Earlene Roach, Liquor Inspector, presented the Liquor License Consent Agenda as follows:
A) J S & Nikko, Inc.
Tramonti at the Charter
This is a renewal of a hotel & restaurant license. This establishment is located at
the Charter on Offerson Road in Beaver Creek. There have been no complaints or
disturbances during the past year.
B) Grille at Singletree LLC
Balata
This is a renewal of a hotel & restaurant license with optional premised. This
establishment is located along Berry Creek Road in Singletree in Edwards. There
have been no complaints or disturbances during the past year.
Commissioner Menconi moved to approve the Liquor License Consent Agenda as presented.

Ms. Roach stated these applications are in order a d all fees have been paid. The maps for the
events and the alcohol management plans are attached to the Board's packets. As this applicant has held
several permits in the past and there have been no proble s, staffhas no concerns. Staff recommended
approval.
Brad Higgins, Fair and Rodeo Manager, Richard esler, Event Coordinator and Nate Nelson, in
charge of the Beer Tents, were present for the hearing.
Mr. Kesler spoke to the Commissioners about ea h event. He reviewed the events in terms of
number of years each event had taken place.
Mr. Nelson spoke to the Board about the number of people who would be serving at each event.
He assured the Board that there would be no cans or bott es sold.
Jack Ingstad, County Administrator, asked wheth r the Chamber would be selling the beer for
the July Fourth event.
Mr. Higgins stated the Chamber of Commerce d cided to not be involved with alcohol sales.
Chairman Stone asked about the plan to fence th area for the July 4th event.
Mr. Higgins stated that there would be fences, 0 on the North side of the property along the
ditch and the other will be on the northeastern side of th property where the pedestrian path is located.
The other two boundaries will be the river and on the fir works side will be where the vendors are
located so as to keep patrons out of that area. There wo ld be two entrances/ exits only.

Pier 13 Liquor, Inc.
Earlene Roach presented a transfer of ownership of a retail liquor store license for Pier 13
Liquor, Inc., d/b/a Pier 13 Liquors. She related that the applicant, Tom Domenico, is the same owner
but now will hold the license in a corporation name. Mr. Domenico and his wife Patty each own 50% of
Pier 13 Liquor Inc. This application is in order and all fees have been paid. All applicants are reported
to be of good moral character. Staff recommended approval.
Tom Domenico, applicant was present for the hearing.
Commissioner Menconi moved the Board approve a transfer of ownership of a retail liquor store
license for Pier 13 Liquor, Inc., d/b/a Pier 13 Liquors.
Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared
unanImous.
EI Jebel Convenience Store
Mr. Treu stated the next two items on the agenda area first is a show cause and the
second will be the renewal ofthe 3.2% Off Premise Beer License for EI Jebe1 LLC, d/b/a EI Jebel
Convenience Store.
Earlene Roach stated this was a show cause hearing due to a sting operation performed by the
Sheriff s Office. Ms. Roach informed the Board that the show cause hearing would consist of the
penalty phase only. In 2003 an alcohol task force was formed and a letter was sent to all establishments
that this task force would be performing underage compliance checks. On January 29,2004 the sting
operation took place. The applicant sold alcohol to the confidential informant and identification was not
asked for.
David See, Director of Operations for EI Jebel LLC, was present for the hearing. He stated he
understands the seriousness of the violation and that it should not have happened. He assured the Board
that steps would be taken to avoid this type of occurrence in the future. He stated that liquor sales are
minimal at that location and it appears that his staff was not taking the consequences seriously.
Chairman Stone asked for specific ways that the applicant would address the situation.
Mr. See stated that he would insure that they would be committed to getting all oftheir people
through courses available through the County, or TIPS training courses.
Commissioner Menconi inquired as to days of violation being held over a Sunday.
Ms. Roach stated that the days run sequentially and that if it is a 15 day suspension one of the
days would be a Sunday.
Commissioner Menconi commended Mr. See for recognizing their responsibility and the course
of action that he proposed taking to eliminate the possibility of this happening again. He also suggested
that the organization implement a policy of immediate termination for employees who sell to a minor.
Ms. Roach stated that sting operations had been done in the past and she was unaware of whether
E1 Jebe1 Convenience store had been included.
Bryan Treu, Assistant County Attorney, stated that EI Jebel was the only unincorporated store
that sold to a minor during this particular operation.
Chairman Stone asked what type of latitude was available for requiring a written policy
regarding this type of situation in the future. He stated that the penalty is not as important as rectifying
the situation. In the past the penalties didn't seem to be effective. He inquired as to requiring a written
policy that each employee would sign with the knowledge that ifthis happened to any of them they
would immediately be terminated. If this type of agreement was signed and in the file of the operator it
would be beneficial to prove that attempts were made in the past to solve the problem.

Mr. Treu stated that this type of requirement was easonable and could be placed as a condition
on future renewals.
Chairman Stone asked if Ms. Roach had ideas as what had worked in the past. He wondered
if the County had an alcohol management plan.
Ms. Roach stated that the County did not have su h a document. She stated that other ideas
included putting stickers on paychecks, regular staffmee ings to discuss the situation and employee's
liability. It is really up to the applicant to present ideas a to how to manage the situation.
Commissioner Menconi asked Ms. Roach to pres nt examples to future applicants of great
alcohol management plans for them to use as examples.
Ms. Roach stated that new applicants are provide with these examples.
Chairman Stone asked the applicant what he wou d like to offer in terms of written suggestions.
Mr. See stated that he operates a fairly small oper tion. He didn't feel that it would take very
long to get everyone TIPS trained. He agreed to a writte and signed policy for his staff. He also
suggested that this be re-signed after each review. He co mitted to TIPS training completion for all
staff within 60 days.
Chairman Stone asked that Mr. See provide a cop to Ms. Roach ofthese forms after they are
signed. He also asked Mr. See to provide a commitment 'n writing about the TIPS training timeline.
Commissioner Menconi moved based on the stip lation signed by the applicant on March 3,
2004, the Board find there was a violation of the Colorad Liquor Code, section 12-47-901(1)(a), sale of
alcohol to a minor, and suspend the 3.2% off premise be r license for EI Jebel LLC, d/b/a EI Jebel
Convenience Store for a period of 15 days, holding 10 0 those days in abeyance for a period of one
year. He also moved the Board direct the license holder 0 prepare and submit a written liquor policy to
be acknowledged by each individual employee in a form acceptable to Eagle County within sixty days.
The Board shall direct the license holder to ensure that al employees who sell alcohol are server trained
within sixty days.
Chairman Stone seconded the motion. Of the tw voting commissioners the vote was declared
unanImous.
El Jebel Convenience Store
Earlene Roach presented a renewal of a 3.2% Of Premise Beer License for EI Jebel LLC, d/b/a
EI Jebel Convenience Store.
Commissioner Menconi moved to approve the ap lication for renewal of the 3.2% Off Premise
Beer License for EI Jebel LLC, d/b/a EI Jebel Convenie e Store.

Chairman Stone stated that he had received numerous letters regarding this file and inquired as to
whether the applicant had been receiving copies ofthese letters.
Mr. Forinash informed Chairman Stone that this was the case.
AFP-00187 Berry Creek Ranch
Jena Skinner-Markowitz, Planner, presented file number AFP-00187, Berry Creek Ranch. She
stated the intent of this project is to modify three main elements of the previous plat: 1) To reconfigure
the common, side lot lines and utility and drainage easements between Lots 33 & 32 and Lots 33 & 34;
2) To relocate and/or vacate portions of the previously platted 15' wide access, utility and drainage
easement, and; 3) To create a temporary construction easement on Lot 32 (for the benefit of Lot 33).
These modifications are proposed in order to accommodate the expansion of the existing home (see
attached). All three lots are owned by the same owners. The temporary construction easement will
expire January 1, 2005 or upon completion of said construction, whichever comes first pursuant to
General Note 8.
Pursuant to Section 5-290.G.3. Standards for Amended Final Plat:
a. Adjacent property. Review of the Amended Final Plat has determined that the proposed
amendment DOES NOT have an adverse effect on adjacent property owners. All adjacent property
owners were notified for this file. No responses were received from the following adjacent property
owners, as supplied by the applicant: William S. Silvers, Susan Toni Berns, Steve N. & Kathryn Haber
and Dorothy H. Gardner QPR Trust: John R. Gardner and the BLM
b. Final Plat Consistency. Review ofthe Amended Final Plat has determined that the proposed
amendment IS NOT inconsistent with the intent of the Final Plat. The three lots will remain residential
as intended. Permission from the owners of the utility easements, necessary to relocate and/or modify

Bob Narracci, Planning Manager, made a present tion to the Board. He highlighted the intent of
the amended final plat. The other item that would be tak n care of is the temporary construction
easement and an access easement. The property is locate at the northern end of the Singletree
subdivision. He showed a map of the proposed area. He also showed a photo of the existing home.
Grant Herzog and Brian Johnson with Contract 0 e were present for the hearing.
Chairman Stone asked if the applicants had any i tent of building on lots 32 or 34.
Mr. Herzoz stated that the owner was not willing 0 forego future development possibilities. He
stated that the owner is aware that he is making it more d fficult to build on the lots in the future. He
stated that the owner was not willing to forego future dev lopment possibilities.
Commissioner Menconi moved the Board of Cou ty Commissioners approve File No. AFP-
00187, Berry Creek Ranch, incorporating the findings an authorize the Chairman to sign the plat.
