HomeMy WebLinkAboutMinutes 01/16/07 PUBLIC HEARING January 16, 2007 Present: Peter Runyon Sara Fisher Am Menconi Bruce Baumgartner Bryan Treu Robert Morris Kathy Scriver Chairman Commissioner Commissioner County Administrator County Attorney Assistant County Attorney Deputy Clerk to the Board This being a scheduled Public Hearing, the following items were presented to the Board of County Commissioners for their consideration: Executive Session It was moved, seconded and unanimously agreed to go into Executive Session for the purpose of receiving legal advice on enforcement of Land Use Regulations at 14551 Highway 6 and Vail Valley Taxi enforcement action update which are appropriate topics for discussion pursuant to C.R.S. 24-6-402(4)(b), Colorado Revised Statutes. It was moved, seconded and unanimously agreed to adjourn as the Board of County Commissioners and re- convene as the Eagle County Air Terminal Corporation and go into Executive Session for the purpose of receiving legal advice and discussion of matters that are subject to negotiation regarding the East and West concourse concession spaces at the airport. At the close ofthe discussion, it was moved, seconded and unanimously agreed to adjourn from Executive ~ssion and re-convene as the Board of County Commissioners. Consent Agenda Chairman Runyon stated the first item before the Board was the Consent Agenda as follows: A. Approval of bill paying for the week of January 15,2007 (subject to review by the Finance Director) Finance Department Representative B. Approval of payroll for January 18,2006 (subject to review by the Finance Director) Finance Department Representative c. Approval of the minutes of the Eagle County Board of Commissioners meeting for December 5, 2006 Teak Simonton, Clerk & Recorder D. Final Settlement of Agreement between Eagle County and Ewing Trucking and Construction Attorney's Office / eco Trails Representatives E. Resolution 2007-005 for release of Assignment of Certificate of Deposit for Road Cut Permit No. 339l for Julianne Young Attorney's Office / Engineering Representative Agreement between Eagle County and Eagle River Youth Coalition for tobacco education and prevention servIces Kate Forinash, Health & Human Services 1 0l/l6/07 G. Lease Agreement between Eagle County and the Town ofBasaIt for storage space at the Mt. Sopris Tree Farm Tom Johnson, Facilities Management H. Second amendment to agreement for service and support of Eagle County 800MHz Smartzone Communications System between County of Eagle, State of Colorado and Legacy Communications Attorney's Office Representative I. Resolution 2007-006 for the approval of the West End Planned Unit Development Sketch Plan (Eagle County File No. PDS-00049) Jena Skinner-Markowitz, Community Development Chairman Runyon stated that for the record that he voted in opposition of Item 1. Chairman Runyon asked the Attorney's Office if there were any changes to the Consent Agenda. Bryan Treu, County Attorney stated that Item B had a typo and should have read Payroll for January 18, 2007. Commissioner Menconi moved to approve the Consent Agenda, Items A-I, noting the change to Item B. Commissioner Fisher seconded the motion. The vote was declared unanimous. Commissioner Menconi moved to adjourn as the Board of County Commissioners and re-convene as the Eagle County Liquor Licensing Authority. Commissioner Fisher seconded the motion. The vote was declared unanimous. Eagle County Liquor License Authority Kathy Scriver, Clerk and Recorder's Office Consent Agenda Renewals A. Colorado Hotel Operator, Inc. d/b/a Lodge and Spa at Cordillera This is a renewal for a Hotel and Restaurant Liquor License with Optional Premises in Edwards (Arrowhead). There have been no complaints or disturbances in the past year. All the necessary fees have been paid. B. Colorado Hotel Operator, Inc. d/b/a Cordillera Mountain Club This is a renewal for a Tavern Liquor License in Avon (Beaver Creek). There have been no complaints or disturbances in the past year. All the necessary fees have been paid. Other Consent c. CVC Management, LLC d/b/a The Chaparral This is a Manager's Registration for the Chaparral in Edwards. CVC Management, LLC wishes to register Matthew Michael as its new Manager. The application is complete and the necessary fees have been paid. Mr. Michael is over 2l years of age and reported to be of good moral character based upon both the CBI and Sheriff reports. D. Ducks Unlimited, Inc. This is a request for a Special Event Permit. Ducks Unlimited, Inc. is requesting a special event pennit for their annual fundraising banquet on February 8th, 2007 in the Exhibition Hall at the Eagle County Fairgrounds from l2:00 p.m. to 12:00 a.m. All documentation is in order and the required fees have been paid. There were no protests received in the Clerks Office. 2 01/l6/07 Commissioner Fisher moved that the Board approve the Liquor Consent Agenda for January l6, 2007, consisting of Items A-D. Commissioner Menconi seconded the motion. The vote was declared unanimous. Commissioner Menconi moved to adjourn as the Eagle County Liquor Licensing Authority and re-convene as the Eagle County Air Terminal Corporation. Commissioner Fisher seconded the motion. The vote was declared unanimous. Eagle County Air Terminal Corporation Attorney's Office Representative Commissioner Fisher moved to adjourn as the Eagle County Air Terminal Corporation and re-convene as the Eagle County Board of County Commissioners. Mr. Baumgartrter seconded the motion. The vote was declared unanimous. Citizen Input There was none Annual Appointments Resolution 2007-007 Attorney's Office Representative Mr. Treu stated that the resolution to be signed was slightly different than the one presented. In addition to e appointment changes, Bruce Baumgartner's title was change from Eagle County Administrator to Eagle County anager. Commissioner Menconi moved to approve the Annual Appointments Resolution 2007-007. Commissioner Fisher seconded the motion. The vote was declared unanimous. Commissioner Runyon stated that he'd enjoyed the last year as Chairman. Commissioner Menconi presented Commissioner Runyon with a gavel in appreciation. He further stated that it was great to have him serve the citizens of Eagle County as the Chairman of the Board of County Commissioners.
