
