Executive Session
Chairman Gallagher stated the first matter before the Board was an Executive Session.
Commissioner Stone moved that the Board adjourn into Executive Session for the purpose of
receiving legal advice on specific legal questions concerning Eagle County's ownership of Eagle Park
Reservoir Company Shares and for the purpose of receiving legal advice concerning Bolts Lake
Reservoir and finally for the purpose of discussing pending litigation between Eagle County and
Remonov & Co. all of which are appropriate topics for discussion pursuant to c.R.S. 24-6-402(4) (b)
and (e).
Commissioner Menconi seconded the motion. The vote was declared unanimous.

Ray's
Earlene Roach presented a new application for a hotel & restaurant license for Ray's X Bar Fly,
Inc., d/b/a Ray's. The first order of business is to establish the neighborhood and then the needs ofthat
neighborhood. Staff recommends the neighborhood be from the 1-70 Interchange, south along Edwards
Access Road, spreading east and west to include Riverwalk Subdivision, Riverfront Subdivision, South
40 Subdivision and Edwards Village Center and Homestead Subdivision.
Commissioner Stone moved the Board establish the neighborhood "as from the 1-70 Interchange,

concerns with this application. All applicants are reported to be of good moral character. Staff

Chairman Gallagher asked if staff has reviewed the alcohol management plan.
Ms. Roach answered yes. She stated that Mr. Mueller also owns Sato Sushi in Edwards and she
does not have any problems with that establishment. She has no concerns with this new application.

Employee Lottery to Rent the McCoy House (36 Mile House)
Carla Budd, Director of Human Resources, stated the next matter before the Board the employee
lottery to rent the McCoy House. Ms. Budd stated there is only one name who wants to rent this house.
Kelsey McCoy is the winner of the lottery for rental of the McCoy House.
Letter of Support, Kobe Bryant Issue
Jack Ingstad, County Administrator, requested the Board authorize the Chairman to sign a letter
on behalf of the Board of County Commissioners, to the District Court, supporting the request from the
media in the Bryant matter. The request would allow the press and their vehicles to park in the upper
parking lot newly constructed at the Justice Center. He stated the Judge is considering the request
Thursday or Friday. The parking would start in December because the Gallegos lot is being used until
then. He also requested having the Attorneys look at if it is appropriate to file legal papers. He stated he
believes they do have the right to file those because he is specifically named in the decorum order.

Chairman Gallagher asked if they are planning on joining the press in their request.
Ms. Mauriello stated it is simply a request for the court to amend its order that they be able to
relocate and manage the press through the upper parking lot.
Chairman Gallagher asked if the press was going to be charged for the use of the lot.
Mr. Ingstad stated the intent would be to charge for power, telephone lines and those type things
and not the use of this public lot. He recommended they not charge for renting the lot.
The Board concurred.
Abatement Hearings
Jon Harrison, Assessor's Office, presented a petition for abatement for John K. Skeen schedule
No. R028819. Mr. Harrison stated the property was appealed at the Assessor level in May 2003. It was
found that a clerical error occurred when the improvement square footage was incorrectly entered at the
time the home was completed. A new drawing from plans as well as a site inspection June 3, 2003 was
performed. Data corrections to the property record have been completed and are now reflected in the
2003 record. Pursuant to CRS 30-10-114, it is the recommendation of the Assessor's Office that this
abatement be granted for the 2001 and 2002 tax years as follows:
2001 - the original assessed value was $807,190 with a tax amount of$55,266.68, with an
abatement of$188,770 assessed value with a tax amount of$12, 924.70, leaving a balance of$6l8,420
assessed value with a tax amount of $42,341.98.
2002 - the original assessed value was $807,190 with a tax amount of$56,530.76 with an
abatement of$188,770 assessed value with a tax amount of $ 13,220.34, leaving a balance of
$618,420.00 with a tax amount of$43,310.42.
Commissioner Stone moved to approve the abatement for schedule number R028819, John K.
Skeen as presented.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Mr. Harrison presented petitions for abatement for SK Realty LLC, schedule numbers R048005
and R048007. He stated for schedule R048005, the value given to the subject property is supported by
the sales from the appropriate time period. The subject property is located in the Lodge at Brookside
Condominium Complex and does not possess a river view which may affect the value ofthe property.
The sales date sheet includes three sales from the subject complex which also do not possess river views.
The Assessor recommended this abatement be denied.
Schedule R048007, the comparable sales for the time period in question support the value given
for the 2002 tax year. The sales for the time period of the 2003 reappraisal support the lowered market
value. Pursuant to CRS 39-1-104 this abatement should be denied.
Stewart Kleinman, petitioner, stated he disagrees and felt there was room for compromise.
Considering the assessment is $50,000.00 more than what he purchased the unit for in 2001, he does not
believe it is fair.
Chairman Gallagher stated they must deal in real statistics.
Mr. Harrison stated they used comparable sales for the 2001 and 2003 values. He stated he listed
sales as an example and based their appraisal on sales in the same complex. He stated he would be glad
to share any information with the petitioner. He stated the misunderstanding is with the sales they used.
By Statute they must use sales from 1999 and the first half of2000.
Mr. Kleinman stated he does not believe he can negotiate a purchase of $50,000.00 less than the
appraised value. He believes the values should be fair and reasonable.
Chairman Gallagher stated the Statutes do not give the Board the option to set the value at what
was paid for the property. It is not something they can use.
Mr. Harrison stated the sale that occurred in 2001 for the property is germaine to the value they
set and they will certainly consider that sale for future years but cannot consider it for this time frame.

Commissioner Menconi stated if he looks back to one of the submitted charts they show three
sales and it seems the comps were from Brookside and were also units that were not facing the river.
Mr. Harrison stated that was correct.
Commissioner Menconi asked about the square footage of the units. If there are three units in
the complex with the same square footage and none of them have a river view, they would come out
with an appraisal of $360,000.00. Mr. Kleinman's unit is appraised less than that.
Mr. Kleinman asked about other step or options. It does not seem right that you buy something
for one price and you have to pay taxes on a higher value.
Commissioner Menconi stated in looking at other scenario's he apologized to the petitioner but
they are held by Statute as to what the appraisal can be.
Mr. Kleinman stated it does not seem right and does not seem fair.
Mr. Harrison stated the real issue of contention is that they are looking at a 2001 sale and the
Assessor's Office can only look at sales from 1999 and 2000.
Mr. Kleinman used a comparable of buying stock and you would not purchase that stock if they
had to use previous values.
Chairman Gallagher stated the County is a slave to state law and must do appraisals on how the
State of Colorado tells them to.
Mr. Harrison stated the value of properties in Eagle County have been going up every year.
State Statute usually favors the petitioner.
Commissioner Menconi moved to deny schedule numbers R048005 and R048007 as
recommended by the Assessor.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Jon Harrison presented a petition for abatement for Jodie Lynn Frank, schedule number
R014345. Mr. Harrison stated the owner of the subject property appealed the value during the 2003
appeals process. The Assessor's Office corrected the square footage for this condominium complex and
recalculated the 2003 values based on market date. The corrected square footage was then used to
review the values in the 2001 and 2002 tax years. Based on the comparable sales within the appropriate
time frame, the assigned value for the subject property is fair and equitable. Pursuant to CRS 301-10-
114 it is recommended this abatement be denied.
Commissioner Stone moved to deny schedule number R014345, Jodie Lynn Frank, as
recommended by the Assessor.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
File PDF-00082, Final Plat, Arrowhead River Ranch PUD
Cliff Simonton presented file number PDF, Arrowhead River Ranch PUD. He stated the
applicant is requesting final approval of a subdivision Plat that would reconfigure Tract B, Tract C and
Eagle River Road of the Arrowhead River Ranch PUD. Eagle River Road, which provides internal
access to the 20 home subdivision, has been slightly re-aligned, which changes the configuration of both
Tracts B and C. Tract B is additionally being subdivided to create 7 single family lots, the layout for
which is consistent with the approved Preliminary Plan for Arrowhead River Ranch.
The development site is located 1.3 miles east of the intersection of US Highway 6 and the
Edwards Spur Road, immediately adjacent to and north of US Highway 6.
The chronology is as follows:
The Preliminary Plan for the Donovan Parcel PUD (since renamed the Arrowhead River Ranch
PUD) was approved on July 30,2002. The companion 1041 file (No. 1041-0043) was approved on the
same day.
The final plat for the Arrowhead River Ranch PUD was approved on October 22, 2002.

This plat is the second plat for Arrowhead River Ranch PUD, and is the first that establishes
single family home sites. All development for this plat was contemplated by, and is consistent with, the
approved Arrowhead River Ranch PUD Preliminary Plan and the Arrowhead River Ranch PUD Guide.
Pursuant to Section 5-280.B.5.b (3), Final Plat for Subdivision - Action bv the Board of County
Commissioners of the Eagle County Land Use Regulations:
This final plat DOES conform to the approved Preliminary Plan for subdivision.
Required improvements ARE adequate.
Areas dedicated for public use and easements ARE acceptable and;
Pursuant to Sections 5-280.B.3.e., Standards of the Eagle County Land Use Regulations:
1) Consistent with the Master plan. It has previously been determined that the proposed
subdivision IS consistent with the Eagle County Master Plan and the Future Land Use Map of the
Master Plan.
2) Consistent with Land Use Regulations. It has previously been found that the proposed
subdivision DOES comply with all of the standards of this Section and all other provisions of these
Land Use Regulations, including but not limited to the applicable standards of Article 3, Zone Districts,
and Article 4 Site Development Standards.
3) Spatial Pattern Shall Be Efficient. It has previously been determined that the proposed
subdivision IS located and designed to avoid creating spatial patterns that cause inefficiencies in the
delivery of public services, require duplication or premature extension of public facilities, or result in a
"leapfrog" pattern of development.
(a) Utility and Road Extensions. Proposed utility extensions ARE consistent with the
utility's service plan or shall require prior County approval of an amendment to the service plan.
Proposed road extensions ARE consistent with the Eagle County Road Capital Improvements Plan.
(b) Serve Ultimate Population. Utility lines ARE sized to serve the planned ultimate
population of the service area to avoid future land disruption to upgrade under-sized lines.
(c) Coordinate Utility Extensions. Utility extensions DO provide the entire range of
necessary facilities.
4) Suitability for Development. It has previously been determined that the property proposed to
be subdivided IS suitable for development, considering its topography, environmental resources and
natural, or human-made hazards that may affect the potential development of the property, as well as
existing and probable future public improvements to the area.
5) Compatible with Surrounding Uses. It has previously been determined that the proposed
subdivision IS compatible with the character of existing land uses in the area and DOES NOT adversely
affect the future development of the surrounding area.

Chairman Gallagher asked if Eagle River Road was accepted by the Fire Department.
Mr. Simonton answered yes.

PDS-00036 Edwards Storage Facility
lena Skinner-Markowitz, Planner, presented file number PDS-00036, Edwards Storage Facility.
She stated the applicant wishes to create a mixed use PUD which allows two (2), 35,000 sq. ft., enclosed
RV and mini storage buildings with a 2,000-3,000 sq. ft. dwelling unit attached to each building. This
development is to be built on 2.339 acres in west Edwards. One ofthe dwelling units is to be used for
the property manager/caretaker, with the other unit to be offered as a rental.
The chronology of the application is as follows:

1960- A single family home was built on the unplatted, 2.339 acre area ofland of the proposed
development.
1974- RSL zoning was placed on the property when Eagle County introduced zoning in
September, 1974.
The Planning Commission was primarily concerned with the proposed application's lack of
conformance with the intent and goals of the Edwards Area Community Plan. They also took issue with
the large size of the proposed storage building, and that a residential area was not an appropriate location
for this type of use normally found in the commercial/industrial zone districts.
The Planning Commission recommended denial of this proposal, noting the following caveats, as
stated by Dan Seibel:
"We are concerned with the size of the footprint and mass of the buildings, lot coverage
percentages, industrial type use in residential area, lighting that would go along with security in a
residential area, (and a) change in the character of the neighborhood."

Eagle River Water and Sanitation District/Upper Eagle Regional Water Authority, dated
August 12, 2003:
At the Sketch Plan level of detail, water and wastewater are mentioned briefly.
The sanitation service entity is Eagle River Water and Sanitation District, not the Eagle Valley
Sanitation District.
Our updated District boundary maps indicate that the project property is not located within the
District; inclusion will be required to serve the proposed development.
At Preliminary Plan, the District would like the opportunity to review for Ability to Serve issues.
Barbara Troxel, Adjacent Property Owner, dated August 25,2003:
We purchased land in October, 1962, when the Valley was mostly farming land.
The land was surveyed by a professional Surveyor.
Geneva and Cleaver Kettrey, from whom we purchased the land granted us easements: one
curved across their property, one from Hwy 6 straight to our property.
The two easements are described in the Warranty Deed (reception no. 96573), paragraph 2, and
on the scaled diagram, also part of the deed.
This development greatly decreases the value and residential comfort of my property.
This area is a residential area and not a mini storage area; I highly disapprove of this
development.
I have owned land for 41 years and feel developers should never push me out.
This residential area should remain the same.
Eagle River Fire Protection District, dated August 27,2003:
Please provide a site plan showing the attached vehicle turning radii to confirm accessibility.
Road width for the one-way on the east side is called out at 14' on the landscape plan, and 16' on
the site plan.
Please confirm the actual width and if it meets County requirements.
Hydrant locations need to be called out and verified. Due to the size and use of the buildings,
additional hydrants and fire sprinklers may be required to meet fire flow requirements.
A wildland fire assessment is required (NFPA 1144 form).
Engineering Memo, dated August 29th, 2003:
A State Highway Access Permit will be required for the proposed access onto HWY. 6. The
access must meet the requirements in the State Highway Access Code. It is recommended that the
access permit be submitted concurrently with the preliminary plan submittal.
Eagle County in cooperation with the Colorado Department of Transportation are in the process
of finalizing the HWY. 6 Corridor Feasibility Study. This study will likely recommend that access in
this area be consolidated and a circulation road be constructed so each parcel does not have to directly
access onto HWY. 6. This will improve the existing capacity ofHWY. 6 and make it safer.

As proposed, the road will serve at least four lots in this area of West Edwards. Additionallots
may connect to this road as this area redevelops because of the limitations of accessing HWY. 6 in this
area. As a result, the road will have to meet the standards in the Site Development Standards Section of
the Land Use Regulations.
Colorado Geologic Survey, dated August 29,2003
This site is underlain with Eagle Valley Evaporite. Subsidence due to collapsible soils, hydro
compaction, existing sinkholes, and formation of solution cavities are a serious concern.
Careful attention will need to be given to site preparation and foundation design for the new
buildings; observations of all buildings and property should be made on a regular basis during and after
construction. Early detection of foundation distress and timely remedial actions are important in
reducing the cost of remediation.
A design-level subsurface investigation including sampling, lab testing an analysis will be
needed to determine alluvium thickness or depth to competent bedrock, and to characterize the soil and
rock engineering properties such as density, consolidation potential, bearing capacity and soil
corrosivity.
This information is needed to determine max bearing and dead-load pressures and to develop
final design criteria for foundations, floor systems, and pavements.
Additional foundation damage due to compaction and differential settlement can occur if water
infiltrates the soils as a result of landscape irrigation and run-off.
It is imperative that proper grading, compaction and drainage are incorporated into the
development plans.
Depth to the groundwater should be determined during site-specific investigations as the site is
located approx. 500 ft from the Eagle River.
Groundwater levels could fluctuate to shallow depths seasonally, and during storm events.
Foundation perimeters drains are recommended to help control wetting of potentially expansive
or collapsible soils in the immediate vicinity of the substructure; the systems should be sloped to
discharge to a gravity outlet, storm sewer of sump pump location.
Northwest Colorado Council of Governments, dated September 3,2003
My review focused on whether the application met the recommendations of the Area wide Water
Quality Management Plan (208 Plan), which I believe Eagle County has adopted.
Overall, the proposal meets with the policies and recommendations of the 208 Plan. It does not
necessitate the creation of any new wastewater or water supply facilities and it addresses storm water
runoff related issues. I do have a few suggestions and comments that may strengthen the project's
adherence with the 208 Plan:
The application does not mention whether they will need to get a CDPES discharge permit for
storm water control on a construction site from the Colorado Department of Health. This is required for
any development project creating site disturbance of more than one acre.
In general, a detailed erosion control plan that meets both CPDES and Eagle County
requirements needs to be developed and implemented.
Post construction storm water runoff is addressed primarily by installing a detention basin.
According to the application the detention basin design is to attenuate peak runoff to historic,
pre-development levels. If the basin included a water quality feature such as a riser with gravel pack it
would serve the additional function of providing for enhanced water quality.
The detention basin should be one of the first features installed during site development in order
to provide protection from sediment associated with the clearing of the site. It could be roughed in
during construction then the outlet works described above could be installed later to provide for
treatment of storm water runoff from the finished proj ect.

that they will be subject to the conditions and standards of the PUD.
The Applicant has demonstrated that the entire area affected by this PUD Amendment is owned
by Rodmart Properties, LLC.

STANDARD: Uses. [Section 5-240.F.3.e (2)] - The uses that may be developed in the PUD
shall be those uses that are designated as uses that are allowed, allowed as a special use or allowed as

Table 3-320, "Commercial and Industrial Zone Districts Use Schedule, "for the zone district

Mini and/or RV Storage is not a residential or agricultural use, as is currently found in this area
under the current RSL zoning. These uses are commercial and industrial uses. Pursuant to the Edwards
Community Master Plan, limited "neighborhood commercial" uses may be permitted in West Edwards;
however, there is no evidence to support the need for storage in Edwards.
H FINDING: Uses. [Section 5-240.F.3.e (2)]
The uses that may be developed in the PUD ARE uses that are designated as uses that are
allowed, allowed as a special use or allowed as a limited use in Table 3-320, "Commercial and Industrial
Zone Districts Use Schedule", however, these uses ARE NOT uses allowed in Table 3-300,
"Residential, Agricultural and Resource Zone Districts Use Schedule" applicable to the zone district
designation in effect for the property at the time of this application for PUD.
STANDARD: Dimensional Limitations. [Section 5-240.F.3.e (3)] - The dimensional
limitations that shall apply to the PUD shall be those specified in Table 3-340, "Schedule of
Dimensional Limitations", for the zone district designation in effect for the property at the time of the
application for PUD. Variations of these dimensional limitations may only be authorized pursuant to
Section 5-240 F.3j, Variations Authorized. provided variations shall leave adequate distance between
buildings for necessary access and fire protection, and ensure proper ventilation, light, air and
snowmelt between buildings.
The proposed structures are approximately 37-38,000 square feet each (this includes the storage
building with the attached dwelling unit). With the addition of the parking and roadways, it will be
necessary to have the Board of County Commissioners approve several Variations in order for this

STANDARD: Off-Street Parking and Loading. [Section 5-240.F.3.e (4)] - Off-street parking
and loading provided in the PUD shall comply with the standards of Article 4, Division 1, Off-Street
Parking and Loadinf! Standards. A reduction in these standards may be authorized where the applicant
demonstrates that:
(a) Shared Parking. Because of shared parking arrangements among uses within the
PUD that do not require peak parkingfor those uses to occur at the same time, the parking needs of
residents, guests and employees of the project will be met; or
(b) Actual Needs. The actual needs of the project's residents, guests and employees will
be less than those set by Article 4, Division 1, Off-Street Parking and Loading Standards. The applicant
may commit to provide specialized transportation services for these persons (such as vans, subsidized
bus passes, or similar services) as a means of complying with this standard.
With the nature of this proposal, and the design of the buildings for the multiple uses, a site
specific parking plan will have to be developed and submitted as part of Preliminary Plan. The parking
plan will recognize loading areas, residential, employee, storage unit visitor parking, and parking spots
for people to wait in (overflow), ifthe interior ofthe buildings are occupied with drop offs and RV
parking.
[-/+] FINDING: AS CONDITIONED Off-Street Parking and Loading. [Section 5-240.F.3.e
4)]
It WILL be demonstrated that off-street parking and loading provided in the PUD complies with
the standards of Article 4, Division 1, Off-Street Parking and Loading Standards, without a necessity for
a reduction in the standards, at Preliminary Plan.
STANDARD: Landscaping. [Section 5-240.F.3.e (5)] - Landscaping provided in the PUD
shall comply with the standards of Article 4, Division 2, Landscaving and Illumination Standards.
Variations from these standards may be authorized where the applicant demonstrates that the proposed
landscaping provides sufficient buffering of uses from each other (both within the PUD and between the
PUD and surrounding uses) to minimize noise, glare and other adverse impacts, creates attractive
streetscapes and parking areas and is consistent with the character of the area.
A detailed landscaping plan is required top be submitted as part of the Preliminary Plan. That
plan should detail all types, location of all materials to be planted as part of this development. A cost
estimate will also be necessary for collateralization purposes.
[-/+] FINDING: AS CONDITIONED Landscaping. [Section 5-240.F.3.e (5)]
It WILL be demonstrated that landscaping provided in the PUD can comply with the standards
of Article 4, Division 2, Landscaping and Illumination Standards.
STANDARD: Signs. [Section 5-240.F.3.e (6)] - The sign standards applicable to the PUD
shall be as specified in Article 4, Division 3, Sign Regulations. unless, as provided in Section 4-340 D.,
Signs Allowed in a Planned Unit Develovment (PUD). the applicant submits a comprehensive sign plan

for the PUD that is determined to be suitable for the PUD and provides the minimum sign area
necessary to direct users to and within the PUD.
The applicant has made statements that signage will comply with Eagle County sign standards;
however the draft PUD Guide in the current application does not contain statements regarding signage.
A PUD sign code will be necessary at Preliminary Plan.
[-/+] FINDING: AS CONDITIONED Signs. [Section 5-240.F.3.e(6)]
The sign standards applicable to the PUD ARE NOT as specified in Article 4, Division 3, fugn
Regulations. However, the Edwards Storage Facility PUD will make reference to a comprehensive sign
plan within the PUD Guide to be submitted at Preliminary Plan.
STANDARD: Adequate Facilities. [Section 5-240.F.3.e (7)] - The applicant shall demonstrate
that the development proposed in the Preliminary Plan for PUD will be provided adequate facilities for
potable water supply, sewage disposal, solid waste disposal, electrical supply, fire protection and roads
and will be conveniently located in relation to schools, police and fire protection, and emergency
medical services.
Existing facilities (electricity, telephone, gas, cable, etc) currently servicing the residents living
on the proposed property are available, and currently exist; however, a letter dated August 12,2003
from the Eagle River Water and Sand District, indicate that this property is not located in the District at
this time, and that the "Ability to Serve" of the District will be analyzed at Preliminary Plan. There are
also questions regarding the proposed road layout as stated in the memo from the Eagle River Fire
Protection District, dated August 27,2003. The memo questions adequate turning radii, and if the roads
meet County standards. The Fire Department will also require fire hydrants and fire sprinklers. Failure
to obtain water from the District would be problematic with the Fire Department requirements as well.
The applicant will be required to provide additional information regarding water consumption of
the proposed use in order to assess the need for a 1041 process.
[-] FINDING: Adequate Facilities. [Section 5-240.F.3.e (7)]
The Applicant HAS NOT clearly demonstrated that the development proposed in the this Sketch
Plan for PUD will be provided adequate facilities for sewage disposal, and roads; the applicant HAS
NOT clearly demonstrated that the development proposed in the Sketch Plan for PUD will be provided
adequate facilities for potable water, solid waste disposal and fire protection. In addition, the Applicant
HAS demonstrated that the proposed PUD will be conveniently located in relation to schools, police and
fire protection, and emergency medical services.
STANDARD: Improvements. [Section 5-240.F.3.e (8)] - The improvements standards
applicable to the development shall be as specified in Article 4, Division 6, Improvements Standards.
Provided, however, the development may deviate from the County's road standards, so the development
achieves greater efficiency of infrastructure design and installation through clustered or compact forms
of development or achieves greater sensitivity to environmental impacts, when the following minimum
design principles are followed:
(a) Safe, Efficient Access. The circulation system is designed to provide safe, convenient access
to all areas of the proposed development using the minimum practical roadway length. Access shall be
by a public right-of-way, private vehicular or pedestrian way or a commonly owned easement. No
roadway alignment, either horizontal or vertical, shall be allowed that compromises one (1) or more of
the minimum design standards of the American Association of State Highway Officials (AASHTO) for
that functional classification of roadway.
(b) Internal Pathways. Internal pathways shall be provided to form a logical, safe and
convenient system for pedestrian access to dwelling units and common areas, with appropriate linkages
off-site.
(c) Emergency Vehicles. Roadways shall be designed to permit access by emergency vehicles to
all lots or units. An access easement shall be granted for emergency vehicles and utility vehicles, as
applicable, to use private roadways in the development for the purpose of providing emergency services
and for installation, maintenance and repair of utilities.

(d) Principal Access Points. Principal vehicular access points shall be designed to provide for
smooth traffic flow, minimizing hazards to vehicular, pedestrian or bicycle traffic. Where a PUD abuts
a major collector, arterial road or highway, direct access to such road or highway from individual lots,
units or buildings shall not be permitted. Minor roads within the PUD shall not be directly connected
with roads outside of the PUD, unless the County determines such connections are necessary to
maintain the County's road network.
(e) Snow Storage. Adequate areas shall be provided to store snow removedfrom the internal
street network and from off-street parking areas.
According to recorded documents from Barbara Troxel, (see memo dated August 25,2003), an
access easement exists on the northerly portion of the development property, currently shown on the
application site plan under a portion of the first dwelling unit, landscaping features, and roadway. As
this is a legal easement, the development does not have the right to build on top of it unless evidence is
produced which demonstrates that this easement is no longer valid, or a Vacation has been approved by
the Board of County Commissioners. As such, the development will have to be re-designed to
accommodate the easement prior to Preliminary Plan submittal, if the applicant receives Sketch Plan
approval.
There is a concern from both the Fire Department and Engineering Department with the roadway
standards as contemplated with this Sketch Plan. This development will have to meet all County
standards, unless a Variance is granted by the Board of County Commissioners during the Preliminary
Plan process.
[-] FINDING: Improvements. [Section 5-240.F.3.e (8)]
It HAS NOT been clearly demonstrated that the improvements standards applicable to the
development will be as specified in Article 4, Division 6, Improvements Standards regarding:
(a) Safe, Efficient Access.
(b) Internal Pathways.
(c) Emergency Vehicles
(d) Principal Access Points.
(e) Snow Storage.
STANDARD: Compatibility with Surrounding Land Uses. [Section 5-240.F.3.e (9)] - The
development proposed for the PUD shall be compatible with the character of surrounding land uses.
Currently, the underlying, residential property is compatible with the character of the lands
surrounding it. The proposed uses, however, are not those customarily found within a residential
neighborhood. Storage is most often found on the out-skirts/fringe of a town in either a business or
industrial park, in either Eagle or Eagle-Vail.
The Edwards Area Community Plan, Vision Report states that: ". . . these sites represent the
transition zone from the higher densities of the core to lower densities.. ."; "These sites are appropriate
for medium density residential development and minimal mixed use that would address the service,
retail and office needs of specifically the surrounding neighborhood"; and, ".. . any development should
fit in and reinforce the character of the broader Edwards community." This development, although
potentially providing some residents with additional storage, is not compatible with the master plan as
proposed.
"...these sites represent the transition zone from the higher densities of the core to lower
densities..." This development is not a residential development, and does not act as a transitional use.
The scale of these buildings and lack of open space prevents the storage to act as a visual transition of
the core to the smaller residences of the surrounding neighborhood.
"These sites are appropriate for medium density residential development and minimal
mixed use that would address the service, retail and office needs of specifically the surrounding
neighborhood." Increasing both the floor area and lot coverage by 56,037.762 and 61,132.104 square
feet respectively, does not provide for a minimal, mixed use development. As mentioned previously,
evidence to support the need of this development has not been presented to Staff; RV storage would

draw business from a much larger vicinity and, therefore, is not strictly a neighborhood need. The intent
for the "minimal mixed use" also states that the development should address the, "service, retail and
office needs of specifically the surrounding neighborhood"; this development does not encompass all
those uses.
". ..any development should fit in and reinforce the character of the broader Edwards
community." Immediate neighborhoods surrounding the proposed development site consist of a mobile
home park, Lake Creek apartments, and several single family homes, many which have existed prior to
zoning. The "broader Edwards community" consists of newer, single family, duplex and some multi-
family subdivisions, as well as a centralized, commercial core.
Edwards Storage Facility proposes two (2), 35,000 square foot buildings be built next to the
mobile home park. In looking at the scale of the immediate neighborhood, although consistent in height
with some of the near-by buildings, the storage buildings far exceed the lot coverage and bulk scale of
any surrounding building in visual range, outside of the Edwards commercial core. These buildings will
not "fit in and reinforce the character of.. . Edwards", as the character in the immediate vicinity is
residential, and these uses (except for the two dwelling units) are commercial. Please note that the only
zone district allowing mini-storage as a use by right is the Industrial zone district, which Edwards does
not have. The proposed use could compromise the character of this vicinity of Eagle County.
[-] FINDING: Compatibility With Surrounding Land Uses. [Section 5-240.F.3.e (9) The
development proposed for the PUD IS NOT compatible with the character of surrounding land uses.
STANDARD: Consistency with Master Plan. [Section 5-240.F.3.e (10)] - The PUD shall be
consistent with the Master Plan, including, but not limited to, the Future Land Use Map (FLUM). The
consideration of the relevant master plans during sketch plan review is on a broad conceptual level, i.e,
how a proposal compares to basic planning principles. As a development proposal moves from sketch
plan to preliminary plan review, its conformance or lack thereof to aspects of the master plans may not
necessarily remain static. THE MASTER PLAN ANALYSES BELOW CONSIDER THE

balance the physical, social, cultural, environmental and economic needs of the entire Edwards
Community; however, it may offer storage relief to some people, like those of who live in the mobile
home park and do not have residential storage facilities.
Housing - "Affordable" housing is anticipated in the current application, however, there is no indication
of what rental prices will be.
Transportation - The applicant needs to work with the Eagle County Engineering Department
and the Colorado Department of Transportation to secure appropriate access permits which will function
within Eagle County's parameters.
Open Space - "Open Space preservation is promoted within the Edwards Planning Area through
coordination with land owners, developers and other agencies and organizations". This proposal does
not represent a coordinated effort to preserve any ofthe subject site as Open Space which, in turn, helps
to define a buffer between developments.

Potable Water and Wastewater - Public potable water and sanitary sewer service is anticipated to
be made available to serve the proposed development, however, according to the District, the applicant
will have to become a part of the District before service will be provided. Ability to Serve will be
analyzed at Preliminary Plan, and must be in place prior to final approval.
Services and Facilities - This goal pertains to recycling of solid wastes and provision of public
schools, occupational training and higher education and, as such, is not applicable.
Environmental Qualitv -This proposal does satisfy many of the stated objectives. According to
NWCCOG, overall, the proposal meets with the policies and recommendations of the 208 Plan. It does
not necessitate the creation of any new wastewater or water supply facilities and it addresses storm water
runoff related issues. NWCCOG, however, has the following comments: the applicants need to get a
CDPES discharge permit for storm water control on a construction site from the Colorado Department
of Health. This is required for any development project creating site disturbance of more than one acre.;
a detailed erosion control plan that meets both CPDES and Eagle County requirements needs to be
developed and implemented; post construction storm water runoff is addressed primarily by installing a
detention basin; the detention basin design is to attenuate peak runoff to historic, pre-development
levels. If the basin included a water quality feature such as a riser with gravel pack it would serve the
additional function of providing for enhanced water quality.
Economic Development - The proposal does not promote a balanced mix of land uses in the
Edwards community to encourage a diverse economy. This is not applicable to this type of commercial
use.
Recreation and Tourism - The stated goal is, "Parks, river access, recreational facilities and open
space are provided to meet current and future needs of the residents of Edwards and Eagle County.
These are designed in such a way as to ensure increased accessibility and provide a more even
distribution to the Edwards Planning Area's parks and open space system". This does not apply to this
development as the property does not contain any natural recreational amenities.
Historic Preservation - No historic resources were identified on the subject property. At the time
of this writing, neither the Colorado State Historical Society nor, the Eagle County Historical Society
had provided comment.
Implementation - If approved, the proposed development will be required to efficiently utilize
public infrastructure. Compliance with the Hwy 6 Access Control Plan is strongly recommended as
well. Access may be a primary concern at Preliminary Plan, when the development is analyzed for
traffic and road layouts, etc.
Future Land Use Map (FLUM) - As discussed previously on Page 8 (Compatibility), the
proposed commercial site is identified on the FLUM as an area appropriate for, "medium density
residential development and minimal mixed use that would address the service, retail and office needs of
specifically the surrounding neighborhood." This aspect of the proposal is not consistent with this
recommendation, in that the intent for the "minimal mixed use" also states that the development should
address the, "service, retail and office needs of specifically the surrounding neighborhood"; this
development does not encompass all those uses, nor can it be determined "minimal" with the proposed
storage buildings being the largest buildings in the area. Most importantly, the primary land use intent
for this area is residential. Under the current zoning, it may be possible to develop 5-6, single family
dwelling units, plus lock
[+/-] FINDING: Consistent with Master Plan. The proposed Sketch CANNOT be entirely
shown to be appropriate for its proposed location and be consistent with the purposes, goals, objectives
and policies of applicable master plans -offs on 15,000 sq ft lots for purchase, vs. two units for rental
purposes.
STANDARD: Phasing [Section 5-240.F.3.e (11)] - The Preliminary Plan for PUD shall
include a phasing plan for the development. If development of the PUD is proposed to occur in phases,
then guarantees shall be provided for public improvements and amenities that are necessary and
desirable for residents of the project, or that are of benefit to the entire County. Such public

improvements shall be constructed with the first phase of the project, or, if this is not possible, then as
early in the project as is reasonable.
Not applicable and/or necessary with this proposal. The Edwards Storage Facility is not
expected to expand in the future and is to be constructed all at once.
[+J FINDING: Phasing Section 5-240.F.3.e (11)
A phasing plan IS NOT necessary for this development.
STANDARD: Common Recreation and Open Space. [Section 5-240.F.3.e (12)] -
The PUD shall comply with the following common recreation and open space standards.
(a) Minimum Area. It is recommended that a minimum of25% of the total PUD area
shall be devoted to open air recreation or other usable open space, public or quasi-public. In addition,
the PUD shall provide a minimum of ten (10) acres of common recreation and usable open space lands
for every one thousand (1,000) persons who are residents of the PUD. In order to calculate the number
of residents of the PUD, the number of proposed dwelling units shall be multiplied by two and sixty-
three hundredths (2.63), which is the average number ofpersons that occupy each dwelling unit in
Eagle County, as determined in the Eagle County Master Plan.
(b) Areas that Do Not Count as Open Space. Parking and loading areas, street right-of
ways, and areas with slopes greater than thirty (30) percent shall not count toward usable open space.
(c) Areas that Count as Open Space. Water bodies, lands within critical wildlife habitat
areas, riparian areas, and one hundred (100) year floodplains, as defined in these Land Use
Regulations, that are preserved as open space shall count towards this minimum standard, even when
they are not usable by or accessible to the residents of the PUD. All other open space lands shall be
conveniently accessible from all occupied structures within the PUD.
(d) Improvements Required. All common open space and recreational facilities shall be
shown on the Preliminary Plan for PUD and shall be constructed and fully improved according to the
development schedule establishedfor each development phase of the PUD.
(e) Continuing Use and Maintenance. All privately owned common open space shall
continue to conform to its intended use, as specified on the Preliminary Plan for PUD. To ensure that
all the common open space identified in the PUD will be used as common open space, restrictions
and/or covenants shall be placed in each deed to ensure their maintenance and to prohibit the division
of any common open space.
(/) Organization. If common open space is proposed to be maintained through an
association or nonprofit corporation, such organization shall manage all common open space and
recreational and cultural facilities that are not dedicated to the public, and shall provide for the
maintenance, administration and operation of such land and any other land within the PUD not publicly
owned, and secure adequate liability insurance on the land. The association or nonprofit corporation
shall be established prior to the sale of any lots or units within the PUD. Membership in the association
or nonprofit corporation shall be mandatory for all landowners within the PUD.
The total acreage of Edwards Storage is approximately 2.339 acres. Development will occur on
the majority of property, with minimal area left as open space. Landscaping will fill in any lands not
covered by asphalt or buildings. Dwelling units will have small lawns around parking areas.
Maintenance of landscaping has not been addressed in this application. The applicant has stated that the
nature ofthe development does not warrant the dedication of open space, with, "...a strong landscape
program for the property would be more appropriate than active recreation." Staffs only real concern is
the lack of safe, useable, open space for families that may rent the two dwelling units; children may end
up playing in the access or parking areas of the development.
[-J FINDING: Common Recreation and Open Space. [Section 5-240.F.3.e (12)]
The PUD HAS NOT demonstrated that the proposed development will comply with the
common recreation and open space standards with respect to:
(a) Minimum area;
(b) Improvements required;

(c) Continuing use and maintenance; or
(d) Organization.
STANDARD: Natural Resource Protection. [Section 5-240.F.3.e (13)] - The PUD shall
consider the recommendations made by the applicable analysis documents, as well as the
recommendations of referral agencies as specified in Article 4, Division 4, Natural Resource Protection
Standards.
According to the memo from the Colorado Geologic Survey, dated August 29, 2003, careful
attention will need to be given to site preparation and foundation design for the new buildings, because
of collapsible soils (see attached memo). The applicant will have to provide a Geologic Hazards Report
which, "considers a design-level subsurface investigation including sampling, lab testing and analysis
will be needed to determine alluvium thickness or depth to competent bedrock, and to characterize the
soil and rock engineering properties such as density, consolidation potential, bearing capacity and soil
corrosivity" and other comments, as stated.
[+] FINDING: AS CONDITIONED Natural Resource Protection. [ Section 5-240.F.3.e (13)]
The PUD DOES demonstrate that the recommendations made by the applicable analysis
documents available at the time the application was submitted, as well as the recommendations of
referral agencies as specified in Article 4, Division 4, Natural Resource Protection Standards, have been
considered.
Pursuant to Section 5-240.F.2.a.(15).(a), which states:
(15) Any or all ofthe following requirements, as determined by the Community Development
Director, based on the complexity of the proposal:
(a) Supporting data to justify any proposed commercial and industrial elements in an area
not so zoned;
Staff has requested supporting data to justify the necessity for RV/mini-storage, but has not
received anything validating these uses. This is important information when considering the spatial
dimensions of the storage buildings are based on the need to accommodate large RVs and storage drop-
offs.
Pursuant to the newly adopted Edwards Area Community Plan, any commercial development
proposed in West Edwards is supposed to be "neighborhood commercial". If R V s are coming to park
here from other areas of the County, or even other Counties, this use does not comply with the intent of
the Edwards Area Community Plan. This would also impact traffic through Edwards as RVs from other
areas would be coming in and out of West Edwards, where previously they were absent.
Tom Boni, Knight Planning, introduced Roddy Jones, applicant, and Michael Dunlevie, Attorney
for the applicant. He stated the applicant has been more responsive than most applicants. He is trying to
build a more attractive and quality building. He stated any development in Edwards will have to present
a quality image. They came up with several options. He had a power point presentation, showing a
resident managers unit, the timber trimmed garage door and the building in general. He stated this
project shares a boundary with the Eagle River Mobile Home Park. He spoke to the property to the
South, owned by Barbara Troxel and the Centurytel building. He stated in looking at the Master Plan,
several changes have been made to the application. It is identified as a community center on the Future
Land Use Map. On the Edwards Community Plan, they identity that these sites are appropriate for
residential development or minimal mixed use. The Edwards Access Control Plan, indicates that drives
should be shared. They have addressed consolidation of driveways. There are three aspects of the plan.
The upper levels were for mini storage. The bottom level was for storage of recreational vehicles. As
they have proceeded to look at the market, they are agreeable to lowering the building height and have
the first floor respond to mini storage needs. They are architecturalizing treatment of the outside of the
building. They have met with the manager of the Eagle River Mobile Home Park who felt this was
something that the community needed. He stated they met with the Centurytel people who have
submitted a letter of support. He presented the letter to the Board. The property analysis shows this as
low density development. In speaking with developers they believe this type of market exists for this

property. They believe storage is a use that makes sense in this community and can be attractive and
create a break between the mobile home park and residential development. He stated there are two
residential units attached. This was the original plan submitted which was changed after the Planning
Commission's concern's by reducing the size of the building. He stated with community feedback they
have received favorable comments. He showed two different designs that were proposed. The property
owner to the South has raised objections around a number of issues. There was the construction of an
easement that has not been built yet so they have moved the building as not to encumber that easement.
There was also concern with the height of the building. They have planted evergreens to cover that side
of the building. They have added landscaping. He pointed out the shared driveway.
Commissioner Stone asked how big their building was.
Mr. Boni stated 100 feet by 155 feet and they will have a residence in this building. As a use
that bookends the western side, this proposal addresses a community need. This can fit closer into the
community. The PUD approach allows the community to control the use of the building, With the
reduction in size they have created significant landscaping.
Michael Dunlevie spoke to the easement which is a prescription only easement and is from 1962.
This grants two easements one on the western boundary which is being used and the curved one which is
not being used. With the joint access with Centurytel they are getting rid of another access point and
the easement is being preserved. This project does nothing to harm the easement that it is place.
Mr. Mauriello asked about encroachment on the easement.
Mr. Dunlevie showed the easement and explained indicating they have preserved the right to use
the easement.
Ms. Skinner-Markowitz pointed out a detention pond in the middle of the easement.
Mr. Boni stated they moved the single family residence and explained the detention pond will be
located in another open space on the property.
Mr. Jones stated he has been coming to Eagle County for thirty some years. When looking at
this property it does not look pretty right now. He is not trying to break new ground. They wanted to
build something nice and will keep the building maintained. Mini storage is not enticing but this
building would be made to look nice and access to the storage units would be from inside the building
only.
Chairman Gallagher asked for public comment.
Dana Williams, resident on the Southern parcel, stated he uses the secondary easement quite
frequently. If they are going to landscape as planned he is concerned it will block the view of the
mountain. There will be a loading dock. He pointed out the house he lives in. There is also a third
house and he is concerned with traffic. He stated he does not want to lose his secondary access.
Chairman Gallagher questioned the 18 feet from the deck to the road.
Mr. Williams stated the comer of the deck is 18 feet from the road and there will be increased
traffic.
Tom Harned, area resident, stated he has visited the site and it is not very appealing and family
housing would not be easy to sell. He personally has a 6,000 square foot building in Eagle, a home with
a full basement, a four car garage, a two car garage and two barns and still has to lease storage space.
This fills a great need and will dress up the site. There is a lot of restricted areas in this County where
you are not allowed to park recreational vehicles and this would be perfect for those items.
Brian O'Dell, Edwards resident, stated he sold the property to the applicant. It is not a whole lot
better today but it will be a wonderful addition to the properties to the west. It will be a good benefit for
the valley. There is definitely a need for this type of facility. It does offer a good transition.
Chairman Gallagher closed public comment.
Mr. Boni stated they have included a landscape component and they would like to meet with Mr.
Williams and address all his concerns. Lighting will have to be presented and approved by the Board.
Commissioner Stone asked if the applicant agrees with the conditions of approval.
Mr. Boni stated they agree

Commissioner Stone asked about condition number four, eliminating the RV Storage..
Mr. Boni stated they agree but would like to come back to address the smaller RV storage.
Commissioner Stone questioned the Edwards Community Plan.
Ms. Skinner-Markowitz stated there is information in staff report on page nine and page twelve.
Commissioner Stone asked if this is next to the Woodland Hills project.
Ms. Skinner-Markowitz answered that was correct.
Commissioner Stone asked what the density of that project was.
Mr. Skinner-Markowitz stated 10 units per acre.
Commissioner Stone asked when that file expires.
Ms. Skinner-Markowitz stated the preliminary plan will expire in August 2007.
Chairman Gallagher asked for a graphic of the Edwards Area Community plan and the zone
districts.
Ms. Skinner-Markowitz explained the zoning to the Board.
Chairman Gallagher asked if this was equivalent to the Master Plan adopted by the Planning
Commission. He asked about the three parcels shown on the map and if they were all part of Woodland
Hills.
Ms. Skinner-Markowitz answered yes.
Chairman Gallagher asked about community centers.
Ms. Skinner-Markowitz stated the Edwards area is as shown on the map and the immediate
vicinity pertains to the western portion shown on the map.
Chairman Gallagher asked about water and sewer.
Mr. Boni stated they have three water taps from the Edwards Metropolitan District and there is a
sewer main close they plan to hook to. He stated in preparing this application they reviewed the
Edwards Area Master Plan and they are site 10 which identifies this area as low density, however there
is text that allows for commercial services and retail that service a need for the community.
Ms. Skinner-Markowitz stated at the bottom of page nine it does discuss the uses for that area.
Chairman Gallagher asked how seriously they take what part of what Master Plan. He stated
because it is a mobile home park it must be accepted as Industrial. The idea that it is less than a
residential property is not accurate. The Centurytel building would be light industrial and putting this
building between those two does not legitimize anything someone would want to do. The appropriate
use is what is to be addressed. He stated the Planning Commission was correct in saying this does not
comply with the Master Plan. He stated this use would be better in Wolcott.
Commissioner Menconi asked if there was a recommendation from staff to the Planning
Commission.
Ms. Skinner-Markowitz stated staffs recommendation to the Planning Commission was for
denial based on the same reasons. She read a quote from the Planning Commission.
Commissioner Menconi asked about the discussion where it was indicated there may not be staff
approval.
Ms. Skinner-Markowitz stated staff did discuss the concerns with the applicant.
Commissioner Menconi asked about staff recommendation of approval for Woodland Hills and
denial for this project.
Ms. Skinner-Markowitz stated it was the acreage. The original Edwards Master Plan used for
Woodland Hills was the old one but it did apply to that project. She stated since that time a new
community plan was developed and must be used for this application. There are similarities and
differences with the two proposals.
Commissioner Menconi asked about the 2.3 acres and how much is not parking, building, etc.
Mr. Boni stated building coverage was changed and the open space is 30% to 33%. He stated
this application does respond to a need in the community. He stated they believe the Master Plan does
not rule out community uses.

Commissioner Menconi stated he concurs with the staff and planning commission
recommendations. The work that has been done with the Master Plan indicates this is not the type of
direction they want to go. There was discussion at the Woodland Hills file about this area. He would
not disagree that storage is necessary but he does not believe this is the appropriate location.
Commissioner Stone stated he must agree with Dan Seibel's comments from the Planning
Commission. This project would be sandwiched between two residential uses.
Mr. Jones asked if they would be allowed to come back with a proposal for mobile homes.
Commissioner Stone stated he believes showing the size of the Gallegos building hurt this
applicant. He stated he does not know what is happening with the Woodland Hills project. These long
narrow lots makes it difficult to come up with a plan that includes access. He stated the best answer
would be to have one owner own all of those long strips and create a master plan development. He
continues to struggle with what he would think would be a good development there. It is a tough call
because they already have a patchwork quilt. The Board responds to applications as they are brought in.
They cannot force development of private property. He stated he would consider a lesser density
modular home development which might be keeping with the Woodland Hills development.
Chairman Gallagher concurred with Commissioner Stone that they will not comment on what the
applicant should do with his property. He would be much more inclined to approve something that is
consistent with the Master Plan.
Commissioner Menconi moved that the Board of County Commissioners deny file PDS-00036,
Edwards Storage Facility, incorporating all Staff findings.
Commissioner Stone seconded the motion. The vote was declared unanimous.
There being no further business to be brought before the Board the meeting was adjourned until
November 18, 2003.
