Plat & Resolution Signing
Cliff Simonton, Planner, presented the following plats and resolutions for the Board's
consideration:
Resolution 2003-020, To Approve a Special Use Permit for an Accessory Dwelling
Unit on Lot 10.1, New York Mountain Project (Eagle County File No. ZS-00102). The Board
considered the Applicant's request on January 21st, 2003.
Commissioner Stone moved to approve Resolution 2003-020, approval of a Special Use Permit
for an Accessory Dwelling Unit on Lot 10.1, New York Mountain Project, file number 2S-00102.
Chairman Gallagher seconded the motion. Of the two voting Commissioners the vote was
declared unanimous.

Letter, Town of Vail
Diane Mauriello stated the next matter is a proposed letter to the Town of Vail, concerning the
Miller Ranch Housing.
Chairman Gallagher inquired as to whether an executive session would be appropriate to discuss
this matter.
Ms. Mauriello stated that it was indeed appropriate pursuant to section 24-6-402 sub 4 sub e.
Commissioner Stone moved the Board meet in Executive Session to discuss this letter.
Chairman Gallagher seconded the motion. Of the two voting Commissioners the vote was
declared unanimous.
Commissioner Stone moved to adjourn from the Executive Session and reconvene into the
regular meeting.

Chairman Gallagher stated that there were slight modifications to the letter.
Commissioner Stone stated the Board has been working well with the Town of Vail for many
years. As they have gone through the development of the housing at Berry Creek, it became apparent
that it might simplify the process if purchasers did not have to go through two different entities. This
proposal would allow the. County to take over 100% of the administration. This would enable the
County to deliver the homes to residents in an easier fashion.
Chairman Gallagher concurred in expressing his gratitude to the Town of Vail in their long term
efforts towards this project and their belief in employee housing.
Chairman Gallagher asked for public comment. There was none.
Commissioner Stone moved to authorize the Chairman to sign the letter to the Town of Vail,
regarding the Miller Ranch Housing.
Chairman Gallagher seconded the motion. Of the two voting Commissioners the vote was
declared unanimous.
Blue Ridge Subdivision
John Vengrin, Engineering Department, stated the next matter was a work session on Blue Ridge
Subdivision. He presented a power point presentation which highlighted the location of this property.
This Subdivision received preliminary plan approval by Resolution 2000-108. The Tuckers were not
able to secure the necessary right of way to complete necessary improvements at the intersection ofE!
Jebel Road and Blue Ridge Lane. They have also been unable to sell the PUD until the right of way
issues have been resolved. They would like Eagle County to help them obtain the right of way. The
Tuckers request the Board to find or determine that if they are unable to secure the right of way the
Board should use its powers of eminent domain to do so.
Mr. Vengrin demonstrated on the power point presentation the location of the needed right of
way. He also showed the area ofE! Jebel road that would need to have improvements. He stated the
Engineering staff really didn't have any opinions or recommendations regarding this request. He was
not willing to issue an opinion on condemnation.
Chairman Gallagher asked for clarification on some of the slides. He inquired as to the proposed
access for Kodiac park.
Mr. Vengrin highlighted this access.

Commissioner Stone asked if Kodiac Park and Blue Ridge PUD were supposed to be working
together. He inquired as to whether there were certain conditions on getting the access all the way
through.
Mr. Vengrin explained that a developer called 'Windriver" was interested in acquiring both
parcels. He went on to give more detail about the zoning and PUD situation.
Chairman Gallagher inquired into the turnoffs from EI Jebel Road. He asked whether the road
that was shown, if it went from that point. He inquired as to whether or not there was a travel way that
followed the map on the power point. "If it did follow the line who owns it"?
Mr. Vengrin further clarified the easement for access using the power point map and handouts.
He pointed out a land survey that was done for the Crawfords showing the easement. "The easement
itself is satisfactory until you get to EI Jebel Road. And then there are a number of improvements that
would need to be done." He explained that the road would need to be widened and referred to the map
provided to clarify. He explained that in order to widen EI Jebel Road Eagle County would need to
compensate the owners of the property.
Chairman Gallagher wondered if the County was dealing with two separate entities; Crawford
properties and something else. He inquired as to whether both entities are controlled by the same
people.
Dan Kerst, Attorney for Crawford Properties LLC, clarified that this entity owns all the property
in question.
Steven Isom, Isom and Associates, along with Yancy Nickel and Mark Beckler, Sopris
Engineering, Kevin Tucker, applicant, Steven Beaty, Attorney for the applicant, and Glen Alt, interested
party in this applicant.
Mr. Isom thanked the Commissioners for having the meeting. He stated the question was the
ownership ofEI Jebel Road and what was required under the original PUD. They believed they had
access to the Blue Ridge project but as it turns out they do not. Mr. Isom explained that ifhe had known
there was not a County right of way at the time ofthis PUD they would have had the Crawfords grant a
right of way. He could not find where the 70 foot right of way was ever deeded to Eagle County. He
explained that one of the main things was that at the approval of the Napa Store, Tom Stone tried to
resolve the issue. He believed that this had been resolved. At the time he believed that Bonnie and
Adele Hubell did not believe there was an access issue at that time. He is asking for guidance from the
Board as to how to resolve the problem. He re-stated that the Board has the option to condemn the area
in question to provide the right of way. He asked Mr. Beckler to show how the 70 foot strip became a
problem.
Mark Beckler explained that what happened was the Crawford's branched off and subdivided
their properties. He showed a map highlighting the portion in question. He explained that the deeds
called out in separate boundaries along a distance to a point on the EI Jebel Road right of way. He
believed that there was always the thought that this right of way existed. The next exhibits he presented
were possible solutions to the problem. He showed several areas on the map that would need to be
acquired in order to facilitate the Blue Ridge application.
Chairman Gallagher asked if Mr. Vengrin had an opportunity to review the drawings.
Mr. Vengrin stated he had not.
Chairman Gallagher stated this was not a file hearing.
Dan Kerst stated the Crawford family did not indicate that there was a problem with the access
situation. He stated that Crawford Properties LLC has committed to assure legal access from Blue
Ridge Lane to EI Jebel Road as it exists, as a prescriptive easement. He also stated that Mr. Beckler's
statements about historic deeds that have gone back and forth have all been based on historic vesting
deeds. He stated that none of the deeds have a description of anything approaching a 70 foot right of
way. He stated there is only a prescriptive easement on this County road. He handed out an exhibit
map. The map detailed the frontage road right of way. The Crawfords thought that they had dedicated
this portion of Blue Ridge Lane. He stated that this document created some confusion but did not

convey any rights. He disagreed that the question is ownership. He stated that the Crawfords owned
this property.
He approached and gave copies ofa letter from Schenk, Kerst and Dewinter, LLP. This letter
detailed some of the history of what the Crawfords have done to cooperate. This letter spoke to some
conditions for their cooperation with the expanded right of way.
Mr. Kerst distributed a detailed map of the proposed right of way. He stated that all parties were
interested in a solution. He stated this is a very congested traffic area. He distributed another detailed
map which highlighted fine nuances regarding the area below Gillespie Lane. He pointed out the
difference between the proposed Sopris Engineering solution compared to the Crawfords solution. He
stated that this shows that the Crawfords proposal would be adequate to solve the problem.
Chairman Gallagher asked if the applicant had further comment
Yancy Nicolas stated they are all trying to get a workable solution. He stated he met with the
Crawfords on site and tried to take all of their concerns and issues into account. He stated at one point
the Crawfords agreed that the design that was presented by Sopris was the only one that would work
without variances. He stated that Sopris worked out the engineering.
Chairman Gallagher asked about the speed limit at that site.
Mr. Nicolas replied he believed it was 35MPH.
Chairman Gallagher stated he believed that Sopris Engineering should seek a variance.
Mr. Nicolas explained a variance would have additional impacts on the intersection.
Chairman Gallagher asked about the willingness on the part of the applicant for the two parties
engineers to work together to make it work. He expressed his hesitation to use imminent domain to
make the right of way work.
Mr. 1som explained some of the history of past discussions. He explained they didn't control the
Wendy's site. Wendy's is responsible for the site. Mr. 1som stated it is his desire to get the deal agreed
to quickly.
Mr. Kerst stated the Crawfords are ready to cooperate.
Commissioner Stone stated he thought all of this had been resolved. He stated when the
Crawfords came to the Board previously he tried to address the ongoing discussion. He didn't believe
that the printed minutes explain what he was trying to do. He believed he had tried to resolve it for
everyone's benefit. He believed there was a tie to the condition of approval of the Crawford commercial
building. One ofthe statements was that the Board didn't have an issue with the right of way, the main
concern seemed to be the relocation of utilities and the cost of the same. There were statements made at
the time that the Board did not have an easement problem. He thought the resolution should take 30
days if the two parties were willing to settle it once and for all without looking at the process to see who
can get the last drop of blood. He didn't see any reason why the County should have to employ its
powers of eminent domain. He believes there are plenty of statements on the record. He suggested this
be resolved within the next 30 days, where both parties exhibited a spirit of cooperation without
continuing to come up with more issues. He wasn't sure what he could do to promote this to happen
except to ask County Attorney.
Walter Mathews, Deputy County Attorney, stated some research would be needed. He didn't
believe the County had any way to force the two parties to cooperate.
Chairman Gallagher asked the staff to research the issue. He concurred with Commissioner
Stone about the need to have the two parties work together quickly. He also asked Eagle County's
Engineers to advise about the extent desired for the right of way.
Commissioner Stone offered to play the role of a third party mediator. In this role he would
support the health and welfare of the County. He asked the applicant if this sounded reasonable.
Mr. 1som stated he would welcome County staff to attend the meetings.
Commissioner Stone stated variances had been made with critical findings. He stated the County
would be open to a variance with these conditions.
Chairman Gallagher asked staff to facilitate getting together to work it out.

Mr. Kerst stated he was concerned because of the issue with the type of County road expansion
not on the mind of the Crawfords. He stated that ifit had been made a condition for a right of way as a
condition of the EI Jebel Commercial Building he would have expressed that it wasn't acceptable.
Commissioner Stone expressed that his recollection was different. He hoped that Mr. Kerst
would enter into negotiations in a cooperative manner.
