Chairman Gallagher stated the first matter before the Board was an Executive Session.
Commissioner Stone moved to adjourn into an Executive Session for the purpose of receiving
legal advice concerning the Blue Ridge Subdivision, for the purpose of receiving legal advice regarding
negotions with the School District, Water Authority, Berry Creek and Berry Creek Water, as well as
concerning pending litigation with Cacioppo and the County, and finally on Brotman Land Board case,
all of which are appropriate topics pursuant to C.R.S. 24-6-402 (4) (b) and (e).

Diane Mauriello, County Attorney, stated she would like to pull item E, the Agreement between
the County and the Federal Aviation Administration.
Commissioner Stone moved to approve the Consent Agenda as presented, deleting item E, the
agreement between the Federal Aviation Administration and Eagle County.

Plat & Resolution Signing
Cliff Simonton, Planner, presented the following plats and resolutions for the Board's
consideration:
Resolution 2003-004, to Approve a Permit to Construct Major Extensions of
Existing Domestic Water and Sewage Treatment Systems and for the Efficient Utilization of a
Municipal Water Project in order to serve the Chaveno Parcel, or Planning Parcel "E" of the
Cordillera PUD (Eagle County File No. 1041-42). The Board considered the Applicant's request on
June 18, 2002.

Certification, Head Start Compliance
Kathleen Forinash, Health & Human Services Director, presented the certification of Head Start
Administrative and Programmatic Compliance. Ms. Forinash explained the review that took place in
June of last year and the areas that were needing completion to be in compliance. Today they can certify
that they are in full compliance with the federal requirements.
Commissioner Stone moved to approve the certification of Head Start Administrative and
Programmatic Compliance.

Resolution 2003-005, Commendation of Sheriff A.J. Johnson
Chairman Pro-tern Menconi presented Resolution 2003-005, commendation and recognition of
public service for Sheriff A I. Johnson.
Commissioner Stone read the Resolution for the record as follows:
"Whereas, the Board of County Commissioners of the County of Eagle, State of Colorado
(hereinafter "the Board"), wishes to commend and recognize the public service of Sheriff AJ. Johnson;
and
Whereas, AJ. Johnson has served the citizens of Eagle County for 20 years in the finest tradition
of public service; and,
Whereas, AI. Johnson has shown exceptional allegiance, diplomacy and commitment to Eagle
County and its citizens; and,
Whereas, AJ. Johnson has provided the Sheriffs department with a model for teamwork and
camaraderie for the future and the County with the leadership to create a new jail and a victim's
assistance program; and,
Whereas, the Board desires to recognize the many contributions that AJ. Johnson has made to

AFP-00137, ParcellS, Remonov Center
Joseph Forinash, Planner, presented file number AFP-00137, Remonov Center. He stated this
was amended final plat which would vacate the common property line between Parcel 12, Remonov
Center, and Lot C-1, South Forty Subdivision, and dedicate additional right-of-way along Edwards
Village Boulevard.
The chronology of the application is as shown on staff report and as follows:
1976 - Final Plat for South Forty Subdivision - Filing No. 1 approved creating Lot C-1.
1981 - Final Plat approved for Edwards Village creating Parcel 3.
1985 - Final Plat approved for Edwards Village Center creating Parcel 10 and Tract T from a
portion of what had been Parcel 3 of Edwards Village.
1996 - Final Plat approved for Remonov Center creating Parcel 12 out of what had been Parcel
10 and a portion of Tract T of Edwards Village Center
2002 - A zone change to re-zone Lot C-1, South Forty Subdivision, from Commercial Limited
(CL) to Commercial General (CG), and Special Use Permit for a 50,382 + square foot commercial
development on this site, contingent in part on approval of an amended final plat which is consistent
with the purposes of this plat, approved by the Board of County Commissioners.
Staff findings are as follows and as shown on staff report:
Pursuant to Section 5-290.G.2 of the Eagle County Land Use Regulations, the Community
Development Director has made the following findings:
a. The Amended Final Plat DOES NOT adversely affect adjacent property owners.

Chairman Pro-tern Menconi asked for public comment. There was none.
Commissioner Stone asked if they are still having discussions about road impact fees.
Mr. Forinash stated that discussion will be taking place on the 14th of this month.
Commissioner Stone asked if that discussion will have bearing on this application for final plat
approval.
Ms. Mauriello stated this is purely an amendment to the final plat. The road impact fees are a
separate issue.
Commissioner Stone asked Mr. Mueller where they are in the process.
Mr. Mueller stated they are filing a fee under protest which fees will then be considered in the
hearing on the 14th.
Ms. Mauriello stated that process is in accordance with State Statutes.

Remonov Center, incorporating the Staff findings and authorize the Chairman to sign the plat.

ZS-00071 American Gypsum
lena Skinner, Planner, presented file number ZS-00071, American Gypsum. She stated
American Gypsum has been mining near the Town of Gypsum since the mid 1980's. A Special Use
Permit (ZS-195-90-A) for the purpose of extracting gypsum resources currently exists. The company is
mining in what is called the Eagle Gypsum Mine, north of the Town. The applicant is applying for a
new Special Use Permit (as Eagle County does not have an amendment procedure for Special Use
Permits) for the purpose of continued extraction of gypsum in the existing mining area, as well as future
extraction in a second mining area (found east of the original mine location; see attached). All
processing of material will continue in the American Gypsum wallboard manufacturing facility located
within the Town of Gypsum. Conditions placed on the existing Special Use Permit are to remain in full
effect.
Gypsum ore reserves in the existing mining operation are estimated to last another five (5) years,
at full production. The applicant is applying for the expansion at this juncture to accommodate the long
range planning needs of the company; the haul road for the new mining area will take at least three years
to construct, leaving a two year "buffer" to absorb any unseen circumstances surrounding the existing
reserves, road construction, preliminary mining development, etc.
The chronology of the application is as shown on staff report and as follows:
1984: Board of County Commissioners approved a Special Use Permit for gypsum mining and
processmg.
1986: Board of County Commissioners approved an amendment to the previous Special Use
Permit to expand the mining location.
1990: Board of County Commissioners approved an amendment to the previous Special Use
Permit to expand the mining location, and the amount ofland disturbed at one time from 15, to 25 acres.
2000: American Gypsum (formally known as Centex) makes and application for a mine
expanSIOn.
October, 2002: File is complete: BLM approves expansion.
Upon viewing a detailed presentation made by the applicants, the Planning Commission had no
concerns with the Special Use Permit proposal; they neither added nor altered any of Staffs conditions,
nor offered any further comments.
Referral responses are as follows and as shown on staff report. The date for referral returns was
November 14th, 2002.

Visited the property to review plans.
Proposed amendment is located on approximately 420 acres of land northeast of the existing
mining location; the mine is not located near any residential developments or public facilities.
The proposed mine site contains moderate to steep slopes with sparse vegetation.
The proposed mining plan is to excavate the new ore body in five stages and reclaim each pit as
mining progresses; I have no objections.
The proposed slope reclamation of 2.5: 1 appear to be satisfactory.
To ensure slope stability, compaction of the embankment fills should be verified during
placement.
Sediment basins throughout the mine should be maintained and cleared regularly to ensure
proper function in storms.
Additional Referrals were sent to the following:
Eagle County: Engineering, Attorney, Environmental Health, Assessors, Road and Bridge; and
Sheriff, Colorado State: Forest Service, Division of Wildlife and Division of Minerals and Geology.
Bureau of Land Management, Natural Resources Conservation Service, Gypsum Fire, NWCOG, Eagle
County Historical Society, Town of Gypsum. The leaders labeling the 1 00 year flood plain line on sheets
4 and 5 must not also point to the boundary line. The text calling out the pond must be revised to:

Neither the existing, nor the proposed mining areas fall within the identified, unique land form
areas of Eagle County; the mining areas are located well north of the recognized "Gypsum Cliffs."
Concerning the visual qualities ofthe area. The new mining area is visual from the Town of Gypsum,
American Gypsum has proposed a "reclaim as you go" mining plan. This action will significantly
reduce "scarring" ofthe landscape in that the reclamation will ongoing and not put off until the mine is
expired. The reclamation will utilize a process of sequential backfilling and concurrent reclamation.

Although the mine is located in a watershed, little precipitation occurs in this area.

to be appropriate for its proposed location and be consistent with the purposes, goals, objectives and
policies of the Master Plan and Master Plan FLUM, and related sub-area master plans.
STANDARD: Section 5-250.B.2 Compatibility. The proposed Special Use shall be
appropriate for its proposed location and compatible with the character of surrounding land uses.
The new mining area activity will be replacing the current extraction activity in the existing
mine, traffic and noise levels should remain constant. The applicant has shown, by past example, that
the areas disturbed by the mining operation can, and have been adequately reclaimed. The proposed
method of subsequent backfill reclamation will also be highly effective in visual mitigation.
[+] FINDING: Compatibility. The proposed Special Use IS appropriate for its proposed
location and IS compatible with the character of surrounding land uses.
STANDARD: Section 5-250.B.3 Zone District Standards. The proposed Special Use shall
comply with the standards of the zone district in which it is located and any standards applicable to the
particular use, as identified in Section 3-310, Review Standards Applicable to Particular Residential.
Agricultural and Resource Uses and Section 3-330, Review Standards Avvlicable to Particular
Commercial and Industrial Uses.
The proposed gypsum mine will be located in the Resource zone district. This Special Use
Permit is found under Section 3-1 O.P - Zone Standards for Exploration, Extraction, and Processing
Operations.
Standards 3-10.P:
[ +] 1. Environmental Impact Report. The applicant shall submit an Environmental Analysis
report in accordance with Section 4-460. Included in the report shall be a depiction of location, scope
and design of the proposed use, and an explanation of its operational characteristics and impacts.
[ +] 2. Compliance. The proposed Special Use will be designed and operated in compliance
with all applicable laws and regulations of the County, State, and Federal Governments, and shall not
adversely effect:
a. Water. Existing lawful use of water, through depletion or pollution.
b. Adjacent Land Uses. Adjacent land uses, through generation of vapor, dust, smoke,
noise, glare, vibration or other emanations; or
c. Wildlife. Wildlife and domestic animals through creation of hazardous attractions to wildlife,
impacts on wildlife habitat, or patterns or other means.
[ +] 3. Site Plan. ...a detailed site plan shall be submitted, including landscaping sufficient to
meet the standards found is Section 4-230 Landscaping Design Standards and Materials. Security may
be required to guarantee landscaping, drainage and erosion control.
[ +] 4. Fabrication, Service and Repair All fabrication, service and repair activities associated
with the use shall be conducted within a building (except for incidental repair activities) unless the
applicant demonstrate that it is not practical to do so and insures that all impacts from outside activities
are mitigated.
[+] 5. Storage. All storage of materials associated with the operation shall occur within a
building, or shall be obscured by an opaque fence.
[+] FINDING: Zone District Standards. The proposed Special Use DOES comply with the
standards of the zone district in which it is located and the standards applicable to the particular use, as
identified in Section 3-310, Review Standards Applicable to Particular Residential. Agricultural and
Resource Uses
STANDARD: Section 5-250.B.4 Design Minimizes Adverse Impact The design of the
proposed Special Use shall minimize adverse impacts, including visual impact of the proposed use on
adjacent lands; furthermore, the proposed Special Use shall avoid significant adverse impact on
surrounding lands regarding trash, traffic, service delivery, parking and loading, odors, noise, glare,
and vibration, and shall not create a nuisance.
Plans to reduce visual impacts related to mining operations through reclamation backfilling and
landscaping will minimize any adverse impacts. Extraction activities will remain constant as the
operations transition from the existing mining area to the proposed area. As such, traffic (hauling),
trash, parking and loading, odors, glare and vibration and noise levels should remain constant.
[+] FINDING: Design Minimizes Adverse Impact. The design ofthe proposed Special Use
DOES adequately minimize adverse impacts, including visual impact of the proposed use on adjacent
lands. The Special Use WILL avoid significant adverse impact on surrounding lands regarding trash,
service delivery, parking and loading, odors, glare, and vibration. Adverse impact on surrounding lands
regarding noise and traffic, WILL NOT create a nuisance.
STANDARD: Section 5-250.B.5 Design Minimizes Environmental Impact. The proposed
Special Use shall minimize environmental impacts and shall not cause significant deterioration of water
and air resources, wildlife habitat, scenic resources, and other natural resources.
Referral agents have head either no comment, or positive recommendations concerning this
application. The applicant has also incorporated standards and conditions set forth by the Bureau of
Land Management, and the Department of Minerals and Geology.
[+] FINDING: Design Minimizes Environmental Impact. The proposed Special Use CAN
fully minimize environmental impacts, and though it will not cause significant deterioration of water and
air resources, wildlife habitat, and other natural resources, it WILL NOT cause significant deterioration
to scenic resources.
STANDARD: Section 5-250.B.6 Impact on Public Facilities. The proposed Special Use
shall be adequately served by public facilities and services, including roads, pedestrian paths, potable
water and wastewater facilities, parks, schools, police and fire protection, and emergency medical
services.
The mine provides potable water (bottled) and on site sewage disposal. The proposed mining
area will eventually replace the existing mining operation, there should be no increased impacts to roads,
parks and schools, because mining operations will not be increased as a result of this Special Use
Operations.
[+] FINDING: Impact on Public Facilities. The proposed Special Use IS adequately served
by public facilities and services such as roads, pedestrian paths, potable water and waste water facilities,
parks, schools, police and fire protection, and emergency medical services.
STANDARD: Section 5-250.B.7 Site Development Standards. The proposed Special Use
shall comply with the appropriate standards in Article 4, Site Development Standards.

Steve Onorofskie, Steve Wensel, and Bill Baxter were present for the hearing. Mr.Onorofskie
stated they are doing this well in advance to accommodate the long range planning. The maximum rate
of production will allow them to continue operations in five years. The future operation does not
represent an expansion of the current operations. He explained the reclamation plans. He stated this
transition will need to be in place for the next five years to meet their production schedule. He spoke to
the relocation plan and the plans for the new area. He described the project area. He stated the area is
mostly solid Gypsum with little vegetation or animal habitat. He stated the ash will serve as topsoil for
revegetation. He spoke to the planning process so far and spoke to DMG (Division of Mining and
Geology) plan and the various components. He stated the DMG plan has been finalized and has been
accepted by the State of Colorado. He stated the project area is entirely within BLM land and has passed
the NEP A conformance review. He reviewed the other impact reviews and the procedures used to
approve this. He spoke to the scoping issues including air quality, wildlife, water quality, cultural
resources, native american religious concerns, reclamation and soil stability, recreation, transportation,
noise, socio-economics, minerals management, and visual resources. He reviewed the approval aspects
by the BLM. He spoke to the plan and the development of a new access road of 1.2 miles. When
complete, the mining will be done in incremental stages for re-sloping as it progresses downward. He
spoke to the equipment to be utilized. Mechanical mining methods will be used as they are now.

Material is cut into neat windows simulating farming and the harvest of gypsum. Dust control is
accomplished by using dust suppressant treatment on the haul roads. First stage, Stage A, will be a three
year production plan. He explained the stage processing. When stage A is complete, it will be
backfilled by production of Stage B. There will be five stages over 21 years. Stage E will be the final
four years. When complete the access road will be hauled back and re-sloped. Final reclamation will
then be completed. He showed a mine view model animation. He showed a topographic view of the
area and the various staging periods. Final reclamation will be similar but lower in elevation. He spoke
to the visual analysis taken to meet the BLM requirements. He stated revegetation will also be similar to
current vegetation. He explained the revegetation process. He spoke to dust mitigation and that the
successful procedures currently in place will be utilized. He spoke to dust factor mitigation and showed
slides explaining there will be a smaller footprint of mining activity compared to current operation. He
stated operations will shut down during high wind periods. For haul roads, the road length will decrease
as mining progresses down. He spoke to Highway 6 and the use of truck washing and CDOT assistance
with sweeping. He spoke to the emissions within the plant. He spoke to the present operation's success
and the elements they have implemented thus far and intend on including in the future.
Chairman Pro-tem Menconi asked for public comment. There was none.
Commissioner Stone stated he had no questions.
Chairman Pro-tem Menconi asked about extending the term of the Special Use Permit.
Ms. Skinner stated they have to replace the Special Use Permit with the new application.
Chairman Pro-tem Menconi asked how much longer they have on their Special Use Permit.
Mr. Onorofskie stated they currently have five years and then they will transition to the new area.
Chairman Pro-tern Menconi asked how much time they have allowed to them.
Mr. Onorofskie stated he is not aware of any time limitation.
Commissioner Stone moved the Board of County Commissioners approve File No. ZS-00071,
American Gypsum, incorporating all Staff findings, and the following conditions:
1. Except as otherwise modified by this Permit, all material representations made by the
Applicant in this application and in public meeting shall be adhered to and considered conditions of
approval.
2. This Special Use Permit shall be valid concurrent with approved permits from the Bureau of
Land Management and the Division of Minerals and Geology.
3. All existing conditions governing the existing mining area found in Resolution No. 92-119,
shall remain in full effect, until this portion ofthe mine is completed (see attached Exhibit B).
4. A dust control plan shall be submitted to the Engineering department with the new haul road
grading permit application.
5. All applicable State and Federal standards, regarding air quality, shall be met and adhered to.
6. With the exception ofthe transition or buffer period needed to transfer operations from the
current site to the future site, the maximum amount of land disturbed for mining and excavation, at any

7. Dust suppressants shall be utilized regularly, as necessary.
8. Hours of hauling operation shall be limited to a ten (10) hour day.
9. The applicant shall maintain that portion of County Road No. 51 being used for mining
operations, in a condition satisfactory to the County.
