Commissioner Fisher moved that the Board approve the Liquor Consent Agenda for April 3, 2007,
consisting ofItems A-B, omitting Item B to be considered separately.

Commissioner Fisher stated that at a work session it was brought to the Board's attention that on April 1st at
12:01 a.m. the Rumpus Room was to begin serving their ftrst day of suspension. At 12: 15 a.m. the Sheriff's Office
conducted a bar check and noticed that they had not stopped serving alcohol or posted their suspension signs.
Bryan Treu stated that the Sheriff's Office remained there for an hour and they had stopped serving alcohol
when the Sheriff told them they were under suspension. He suggested the Board approve Item B, in order to ratify
the previous suspension and if the Board desired to bring the license holder back to discuss serving additional days
they could issue another 'Notice to Show Cause'.
Commissioner Fisher stated that because the season is coming to an end she would like to expedite the
'Notice to Show Cause' and get them in sooner rather than later.
Commissioner Fisher moved to approve Item B on the consent agenda and include a 'Notice of Show
Cause' to be approved by the Chairman of the Liquor Licensing Authority.
Commissioner Runyon seconded the motion. The vote was declared unanimous.
Commissioner Runyon moved to adjourn as the Eagle County Liquor Licensing Authority and re-convene

Resolution 2007-031 adopting a First Supplementary Budget and Appropriation of
Anticipated Revenues for Fiscal Year 2007 and authorizing the transfer of budgeted
and appropriated monies between various spending agencies

Chairman Menconi asked the Board if there were any questions or comments with regards to the budget
proposal.
Commissioner Fisher stated the budget proposal had been thoroughly scrutinized and that it does reflect
careful consideration of the items not included in the 2007 budget. She requested a recap regarding the carry
forwards in the 2006 budget.
John Lewis, Finance Department, stated the total amount of additional revenue was 1,968,590.55 for all
funds and 5,175.00 for the general fund. Previously funded purchases were 4,899,981.00 in all funds and
309,586.00 in the general fund. The unallocated fund balance used for the additional appropriations is
1,685,803.47 in all funds and 841,889.00 in the general fund.
Commissioner Runyon thanked Mr. Lewis for his patience and work on the budget.
Chairman Menconi stated that at the recommendation of the County Manager the county had held off on
the new full time employees for consideration. He understands that some items are carry forwards and some are
new dollars. The one time items over $5,000-$10,000 dollars would come from the working fund created by excess
general fund dollars over the last several years.
Commissioner Runyon stated that he was comfortable with that and had no problem with those separations
because keeping track of the capital expenses and identifying them is important.
Commissioner Fisher stated that also included in the supplemental budget are the additional funds that are
being applied to the community service grants.
Chairman Menconi asked about the general fund summary items 120,248,249 and 250. He wondered
which dollar amount Mr. Lewis would be looking at in order to segregate one-time expenses.
Mr. Lewis stated that it would not change what was previously funded. It would not change the changes to
unallocated fund balance other than the fact that less would be taken out of the general fund and more would be
taken out of the column "all funds". The money would be taken out of the working fund instead of the general
fund. The procedure would be to go through the general fund items in the supplemental and determine which
would be one-time expenditures.
Commissioner Runyon moved to approve Resolution 2007-031 adopting a First Supplementary Budget and
Appropriation of Anticipated Revenues for Fiscal Year 2007 and authorizing the transfer of budgeted and
appropriated monies between various spending agencies

C. STAFF FINDINGS: Pursuant to Section 5-290.G.2 of the Eagle County Land Use Regulations the
Community Development Director has determined the following in the review of this Type B Minor
Subdivision:
a. Access, Water and Sewage. The access, potable water, and sewage disposal on the land to be
subdivided IS adequate;
b. Conformance with Final Plat Requirements. The subdivision IS in conformance with the Final
Plat requirements and other applicable regulations, policies, standards, and guidelines; and
c. Improvements Agreements. A Subdivision Improvements Agreement is NOT applicable to this
application.
DISCUSSION:
Mr. Forinash presented a PowerPoint presentation. The presentation included a vicinity map and the
applicant's request to approve a final plat which would subdivide tract A of the Berry Creek Miller Ranch PUD to
create Loti, on which the existing CMC facility is located, and Lot 2, which is currently vacant, to allow Lot 1 to
be conveyed to Colorado Mountain College. The site is southwest of the high school site and northwest of the
recreational tract. Tract A is owned by Partnership for Education, which is comprised of School District and Eagle
County. The college has leased the site from the Partnership. He indicated that staff recommended approval.
Steven Beattie spoke on behalf of Colorado Mountain College. He stated that Mr. Forinash's presentation
had been thorough and compressive and he had nothing more to add. He was present with other representatives
from the college for additional questions.
Bryan Treu, County Attorney added that the Partnership for Education had reviewed and approved the
application and had signed off on the plat and authorized the Chairman to execute the warranty deed to transfer the
property.
Chairman Menconi opened and closed public comment, as there was none
Commissioner Fisher asked about the future use of Lot 2.
Mr. Beattie stated that the entire parcel is owned by the partnership until after the hearing and the lot is
conveyed to the college. There are a number of visions for Lot 2. The entire parcel is leased to the college on a 50-
year ground lease to utilize the entire tract for post secondary and community education purposes. The college is
working with the partnership to develop plans for continued uses. Those plans have not been established but are
constantly under discussion.
Chairman Menconi stated that he would like to see more proactive opportunity between the Board of
County Commissioners, the School District and CMC Board as to what they could be bringing as an educational
amenity to the community.
Doris Dewton, Chairman of the Board and Trustee for CMC spoke. She stated that they currently have
three substantial building projects going on. Colorado College Mountain District is 12,000 square miles and
includes six counties. They try to meet the needs in all the areas. Currently they are completing a new library
addition on the Leadville campus and have begun construction of new buildings in West Garfield County and in
Summit County. Because they basically build with the capital they have, they have an orderly process of reviewing
the needs through the whole system. When the new building was constructed in Edwards they built what they
could afford at the time and what appeared to be large enough. The building has been full at night since a few
months after it opened. The environment for the campus is changing because they have a new high school to be
built in the near future. They are hoping to team with the high school for evening classroom space to resolve some
of the nighttime crowding issues. The Fire Department offered them an opportunity but she doesn't think it's fair
to say they would take any offer from the highest bidder. CMC will probably not have money available for a while
for another building in Eagle County because they still have other areas with needs. Their 5-year strategic plan
only included the previously mentioned building. They are trying to respond to the county's demand or statement
in the agreement that states every 5 years they must present a new plan for the land or the partnership would take
the land back. If they were forced to develop a plan, they will do it with someone who appears to be the most
appropriate partner. If permitted to move at their own reasonable pace it would make their life much easier.

Chairman Menconi stated that he was part of the team that put together the 5-year plan document. The
document was based on promises that were being created by the people who were asking for the 16 acres of
taxpayer's land that was created by the school district's and county funds. Those 16 acres are valued at about a
million dollars an acre and were given to CMC based on promises made. There were supposed to be 3 buildings
and two acres for intramurals. This was not done, nor codified in the document. The reason for the 5-year was put
in was not to force anyone, but to say based on the promises made, if you can't do it by that period of time, it
should revert back to the people who brought it forward in good faith. He understand that not everything goes as
planned but he would like a positive approach to understanding what the needs are and seeing how there is a way to
fundraise together for different opportunities. He believes that if the Fire Department were to put a fire station on
the property it would be out of character.
Commissioner Runyon wondered about their mill levy funding and if it was the same throughout the
county.
Ms. Dewton stated that it was the same, 3.997 through the whole system. They try to provide the same
level of educational quality in all of their facilities.
Commissioner Fisher wondered about the parking shortfalls.
Mr. Forinash stated the current parking is what was approved as part of the site-specific development
review. The parking that is provided is no longer adequate. The college approached staff last fall and asked to add
on to the parking. CMC is anxious to submit an application for a permanent asphalt parking area. The expansion
would allow for 50 additional parking spaces.
Mr. Treu stated that his office had received a letter from the CMC committee to do those improvements on
site.
Commissioner Fisher wondered if ECO bus serviced the area on a regular basis.
Mr. Forinash stated that there was a bus stop near by.
Ms. Dewton stated that she'd spoken to a number of students that don't believe the bus service is adequate.
Commissioner Runyon moved that the Board approve File No. 5MB-00349 and authorize the Chairman to
sign the plat.
Commissioner Fisher seconded the motion. The vote was declared unanimous.
