Mr. Nelson spoke to the Board about the number of people who would be serving at each event. He assured the Board that there would be no cans or bott es sold. Earlene Roach presented a transfer of ownership of a retail liquor store license for Pier 13 Liquor, Inc., d/b/a Pier 13 Liquors. She related that the applicant, Tom Domenico, is the same owner but now will hold the license in a corporation name. Mr. Domenico and his wife Patty each own 50% of Pier 13 Liquor Inc. This application is in order and all fees have been paid. All applicants are reported to be of good moral character. Staff recommended approval. Tom Domenico, applicant was present for the hearing. Commissioner Menconi moved the Board approve a transfer of ownership of a retail liquor store license for Pier 13 Liquor, Inc., d/b/a Pier 13 Liquors. Chairman Stone seconded the motion. EI Jebel Convenience Store Mr. Treu stated the next two items on the agenda area first is a show cause and the second will be the renewal ofthe 3.2% Off Premise Beer License for EI Jebe1 LLC, d/b/a EI Jebel Convenience Store. Earlene Roach stated this was a show cause hearing due to a sting operation performed by the Sheriff s Office. Ms. Roach informed the Board that the show cause hearing would consist of the penalty phase only. In 2003 an alcohol task force was formed and a letter was sent to all establishments that this task force would be performing underage compliance checks. On January 29,2004 the sting operation took place. The applicant sold alcohol to the confidential informant and identification was not asked for. David See, Director of Operations for EI Jebel LLC, was present for the hearing. He stated he understands the seriousness of the violation and that it should not have happened. He assured the Board that steps would be taken to avoid this type of occurrence in the future. He stated that liquor sales are minimal at that location and it appears that his staff was not taking the consequences seriously. Chairman Stone asked for specific ways that the applicant would address the situation. Mr. See stated that he would insure that they would be committed to getting all oftheir people through courses available through the County, or TIPS training courses. Commissioner Menconi inquired as to days of violation being held over a Sunday. Ms. Roach stated that the days run sequentially and that if it is a 15 day suspension one of the days would be a Sunday. Commissioner Menconi commended Mr. See for recognizing their responsibility and the course of action that he proposed taking to eliminate the possibility of this happening again. He also suggested that the organization implement a policy of immediate termination for employees who sell to a minor. Ms. Roach stated that sting operations had been done in the past and she was unaware of whether E1 Jebe1 Convenience store had been included. Bryan Treu, Assistant County Attorney, stated that EI Jebel was the only unincorporated store that sold to a minor during this particular operation. Chairman Stone asked what type of latitude was available for requiring a written policy regarding this type of situation in the future. He stated that the penalty is not as important as rectifying the situation. In the past the penalties didn't seem to be effective. He inquired as to requiring a written policy that each employee would sign with the knowledge that ifthis happened to any of them they would immediately be terminated. If this type of agreement was signed and in the file of the operator it would be beneficial to prove that attempts were made in the past to solve the problem. 20 03-09-04 Mr. Treu stated that this type of requirement was easonable and could be placed as a condition on future renewals. Chairman Stone asked if Ms. Roach had ideas as what had worked in the past. He wondered if the County had an alcohol management plan. Ms. Roach stated that the County did not have su h a document. She stated that other ideas included putting stickers on paychecks, regular staffmee ings to discuss the situation and employee's liability. It is really up to the applicant to present ideas a to how to manage the situation. Commissioner Menconi asked Ms. Roach to pres nt examples to future applicants of great alcohol management plans for them to use as examples. Ms. Roach stated that new applicants are provide with these examples. Chairman Stone asked the applicant what he wou d like to offer in terms of written suggestions. Mr. See stated that he operates a fairly small oper tion. He didn't feel that it would take very long to get everyone TIPS trained. He agreed to a writte and signed policy for his staff. He also suggested that this be re-signed after each review. He co mitted to TIPS training completion for all staff within 60 days. Chairman Stone asked that Mr. See provide a cop to Ms. Roach ofthese forms after they are signed. He also asked Mr. See to provide a commitment 'n writing about the TIPS training timeline. Commissioner Menconi moved based on the stip lation signed by the applicant on March 3, 2004, the Board find there was a violation of the Colorad Liquor Code, section 12-47-901(1)(a), sale of alcohol to a minor, and suspend the 3.2% off premise be r license for EI Jebel LLC, d/b/a EI Jebel Convenience Store for a period of 15 days, holding 10 0 those days in abeyance for a period of one year. He also moved the Board direct the license holder 0 prepare and submit a written liquor policy to be acknowledged by each individual employee in a form acceptable to Eagle County within sixty days. She stated the intent of this project is to modify three main elements of the previous plat: 1) To reconfigure the common, side lot lines and utility and drainage easements between Lots 33 & 32 and Lots 33 & 34; 2) To relocate and/or vacate portions of the previously platted 15' wide access, utility and drainage easement, and; 3) To create a temporary construction easement on Lot 32 (for the benefit of Lot 33). These modifications are proposed in order to accommodate the expansion of the existing home (see attached). All three lots are owned by the same owners. The temporary construction easement will expire January 1, 2005 or upon completion of said construction, whichever comes first pursuant to General Note 8. Pursuant to Section 5-290.G.3.
