Fisher Commissioner Commissioner Deputy County Attorney County Administrator Clerk to the Board Absent: Tom Stone Chairman This being a Special Meeting the following items were presented to the Board of County Commissioners for their consideration: Public Hearing, Roaring Fork Open Space Parks & Rec District Renee Black, Asst. County Attorney, presented the first item on the agenda, a public hearing on the Roaring Fork Open Space Parks and Recreation Special District. Ms. Black introduced Bob Schultz. Bob Schultz spoke to the Amendments to Service Plan, stating these were written through Sherman and Howard and there are wording changes. He stated the first has to do with the power of condemnation. He stated this district would have very limited powers of condemnation and have no interest in waging power of condemnation looking only for voluntary land owners to sell. He stated Mr. Jordan had a specific approach for doing so, and they have something that ties their hands for future endeavors. The second has to do with the consent to formation of other park and recreation districts. He spoke to the rec district for the Tree Farm and he has seen discussion for a county-wide district. They would consent to not having to have any right to battle or screen future park and recreation districts. The third was a concern expressed in Garfield County that this could be construed as a plot to try and block growth by preventing the extension of utilities. He stated they are not in the business to cause any forward movement of utilities. The fourth is the relationship with the County. He spoke to the Statutes and the governing entity having the opportunity to review any proposed purchases. They are happy to comply. The fifth is the cap on the tax rate. They believe it is important to place a cap though they pay a higher interest rate. He did not feel comfortable not being able to give an exact figure. On number six, it is another wording change recommended by Blake Jordan and it is the prelude to the split of funding. He stated 70% is for land purchased, 15% for trails and recreation and 15% for administration and overhead. Ms. Black pointed out that page six may be missing. Mr. Schultz stated that part did not change. Chairman Pro-tern Phillips asked if the district has heard from anyone who had requested to be excluded? Mr. Schultz stated he heard only from one land owner who was out of state and initially wanted to be excluded and now felt better about being in the district. He suggested there have been a total of two other telephone calls and those had not had the benefit of the articles. Ms. Black stated after the date they heard exclusions, there has been one additional letter submitted, though there is no name or address attached. Mr. Schultz stated Ms. Grant has previously asked to be excluded. Chairman Pro-tern Phillips asked if anyone has talked about using this particular district to at least be the facilitator for the Tree Farm. Mr. Schultz stated he met with the Tree Farm Task Force and the discussion is around who will 1 09-12-2000 specifically use the area. He suggested the Mid- Valley Metro District may be a better match. He suggested they aren't particularly interested in that. He stated the last time he talked with the Tree Farm Task Force they were over 10 mills. He suggested he would try to get his foot in the door by putting in a couple of ball fields and then trying to sell it to the voters. He suggested the roads and the County building will be a real improvement. Chairman Pro-tem Phillips stated her concern is the overlapping districts. Mr. Schultz stated he hopes that the Metro District will step forward and abandon the recreation district and take the mill rate they are planning and put that into the Tree Farm as a act of good faith, and perhaps they can put some trails out there. Then people will start using it and perhaps open their wallets. Ms. Black suggested the exclusion was not really timely though it was listed in the paper for today's meeting as well. She recommended a motion to deny or approve the request for exclusion. Commissioner Gallagher moved to deny the request for exclusion for Eugenia Grant for the Roaring Fork Open Space Parks and Recreation Special District. Chairman Pro-tem Phillips seconded the motion. In discussion, Chairman Pro-tern Phillips stated Ms. Grant said in her letter that someone else should be paying for some of this rather than just the property owners. She also spoke to the burden on seniors with rising property tax. Chairman Pro-tern Phillips called for the question on the motion. Of the two voting Commissioners the vote was declared unanimous. Chairman Stone was not present for this hearing. Commissioner Gallagher asked if they were de-brucing on this ballot question. Mr. Schultz explained they will have four questions, formation, approval ofthe tax, authorization to bond and the de-brucing question. Then there are candidates on the ballot. He stated they have five candidates but would like to get more. He stated they are Dick Stephenson, Carter Jackson, Charlie Wellman, Tiffany Gilfred and Bill Grey. Chairman Pro-tern Phillips asked for additional discussion. There was none. Commissioner Gallagher moved to approve the Service Plan for the Roaring Fork Open Space Parks and Recreation Special District meeting. Chairman Pro-tern Phillips seconded the motion. Of the two voting Commissioners the vote was declared unanimous. Mr. Schultz spoke to the concern of signing the IGA for the cost ofthe election. They will be happy to pay for the election if they win, but if they loose, who will be required to pay the associated costs. Commissioner Gallagher stated he doesn't see any other way to form a new district and he does not believe the proponents of the proposed district should not be liable for paying for the election costs for the proposed district. Commissioner Gallagher moved to accept an agreement in writing that if the district should fail the County will absorb the cost of the election. If the district does not fail the district will pay their fair share of the election costs and Charles Wellman will be the designated election official. Chairman Pro-tern Phillips seconded the motion. Of the two voting Commissioners the vote W:iS declared unanimous.
