Commissioner Commissioner Acting County Administrator County Attorney Deputy Clerk to the Board This being a scheduled Public Hearing, the following items were presented to the Board of County Commissioners for their consideration: Executive Session Commissioner Stone moved that the Board go into executive session for the purpose of discussing pending negotiations with airlines and fot the purpose of receiving legal advice and discussing negotiations related to Crown Mountain Park and Recreation District lease and watet court filing and further to discuss negotiations associated with the runway extension all of which are appropriate topics for discussion pursuant to CRS 24-6-402(4)(b). Comtnissioner Runyon seconded the motion which passed unanimously. At the close ofthe discussion Commissioner Runyon moved to adjourn from executive session and Commissioner Stone seconded the motion which passed unanimously. Later in the day Commissioner Runyon moved that the Board go into executive session for the purpose of receiving legal advice concerning the runway extension which is an appropriate topic for discussion pursuant to CRS 24-6- 402(4)(b). Commissioner Stone seconded the motion which passed unanimously. At the close of the discussion CorniI1issioner Stone moved to adjourn from executive session and Commissioner Runyon seconded the motion rhich passed unanimously. Commissioner Runyon seconded the motion. The vote was declared unanimous. Eagle County Liquor License Authority Kathy Scriver, Clerk and Recorder's Office Consent Agenda Renewals 2 7/12/05 A. The French PreSs Edwards, CO This is a renewal of a Tavern Liquor License, in Edwards. There have been no complaints or disturbances in the past year. All the necessary fees have been paid. B. Drink Edwards, CO This is a renewal of a Retail Liquor Store License, in Edwards. There have been no complaints or disturbances in the past year. All the necessary fees have been paid. Other Consent C. Rocks Modern Grill B~aver Creek Village, CD This is a request for three separate items. The applicant wishes to change its trade name from Black Diamond Grille to Rocks Modem Grill. Next, they are registering Jeffrey Bay as their new manager. Mt. Bay is reported to be of good mdral character, based upon the Sheriffs report. Finally, the applicant is seeking a modification of its premises. They are remodeling the restaurant's interior, which does not affect the cutrent liquor boundary. All the necessary fees have been paid. Commissioner Runyon moved that the Board approve the Liquor Consent Agenda for July 12, 2005, consisting ofItems A-C. Commissionet Stone seconded the motion. The vote was declared unanimous. Cofuttrissioner Stone moved to adjouth as the Eagle County Liquor Licensing Authority and re-convene as the Boatd of County Commissioners. Resolution 2005-088 Assessot's Reports: Assessed Value of Taxable Real and Personal Property in Eagle County Joyce Mack, Assessor Joyce Mack presented the board with a report summarizing the assessed value and appeals for real taxable property, personal ptoperty and all taxable property. Cdnllllissioner Stone moved that the Board approve the Resolution 2005-088 111 Re: Presentation of reports of assesSor of valuation for assessment for taxable real and personal property in Eagle County. COh1n1issioner Runyon seconded the motion. The vote was declared unanimous. Resolution 2005..089 Calling an Election to be held on the next General Election for the Purpose of Determining Whether or Not a Home Rule Charter Commission shall be Elected; Dividing Eagle County into Three Compact Districts, Such Districts to be as Nearly Equal in Population As Possible, For the Purpose of Electing Charter Commission Member by District; Directing Publication of the Same at Least Sixty Days Prior to the Election; and Authorizing the Chairman of the Board to Execute Letter of Intent to Participate in the November 1, 2005 Coordinated Election County Attorney's Office Representative Cliff Simonton presented the Board with testimony in terms of population in the Commissioner districts. 3 7/12/05 Comrrtissioner Runyon moved to approve the Resolution-089, Calling an election to be held on the next general election for the purpose of determining whether or not a Home Rule Charter Commission shall be elected; dividing Eagle County into three compact districts, such districts to be as nearly equal in population as possible, for the pUrpose of electing charter commission member by district; directing publication of the same at least sixty days prior to the election; and authorizing the chairman of the Board to execute letter of intent. Comrrtissioner Stone stated he would not be voting in favor of this Resolution. He is against diverting money from the General Pund, and felt it would be much more appropriate to have the cost of this endeavor paid for by a new additional mill levy. Comtnissioner Runyon pointed out that this additional expense is somewhere slightly greater than 1/10ili of 1 % of the total budget and that it just confuses the issue in doing it in that fashion. Chairman Menconi seconded the motion. The motion passed by a vote of two to one with Commissioner Stone voting against. Resolution 2005..090 Amending Eagle County Local Resident Housing Guidelines KT Gazunis, Housing Ms. Gazunis gave a brief presentation of this Resolution that amends the Eagle County local resident housing guidelines that were adopted in April of 2004. The changes to the guidelines reflect the finding of the NexuslProportionality Study which recommended a 20% mitigation rate for onsite housing, 25% mitigation rate for housing offsite, and 30% m:itigation rate for payment in lieu of providing that housing. Chairman Menconi asked if the Resolution referenced the numbers. Ms. GaZUDis stated it did. CotrUhissioner Runyon questioned the residential employee generation rate table in her report that stated a rate of 0.22 for residential employee generation and asked if this reflected a second home or local housing. He thought the rate should be higher. Ms. Gaiul1is ex.plained the rate would probably be higher for second homes than it would be for local homes and the table is from latest NexuslProportionality Study and that data will be re-examined. Comtnissioner Runyon asked if the formulation was going with what was getting approved. Ms. Gazunis reiterated that the data would be updated and all that is being changed at this time is the mitigation rate. Comtnissioner Runyon moved the Board to approve Resolution 205-090 Amending Eagle County local resideIit housing guidelines adopted in April 2004 incorporating the changes in mitigation rates Chairman Menconi seconded the motion. The motion passed by a vote of two to one with Comtnissioner Stone voting against. Commissioner Stone stated that you can't have an anti-growth attitude and build homes for people at the same time. Other: Ms. Mauriello requested a motion to appoint Chairman Menconi to the state round table and authorize him to sign the appointment book. Commissioner Runyon moved to appoint Chairman Menconi to the state round table discussion and authorize him to sign a letter of that appointment. Chairman Menconi seconded the motion. The motion passed by a vote of two to one with Commissioner Stone voting against. Miller Ranch is a 125 lot subdivision, Planned Unit Development with a Mill Loft patcel, and open space parcels, located south of Interstate 70 east of the Edwatds Spur Road and extends south to the Union Pacific Railroad and east to the Arrowhead Subdivision. The lots in this block comprise Townhomes with detached garages and the land itn:lrtediately adjacent to it. The easement that the applicaht is requesting to be vacated was dedicated to the public for the purpose of utility, dtairtage and snow storage on the Miller Ranch, Filing 2, Final Plat. The utility function of this easement was designed to accommodate various shallow utilities. The latger rectangular portion was created primarily to accommodate electrical equipment such as transformers for Holy Cross Energy. During construction, Holy Cross Energy placed the transformers at different locations per their design changes. Transformers are not needed at this location in the easement on Lot 76. ' In the fall of 2004, Marcin Engineering, LLC discovered the garage, located at Lot 76, encroached up to 2.43 feet into the easement (Figure 2). Upon investigation of the encroachment, it appears that the functionality of the easement for shallow utilities was not impacted by the construction of the garage. The County Road & Bridge Department has responded verbally that the decreased snow storage area at this location would not cause significant problems. 6 7/12/05 The applicant is requesting that portions of the easement be vacated so that the title of the house is not encumbered by the easement. The remaining portion of the easement is adequate for the installation and maintenance of utilities, drainage, snow storage, and similar improvements. STAFF FINDINGS: The Eagle County Land Use Regulations (ECLUR) require that a vacation be demonstrated to be in the general interest of the public's health, safety and welfare, not to be in violation oflaw, to be in compliance with the ECLUR and the Master Plan, and not leave any adjoining land without a means of access to another public road. The following findings are made: The applicant has filed a petition for a vacation of the easements and right-of-way in conformance with the requirements of Section 5-2200. Proper public notification for the petition has been issued in conformance with Section 5-2200 C.4.a. and the petition is ready for consideration by the Eagle County Board of County Commissioners. The proposed vacation will not leave any adjoining land without a means of access to another public road. DISCUSSION: Peter Sulmeisters, Eagle County Engineering, presented a PowerPoint presentation for file G-00022 & G- 00023: two easement vacations for utility, drainage, and snow storage. The presentation included aerial photos of the easements and the surrounding area; it also included detailed photos of the areas of encroachment. The applicant wants Eagle County to vacate a portion of the easement because a garage has enctoached into the easement. Chairman Menconi opened public COmh1ent. There was none. He closed public comment. Cothtnissionet Stone asked Vince Hooper of ASW realty to come forward and explain whether this would take care of all the foreseeable easement vacations arid explain if the encroachments came after the fact or whether they knew at the time the garages were built. Mr. Sulmeisters intetjected that they came to find out after the fact, after the garages were built. Mr. Hooper's comments wete not pertinent to these files. Cothtnissioner Stone asked if it would be possible to predict at this stage of development, if there would be potential for any additioIial encroachments. Ms. Mauriello stated that there were a couple of places where there were potential encroachments and a number of transfonners and other utilities that were not within the easement and these encroachments had been rectified. She added that it is a tight building site and they're trying to catch things as they occur. Commissioner Stone requested a pto active approach and that they get the County's approval in advance if an easement vacation is needed and that this be done prior to building. Ms. Mauriello stated that she felt it was an excellent point because the vacation process, depending on the approach that is used, could have stringent notice requirements and this could significantly affect the developer as units selL Commissioner Runyon m.oves to approve file No. G-00022 and G-00023 with the following conditions: 1. Except as otherwise modified by these conditions, all material representations of the applicant in this application and all public meetings shall be adhered to and considered conditions of approval. 2. The vacation will not be in effect until a Quit Claim Deed for the vacated easement is recorded with the Eagle County Clerk and Recorder. 3. The vacation. will not be in effect until the Resolution of the Eagle County Board of County Commissioners approving the vacation is recorded with the Eagle ComIty Clerk and Recorder.
