Consent Agenda
Chairman Gallagher stated the first matter before the Board was the Consent Agenda as follows:
A) Approval of bill paying for the week of November 11,2002, subject to review by
County Administrator
B) Approval of payroll for November 14,2002, subject to review by County
Administrator
C) Approval of the minutes of the Board of County Commissioners meeting for October
17,2002
D) Agreement between the County of Eagle and the Eagle River Youth Coalition for
activities related to the implementation of the Eagle County Communities of Excellence in Tobacco
Control
E) Agreement between the County of Eagle and Jennifer Fornberg, Psyd, for infant and
toddler services
F) Resolution 2002-159, conferring Power of Attorney upon Diane H. Mauriello, County
Attorney, Bryan R. Treu, Assistant County Attorney and Bruce Strasinger, Paralegal, to act as Attorney
in Fact for the County of Eagle, State of Colorado, with respect to Letter of Credit No. 523, in the

Chairman Gallagher asked if there were any changes to the Consent Agenda.
Diane Mauriello, County Attorney, stated there are no revisions or changes to the Consent
Agenda.
Chairman Gallagher asked Ms. Forinash about item E, Agreement between Eagle County and
Jennifer Fornberg, Psyd. He spoke to the $60.00 per hour in the contract, but related he did not see a
cap.
Kathleen Forinash, Health & Human Services Director, stated rather than put a cap, they put a
pre-authorization for the sessions.
Chairman Gallagher asked if there is a cap on the number of sessions.
Ms. Forinash explained they have a system for obligating funds and are able to track the use.
Commissioner Stone spoke to item F, a Letter of Credit for PPG, Red Sky Corporation. He
asked if there is a need to call on that Letter of Credit.
Ms. Mauriello stated they expect to receive the new Letter of Credit before the week's end.
Commissioner Stone moved to approve the Consent Agenda as presented.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Plat & Resolution Signing
Bob Narracci, Planner, presented the following plats and resolutions for the Board's
consideration:
5MB-00312. The Homestead - Filine 2. Blocks 13 thru 16. A Resubdivision A Final
Plat, the purpose of which is to subdivide Lot 3, The Homestead, Filing 2, to create two (2), 'li duplex
lots, Lot 3A and Lot 3B. Staff findings are as follows:
Pursuant to Section 5-290 (G) (1) of the Eagle County Land Use Regulations:
5-290 (G) (1) Standards for Type A and Type B Subdivision
(G) Standards. The Board of County Commissioners and the Community Development Director

Resolution 2002-160, Fifth Supplementary Budget
Mike Roeper, Finance Director, presented Resolution 2002-160, adopting a fifth supplementary
budget and appropriation of anticipated revenues for Fiscal Year 2002, and authorizing the transfer of
budgeted and appropriated monies between various spending agencies. He explained this request has
revised expenditures of$639,603.00 and revenues of$654,603.00, which includes the revision of
expenditures of$175,000 for Mountain Glen.
Commissioner Menconi asked about the expenditure of $6,970.00 for the Condominium
Association special assessment at the Avon Center building, do they have someone who represents the
County at the Association meetings.
Jack Ingstad, County Administrator, stated that Rich Cunningham, Director of Facilities
Management, serves as the County's representative on this Board. He explained this is in part to the
increased costs and the County will also see an increase in costs due to the Drivers License Examiners
leaving at the end of October.
Commissioner Menconi spoke to the improvements to the general area.
Mr. Ingstad stated there is a major renovation going on and this is the special assessed share.
Commissioner Menconi asked for an update on what is going on at that facility. He stated other
tenants are also amazed at the amount of improvements that go on in this building.
Commissioner Stone moved to approve Resolution 2002-160, adopting a fifth supplementary
budget and appropriation of anticipated revenues for Fiscal Year 2002, and authorizing the transfer of
budgeted and appropriated monies between various spending agencies.
Commissioner Menconi seconded the motion.
Commissioner Menconi stated again that he would be more than willing to add his expertise in
property management to assist in the reduction of expenses in hopes that they don't have to incur all of
the costs that have been approved today.
Chairman Gallagher called for the question on the motion. The vote was declared unanimous.
3rd Quarter Interest Report
Karen Shaeffer, Eagle County Treasurer, presented the 3rd Quarter Interest Report for the Board's

review. She stated it does look as though they will reach the interest revenues budget this year.
Commissioner Menconi asked how the property sale went.
Ms. Shaeffer explained they did very well and had no strike offs to Eagle County.
Resolution 2002-161, Try Transit Week
Diane Mauriello presented Resolution 2002-161, designation of November 23rd thru the 28th,
2002, as Try Transit Week.
Ms. Mauriello stated this is simply a designation for the week of November 23rd thru 28th as Try
Transit Week. She stated the resolution is a statement from the Board of County Commissioners to try
transit this week.
Chairman Gallagher spoke to the importance of public transit and the use of the bus.
For the record, the resolution is as follows:
"Whereas, the Board of County Commissioners of the County of Eagle, State of
Colorado (hereinafter the "Board") acknowledges that public transportation is vital to the quality of life
and the economic well-being of the citizens of Eagle County; and
Whereas, workers, school children, senior citizens, people with disabilities, and those unable to
afford automobiles use public transportation to gain access to jobs, schools, medical facilities, and other
fundamental services; and
Whereas, the Board wishes to join ECO Transit, Town of Avon, Town of Vail, and others in
celebrating "Try Transit Week" on November 23rd to 28th, 2002; and
Whereas, "Try Transit Week" promotes the benefits of effective transit service, builds public
support by increasing awareness of how public transportation betters the quality oflife in Eagle County,
attracts new customers to transit service, and honors both transit employees and regular customers; and
Whereas, the Board desires to encourage all citizens to celebrate the many benefits our
community experiences when more people use public transportation; and
Whereas, the Board desires to encourage all employers to emphasize the many benefits of public
transportation to their employees.
Now, therefore, be it resolved by the Board of County Commissioners of the County of Eagle,
State of Colorado:
That, the Board hereby finds, determines and declares that November 23rd to 28th, 2002, shall be
designated as "Try Transit Week" in Eagle County and be celebrated by families and communities
throughout Eagle County. The Board calls upon all citizens to examine their personal travel choices, to
commute via transit or share a ride during "Try Transit Week."
That, the Board hereby finds, determined and declares that this Resolution is necessary for the
public health, safety and welfare of the residents of the County of Eagle, State of Colorado.
Moved, read and adopted by the Board of County Commissioners of the County of Eagle, State
of Colorado, at its regular meeting held the 12th day of November, 2002.

Earlene Roach, Liquor Inspector, presented the Liquor License Consent Agenda as follows:

Alpinista Pizzeria
This is a renewal of a hotel & restaurant license. This establishment is
located in the Riverwalk Center in Edwards. There have been no
complaints or disturbances during the past year.
B) Wolcott Market, L TD
Wolcott Liquors
This is a renewal of a retail liquor store license. This establishment is
located along Highway 6 in Wolcott. There have been no complaints or
disturbances during the past year.

Wolcott Market
This is a renewal of a 3.2% QffPremise Beer License. This establishment
is located along Highway 6 in Wolcott. There have been no complaints or
disturbances during the past year.
Ms. Roach stated there have been no complaints or disturbances for the last year and staff
recommends approval.
Commissioner Menconi moved to approve the Liquor License Consent Agenda for November
12,2002, as presented.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Shop & Hop
Earlene Roach presented a request for continuance of a scheduled Show Cause hearing for
Terrance S. Marcum, d/b/a Shop & Hop. She stated Mr. Marcum has purchased non-refundable tickets
for the date of the hearing. Staff recommended approval of the continuance and requested the Board re-
schedule the hearing to December 10, 2002.
Chairman Gallagher asked Mr. Marcum where he is going.
Mr. Marcum stated he is going to Arizona for a hunting trip and it will cost him considerably if
he must cancel.
Commissioner Stone moved to accept the continuance request from Terrance S. Marcum, d/b/a
Shop and Hop and reschedule the Show Cause Hearing to December 10, 2002.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
South Forty Liquors
Earlene Roach presented a request for continuance of a scheduled Show Cause hearing for
Edwards Discount Liquors, Inc., d/b/a South Forty Liquors. Staff recommended approval ofthe
continuance and requested the Board reschedule the Show Cause Hearing to December 10, 2002. She
stated Larry Esqwith, applicant, is present. He is also going to be out of town.
Larry Esqwith stated he has booked non-refundable tickets to Tampa, Florida to visit family. He
stated his wife will also be attending a training academy while there.
Commissioner Menconi moved to accept the continuance request from Edwards Discount

SE-00033, Ostrander Exemption
Ross Easterling, Planner, presented file number SE-00033, Ostrander Exemption. He stated the
purpose of this application is to obtain subdivision exemption approval in accordance with Section 5-
270 of the Eagle County Land Use Regulations. The parcel is a pre-existing lot of record created prior to
August 22, 1984. The subject parcel was created and conveyed by Neil and Polly Gray to Phyllis T.
Pender and T.C. Pender on October 26, 1965. Eighteen (18) months prior to the creation ofthis parcel
Eagle County adopted procedures to subdivide property. The Ostrander's acquired the property in
October 2001 and applied for a building permit for a single family home earlier this year. The building
permit has been approved by the Environmental Health and Building Divisions. Upon execution ofthis
exemption plat the building permit will be released to the applicants. Road impact fees have been paid.

AFP-00145, Beard Subdivision
Jena Skinner, Planner, presented file number AFP-00145, Beard Subdivision. She stated the
intent of this plat is to reconfigure a shared lot line between Parcels 1A and lB. Each parcel will
maintain the Agricultural Residential zone district minimum of 10 acres.
Staff findings are as shown on staff report and as follows:
Pursuant to Section 5-90.G.2. Standards for Amended Final Plat:
Adjacent property.
Review of the Amended Final Plat has determined that the proposed amendment DOES NOT
have an adverse effect on adjacent property owners. The following adjacent properties have been
notified: R. G. Jacobs, Eileen Forte-Jacobs, and Steven Kern, Lynne Nelson Kerne. No letters of
opposition have been received by the Community Development Department, from any of these owners,
prior to the distribution of this Staff report.

Ms. Skinner stated the adjoining property owner was concerned with the creek however, the
applicant does not intend to make any changes to the creek nor to Spring Creek Road and it is shown
that way on the plat.
David Nudell, representing the applicant, stated Ms. Jacobs has agreed with the proposal.
Chairman Gallagher asked if the notice needs to be redone or can the Board continue.
Kevin French, applicant, the easement did exist prior to any of the proposed changes. Instead of
having the easement going across the creek, he has angled it so that it avoids the creek.
Ann Kaffkart, area resident, stated she is not an adjacent homeowners, but they would all like to
know what is going on.
Archie Jacobs, adjacent property owner, stated he heard rumors and related he was not notified
by the County. He stated he does not know ifhe objects or not as he does not know what is happening.
Ms. Mauriello stated she does not know if there is proof of the mailing other than a notification
on the computer. She stated the Regulations indicate notice must be given to all adjacent property

owners.
Commissioner Stone stated for the applicants benefit it would be wise to take the two weeks and
come back with this application on the 26th of November.
Chairman Gallagher suggested the applicant could speak to Mr. Jacobs and report back later in
the day.
Mr. Ingstad suggested if the notices were not mailed this process could be challenged.
Commissioner Stone moved the Board table File No. AFP-00145, Beard Subdivision, to
November 26, 2002 at the applicants requests.

AFP-00157, Lot 36, Cordillera
Bob Narracci presented file number AFP-00157, Lot 36, Cordillera. He stated this was an
Amended Final Plat, the intent of which is to reconfigure lot lines between Lot 36, Filing 1 and Filing 2
(Phase 1 of the Les Pyrenes Townhomes), Lot 1, Filing 1 (The Lodge at Cordillera), and Tract X, Filing
3, an as yet undeveloped parcel in the Cordillera Subdivision. This plat adjusts lot lines to better match
existing above-ground improvements and below-ground utility installations.
Staff findings are as shown on staff report and as follows:
Pursuant to Section 5-290.G.3 of the Eagle County Land Use Regulations, the
Community Development Director has considered the following in the review of the Amended
Final Plat:
a. Adjacent Property. Fifteen (15) adjacent property owners were notified. No comments or
letters have been received. The proposed amendment does not adversely effect adjacent property
owners;
b. Final Plat Consistency. The proposed amendment is consistent with the intent of the Final
Plat;
c. Conformance with Final Plat Requirements. The proposed amendment conforms to the
Final Plat requirements and other applicable regulations, policies and guidelines;
d. Improvements Agreement. An improvements agreement is not applicable; and
e. Restrictive Plat Note Alteration. A restrictive plat note alteration is not applicable.
Lance Badger, representing Kensington Partners, stated these properties were created
approximately 10 years ago. This application is to clean up the boundary lines and is merely a
housekeeping item.
Commissioner Stone questioned the maps.
Mr. Badger stated those two parcels were part of the same planning parcels. He stated he does
not know how they came out as they are currently shown but they are trying to clean it up.
Commissioner Stone asked if this gives the applicant the ability to build additional structures or
expand to Tract X.
Mr. Badger stated the tract boundary is a legal description but the legal description encompasses
all the boundaries. He stated the uses are permitted under the planning parcel description.
Commissioner Stone stated it appears the applicant could build on a larger area. He stated he is
curious as to if the neighbors have any issues or if they have been notified.
Mr. Badger stated the village center can be built on either parcel. He stated this is the last piece
of property in Cordillera to be developed. He gave examples of the zoning. He stated they could put
townhomes or village homes on this property today.
Commissioner Stone stated he is trying to avoid problems with neighboring property owners.
Chairman Gallagher stated they are not changing their development rights on the parcel.

Chairman Gallagher stated this work session is to review Chapter 37 of the Land Use Regulation
files LUR-0038, Local Resident Housing Requirements, LUR-0039, Inclusionary Housing, LUR-0040,
Residential Employee Housing Linkage and LUR-0041, Commercial Employee Housing Linkage. He
stated these are draft regulations. He stated he would like to discuss these files with the various Towns
within Eagle County to determine ifthere is a need for these Regulations. He stated he has been told
that the municipalities are waiting for the County to pass the regulations then they will begin work on
theirs.
Commissioner Menconi thanked everyone for their attendance.
Discussion ensued on the proposed Regulations.
Commissioner Stone moved to table file number LUR-0038, Local Resident Housing,
Requirements, LUR-0039, Inclusionary Housing, LUR-0040, Residential Employee Housing Linkage
LUR-0041, Commercial Employee Housing Linkage, to January 7,2003.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
There being no further business to be brought before the Board the meeting was adjourned until
November 19,2002.
