HomeMy WebLinkAboutMinutes 12/16/04 SPECIAL PUBLIC HEARING December 16, 2004 Present: Michael Gallagher ArnMenconi Jack Ingstad Bryan Treu Don DuBois Commissioner Commissioner County Administrator Assistant County Attorney Deputy Clerk to the Board Absent: Tom Stone Chairman This being a Special Public Hearing starting at 9:16 am, the following item was presented to the Board of County Commissioners for their consideration: Chainnan Pro..Tem Gallagher stated the first item before the Board was the Certification of Mill Levies. A. Certification of Mill Levies Cindy Preytis, Finance Ms. Preytis stated that these Levies represent all taxing districts in Eagle County. This certification must be completed per Colorado Statute by December 22, 2004. Chairman Pro-Tern Gallagher asked what portion of the docUlllent would be sent to the Secretary fState. Ms. Pteytis stated that the entire docUlllent would be sent. Chairman Pro-Tem Gallagher opened Public Comment and closed it, as there was none. Commissioner Menconi moved to approve the 2005 Certification of Mill Levies and Revenues. Chainnan Pro-Tern Gallagher seconded the motion. Of the two voting commissioners, the vote was declared unanimous. Mr. Ingstad asked to see where Eagle County's Mill Levies were listed on the document. Ms. preytis stated it c()Uld be found on Page 4. Mr. Roeper stated that the distribution of the monies was only slightly different from the previous year due to reduction in the debt service. Mr. Ingstadasked if the Social Services Fund was remaining the same. Mr. Roeper concurred with that statement. Commissioner Menconi asked which debt was paid off and what the payment was. Mr. Roeper stated that the building debt was $700,000, approximately. Mr. Ingstad asked if a Mill Levy then went away once a debt was repaid. Mr. Roeper stated that the total Mill Levy is the same. Mr. Ingstad asked how the Mill Levy could remain in place after a debt is paid. Mr. Roeper stated that the total Mill Levy has remained in tact, historically, and the savings has been directed to the General Fund. Chairman Pro-Tern Gallagher also couldn't understand how the collection of taxes could continue after a debt has paid off. Mr. Ingstad asked the Legal Department to look into the issue of the additional tax collection. 1 12-16-2004 Commissioner Menconi stated that Eagle County could be collecting an additional $150,000 that is no longer required. Mr. Ingstad concurred. Commissioner Menconi asked what the General Fund ramifications could be if it is determined that Eagle County was collecting unauthorized monies. Mr. Ingstad stated he would try to raise the temporary reduction in Mill Levy in order to get the General Fund to balance. He stated it could end up in court, and it needed to be looked at. Commissioner Gallagher asked when the tax notices are sent out. Ms. Preytis stated they get sent out in January. Commissioner Gallagher stated that refunds may need to be given.
