Resolution 2006-039 Appointing Liana Carlson Moore, Thomas Cole, Patricia Hammon, Carol Busch, John King, Tim Losa and William Heicher to the Eagle County Planning Commission County Attorney's Office Representative Commissioner Menconi moved to approve item G. Commissioner Runyon seconded the motion. The motion passed by a vote of two to one with Commissioner Stone voting against. Commissioner Stone stated that the Board has established a pattern of moving associate members into regular member positions. He objects to appointing two people who have never been on a planning commission. Chairman Runyon appreciated the comments, but stated it was a blind decision, and the recommendations were based on interviews with the candidates. Commissioner Stone was concerned about Thomas Cole's position on 35 acre tract development and his lack of concern about state law. The planning commission must implement the Eagle County land use regulations and use them as a basis for their recommendations. Citizen Input There was none. Resolution 2006-040 In the Matter of Amending the County Land Use Regulations to Strengthen the Application Submittal Requirements and Standards for Evaluating Proposed Changes in Zoning (Eagle County File No. LUR-0059) Bob Narracci, Community Development Mr. Narracci stated that on March 2151 this plan was approved with three changes. The first change is related to tying zone changes to a conceptual site plan and the new plan includes PUD, Companion Minor Subdivision or Companion Special Use Permit. The next change requested was pertaining to consistency with the comprehensive plan. The change included removal of specific dates for each of the appropriate plans to reflect the most current plan instead. The third and final change is related to public benefit. The examples of public benefit were amended to include child care and multi modal public transportation. Eagle County will be holding various Special Events, including the annual Oyster Feed and Fair and Rodeo on the following dates and times: 5/20/06 from 5:00 pm to 1:30 am; 7/29/06 from 5:30 pm to 12:00 am; and 8/2/06-8/5/06 from 5:30 pm to 12:00 am at the Eagle County Fairgrounds in Eagle. All fees have been paid, no protests have been filed, and the various Eagle County departments have stated no objections. Staff has had no problems with events held by this applicant in the past. Other Liquor Bryan Treu, County Attorney state that the Rocky Mountain Elk Foundation is proposing to put on a fund raiser April 22, 2006 at the fairground exhibit hall. The vote was declared unanimous. Other Commissioner Stone addressed a resolution concerning support for a joint resolution that would be coming before the State Legislature. Bryan Treu, County Attorney stated the resolution had been proposed supporting the house joint resolution for the Colorado forest health. It is a house resolution being proposed by a big contingency of both house and senate representatives to urge the Colorado congressional delegation and some of the federal land management agencies to increase funding in Colorado, specifically for wildfire and bug devastation of our forest. Following approval of the Frost Creek and Salt Creek Planned Unit Development Amendment on December 14, 2004, a grading permit was issued by Eagle County to allow site earthwork to commence. This grading earthwork is collateralized with the County in the form of a Letter of Credit. STAFF REPORT REFERRAL AND PUBLIC RESPONSES: All review agency referral responses have been satisfactorily addressed. 20 4/4/06 One e-mail response, dated March 23,2006, from an adjacent neighbor of the Frost Creek property living in the Mosher Subdivision has been received and is attached to this report. This e-mail is premised upon Adam's Rib earthw~rk activities and techniques throughout the 2005 construction season and sets forth several observations and 'uggested solutions: (1) Completion this spring of the public bicycle path along Brush Creek Road, from the Hardscrabble intersection, around and through the Salt Creek property and out to the southern-most end of the development; (2) Assistance in defraying homeowners' additional expenses in keeping houses clean; (3) Assistance with car care; (4) Properly graveling / maintaining Eaton Lane in a passable fashion; (5) Proper completion of the earthen berm on the Frost Creek Property adjacent and parallel to Eaton Lane; (6) To gain control over the profuse amount of trash, food wastes and other debris brought to the Frost Creek site and carelessly deposited by the various contractors; (7) Provide regular compliance with posted speed limits on Brush Creek Road. Adam's Rib contractors regularly exceed the speed limit placing pedestrians and children walking to their bus stops in increased danger; (8) Bureau of Land Management Access; an existing BLM trailhead is located at the 'comer' where Eaton Lane and the Frost Creek 'emergency / secondary access' road meet. This trailhead has been used by horseback riders for many years. Said trail lies within 10 to 15 feet ofthe project's property line, although no construction is planned on or near the trail location. It is requested that the developer continue to allow and even encourage public access at this point for the existing trail site. This might entail moving a fence and / or gate a short distance to the south. Alternatively, there would need to be two trails to the same point of access: one for Frost Creek residents and one on the other side of the fence for the general public. lAJOR CONCERNS AND ISSUES: None identified by Staff or Referral Agencies. STAFF FINDINGS: Pursuant to Section 5-280. B.5.b(3). Final Plat for Subdivision - Action bv the Board of County Commissioners. of the Eagle County Land Use Regulations, the following finding is made: The Final Plat DOES conform to the approved Preliminary Plan for Subdivision for the Frost Creek and Salt Creek Planned Unit Development, and Pursuant to Section 5-280.B.3.e, Subdivision Standards, of the Eagle County Land Use Regulations, the following findings are made: (1) Consistent with Master Plan. The proposed subdivision IS consistent with the Eagle County Master Plan and the FLUM of the Master Plan; (2) Consistent with Land Use Regulations. The proposed subdivision DOES comply with all of the standards of this Section and all other provisions of these Land Use Regulations, including but not limited to, the applicable standards of Article 3, Zone Districts, and Article 4, Site Development Standards; (3) Spatial Patterns Shall Be Efficient. The proposed subdivision IS located and designed to avoid creating spatial patterns that cause inefficiencies in the delivery of public services, or require duplication or premature extension of public facilities. (a) Utility and Road Extensions. Proposed utility extensions ARE consistent with the utility's service plan. Proposed road extensions ARE consistent with the Eagle County Road Capital Improvements Plan. 21 4/4/06 (b) Serve Ultimate Population. Utility lines ARE sized to serve the planned ultimate population of the service area to avoid future land disruption to upgrade under-sized lines. (c) Coordinate Utility Extensions. Generally, utility extensions ARE allowed only when the entire range of necessary facilities can be provided, rather than incrementally extending a single service into an otherwise un-served area. (4) Suitability for Development. The property proposed to be subdivided IS suitable for development, considering its topography, environmental resources and natural or man-made hazards that may affect the potential development of the property, and existing and probable future public improvements to the area. (5) Compatible with Surrounding Uses. As previously found with the PUD Sketch Plan, PUD Preliminary Plan, and the PUD Preliminary Plan Amendment; this proposed subdivision IS compatible with the character of existing land uses in the area and WILL NOT adversely affect the future development of the surrounding area. (6) Conformance with Preliminary Plan Approval. All conditions of approval established with the Preliminary Plan have been satisfied. (7) Fees-in-Lieu of School Land Dedication. Based upon a Summary Appraisal Report, dated March 14,2006, prepared by Mark Chapin, the entire 1,106,536 acre Frost Creek property is valued at $l7,000,000 (Seventeen Million Dollars). This equates to $15,363.259 per acre. Using the Eagle County Land Use Regulation formula for determination of School Land Dedication Standards: 97 single-family residences x 0.0151 = 1.4647 acre dedication requirement. Hence, the dollar amount for the fees-in-lieu ofland is: 1.4647 acres x $15,363.259 per acre = $22.502.56. This amount must be paid prior to recordation of the Final Plat. DISCUSSION: Commissioner Menconi was ill and not present. Mr. Narracci presented the file using a Power Point presentation. He provided some history and a project summary. He stated that several emails had been received which questioned whether the conditions had been satisfied. Chairman Runyon asked for a summary of the conditions that were problematic. Mr. Narracci stated that the Lion's share of the conditions were related to engineering details. There was an incredible amount of detail and many conditions that were required. There were also some conditions related to best management practices. In addition to the normal setback requirements the Board placed an additional 50 foot setback from the edge of the wetland riparian areas - much greater than other instances in the county. There was mention of wildlife mitigation plan. The applicant adjusted the lot configuration to satisfy the majority ofMr. Heicher's concerns. A mitigation fee was provided for wildlife in the amount of approximately $13,000.00. He has also received the fees in lieu of land for school land requirements. Ray Merry has worked with the applicant to satisfy Department of Environmental Health issues. There was a lot of discussion related to a bicycle path and the applicant is committed to installing a path from the north and south ends of the development. A temporary trail head will be provided at Trail Gulch and a permanent version completed when the bike path is installed. Chairman Runyon asked whether all conditions had been met. Mr. Narracci indicated that the plan had been reviewed exhaustingly. He also stated that all PUD approval and typical findings for final plat and subdivision have been satisfied. Chairman Runyon opened public comment. He informed the public that comments must be limited to the applicant meeting the requirements of preliminary approval. Rosie Shearwood, Brush Creek resident spoke. She thanked Mr. Narracci for his hard work on the application. She wondered about the timing of improvements to the road including the bike path. There are two sections on Brush Creek; one along the Salt Creek turnoff which is narrow and dangerous for bikers. She suggested 22 4/4/06 aligning the bike path along the Old Salt Creek road. She is also concerned about the intersection at Capital and Brush Creek. The town is trying to rectify the intersection. Cindy Cohagen, resident of Brush Creek spoke. She thanked staff as well. She is concerned that the bike path will not be built completely until future development is completed. She wonders why providing a trail head . rould not be done simultaneously with the bike path. It is incredibly dangerous for bikers as it is currently configured. Charlie Ridgway, adjoining property owner spoke. He wondered about the parking facility on Old Salt Creek Road. The County has not vacated their easement even though they have abandoned the road. He doesn't understand why the applicant would have to provide a parking area if the public cannot gain access. He requested a permit to maintain the road as far as it accessed his lots if the County would not be willing to vacate the easement or maintain the road. He encourages the County look into the future and maintains the road to provide access to the trail head. Commissioner Stone clarified that the County had not abandoned the road. Ms. Migchelbrink stated that the County had ceased maintenance of the road. She stated that it was not vacated, and she doesn't believe it should be vacated. There is a very expensive bridge on the road that needs to be rebuilt. Commissioner Stone stated that the road has not been abandoned, nor vacated. He recalls when approval was granted to Adam's Rib, the Town of Eagle had weighed in heavily. Chairman Runyon wondered if this issue pertains to whether the applicant had fulfilled the requirements of the preliminary plan. He encouraged Mr. Ridgway to work with staff to resolve the question. Annie Egan, resident of Brush Creek spoke. She is in agreement with Ms. Shearwood and Ms. Cohagen's statements. She believes the wetlands should be addressed more than simply an identification. She suggests a conservation easement. Chairman Runyon closed public comment. Bruce Greg, project manager for Adams Rib responded. He addressed the bike path issues. He stated that they would like to move this quickly forward with due review from the County and being a cyclist himself he is in avor of having a bike trail on many public roads. In regards to the wetlands, he indicated that an easement has een set aside to delineate these areas. Vern Brock, project engineer spoke to the Board. The project has been held to a greater separation from wetlands and riparian areas than the rest of the county. All building envelopes have been analyzed and set to not infringe upon the wetlands. All of the wetlands are in a drainage easement with regards to the 100 foot floodplain. He believes there are adequate safeguards to prevent damage to the wetlands. They have met with Ellie Caryl related to the bike path. In regards to Capital and Brush Creek intersection, he stated that the Town of Eagle is aware ofthe issue. In the past, Adam's Rib was presenting 1700 units, and Eagle Ranch was required to provide adequate infrastructure to accommodate this growth. He believes the Sylvan Lake Road will take a lot of the future additional traffic. Chairman Runyon requested the applicant to consider making the golf course public or semi public. There are 19 golf courses in the valley and of those only 3 are public. This is not a condition - but a request. It could be a real benefit for the community. Commissioner Stone did not have any questions, but thanked the applicant for attempting to address the neighbor's comments. New conditions cannot be added, but he encouraged them to continue with their good neighbor policy. Commissioner Stone moved to approve File No.PDF-00091, incorporating the Staff findings, and authorize the Chairman to sign the plat and the Subdivision Improvements Agreement. Commissioner Runyon seconded the motion. Of the two voting commissioners the vote was declared unammous. There being no further business befi.
