This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of October 26, 1998, subject to review by County Administrator
B) Approval of the minutes of the Board of County Commissioners meetings of October 5 & 13,
1998
C) Resolution 98-121 and Power of Attorney conferring authority on Attorneys Office to draw on
Letter of Credit No. 986-0193 for Robert 1. Law for $2,000.00, drawn on 1st Bank of Avon for road cut permit
2467, Letter of Credit will expire October 28, 1998
D) Resolution 98- and Power of Attorney conferring authority on Attorneys Office to draw on Letter
of Credit No. S801340 for River Pines Development for $347,452, drawn on Norwest Bank, Letter of Credit will
expire November 1, 1998
E) Resolution 98-122 and Power of Attorney conferring authority on Attorneys Office to draw on
Letter of Credit No. 6249 for Vail Corporation, Arrowhead at Vail, Filing 18 for $848,204.50, drawn on Colorado
National Bank, Letter of Credit will expire October 31, 1998

I) Presentation of Letter of Commendation to Mike Gruber.
Chairman Johnson stated he won't be voting on item B as he was not present on the 5th and only present for
part ofthe 13th.
Renee Black, Asst. County Attorney, stated items D and H are to be pulled.
George Roussos, County Engineer, spoke to item I and the resignation of Mike Gruber. He spoke to Mike's
accomplishments during his time at Eagle County and the recognition the County has received as a result of Mike's
efforts. He expressed his thanks to Mike and formally commended his accomplishments.
Chairman Johnson called Mike to the microphone. He asked Mike to recap on what he has done and why he
is leaving the County.
Mr. Gruber explained part of his job is to keep the roadways free flowing and safe for the public. He stated
he protects the roadways. He stated he is leaving because a business opportunity has come up to run a sign shop.
He suggested it up his alley and worth a try.
Mr. Roussos stated this program is Mike's legacy to County, however they have hired a replacement person
who was trained by Mike and whose application Mike supported.
Chairman Johnson spoke to the letter of commendation.
Mr. Roussos read the letter into the record.

Commissioner Phillips moved to approve Resolution 98-128, PDA-00013, Riverwalk Planned Unit
Development Amendment.
Commissioner Gates seconded the motion. Commissioners Phillips and Gates voting aye and Chairman
Johnson abstained as he was not present for the hearing.
Resolution 98-129. PDA-00011. Brett Ranch Planned Unit Development Amendment. This is a
resolution to approve the amendment to the Brett Ranch PUD Control Document. The Board considered this file on
August 31, 1998.
Commissioner Gates moved to approve Resolution 98-129, PDA-OOOII, Brett Ranch Planned Unit
Development Amendment.
Commissioner Phillips seconded the motion. Commissioners Phillips and Gates voting aye and Chairman
Johnson abstained as he was not present for the hearing.
Resolution 98-130. FDP-0001. Two Rivers Floodplain Development Permit. This is a resolution
to approve the petition to grant a floodplain development permit in order to proceed with the Two Rivers Village
Preliminary Plan and 1041 permit proceedings.
Chairman Johnson stated this matter was tabled from last week.
Steve Isom, Isom & Associates, stated they asked for time to be able to review item 15. He stated they
knew they needed to do a LOMAR.
Paul Clarkson, Senior Planner, suggested the resolutions might be mixed up.
Steve Isom stated he has not seen a copy of the Resolution.
Mr. Gallegos stated he has not either.
Ms. Black stated the floodplain was never in question.
John Vengrin, Engineering Department, stated he was the staff member who initiated the report. He stated
the FDP is not effected by the change made to the resolution. He stated a copy of this was cleared through the
attorney's office.
Chairman Johnson stated it is included with three conditions. He read those conditions into the record.
The Board concurred that was what is being considered today.
Renee Black stated the attorney's office is recommending approval.
Mr. Vengrin suggested this is the permit that needs to occur first.
Commissioner Phillips asked about the confusion.
Mr. Vengrin spoke to the public hearing of October 5 when the Board made the recommendations for
approval. The Wednesday following they received a call from FEMA and raised some issues about the timing of
the project and the building ofthe structures. They wanted to make sure if structures where built before the
LOMAR was complete, they would then require flood insurance. He spoke to the letter received from FEMA and
their recommendation the LOMAR be completed before any building takes place. They are trying to clarify the
process.
Commissioner Phillips suggested it is after the fact and has been approved. She wonders if they can do all
the additions to this after they approved it with conditions.
Ms. Black stated that is why it was advertised again.
Commissioner Phillips questioned if it is legal to bring up things after a motion has been closed.
Chairman Johnson stated the final action is the resolution for this purpose. He stated they don't have to do
the additional condition if the Board chooses not to, but FEMA has stated if building permits are issued and
structures built, the people that own the property will have to purchase flood insurance, increasing the costs to those
that build there.
Commissioner Phillips suggested they will have to have another hearing.
Ms. Black stated the final action is when this is signed. They have indicated they want to go forward. The
problem with FEMA is ifthey decide they are not in compliance they will not write flood insurance for the County.
Commissioner Phillips stated they understood they had to bring it up and out of the floodplain before any
construction started. What is being considered right now is the floodplain development plan.
Mr. Isom stated part of the application includes all of the development of this project including all the floor
elevations. He does understand this floodplain issue does include the entire project.

Mr. Isom stated they submitted the grading permit application September 14. He stated their wording
provides a little more leeway.
Commissioner Gates asked about taking up the 1041 today.
Ms. Black stated that was pulled for today and is scheduled for next week.
Chairman Johnson asked about the effects ofFEMA and the insurance rates. He asked Ms. Black for
clarification.
Ms. Black stated FEMA issues proclamations on a County wide basis and if they find they are out of
compliance they will not write insurance for the entire County.
Bob Gallegos stated he is unclear as to why they are here. He stated the Board approved the plan of the 5th
which does allow them to get building permits. He spoke to the CO's.
Chairman Johnson stated you can receive TCO's.
Mr. Gallegos questioned if they are misreading the letter from FEMA and asked if they are creating an issue.
They do have an approved project and asked if they need this additional condition. Mr. Gallegos stated they plan to
do what is required by FEMA for the LOMAR.
Chairman Johnson stated FEMA is asking the four conditions be signed off on before any building permits
are issued.
Mr. Isom referred to the one foot above and the application for flood insurance.
Mr. Clarkson questioned if that effects the flood insurance for the County.
Jim Kreutz stated there is nothing in this FEMA letter that says anything about building permits. He stated
there is no implication. It says you must comply with CLOMAR before getting the LOMAR and if you don't
comply you have to get flood insurance. He stated there is nothing that says the County can't issue building permits
and if it does that the County is in jeopardy.
Mr. Gallegos suggested they would like to bring in their land use attorney as he feels they are creating an
issue that doesn't exist. He stated he is concerned with the maze of regulations and another hindrance to moving
forward with this project. He suggested if they are tabling this that they come with their attorneys.
Ms. Black stated they have been working towards finding a way to resolve this.
George Roussos suggested it is unfortunate not to have clarity from FEMA on their position. He stated this
is a major project and he hopes they will clarify the issues and address the impacts. He stated the letters are not
clear and you can read into it what you want. He proposed they get Mr. Olsen or their agent involved.
Commissioner Gates suggested if they can instruct him as to what information they need it would be
beneficial.
Commissioner Phillips suggested they recognize there are some issues and she thought they were working to
resolve the issues. She spoke to the previous meeting and the conditions set. They now have additional conditions
being submitted. This is a major affordable housing issue and she believes they have to get these questions
answered to get this project to the point they can move forward.
Chairman Johnson suggested staff understands the priorities are affordable housing but if the insurance
increases it will not be beneficial to anyone in Eagle County. He suggested they must contact Mr. Olsen and have
clarification so they can move forward.
Mr. Gallegos stated they have no problem with Mr. Olsen coming in but they do not want to visit CLOMAR
or anything else that has been approved.
Mr. Isom asked about any additional changes.
Ms. Black stated there are some minimal changes but they do not effect the intent of the resolution.
Chairman Johnson suggested they work on the language together and hash it out beforehand. He asked for a
letter for the grading permit.
Mr. Clarkson suggested the grading permit be officially appealed.
Jim Kreutz stated the appellant procedure has requirements of its own. They recognize they are in a catch
22. He stated they had to get the exemption to get it out of the floodplain.
Chairman Johnson stated they are talking about an exemption not an appeal.
Commissioner Phillips asked about raising the floodplain insurance for everyone.
Ms. Black stated when they received this letter from FEMA it included a line about jeopardizing the County
program. In researching this she stated if they determine there is non-compliance with their plan it is something
they could do.

VRDC will reserve tee times to accommodate four tee times for sixteen golfers. The rate for EC residents will be
discounted 40% ofthe hotel fees. VR will make the course available for charitable events twice annually. The goal
is to have people playing this course to it capacity.
Mr. Ragonetti passed out the change in language they are proposing for the four daily tee times, being
sixteen golfers.
Chairman Johnson spoke to the charity tournaments and asked ifthey are slated for local charities or a mix
with national.
Jim Thompson, VR Development Company, stated their intent is for local charities.
Commissioner Phillips questioned the 40% discount for locals.
Mr. Thompson responded that is included.
Chairman Johnson asked if the 40% during the shoulder seasons means a 40% discount of what is being
charged guests at that time.
Mr. Ragonetti stated he distributed revisions that reflect the agreements as they are now.
Chairman Johnson reviewed the revisions stating Monday through Thursday, four tee times for sixteen
golfers during those days. He asked how many tee times a day.
Mr. Thompson stated about 10% of the tee times during the shoulder seasons will be available for local play.
He stated the situation is that their company has been looking for a location for a golf course. They currently have
only 50% of the tee times at Beaver Creek. Their intention is to create a venue for people renting properties to play
golf. The notion of allowing locals the experience of playing a quality course makes sense. In the height of the
season they need to use the course for its intended use. They are budgeting $25,000,000 million to create the course
but to extend the privileges beyond what they propose is costly to them.
Chairman Johnson asked about the agreement with the Bellyache Ridge Homeowners.
Mr. Jamar introduced Alex Siscandery.
Mr. Siscandery stated there are two agreements, one being a short agreement that says before they come
back for further development above what is approved today, they will conduct a thorough water study. Secondly
they have said if and when they come back, they will get back to the Board a comprehensive plan for this property
and any other they plan to develop. Thirdly they will come to an agreement with the DOW which they have done,
The district agreement goes into specifics with what they can and can't do with the water. They have agreed to
limit the use ofthe four golf course well to below what they can use by State law. If and when they develop the
twelve lots they will limit the water consumption to below what they are allowed by law. They are going to work
with the Bellyache folds regarding a consolidated metro district. There are a lot of variables. The biggest part of
the metro district agreement are the triggers that set off if they exceed the water use. If they do that, they will
provide the over sizing system that will allow them to hook up. They have had problems with their water
distribution system and this may be a way to help them out.
Jim Fritze, County Attorney, asked what the contemplated water source will be for the twelve homes.
Mr. Siscandery stated individual wells for each.
Commissioner Gates questioned the aquifer and the levels.
Glenn Forzac, representing the applicant, stated there is a limitation for each site well and it is far below
what you would be entitled to on a 35 acre site.
Chairman Johnson suggested they had a proposal here previously that dealt with pull from three different
aquifers.
Mr. Forzac stated you may tap anyone or all aquifers. They will limit the amount of diversion and limit the
acre feet. The third faction is these are a considerable distance from the metro district wells. The big aspect is the
amount agreed to is below what would be drawn on 35 acre parcels.
Jane Edmere, representing the Bellyache Ridge residents and the Metro District, stated their primary
concern is the availability of water in the aquifers for additional consumption.
Commissioner Gates asked if that is for consumption on their property and up on the ridge.
Commissioner Philips asked where the twelve houses would be located.
Mr. Jamar showed those on the map.
Jim Fritze stated that was done to allow the Board to view the compatibility of the use by right. He
explained they did this up front so that when they come back they can see the objective.
Greg Jouflas, resident of Wolcott, urged the Board to vote in favor ofthe project. He stated Eagle County
will get a beautiful resort facility. He stated VRDC will enhance the recreational facility. He stated this is an
