Executive Session
Chairman Pro-tern Gallagher stated the first matter before the Board is an Executive Session.
Commissioner Stone moved that the Board go into Executive Session for the purpose of
receiving legal advice on pending litigation and for the purpose of instructing negotiators concerning
settlement of two water court cases involving Kummer Development Corporation Case Nos. 99 CW 242
and 99CW 243 and for the purpose of providing direction to negotiators concerning pending or potential
litigation in the form of water court applications, specifically CWCB Instream Flows, Eagle Park
Reservoir Company Exchange PIan, Buchholz Change of Rights, Colorado Springs Exchanges and
Gypsum Agumentation and Exchange Plan, Wolford Mountain Reservoir Enlargement Application and
for the purpose of discussing negotiations with Berry Creek LLC concerning its Development
Agreement with Eagle County all of which are appropriate topics for discussion pursuant to C.R.S. 24-6-
402(4)(b) and (e).
Commissioner Menconi seconded the motion. The vote was declared unanimous.

Adoption, Revised Airport Master Plan
Rich Cunningham, Director of Facilities Management, requested the Board approve the revised
Airport Master Plan. He stated there are a couple of minor corrections, the first item was referral to the
west runway and it should be west runway extension. He requested the Board approve the revised
Master Plan and direct staff to make the necessary corrections. He stated this document makes reference
to the Capital Improvements Program to the Airport. He suggested the Capital Improvements Program
be brought back to the Board for approval at a later date.
Chairman Pro-tern Gallagher asked if there was a time issue with the Airport Master Plan.
Mr. Cunningham stated it must be submitted to the FAA as soon as possible to continue with the
environmental assessment.
Chairman Pro-tern Gallagher stated this plan was sent to an outside entity and a peer review was
performed and these corrections were not caught.
Jack Ingstad, County Administrator, stated the corrections are minor. They refer to it as a stop
way and the County refers to it as an extension. He stated there have been a lot of changes since the last
Capital Improvement Plan and it is important to get all items on the list.
Chairman Pro-tern Gallagher asked if that can be done in house.

Mr. Cunningham stated they will just have an amendment sheet on the front.
Mr. Ingstad stated this Master Plan is probably outdated and a new process will be started in the
near future.

ZS-OOIII AT&T at Lake Christine Wilderness
Jena Skinner-Markowitz presented file number ZS-OOIII, AT & T at Lake Christine Wilderness.
She stated the applicant desires to add new equipment for AT&T on an existing Low Power Wireless
Telecommunications Facility located on the Public Service/Excel Energy Lake Christine Wilderness
property, near Basalt. The Telecommunications Facility, built in 1979, currently contains several
Carrier's equipment on the tower. The Special Use Permit for AT&T (ZS-354-1994) specified the type
and number of antennas; the current Special Use limits AT&T to four antennas. Due to this specificity,
it is necessary to "amend" the existing Special Use.
The original Special Use Permit limits AT&T to four (4) omni whip antennas. Two of those will
be removed, and six (6) panel antennas will be added to the tower.
The chronology ofthe application is as follows and as shown on staffreport:
1979 - The one acre site was transferred from the State ofColorado to Colorado-Ute Electric
Association solely for use as a telecommunications facility site.
1992 - Along with all existing improvements, the site was transferred to Public Service Company
of Colorado and Tri-State Generation and Transmission Association et alia. The basic Public Service
tower consists of a 62 foot steel tower with a solar panel, 7 foot dish and one 9 foot dish attached at 23
feet above ground.
1994 - Cellular One Telecommunications, now AT&T, added the top 4 omni-directional whip
antennas, and a prefabricated 32' x 12' fiberglass building adjacent to the base of the tower.

2000 - VoiceStream was approved to place additional equipment on the tower consisting of9
panel antennas grouped in three groups of3, and an independent pole with 2 microwave dishes; this was
part of a separate Special Use Permit (ZS-00058).
The Planning Commission overall, had no issue with the proposed application, as long as Staffs
conditions were incorporated as part of the recommendation. The Planning Commission recommended
unanimous approval of this proposal.
Referral responses are as shown on staff report and as follows:
Colorado Division of Wildlife, memo dated December 12,2003
Staff has reviewed the project and it should have minimal, if any, impacts to wildlife.
There is one important aspect:
AT&T has the right of way access agreement from CDOW to access the privately owned facility.
This agreement has restrictions concerning access dates for the protection of wildlife and so as to
not interfere with hunting on this property.
AT &T is restricted to the third Wednesday of April, May, June, July and August of each year for
normal maintenance, upgrades, inspections, etc.
Unless a different arrangement is made with Wildlife Manager Pat Tucker, this project must be
completed within the agreed upon schedule.

Due to scheduling, the Basalt Planning Department will respond on behalf of the Planning and
Zoning Commission.
The application submittal reflects no new site impacts and very limited, if any, visual changes to
the installation. Maintaining consistency with those representations is considered critical.
Coordination with CDOW and their regulations including winter closures within the Lake
Christine Wilderness Area needs to be assured.
Should site inspections indicate conditions that warrant further environmental mitigation such as
revegetation, weed control, or erosion prevention measures, requiring said mitigation as a condition of
this permit is recommended.

Matt Butler, AFL Telecommunication representing the applicant, stated there is a need for
additional equipment to expand telephone service due to the explosion of wireless phone service. A.T.
& T. has had a lot of growth in this field and need to expand their services. He requested the Board
approve the request.
Chairman Pro-tern Gallagher asked about lights on the tower.
Ms. Skinner-Markowitz stated there are currently no lights and it will not be possible to have
lights with the new height.
Chairman Pro-tern Gallagher asked about ten feet above the building as a limitation. He stated
there are already antenna's over that height on the building.
Ms. Skinner stated those came from the original special use permit. Condition number six is for
the building only.
Chairman Pro-tern Gallagher stated it is his understanding that this is pre-approving any
equipment the applicant wants to put on the tower.
Ms. Skinner-Markowitz stated this was a concern on the original special use permit and this was
carried over from 1994.
Mr. Butler stated the carriers would like to have flexibility in case the tower gets overloaded
and additional equipment must be added.
Chairman Pro-tern Gallagher asked about the dimension on the lower side of the tower.
Mr. Butler stated the shelters are normally ten feet in height.
Chairman Pro-tern Gallagher stated this states that the applicant may put a 12 foot dish on top of
the building.
Ms. Skinner-Markowitz stated the applicant must let staff know what they are planning and
staff will decide if additional approval is necessary.
Ms. Mauriello stated the applicant may add additional communication equipment within the
perimeters that have been set. The Board can attach conditions as they see fit if they are uncomfortable
with the current conditions.
Commissioner Menconi asked about the impacts and Chairman Pro-tern Gallagher's concerns.
Chairman Pro-tern Gallagher stated he is concerned with giving approval for something they
have not yet seen.
Mr. Butler stated he does not have a problem with revising the conditions on the special use
reVIew.
Ms. Mauriello recommended "any additional communication equipment (antennas, satellite
dishes, etc.) shall require necessary approvals to be obtained from the Division of Wildlife for facility
expansion and any necessary permits must be obtained from Eagle County.
Commissioner Menconi moved the Board of County Commissioners approve file number ZS-
00111 , AT & T at Lake Christine Wilderness, incorporating the staff findings, and with the following
conditions:
1. Except as otherwise modified by this Permit, all material representations made by the
Applicant in this application and in public meeting shall be adhered to and considered conditions of
approval.
2. Applicant (AT&T) shall notify the Community Development Director when altering or
modifying equipment on the Telecommunications Facility. Notification shall include both a written
description and detailed plans showing equipment on the tower, as well as any modifications to the
equipment shelter. Any increase in the height of the tower, or expansion of the equipment shelter, will
necessitate a new Special Use Permit.
3. All equipment shall be painted to blend in with the surrounding landscape.

4. Applicant must comply with all requirements of the Colorado Division of Wildlife regarding
access and seasonal restrictions.
5. There shall be no lighting of the proposed additions to the site.
6. Any additional communication equipment (antennas, satellite dishes, etc.) shall require
necessary approvals to be obtained from the Division of Wildlife for facility expansion and any
necessary permits must be obtained from Eagle County.
7. Following any construction/installation activities any disturbed areas shall be reseeded with a
seed mix approved by the Colorado Division of Wildlife.
8. Applicant shall make application for and receive all of the appropriate permits (building,
electrical, etc.) from Eagle County prior to any construction/installation activity on the site.
9. All storage of materials shall be within a building or obscured by a fence.
Chairman Pro-tern Gallagher seconded the motion. Of the two voting Commissioners the vote
was declared unanimous.
There being no further business to be brought before the Board the meeting was adjourned until
February 10,2004.
