He feels it will be good to have the discussion to be able to put this together. He feels that there was a poor turnout, limited time frame and lack of public interest. Chairman Menconi stated that he is sorry that Commissioner Stone feels this is a top down decision, as Commissioner Runyon ran on this issue. Commissioner Stone stated there are no guarantees that there will be any additional commissioners. This vote is to go to home rule which offers no guarantees. Chairman Menconi responded that this fear tactic would be heard leading up to the election. The commissioners trUst the citizens of Eagle County to make the right decision. Eagle County AsseSSOr · No comment. Basalt and Rural Fire Protection District . District represehtatives have met with the Applicant and have discussed with him the International .l3uilding and Fire Code tequirement regarding sprinklers for mixed use occupancies which include a residence. The District supports his efforts to achieve a home business and offers several comments regarding fire code compliance. . Access is required to meet the applicable provisions of the International Fire Code as adopted by Eagle County. The access on the grading plan needs to be verified. Turning radius needstomeet the larges responding vehicle, in this case requires a minimum inside 28 foot radius and an outside 45 foot radius to maneuVer. Vehicle weight is 60,000 pounds. . A crucial part of access is attachment to a water source. Mr. Kim has indicated that a nearby pond could be accessed for manual water supply. If this becomes the fmal choice, then access needs to be designed to allow safe drafting operation via dry hydrant and provide the room required for tactical maneuvenng. · PurSuant to the International Building and Fire Code, an automatic sprinkler system shall be provided throughout all buildings with a group R area. This building would be required to be sprinklered to the NFP A l3 standard for the commercial space and 13 R could be considered for the residence based on separation in building design. This standard requires water supply meeting sprinkler demand and additional water for manual fire suppression needs. The fire sprinkler in this scenario is sufficient t meet the requirements of the International Fire Code. . The stored water supply for the system can be from a pond or a buried tank. In either scenario, the fire fighting apparatus would need to connect to the tank via a dry hydrant system meeting the policies and specifications of the Fire District. . The District supports the Applicant in his home business. It is recommended that the Applicant and his engineer representative meet with the Fire District to determine sprinkler and outside hose requirement design that meets the Districts operational needs and complies with the adopted Building and Fire Code prior to submitting plans for building permit application. Colorado Division of Wildlife . The Division of Wildlife staff has reviewed this plan to operate a catering business. The impacts to' wildlife should be minimal. · The Division has had reports of black bear activity in this area. All precautions for food and waste storage to minimize conflicts with wildlife should be considered. A list of approved bear resistant containers is available at the Division of Wildlife office. 20 7/05/05 . In other situations, especially with food smells, bears have gained entry through unlocked windows and doors. The commercial kitchen and related catering business will be secondary to the primary residential nature of the site. Nonetheless, as a condition of approval, prior to the construction of a second dwelling on the site, the owner should apply for and obtain a Certificate of Zoning Compliance as provided in Section 5-300, Limited Review Use, and 1ection 5-2100, Certificate of Zoning Compliance, of the Land Use Regulations. [Condition # 1] 23 7/05/05 Activity Conducted Indoors - All activities associated with the home business must be conducted indoors, and all materials and equipment used in the home business must be stored in a building. The Applicant states that all catered cooking will be done indoors. A condition of approval requiring that all materials be stored in a building is provided below. Employment - A home business must be conducted by persons residing on the premises and by no more than two (2) employees residing off-ptemises. The Applicant has indicated that up to two seasonal employees residing off- premises will be used. Patrons - A home business may serve patrons on the premises. However, the Applicant states that, only on rare occasions, will patrons come on premises for a "tasting" prior to a catered event. Parking - A specified number of parking spaces is required to accommodate off-premise employees and patrons, in addition to the required residential parking. The Applicant is providing adequate parking on-site. Sales - only incidental sales on-site are permitted. Since the home. business is catering, all sales are off-site. Ntdsance - Noise, electrical or magnetic interference, vibrations, heat, glare, odors, fumes, smoke or dust are limited, and hours of operation must be such that the home business operation does not create a public nuisance, disturb neighbors, Or alter the residential character of the premises. It is not expected that any such nuisances will occur. Codes - The building housing the home business is required to comply with all County or State building, fire and safety codes applicable to the particular business. Eagle County Environmental Health has noted a number of specific requirements for establishing and operating a commercial kitchen on this site. As a condition of approval, the Applicant should conform to all requirements for operating a commercial kitchen, including those noted in the memorandum from Eagle County Environmental Health dated May 27, 2005. [Condition # 2] Signs and :tnlllllina.tion - Signs or other outdoor structures advertising the home business are not permitted. No signs are proposed. As a general condition of approval, the catering home business should be conducted in a manner consistent with the provisions of Section 3-31O.F.1., Home Business, in the Eagle County Land Use Regulations. [Condition # 3] [+] FINDING: Zone, District Standards [Section 5-250.B.3] With the recommended condition, the proposed Special Use DOES meet the standards of the zone district in which it is located, and DOES meet the standards applicable to the particular use, as identified in Section 3-310, Review Standards Applicable to Particular Residential. STANDAJlD: Design Minimizes Adverse Impact [Section 5-250.B.4] - The design of the proposed Special Use shall minimize adverse impacts, including visual impact of the proposed use on adjacent lands; furthermore. the proposed Special Use shall avoid significant adverse impact on surrounding lands regarding trash, traffic, service delivery, parking and loading, odors, noise, glare, and vibration, and shall not create a nuisance. Deliveries to the kitchen are expected to he limited to two r three times per week, similar to FedEx or U.P.S. deliveries. Adequate space exists for parking and loading of vehicles. It is reasonable to expect that odors, noise, glare, vibration and other forms of nuisance will be within applicable limits. Nonetheless, as a condition of approval, the operati~n of the commercial kitchen and its related activities should be done in conforll1ance with the proVisions of Division 4-5, Commercial and Industrial Performance Standards, of the Eagle County Land Use Regulations. HousineGuidelines. - On April]3, 2004, the Board of County Commissioners approved Resolution No. 2004-04 adopting Housing Guidelines to establish a framework for discussion and negotiation of applicable housing criteria. the proposed home business does not represent "new residential development" as provided in the Housing Guidelines. DISCUSSION: Mr. Forinash informed the board that a memo had been sent to the board which included conditions addressing direction given by the board at the prior meeting. He had not had an opportunity to review this memo with the applicant. He presented the conditions numbering 1 - 12. At the applicants request there were four conditions they wish to tevise. Condition 10 revised the question of who would be defined as friends, it was suggested that this condition be modified. He suggested that the wording be such that no paid commercial events shall be held on site or events involving the use of a COh1l11ercial kitchen. Condition 11 refers to vendor delivery times and the applicant requests that these hours be extended to 7:00 a.m. to 5:00 p.m. Mr. Mathews, county attorney informed the board that there are three resident neighbors who were not able to be present who had requested that the item be tabled. Mr. Forinash stated that the board had received letters in support of the operation from residents in the area. He had also received 8 letters of opposition. Chairman Menconi asked about the two veins of thought. Mr. Forinash stated that there had been several items from vendors indicating anywhere from one delivery every other week to two deliveries per week. One individual, Robert Crown has regular client visits steps away from her business and he would be very sensitive to disruption on the site. He has never been inconvenienced by deIlvety trucks. He personally works 7 days a week and most evenings. Jeffrey Civas, owner of Snowmass lawn and plant. His office is adjacent to the space, and shares a driveway. He says that he has many vehicles and employees, but has never had any problems with the applicants. . He has never seen more than 4 people in the kitchen at one time. He has not beeh inconvenienced. the applicants Laura Kim and Gary Wright were present. She thanked the Commissioners for their time and expressed satisfaction with the additional conditions of approval. She feels that they will exceed the 'Board's expectations. They are building their primary residence over the barn and hope to be able to build a separate single family residence if the opportunity ever presents itself. their agricultural pursuits are full blown and they hope to utilize their home business to spend more time on theit property. She responded to a letter from a neighboring resident. She believes that this woman works for the property management company who runs their building. They have had some conflicts in the past with the CAM charges and the applicant determined that they had been mis-charged and wete actually paying the manager's fees. She has no other idea why this woman would have sent this letter. Condition 11 needs to be edited to include Friday deliveries; Monday through Friday. Chairman Menconi spoke about this application. This item had been tabled and public comment was closed at that time, but since then numerous letters have been received. When he received the letter from Judy Cemasek, he had concerns as to the amount of traffic which could occur. He is concerned about the level of attack related to this file. They have listened to more testimony than on most files. The only concern he has is the management of the conditions and whether they become a burden on the county. He believes in giving everyone a chance and the applicant has one year to prove that they can manage it well. Much of the testimony has been dramatic. He feels that everything has been exaggerated. He requests that the applicant stay within the basics and meet the criteria of a home business. If these conditions are not being followed, the use will be pulled. Mr. Jay Leavitt, resident at 60 Viega, Aspen Mesa Estates. They have been following the case closely. They have comments related to the conditions proposed. Condition 9 states that it is subject to annual review. Chairman Menconi did not allow Mr. Leavitt to speak because he had already submitted his comments and questions. He stated that the only testimony he would allow was new information or comments. The county will do the review, not the planning commission. He believes the county can handle the conditions. 28 7/05/05 Commissioner Runyon spoke to the applicant. He asked about their current operation. The applicant indicated that they currently operate a business in a residential complex. They indicated that they owned that property. Commissioner Runyon wondered why the applicant wanted to make this change. Ms. Kim indicated that her clients are in all areas of the state and out of state. The primary reason for re- ocating their business is to be truly able to operate a home business and have a better use of their time available. They want to consolidate their efforts and spend more time on their own property. Commissioner Runyon asked if they had vans to transport food. Ms. Kim stated that they have one van and one truck and manage their business specifically. They are catering for 200 this evening and there are 4 people preparing the meal. This would take one van trip to deliver. Commissioner Runyon asked about wait personnel. Ms. Kim indicated that these people meet them at the site. There are occasions when they carpool from the parking area, but they never meet at the location where the food is being prepared. Commissioner Runyon asked about the maximum numbet of employees. Ms. Kim indicated that this is the high number of staff required to make a meal. They are hoping to have an 850 squa.re foot work area in their new location. Commissioner Runyon indicated that this application is pushing the idea of a home business. When considering the size of their pro'Perty, their neighbors are accusing the applicant oflying. It would seem to be very sitnilar to an agricultural operation. The building can be built regardless of this request. He has a problem with pushing the envelope and the spirit of an idea of operating a home office. This is more appropriate in a corrtmercial business of some sort and not necessarily appropriate in a home environment. Building a kitchen of this size is very expensive and he cautions them to consider this when they agree to the conditions. Chairtnan Menconi stated that he is in favor of the file with the conditions. He asked for Commissioner Runyon's feedback. Co'mmissioner Stone stated that he is in favor of home businesses. He was not present for the discussion of the special use pertnits for Loftworks. He saw the applicant change what was allowable. There was concern and sensitivity to restrict which types of home businesses would be allowed. He believes that this is not the type of home business that would be allowable. He believes that Mt. Leavitt makes some good points. He believes that if his were to be approved that the annual review process should be more clearly identified. He wonders if this is an dministrative review and which factors will be reviewed. He is still not in faVor of approving this file. He referred to no' catered events - the wording in the conditions is fine. He appreciates Mr. Leavitt's comment about the Special Use Permit. The permit goes with the land, not the owner, he also has some concerns about code enfOrcement. He was surprised at the answers about how many people are employed by the applicant. Ms. Kim stated that three employees ate working today - and that already puts her in violation of the Special V se Permit. The Special Use Pettnit only allows 2 employees and as she indicated today she has three employed. He wondered how the applicant would not be in violation of the permit immediately. He echoed Commissioner Runyon's warning of the investment that would be lost if the conditions weren't met. A special use permit for a home business is a limited use. It isn't meant to be a commercialization of a residential atea. He doesn't see this as an appropriate home business. He asked about the fact that they live in the Woody Creek affordable housing unit. Ms. KiIn indicated that they would sell that qIlit and it would go back into the housing lottery for re-sale. Commissioner Stone asked about today's function having three employees. Ms. Kim indicated that they are allowed two on site and two off site employees. In the kitc]1en they are using today they have no rules. She knows her business and they have tailored that business and are very client specific. They don't necessarily want to grow in their catering business but prefer to grow in their agricultural business. She asked for a chance and guaranteed that every condition would be followed. They would be a unique operation similat to small businesses in Palisade. Commissioner Stone imagined himself saying one day that there might be events that would require replacing themselves with other employees and in so doing exceeding the limit imposed by the conditions. He believes conditions can be added infinitum, but suggested that it's the wrong type of home business for the location. The neighborhood sees this as a commercialization of the area. In a year if things aren't going well it won't be easy to pull the permit because of the money invested in the infrastructure of the space. He is from Chicago but has been visiting for many years. He bought a lot l3 years ago and has lived there during the summers. As they watched the development in Cordillera they did a lot of hiking and hiked over the tract in question. The developer, Kensington partners had it for sale with an impractical plan. They asked Johnson and Kunkel to find another way to access the property. Mr. Rothkopf approached the developer who agreed to sell him the parcel ifhe could get the easements from the Cordillera Metro District. They came to an agreement and bought the land. They are asking to build a hOuse for the family and a small caretaker's unit. He wanted to maintain the ability to add a building envelope should his children wish to build another home in the future. Chairman Menconi asked if Davis Excavating is working on this project. Chairtnan Menconi opened public comment. There was none. He closed public comment. Commissioner Stone suggested subdividing the property now. Chris Williams, Johnson Kunkel and Associates responded that they wanted to keep it one lot for tax purposes. Col11tnissioner Runyon asked about the size of tract A The owner indicated that tract A is 142 acres. Lot One and two are over 35 acres each. Commissioner Runyon asked about the ridge line. He wondered if the building envelope would be on the ridge line. Mr. Rothkopf stated that the house would not be visible from below. They have conformed to the ceiling requirement. Chairman Menconi asked where the road ends currently. Mr. Williams showed the road on the slide. Chairman Menconi asked about the new road location. He wondered how it would make the home easiet to access. Mr. Rothkopf stated that there were two building envelopes. The most desirable was to the West ofthe envelope. The steep part of the land is where the road ends. This allows the toad to sweep up to the new building. Chairman Menconi stated that the main thing that jumps out is that two envelopes are being traded for one smaller and one larger. He wondered if the size of the existing building envelopes. The owner indicated that the original size of the building envelopes had not been increased. Commissioner Stone moved to approve file AFP-00208 - Cordillera Filing 33 and authorize the Chairman to sign the plat. Commissioner Runyon seconded the motion. The vote was declared unanimous.
