Chairman Gallagher stated the Attorney's Office has requested item E be withdrawn.
Diane Mauriello, County Attorney, stated there are no other items for comment.
Commissioner Stone stated he would like to make an amendment to the Commissioner meeting
minutes of July 31, 2003, as follows:
"After the break:, Tom Macy from the Conservation Trust, made a commitment that the balance
ofthe money needed to fully complete the sale of the Bair Ranch had been raised from an anonymous
donor during the break."
Chairman Gallagher concurred with Commissioner Stone.
Ms. Mauriello suggested that the step would be approval of the minutes. A separate motion
would be needed indicating the change.
Chairman Gallagher stated it is his memory the conversation took place as mentioned by
Commissioner Stone.
Commissioner Stone moved to approve the Consent Agenda as presented, excepting item E and
C.
Chairman Gallagher seconded the motion.
In discussion, Chairman Gallagher questioned items F & G concerning the Ambulance District.
He stated in looking at the documents for ECAD he sees six ambulances. He questioned certification of
the District's spare transports.
Sara Schipper, Health and Human Services, stated they inspect the ambulances to make sure that
they carry the appropriate supplies.
Chairman Gallagher asked what they are certifying. He stated they do not say how many
ambulances they operate.
Ms. Schipper stated the certification includes only the ambulances. She stated she insured last
year that they had six.
Chairman Gallagher stated he knew they also had old suburban's they used to put skiers in at the
bottom of the hill to take to the clinic.
Ms. Schipper stated the County only certifies the ambulances.
Chairman Gallagher asked Ms. Schipper to look into this matter. He asked the same about item
G as they show three ambulances.
Ms. Schipper stated she would do so.
Chairman Gallagher stated he would like to know what the County's obligation is. He stated he
guarantees the ambulances from here do not go to Basalt. He asked if they should be inspecting the ones
in Basalt.
Chairman Gallagher questioned item H, the funding available for the Airport project. He asked
if schedule 3 had been funded.
Rich Cunningham, Director of Facilities Management, stated it has not.
Chairman Gallagher stated the increase then was only in schedule 2.
Mr. Cunningham stated that was correct.
Jack Ingstad, County Administrator, stated Mr. Seifers has related the FAA added those monies
to the taxiway project as the bid. He stated this was not anticipated in the first round of projects.
Chairman Gallagher questioned the adequacy oflighting on the existing "B" taxiways and
connecting ways that were scheduled for replacement in schedule 3.
Ovid Seifers, Operations Manager, stated the current reflectorized tube system is all there is.
The only lights are on the edge of the runway.
Chairman Gallagher called for the question on the motion. Of the two voting Commissioners the
vote was declared unanimous.
Commissioner Stone moved to approve item C, the meeting minutes for July 29, 2003 as they are
and approve the minutes for July 31, 2003, adding the following verbiage right after the break:, "the
Board having reconvened asked Tom Macy ifhe had come to a solution to closing the entire transaction

at the same time. Mr. Macy responded an anonymous donor came forward and committed the balance
of all monies necessary to close the transaction on the Ranch at one time.
Chairman Gallagher seconded the motion. Of the two voting Commissioners the vote was
declared unanimous.
Plat & Resolution Signing
Chairman Gallagher stated there are no plats or resolutions for the Board's consideration::
Final Settlement, OldCastle SW Group, Inc.
Diane Mauriello presented final settlement for OldCastle SW Group, Inc., d/b/a B & B
Excavating, Inc., for labor and materials for improvements and construction of Miller Ranch Road,
Berry Creek / Miller Ranch, Edwards, Colorado. She stated this matter was published and no claims had
been received.
Chairman Gallagher stated this matter is for the roads.
Commissioner Stone moved to approve final settlement for OldCastle SW Group, Inc., d/b/a B &
B Excavating, Inc.
Chairman Gallagher seconded the motion. Of the two voting Commissioners the vote was
declared unanimous.
PDF-00080 Red Sky Ranch
lena Skinner-Markowitz, Planner, presented file number PDF-00080, Red Sky Ranch. She
stated the intent of this plat is to: resubdivide lots 69 and 70, and tracts GC8, GC10, GC12, and OS8,
and create there from, new lots 70, 88, and 89, Tracts W-1, W-2, GC8, GClD, GC12, OS8, and OSlO;
eliminate lot 69; and create and vacate certain easements.
Pursuant to Section 5-280.B.5.b (3), of the Eagle County Land Use Regulations:
(1) This final plat DOES conform to the approved Preliminary Plan for subdivision.
(2) Required improvements ARE adequate.
(3) Areas dedicated for public use and easements ARE acceptable and;
Pursuant to Sections 5-280.B.3.e. of the Eagle County Land Use Regulations:
(1) Consistent with the Master plan. The proposed subdivision IS consistent with the Eagle
County Master Plan and the Future Land Use Map of the Master Plan.
(2) Consistent with Land Use Regulations. The proposed subdivision DOES comply with all of
the standards ofthis Section and all other provisions of these Land Use Regulations, including but not
limited to, the applicable standards of Article 3, Zone Districts, and Article 4 Site Development
Standards. All additional improvements have been approved by the Engineering Department and
collateralized as part of the associated Subdivision Improvements Agreement.
(3) Spatial Pattern Shall Be Efficient. The proposed subdivision IS located and designed to
avoid creating spatial patterns that cause inefficiencies in the delivery of public services, require
duplication or premature extension of public facilities, or result in a "leapfrog" pattern of development.
Lots 88 and 89 were approved as part of the recent PUD Amendmentfor Red Sky Ranch approved
December 17, 2002.
a. Utility and Road Extensions. Proposed utility extensions ARE consistent with the utility's
service plan or shall be required prior County approval of an amendment to the service plan. Proposed
road extensions ARE consistent with the Eagle County Road Capital Improvements Plan. These
improvements do not affect any Eagle County Roads, only the internal roads of the Red Sky Ranch PUD.

b. Serve Ultimate Population. Utility lines ARE sized to serve the planned ultimate population
of the service area to avoid future land disruption which would occur if under-sized lines had to be
upgraded.
c. Coordinate Utility Extensions. Utility extensions shall only be allowed when the entire range
of necessary facilities can be provided, rather than incrementally extending a single service into an
otherwise un-served area. This area HAS the ability to be served by water and sewage disposal, and is
served by all other utilities including, telephone, gas, cable, etc.
d. Suitability for Development. The property proposed to be subdivided IS suitable for
development, considering its topography, environmental resources and natural or human-made hazards
that may affect the potential development of the property, as well as existing and probable future public
improvements to the area.
e. Compatible with Surrounding Uses. The proposed subdivision IS compatible with the
character of existing land uses in the area and DOES NOT adversely affect the future development of
the surrounding area. All modifications as shown on the proposed plat, were contemplated and
approved as part of the recent PUD Amendment for Red Sky Ranch approved December 17, 2000.
Chairman Gallagher asked about the net gain in density.
Ms. Skinner-Markowitz stated there is no gain in density.
Gerri Arnold, applicant, was present for the hearing.
Chairman Gallagher called for public comment. There was none.
Commissioner Menconi moved the Board approve File No. PDF-00080, Red Sky Ranch,
incorporating the findings and authorize the Chairman to sign the Plat and Subdivision Improvements
Agreement.

LUR-0045, Cash in Lieu of School Land Dedication
Joe Forinash presented file LUR-0045, Cash in Lieu of School Land Dedication. He stated the
following is the proposed amendment:
SECTION 4-700 SCHOOL LAND DEDICATION STANDARDS
Formulas. Pursuant to Section 30-28-133(4)(a), c.R.S., 1973, as amended, the subdivider of
land in each residential subdivision or portion of a subdivision intended for residential use shall allocate
and convey sites and land areas for schools, when such are reasonably necessary to serve the proposed

subdivision and the future residents thereof, as determined by Eagle County, based upon the School
District's long range capital plan and evidence ofthe impact ofthe subdivision on the District, by
applying the formulas set forth herein. (am 05/15/01)
Single-Family Units.
Number of units X 0.0151 = dedication requirement in acres.
Duplex and Multi-Family Units, excluding Townhouse Units.
Number of units X 0.0025 = dedication requirement in acres.
Townhouse Units, Defined as Multi-Family Units Where Each Unit is Located on a
Separate Platted Lot.
Number of units X 0.0054 = dedication requirement in acres.
Mobile Home Units.

and Shall Be Usable. When land is dedicated for the purpose of providing a school site, it shall

event that the School District determines subsequent to dedication that such school site is not reasonably

value of unimproved land. This valae shall be set annually by the Board of County Commissioners on an
acre basis v/ith recommendations from the School District. The Board of County Commissioners shall
determine the amount of such payment after considering information and testimony presented at the
hearing for the final plat.

submit a report by a qualified appraiser, who is a member of The }..ppraisal Institltte M.A.!., 'which
establishes a ne'l( value. The Board of County Commissioners shall review such report and detennine
the value of such land.
Appraisal of Land to Be Subdivided. The subdivider shall provide, as part of the application for
the final plat, an appraisal of the land area to be platted, prepared by a licensed or certified appraiser, of
the current full market value of the land area being platted. The appraisal report shall be completed as a
Summary Appraisal Report using the market approach to appraisal, and shall be dated no more than six
(6) months prior to the date of application for the final plat. Full market value shall be based on
anticipated market value after completion of platting.
Money Shall Be Held By the Board. When money in lieu of land is required or when monies
have been paid to the Board from the sale of such dedicated sites for schools, it shall be held by the
Board for the acquisition of reasonably necessary sites for the construction of school facilities eF
employee housing, f-or the purchase of employee housing units for the School District or for the
development of said sites. If housing units are purchased, a deed restriction restricting their use to
School District employee housing shall be required and oVlllership shall remain in the name of the
School District.
Dedication Requirements Shall Apply Only Once. School land dedication requirements shall
apply only once to the same land area. Dedications shall not be required ofre-subdivisions ofthe same
land when a dedication has previously been made.
Dedication Shall Occur at Final Plat. The actual dedication or payment shall occur at the Final
Plat stage.
Chairman Gallagher called for public comment. There was none. He closed public comment.

Commissioner Stone asked about item C on the update, if the word Colorado should be used in
conjunction with a licensed or certified appraiser.
Mr. Forinash stated he would make that change.
Chairman Gallagher asked about item E, full market value. He asked ifthe appraisers knew
what that meant.
Mr. Forinash answered yes.
Chairman Gallagher stated on page 1 of the proposed Land Use Regulations, item B, land shall
be usable. He questioned the proceeds and where they would go.
Walt Matthews, Deputy County Attorney, stated it is by State Statute.
Commissioner Stone suggested the sentence read "according to State Statute."
The Board concurred.
Commissioner Menconi moved to approve file number LUR-0045, Cash in Lieu of School Land
Dedication, with two changes, distinguishing licensed or certified appraiser and changing it to "a
Colorado licensed or certified appraiser," and referencing State Statutes on page 1 item B, land shall be
usable.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Chairman Gallagher asked the Assessor's Office about full market value. He asked Mr. Chapin
to meet with Mr. Forinash to tweak the language.
There being no further business to be brought before the Board the meeting was adjourned until
September 9, 2003.
