envelope to accommodate the footprint of a proposed home, including all exterior decks and patios. The size of the

approximately 10 feet downhill to the east). As a result, the home will be provided a better view of Beaver Creek
Village and mountain (to the southeast), and additional room will be created for driveway and parking areas on the

NOTIFICATION! ADJACENT OWNER RESPONSE: Notice of this application has been provided in accordance
with Eagle County Land Use Regulations Section 5-21 O.E, Notice of Public Hearings. Related provisions of the
Beaver Creek PUD Guide, which require a full 30 day notice to all adjacent property owners, have also been met.
Several adjacent property owners have voiced concern, and at least two remain opposed to the amendment. Letters
regarding this proposal have been received as follows (please see attached):
Mr. Tim Kelly, letter of April 20, 2004. Mr. Kelly, who owns Lot I directly across the street to the west from the
subject property, approves of the proposed envelope adjustment
Mr. Barry Sanders, (represented by Mr. Burton Levin) letters of February 26,2004, June 24, June 27, and June 28,
2004, and August 27,2004, the last including a letter from Mr. Rick Pylman, AICP, who has also been retained to
represent Mr. Sanders. Mr. Sanders owns Lot 6, which is directly east of and below the subject property. He is
opposed to the envelope change, and has indicated that he will be present on September 7th.
Mr. John Cooke, letters of January 16,2004 (to the Beaver Creek DRB), June 25, 2004 and June 28, 2004. Mr.
Cooke owns Lot 4 which is kitty-comer to the north and east. He is opposed to the envelope change. Mr. Cooke faxed
a copy of his June 25th letter to staff again on August 26th. His letter of June 28th indicated that he would be also
present at the public hearing on September 7.
Mr. Jeffery Chircus, two letters dated June 24, 2004 and a third dated June 28. Mr. Chircus owns Lot 5 which is
north of the proposed residence. Originally opposed to the plan to move the home 20 feet to the east, Mr. Chircus has
met with the George family and has accepted the most recent proposal, which is to move the house 10 feet to the east,
and reduce a gable roof section on the east side of the house from a 12 foot overhang to a 6 foot overhang.
As a part of their application, the Georges delivered copies of letters indicating approval from all other adjacent
property owners (see attached).
STAFF FINDINGS: Pursuant to the Beaver Creek PUD Guide, Section XII, Building Envelope Amendments,
Subsection B, Public Meeting, "The Building Envelope Amendment will be approved by the Eagle County
Commissioners if the Eagle County Commissioners find that the Building Envelope Amendment:
(i) Does not substantially impact in an adverse manner the view corridor of any property ownel'_~C!}tJ~(}t/1-_~()i~~~____

of the proposed building envelope amendment has been sent.
"Substantial impact on a view corridor" for the purpose of evaluating conformance to this standard is not derIDed
by the PUD Guide nor is it defined by Eagle County Land Use Regulations. An evaluation is therefore somewhat
subjective, but would logically include the spatial orientation of any existing and potentially impacted house, the
interior spaces and window positions of that home, its exterior occupied spaces like decks and patios and the
corresponding features of the surrounding countryside.
Based on the orientation of homes and windows features that already exist in this area of Beaver Creek, primary
views are to the south toward the Beaver Creek village and ski mountain, and to the east toward the golf course
and eastern hillside of the Beaver Creek valley. As such, and if this is indeed true, the greatest potential for a view
corridor impact from this proposed amendment would be to the Chircus residence to the north. While Mr. Chircus
was originally against the envelope amendment, he has since reached an agreement with the Georges and is no
longer opposed (reference his letter of June 28, 2004)
Based on the relative positions and orientations of the homes owned by Mr. Cooke to the northeast and Mr.
Sanders to the east, a "substantially adverse impact" to their view corridors is not readily apparent. No doubt, the
views "up the hill" for both the Sanders residence and the Cooke's residence will be impacted by a home
constructed on the subject property, even ifit is constructed in the currently platted envelope. Any "view corridor
infringement" created by moving the home 10 feet to the east, however, would seem nominal when compared to
the overall view attributes provided to these two homes. The proposed amendment will allow a home on Lot 7 to
be built closer to Mr. Sander's out-door hot tub, which is located on the west side of his house.
(ii) Is required by geologic or other hazard considerations.
The proposed envelope amendment was not prompted by any identified geologic or other hazard.
Cliff Simonton of Community Development presented this file. He stated that the envelope will actually move
further than 10 feet to the east as previously mentioned, however, the building will only move 10 feet further east.
This will provide more room for parking and improve views. There was no land use application that pre-dates this
proposal. He showed various satellite images of the property. This house would be the final one constructed in the
neighborhood. He pointed out where the various neighbors lived, as some were in attendance. The building plan is
still the same as the original proposal, and there is a deed restriction that will be presented with this plat that will
prevent any further building to the east.
Chairman Stone asked for clarification about some of the slides, and whether anything would be built beyond a
line shown.
Mr. Simonton stated that an outdoor deck and lower patio would be built along with other amenities. By
approving the envelope, the applicant will not have to go through the Minor Modification to a POO procedures as
required through the Beaver Creed PUD Guide. The entire house, including the decks, has been shifted back i 0 feet to
the west from what is shown in the proposal.
Commissioner Gallagher asked if the deck is not required by Eagle County Regulations, but by the Beaver Creek
Regulations, to be within the building envelope.
Mr. Simonton stated that all improvements must be within a building envelope according to the Beaver Creek
POO Guide. He stated that Eagle County POO Guides trumps Beaver Creek Land Use Regulations when it has
specific language to aspecific topic. The language of the Eagle County PUD is hazy with regards to this matter.
Commissioner Gallagher asked for a legal opinion about this matter. He then asked for the distance between the
old building envelope and what is planned for construction.
Mr. Simonton stated that there would be 18 feet of improvements as opposed to the original 28 feet proposed. The
applicant has marked out the footprint of the home in blue ribbon for the Board to see. The property drops off quite
steeply, about 25-28% beyond the envelope.
Commissioner Gallagher asked if the blue ribbons represented the 20 foot or 10 foot movement.
Rick Travers and Bob Lindell representing the applicant were present to answer questions. They stated that orange
ribbons have replaced blue ribbons, but that the blue ribbons had represented the 20 foot offset. The orange ribbons
show the current footprint with the 10 foot offset, not the 20 foot.
Mr. Simonton showed various photos and stated that letters from property owners had been received concerning
the application. Mr. Chircus had originally opposed the proposal, but has since indicated his agreement to the

negotiated proposal. Mr. Simonton told the commissioners where to find these letters in their packets, and he gave the
standards for the Board to consider when deciding whether or not to approve this proposal. It stated, "The
commissioners will approve the envelope adjustment if they find that the adjustment does not substantially impact in
an adverse manner the view corridor of any adjacent property." Staff made positive findings and recommended
approval.
Mr. Gary George, the owner of the property, spoke to the board. His comments indicated that they have tried to
work out their differences with all parties before coming to this meeting, and this was their last resort. The proposal
would not harm the other property owners and it would enhance the neighborhood. He agreed with a portion of Burt
Levin's letter of August 24th, which stated, "The Eagle County Board of Commissioners will approve the building
envelope ifit doesn't substantially impact a view corridor on any adjacent property owner." He doesn't believe that
this proposal substantially impacts any views. He also stated that the letter's reference to "a view of light and air" is
not found anywhere in the regulations. This process was started 11 months ago. The previous owner of Mr. Chircus'
home had given written consent to move the George's house 20 feet to the east. Mr. Chircus, after buying that
property, asked to move the house only 10 feet and to reduce a gable to 6 feet, from 12 feet, and the applicants agreed
to that. In January, they offered to plant additional trees, at their own expense, and asked for any other possible
solutions to resolve this matter with the other neighbors. Most of the houses had already screened off their view
corridors with trees, and the view corridors look to the East, anyway. The house is only moving 10 feet from the
original envelope. The change to the building envelope was part of a catch-22 and came after discussions with Eagle
County Staff. They have a deed restriction that will not allow any subsequent owner to build upon the property. He
then pointed out the distances between houses of the various lot owners. His house would be 141' 7" from a Mr.
Sanders' house, and Mr. Spector's house, a three-story house, is 120' 9" from Mr. Sanders' house, after the proposed
adjustment. Mr. Chircus' house is almost 100' closer to Mr. Cooks' house than the George residence would be.
Homes are allowed to be three stories tall, but they are not going to do that. Their front door will be 71' from the road;
other neighbors' doors are 80' and 70', so their house would conform to the setbacks of others in the area. The height
of the house would actually drop 2', if the proposal would be approved, and would enhance the neighbors on Borders
Road. Additional landscaping and more maneuverability for cars would also result from approval. Two impartial
staffs have looked over this proposal and have given their approval.
Bob Lindell, the architect, then spoke about the proposal. He told the Board members that this is a reinstatement
of a project from about 3 years ago called the Lomax House, with slight alterations. The deck and lower patio are
identical. The 10' change will allow for cars to turn around and gives room for planting. There is an upper deck and a
patio down below to give some views. They have twisted the building back to not encroach on the total views. The
roof overhangs and decks are considered minor encroachments, which are allowed outside of the envelope. The
existing square footage js less than the original envelope.
Rick Travers stated that these plans, including those outside of the envelope, were previously approved by the
Beaver Creek Design Review Board, as this is regularly done. They re-shifted the envelope so they wouldn't have to
come before the Board two times, but only once. There is a restriction in place to keep these exterior spaCes as exterior
spaces only, so no future owner could put livable space in that area.
Mr. Lindell spoke again how the most affected neighbor, Mr. Chircus, had given his consent to the proposal.
Mr. Travers reviewed the standard, yet again, that there must be no substantial impact of an adverse manner of a
view corridor for denial.
Mr. Lindell stated that the proposed house will be 2 stories, looking from the behind, 1 Y2 stories looking from the
road. The neighbors have 3 stories. From a massing standpoint, the applicants are allowed 35 feet and they have
planned 25 feet.
Commissioner Menconi asked what the square footage of the proposed home will be.
Mr. Lindell stated that it would be about 10,000 square feet, or a little less.
Mr. Travers showed more photos and views from various property owners' homes. These photos gave the
distances between homes and the elevation changes. He clarified that the architectural design, shown with blueprints
and windows, of Mr. Sanders' home are not facing the George residence. The view corridors are not of the George
residence. Most homes are well down slope of the proposed home. They believe that the only home impacted by this
proposal is the Chircus' residence, and the Chircus' are in support. He then addressed a letter from Mr. Levin, the
Sanders' attorney, stating that the envelope is moving 28 feet, as not being true. The Sanders' themselves, have
encroachments outside of the building envelope as well. He next addressed the 2nd argument about how the opposition
has relied on these building envelopes. The opposition, Mr. Travers pointed out, have also modified their envelopes
and they do not have a rectangular envelopes, either.
Commissioner Gallagher asked if this building envelope had been previously approved for the Lomax home.
Mr. Lindell stated that it fit within the original envelope and did not need the modifications. The minor

encroachments of the deck, etc. were still outside of the envelope, though.
Chairman Stone opened public comment.
Burt Levin, attorney for the Sanders, spoke. He stated that the building envelope application would result in the
envelope moving 28' closer to the Sanders' home, not 18'. The Sanders are looking for fairness and consistency and
don't want their investment jeopardized. The assumption in the neighborhood is that the buildings comply with the
existing envelopes. Allowing this modification would upset that balance. There are multiple views from the Sanders'
residence, not only the one view that Mr. Travers spoke of. There is more to "views" than from inside of the house,
such as being in the yard. He believes the impact is substantial, not trivial. They used to own Mr. Cook's Lot 4, but
they bought the vacant Lot 6 with an understanding that the views would not be compromised, and they followed the
building envelopes. The fact that a previous owner did not object is not significant, as regulations allow for all
interested parties to be present. Mr. Chircus is not in favor of this amendment; rather, he is neutral, based on the
wording of his letter. All houses closer as a result of the amended building envelope oppose this, while all houses that
move further away because of the amended building envelope approve it. If the commissioners don't approve the
change, the Georges get what they paid for, if approved, the Sanders will be harmed.
Rick Pylman spoke on behalf of the Sanders. He has great experience with building envelope designs, and their
function is to come up with the best design for the neighborhood, as a whole. Building envelope amendments are
common and most are for a minor encroachment of an architectural design. This is not that; this is an entire shifting of
a building envelope. This envelope, for Lot 7 (George Residence), was not placed there by accident; it was well
thought out, though it is somewhat close to the road. The current envelope gives great views, protects views of other
residences, and allows for great spatial arrangement between homes, as pointed out on a slide.
Chairman Stone asked if the slide shows the platted envelopes, rather than how the houses were actually built. He
stated that all homes seemed to have some adjustment made outside of their envelopes.
Mr. Pylman stated that the proposed patio encroachment would not be bothersome, but the upper deck would
encroach 28' from the original envelope. The existing grade is 16%, which is relatively flat in Beaver Creek terms.
With the adjustment, the grade becomes 24-36%, which is very steep. The deck and roof overhang, as proposed, will
create a sense of "looming over" for the Sanders' residence, and it does impact the Sanders' views in a major way. He
encouraged denial of the application, especially since there was an original architect plan that fit within the envelope.
Barry and Nancy Sanders, opposed to the application, spoke to the Commissioners. They felt this proposal would
be a substantial change, not a trivial one. They like the Georges and welcome them as neighbors, but don't like the
proposal. The house is for 11,012 square feet, not the 10,000 as originally stated. They bought their current home
with full awareness of the existing building envelopes and setbacks. They knew a house would be built on the
George's lot, but they figured it would be built 28' further back. The items to be built "at grade" will require the
building of a retaining wall, which will impact their views. They bought a new house and moved it to maximize
separation between houses. Their own envelope has a "funny" shape because the County created it as a result of an
unopposed application filed by the Sanders. Where there is no view, they have a hot tub area, at grade, and a circular
seating area. Though cottonwood trees have been planted, their leaves will be disappearing, eliminating the privacy.
Nancy Sanders spoke to the Board and reiterated what her husband had said. The skylight in her bathroom will
now allow the Georges to look directly into it, specifically into the bathtub.
Commissioner Menconi asked what the impact is specifically.
Mr. Sanders stated that the retaining wall and deck will loom over their house and will be the background to their
house, invading their privacy.
Commissioner Menconi asked about the amenities in place.
Mr. Sanders stated that the hot tub and sitting area are located there.
Commissioner Menconi asked ifthere was any room for negotiation or whether they only want the building within
the existing envelope.
Mr. Sanders stated he wants it within building envelope.
Commissioner Menconi asked if the Georges could get approval from the Beaver Creek DRB if the house was
built within the original envelope.
Mr. Simonton stated that the proposal would probably come back before the Board of County Commissioners
agam.
Commissioner Menconi asked if any decks are outside of the envelope.
Mr. Simonton stated that the Chircus' deck is outside the envelope.
Mr. Sanders stated that some of his decks are at grade and outside of the envelope.
John Cook, property owner, spoke to the Board. He lives in the Sanders' original home and purchased it from
them 10 years ago. Before he purchased his home, many negotiations were held with various property owners in the
area regarding envelopes, heights, and architecture, and compromises were made. When he purchased, it was done so

upon reliance of the building envelopes that existed. This proposal represents a 28 foot extension from the original
envelope. The views and spaces are in all directions and should not be confined to one direction.
Chairman Stone then closed public comment.
Mr. Lindell stated that most of the arguments are subjective and the data is not correct. He submitted a
comparison ofthe new proposal with the old Lomax proposal to the commissioners.
Chairman Stone asked if the maximum distance between the platted building envelope and the amended building
envelope was 28 feet, consisting of the building and the deck.
Mr. Travers stated yes, but the actual building would only be moved 10 feet based on the original plans. The other
18 feet comes from plans that were already approved in a prior application.
Mr. Lindell stated that the George's patio and deck are the same ones approved by the Lomax plan. The retaining
wall will only be 4 feet tall. The overhangs will only be two feet and there is one partial covering that will come out 6
feet.
Chairman Stone read from the applicant's submitted book that will be part of the official record. He then asked
about support columns for the deck.
Mr. Lindell stated there would be 3 foot stone columns that would support the deck. They go three feet above the
deck and would have metal railings between them.
Mr. Travers pointed out that the original platting did not consider the view up the steep hill; otherwise other homes
would have had their envelopes pushed back, as well. They had tried to meet with the Sanders about their concerns,
but the Sanders rebuffed all attempts. This meeting represents the first time the applicants have met with them. No
one from the objecting parties has mentioned the specific standards for denial in their arguments.
Mr. Lindell stated that the livable square footage for the George's will be 9800 feet, the deck will only be 8 feet
wide, and the patio is only 20 feet wide. Mr. Chircus' called him on his cell phone and gave his full support and was
not neutral as stated by the opposition.
Mr. George submitted and read an e-mail addressed to Mr. Levin, Mr. Pylman, Mr. Cook and the Sanders. There
was no response from any of these parties. He read from the letter about assuming the expense of planting some
additional spruce trees and coming to a binding agreement. Mr. Chircus' response to the e-mail was, "Perfect". They
already have one house in Beaver Creek that will not meet the needs for his entire family and grandkids. He stated that
Mr. Pylman mentioned that the George residence is "somewhat close to Borders Road." The Georges are trying to
conform to Borders Road by proposing the amendment to the envelope. There was a letter from the Sanders that
objected to the Lomax house in 1999.
Chairman Stone commented the building envelope changes are the most contentious arguments the Board must
face and consider. He read from a letter submitted by Mr. Levin, "The building envelope amendment will be approved
by the Eagle County Commissioners, if they find that the building envelope does not substantially impact in an adverse
manner the view corridor of any property owner to whom notice of the proposed building envelope amendment has
been sent or is required by geologic or hazard considerations." What applies at this hearing is the opposition from
neighbors; the consideration does not address to the privacy of the adjacent property owners and that seems to be the
main point of contention of the opposing parties. Both parties should have submitted the views of a building built
within the building envelope and the building built based upon the proposed modification. He surmised that there
would not be a significant change as it is not a primary view couidor. Almost every single building envelope in the
neighborhood has been changed in some manner. Building envelopes are used as a guide for building with the primary
view corridors in mind.
Commissioner Menconi had no comments.
Commissioner Gallagher generally agreed with Chairman Stone's comments. He expressed surprise that size of
the house is being mentioned as a concern.
Commissioner Menconi wanted clarification about the wording of the regulations and wondered if the Board could
ever prevent movement of a building envelope, if no one objected to the amendment.
Ms. Mauriello stated that the board will approve an amendment to the building envelope if it doesn't substantially
impact in an adverse manner the view corridor, and the board could not prevent movement, ifno one objected. If the
POO falls silent on an issue and Land Use Regulation's are not, the Land Use Regulation's are controlling. If the POO
conflicts with LUR's, the POO will rule. She confirmed that the standard that everyone had previously mentioned is
the standard that the Board must apply when making a ruling.
Commissioner Menconi asked how the Board can define "view corridor".
Ms. Mauriello stated it would be up to the Board to define it.
Mr. Simonton stated that view corridors are quite subjective and up to the discretion of the Board of County
Commissioners.
Commissioner Menconi asked about "reliance" of the building envelopes when making a purchase.

Ms. Mauriello replied that prospective purchasers look at plats and building envelopes when deciding whether or
not to purchase the property.
Commissioner Menconi asked Mr. Simonton why he recommended approval for this amendment.
Mr. Simonton stated that the judgment was based upon whether or not moving the envelope further down would
create the "looming in the sky". They were unable to determine whether a 2-story building 10 feet closer as opposed
to a 3-story building 10 feet further back would create a significant difference. The main level deck was within the
massing of the building and is lower than what the roof would have been.
Commissioner Gallagher asked to see the plat before making a motion.
Chairman Stone made comments about "reliance" on building envelopes when making a purchase. He believes
that, if this truly were the case, no amendments to building envelopes should ever be allowed.
Commissioner Gallagher is inclined to approve this plat with conditions. He asked the attorney to make an
appropriate condition and then he would be prepared to make a motion.
Commissioner Gallagher moved the Board approve File No. AFP-00194 with the following conditions, and
authorize the Chairman to sign the plat.
1. Except as otherwise modified by these conditions all material representations of the applicant in this

PROJECT DESCRIPTION
SUMMARY: Proposal for the third phase of the Recreation Tract improvements which include: [1] a
skateboard park; [2] a playground; [3] a building pad for future buildings; [4] proposed parking sub-grade
preparation and stabilized road base, as well as grading and drainage; [5] a grassed berm along the west side of
the existing synthetic soccer field; [6] sub~grade preparation and stabilized road base for roadways around the
future building pad, including storm drainage facilities; and [7] sod and seeding and an irrigation system around
the pond. The only new structure which is included in this review is a restroom facility adjacent to the
playground. Otherwise, this site specific review does not include building footprints or design. Other buildings
proposed for the site will be the subject of subsequent site specific reviews.
CHRONOLOGY:
1999 - The Eagle County Recreation Authority (whose interests were later to be transferred to Eagle
County) and the Eagle County School District (RE-50J) entered into an Intergovernmental Agreement to
develop the Berry Creek / Miller Ranch site on a joint basis.
2000 - A PUD Sketch Plan was approved by the Board of County Commissioners.
2002 - A Combined PUD Sketch / Preliminary Plan for the Berry Creek / Miller Ranch PUD was
approved by the Board of County Commissioners in March. The final plat for the Berry Creek / Miller
Ranch POO was approved in May.
2002 - Site Specific Development Plan approved for Phase I improvements on Tract C which included
[1] three multi-purpose athletic fields; [2] a passive park area to include a picnic shelter, seating and
playground apparatus; [3] landscaping, including a berm along Miller Ranch Road; and [4] drainage and
detention improvements.
2003 - Site Specific Development Plan approved for a multi-purpose pond on Tract C to provide storm
water detention, water supply for irrigation (including operational storage), recreation and aesthetics.
2003 - Site Specific Development Plan approved for Phase II of recreation field improvements,
including: [1] a natural grass softball field with a 200 foot foul line and backstop; [2] a natural grass

DISCUSSION:
Approval of this phase of improvements to the Berry Creek Recreation Tract may occur after
consideration by the Planning Commission and the Board that the development is consistent with the
PUD Guide, the PUD Preliminary Plan, the Master Circulation Plan, and the Master Drainage Plan for the
PUD.
Consistency with the PUD Guide
The PUD Guide establishes that the purpose for this Tract is to "provide sites for indoor and outdoor
recreation, including active and passive recreation areas, parking facilities, and other community-oriented

facilities." Permitted uses, specifically as they relate to this planning review file, include, among other
things: Sports fields; recreation and community centers; ball fields and hard court areas; skate parks;
parks and playgrounds; picnic areas; trails; childcare facilities; other similar indoor and outdoor recreation
facilities; and utility facilities. All of the uses proposed or contemplated in this application are uses
permitted by the PUD Guide.
The number and design of on-site parking spaces is to be established through this site specific
development review. Phase I recreation field improvements, which included three soccer fields, included
parking for 128 vehicles. The rationale was to provide spaces for 30 vehicles for participants on each of
the three fields, plus 38 additional spaces for transition times between games. A limited amount of this
parking was also required to accommodate visitors to the multi-purpose pond at the west end of the
Recreation Tract. Phase II improvements have included 80 additional spaces. The total number of parking
spaces provided prior to these Phase III improvements is 208.
Phase III improvements include sub-grade preparation and stabilized road base for an expanded parking
area and internal roadways that will provide approximately 365 parking spaces total, inclusive of the pre-
existing 208 parking spaces. A recreation center and child care facility is contemplated for this site, but
the size of these facilities has yet to be determined. The recreation center and child care facilities,
including required parking, will be the subject of subsequent reviews. Parking is adequate for the
improvements completed to date.
All of the proposed uses fall well within the dimensional limitations prescribed in the PUD Guide as it
relates to minimum setbacks (20 feet from perimeter), maximum lot coverage (buildings: 50%; all
impervious materials: 80%), and building height (45 feet).

The development occurring on this Tract IS consistent with the PUD Guide.
Consistency with the PUD Preliminary Plan
The Preliminary Plan approved for the Berry Creek / Miller Ranch PUD contemplates the development of this
Tract as a recreation site. An overall landscape plan for the Berry Creek / Miller Ranch PUD, which was
approved with the PUD Preliminary Plan, includes a streetscape/landscape plan for the Miller Ranch Road
right-of-way. Landscaping detail was shown along that part of Miller Ranch Road immediately east of its
intersection with the Edwards Spur Road, in the vicinity of the Housing Tract D, and in the vicinity of the
Berry Creek Middle School. Irrigation is proposed to be primarily by use of non-potable water. The overall
landscape plan for the Berry Creek / Miller Ranch PUD provided that landscaping and irrigation of individual
sites are to be reviewed during the site specific development review for each site. No additional landscaping
along Miller Ranch Road is proposed with the development of this Phase.
A landscape plan for the playground and skate board park is included in the application. In addition,
landscaping and irrigation is proposed for the area around the pond. Other landscaping proposed as part of
Phase III consists of planting, with temporary irrigation, of natural grasses in the area of the building pads.
The landscape plan submitted for this phase Of the recreation site development is consistent with the overall
landscape plan.
A permanent restroom facility is proposed immediately adjacent to the proposed playground. Infrastructure is
proposed for a second restroom facility adjacent to the skate park. Existing portable toilets are shown near the
southeast comer of the parking area, and an additional portable toilet is located south of the amphitheater area
adjacent to the pond.

The development occurring on this Tract IS consistent with the PUD Preliminary Plan.
Consistency with the Master Circulation Plan
The Master Circulation Plan approved as part of the PUD Preliminary Plan provides a primary access point into
the Recreation Tract near the location currently being used to access the existing parking lot. This access point is

intended to serve both the Recreation Tract to the south of Miller Ranch Road and the proposed High School
Tract to the north of Miller Ranch Road. Ultimately a single lane traffic circle is contemplated to serve both
Tracts.
A traffic study was provided for the Phase I recreation field improvements reflecting aT-intersection where the
access to the parking area for this site enters Miller Ranch Road. The traffic study indicated that the T-intersection
is sufficient to handle the traffic generated by the three recreation fields of Phase I at an "A" level of service.
Phase II improvements included additional recreation fields consisting of either two softbal1Jbaseball fields or a
fourth soccer field (depending on the configuration), and 80 additional parking spaces. The additional traffic
. generated by Phase II was not expected to generate enough traffic to warrant a traffic circle. Similarly, the
additional traffic generated as a result of Phase III is not expected to warrant construction of the traffic circle at
this time.
The Land Use Regulations require that road impact fees be collected prior to development of new traffic
generating development. Even though Eagle County is both the developer of the site and the "collector" of the
road impact fees, it is necessary to transfer the calculated fee to the appropriate road impact fee account. Road
impact fees were not paid prior to development of the multi-purpose pond, so the calculation of fees payable at
this time should reflect both the pond area and the Phase III improvements. As a condition of approval, an
appropriate road impact fee for the pond area and the Phase III improvements should be paid prior to the time
Phase III improvements are initiated.

The development occurring on this Tract IS consistent with the Master Circulation Plan.
Consistency with the Master Drainage Plan
The drainage improvements for Phase III are designed be consistent with earlier Phases, with run-off from the site
being directed to the multi-purpose pond near the west end of the Recreation Tract. The Engineering Department
has not noted any concerns with respect to the drainage plans which have been provided.
The County Engineering Department has reviewed the construction plans, and has determined that the plans
provide adequate preliminary plan level of detail that is required for this Site Specific Development Review.
Certain items identified by the County Engineer will need to be addressed and incorporated in the construction
plans. Final construction plans will need to be approved prior to issuing grading and/or building permits for the
proposed improvements.

The development occurring on this Tract IS consistent with the Master Drainage Plan.
Joe Forinash presented this file and gave a brief chronology of it. He showed several slides of the
property for the Board, stating that the application is for site specific development review for Phase III of
Recreation Tract improvements which adds: a skateboard park, playground, restroom facility, and other amenities
outlined in the Staff Report. Staff findings are all positive, and staff recommends approval with conditions.
Rich Cunningham, represented the applicant, and agreed with Mr. Forinash's comments.
Chairman Stone opened and closed public comment, as there was none.
Commissioner Menconi had no comments.
Commissioner Gallagher was concerned about the vegetation on the playground potentially providing
concealment and preventing visual parental control. He would like to see it changed to allow for more safety.
Mr. Cunningham said it is specified to be a tree and the plan may be mislabeled.
Chairman Stone asked about minimizing dust from the Recreation Center and the parking layout.
Mr. Cunningham stated that they will be seeding, mulching, and sodding it before winter and will re-seed
it in the spring. They will be changing the layout of the parking, as well.
Chairman Stone asked about plowing the lot in the winter, as it is a park and ride lot.
Mr. Cunningham showed the proposed route that ECO Transit will follow, and what Road and Bridge
will probably plow.
Chairman Stone asked about the timetable for the playground and the skate park.

Mr. Cunningham stated that construction had begun and it would take about six months to construct.
Adding in winter shutdown, the playground should be completed in July of 2005. The skate park is following the
same timetable as the playground, as this is all one contract with one contractor.
Commissioner Menconi moved the Board approve File No. PR-00025, incorporating the staff findings,
and with the following conditions:
1. An appropriate road impact fee for the pond area and the Phase III improvements shall be paid prior
to the time Phase III improvements are initiated.
2. Except as otherwise modified by these conditions, all material representations of the Applicant in this
application and in all public meetings shall be adhered to and considered conditions of approval.
Commissioner Gallagher seconded the motion. He then asked if there is a need for a condition based
upon engmeenng concerns.
Mr. Forinash stated that engineering is satisfied and believe the plan will work.
Peter Sulmeisters of the Engineering Department spoke and stated that the items in the memo are
relatively minor, more like dotting I's and crossing T's.
Chairman Stone stated for the record that all findings given in the staff report were positive.
