discussing potential purchase and acquisition of land in the town of Eagle for future Justice Center
Expansion and for receiving legal advice on potential art displays at the Airport and negotiation of

Chairman Gallagher asked the Attorney's Office if there were any changes to the Consent
Agenda.
Diane Mauriello, County Attorney, stated there are several items to be pulled, item G,
Agreement between Eagle County and Donald Bisset, item P, Agreement between Eagle County and
Tina Fleishman, and item Y, Agreement between Eagle County and Anderson Western Colorado
Camps, Ltd. She stated they are waiting for signed documents to be returned. Ms. Mauriello stated
finally item JJ, Eighth Amendment to Fixed Base Operator Concession and Lease Agreement between
the County of Eagle, State of Colorado and Vail Valley Jet Center needs a revision to Exhibit B in that
document.
Commissioner Menconi moved to approve the Consent Agenda as presented items A through
KK, removing items G, P, Y and JJ.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Plat and Resolution Signing
Cliff Simonton, Planner, presented the following plats and resolutions for the Board's
consideration:
5MB-00328, Berry Creek Ranch, Filing 4, Block 5, Lot 26. He stated this was a
Minor Type B Subdivision, the purpose of which is to create two Yz duplex lots, Lot 26A and Lot 26B,
and an access easement. Staff findings are as follows:

a. Access, Water and Sewage. The adequacy of access, potable water, and sewage
disposal on the land to be subdivided;
b. Conformance with Final Plat Requirements. Its conformance with the Final Plat
requirements and other applicable regulations, policies, standards, and guidelines;
c. Improvements Agreements. The adequacy of the proposed Improvements
Agreement, where applicable.
Commissioner Stone moved to approve final plat file number 5MB-00328, Berry Creek Ranch,
Filing 4, Block 5, Lot 26. incorporating staff findings.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Resolution 2004-003, Denying Approval of the Edwards Storage Facility Planned
Unit Development Sketch Plan, File No. PDS-00036. The Board considered the Applicant's request
on November 4th, 2003.
Commissioner Menconi moved to approve Resolution 2004-003, denying approval of the
Edwards Storage Facility PUD Sketch Plan, file number PDS-00036.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Resolution 2004-004, To Approve a Zone Change and the Planned Unit
Development Combined Sketch / Preliminary Plan for the McCoy Springs at Arrowhead Planned
Unit Development, Files No. ZC-00063 and PDSP-00018. The Board considered the Applicant's
request on November 18th, 2003.
Commissioner Stone moved to approve Resolution 2004-004, to approve a zone change and the
PUD combined Sketch and Preliminary Plan for the McCoy Springs at Arrowhead PUD, file numbers
ZC-00063 and PDSP-00018.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Resolution 2004-005, To Approve PUD Amendments for the Riverwalk at Edwards
Planned Unit Development Control Guide, File No. PDA-00046. The Board considered the
Applicant's request on December 9th, 2003.
Commissioner Menconi moved to approve Resolution 2004-005, to approve PUD Amendments
for the Riverwalk at Edwards PUD Control Guide, file number PDA-00046.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Resolution 2004-006, Designation of Official Legal Newspaper
Diane Mauriello presented Resolution 2004-006, concerning designation of the Official Legal
Newspaper for Eagle County. She stated this resolution designates the Eagle Valley Enterprise as the
legal newspaper for 2004. She stated bid proposals were sent to the Vail Daily, Enterprise and Vail
Trail. The bid submitted from the Enterprise met Statutory requirements.
Commissioner Stone asked about the increase in advertising costs.
Jack Ingstad, County Administrator, stated they had asked the applicant to be present at this
meeting but after discussing the bid, the applicant related there was a mistake in the submitted figures.
They made an adjustment to the rates. He stated after the adjustments staffrelated the applicant did not
need to be present.
Chairman Gallagher asked if there was a monopoly. He asked if the Vail Trail qualified.
Commissioner Stone stated they do not qualify because of the format of the newspaper and they
do not sell they papers and do not qualify for that certain class of mailings.
Commissioner Stone moved to approve Resolution 2004-006, designation of the Official Legal
Newspaper for Eagle County as the Eagle Valley Enterprise.
Commissioner Menconi seconded the motion. The vote was declared unanimous.

Final Settlement - GMCO Corporation
Diane Mauriello presented final settlement with GMCO Corporation for supplying magnesium
chloride. She stated this matter was published and no claims have been received.
Commissioner Menconi moved to approve final settlement with GMCO Corporation as
presented.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Final Settlement - Kolbe Striping
Diane Mauriello presented final settlement with Kolbe Striping for centerline marking project.
She stated this matter was published and no claims have been received.
Commissioner Stone moved to approve final settlement with Kolbe Striping as presented.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Final Settlement - Gonzales Construction Co., Inc.
Diane Mauriello presented final settlement with Gonzales Construction Co., Inc. for guardrail
project. She stated this matter was published and no claims have been received.
Commissioner Menconi moved to approve final settlement with Gonzales Construction Co, Inc.
as presented.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Increase Colorado Department of Housing Lending Limits
KT Gazunis, Director of Housing, stated the next matter is an increase in the Colorado
Department of Housing Spending Limits for the Down Payment Assistance Program. She stated these
are the funds that are received in a grant from the State of Colorado and are for those individuals that
make the 80% or lower from the HUD published median income. It is used for those that apply for the
local funds. The local funds cap has been $10,000.00 and the State funds have been $10,000. The State
is increasing their funds to $11,700.00 or 4.5% of the purchase price of the home, whichever is lower.
Chairman Gallagher asked about the poverty level.
Ms. Gazunis stated 80% of the HUD pub Ii shed median income.
Chairman Gallagher asked if this has the blessing of the Advisory Board.
Ms. Gazunis stated it does.
Commissioner Menconi moved to approve the increase of the CDOH lending limits to
$11,700.00 or 4.5% of the cost of the house, whichever is lower.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Permit, Colorado Department of Housing
KT Gazunis stated the next matter is a Permit from the Colorado Department of Housing for the
Down Payment Assistance at Miller Ranch. She stated in the past the Board has related they did not
want to use the Down Payment Assistance Funds at Miller Ranch. However, the Colorado Division of
Housing assistance funds are not local monies. She stated the Homebuyers Assistance Committee
would like the Board to make those funds available at Miller Ranch. She stated at 6% interest the 80%
median income families could afford millloft and townhomes at Miller Ranch.
Chairman Gallagher stated some of the Down Payment Assistance funds have been County
momes.

Ms. Gazunis stated there has been a general fund allocation and there is an identified line item in
the housing fund that the money is lent to people to purchase homes. In the past it has been around
$100,000.00 to $150,000.00. One year they borrowed money from the Road & Bridge Fund. That has
been local money. In addition to that they write to the State Division of Housing and have been awarded
pass through funds that are given specifically to people who are 80% or lower. They have been
matching the local funds against State funds. The Commissioners have indicated they did not want the
local funds to go to Miller Ranch.
Commissioner Stone moved to permit the Colorado Department of Housing Down Payment
Assistance monies to be made available at Miller Ranch.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Commissioner Stone asked about the additional monies the President is allowing for this
program.
Ms. Gazunis stated she will be able to update the Board at the end of next week.
AFP-00179 Watson Rural Homesite
Joseph Forinash, Planner, presented file number AFP-00079. Watson Rural Homesite. He stated
this was an amended final plat for the purpose of removing a plat note which reads "This parcel will not
be sold to create a separate house site until such time Eagle County amends this plat" and allow the
owners to sell the subject parcel.
This parcel was created under a temporary provision (expired in 1984) ofthe Land Use
Regulations which allowed the creation of "rural homesites" (minimum of2 acres) under certain
conditions for the purpose of allowing ranchers to provide home sites for their children. Staff has
thoroughly reviewed the related files and Planning Commission and Board minutes and has been unable
to determine the reason the restrictive plat note was included on the earlier plat. The site has legal water
well. The owner will need to demonstrate prior to issuance of a building permit that any soil conditions
have been properly reflected in building design and that an adequate septic system will be provided.
Staffhas determined that the restrictive plat note may be removed without any detrimental effects.
The chronology of the file is as follows and as shown on staff report:

Barbara and John Watson, applicants, were present for the hearing.
Ms. Watson stated they owned three sides of the property. She stated they are asking that they
be allowed to sell the middle portion of the property.
Chairman Gallagher asked if there were other parcels that have the same plat note.
Mr. Forinash answered no.
Commissioner Stone asked if this was a legal non-conforming lot.
Mr. Forinash answered yes.
Commissioner Stone moved the Board approve File No. AFP-00179, Watson Rural Homesite,
incorporating the Staff findings, and authorize the Chairman to sign the plat.
Chairman Gallagher seconded the motion. Of the two voting Commissioners the vote was
declared unanimous. Commissioner Menconi was not able to attend the afternoon session due to a
seminar on taxes.
AFP-00173 Hardscrabble Creek Subdivision
Joseph Forinash presented file number AFP-OOI73. Hardscrabble Creek Subdivision. He stated
this was an amended final plat for the purpose of deleting the existing building envelope which is too
close to the property line to allow a septic system to work properly, and creating a new building
envelope of the same size in a more appropriate location.
The chronology ofthe files is as shown on staff report and as follows:
1981 Final plat for hardscrabble Creek Subdivision approved, creating Lot 25.
