Gordon Adams, Asst. Road & Bridge Director, stated the company does have more than six trucks and can
get the job done faster, He stated he believes it is in the best interest ofthe County to proceed. He stated it starts
where the pavement ends and finishes where the church sits. He stated they will take it down to the original base
and add four inches of gravel.
Commissioner Phillips moved to approve the consent calendar as presented, pulling item E, item C with
corrections,
Chairman Pro-tern Gates seconded the motion. Of the two voting Commissioners the vote was declared
unanimous. Chairman Johnson was not present at this hearing.
Plat & Resolution Signing
Scot Hunn presented the following plats and resolutions for the Board's consideration:
5MB-00117. Lot 15. The Homestead pun. Filing No.2. He stated this was a Minor "Type B"
Subdivision, a resubdivision of Lot 15, The Homestead, to create two (2) lots, Lot 15 A and Lot 15 B. This plat
does contain a duplex split caveat stating that only one two-family residence may be built on the combined area of
the two lots.
Commissioner Phillips moved to approve final plat file number 5MB-OOl17, Lot 15, The Homestead PUD,
Filing No.2, incorporating staff findings,
Chairman Pro-tern Gates seconded the motion. Of the two voting Commissioners the vote was declared
unanImous.

School Bond Issue
Chairman Pro-tern Gates stated the next item is in addition to the agenda for today is a proposed resolution
supporting the school bond issue,
Bob Loeffler, Deputy County Attorney, stated this hearing is open to all public comment.
Jack Lewis, representing the School District, stated ifthere are questions to be answered he would be happy
to do so.
Chairman Pro-tern Gates questioned why the Commissioners should be involved in this decision. He stated
he does not believe the Board should be in support or not in support of this resolution. He does not want the
County's decision to influence the voters, He believes the voters should decide this issue,
Commissioner Phillips stated she agrees with Commissioner Gates and also she believes the schools do need
more room, She stated this matter is on the ballot and the voters should be the ones to decide and not be influenced
by anyone. She stated she has been in the schools and knows there is a space problem. She also stated maybe the
school should look into renting space to day cares and pre-schools to help with funds. She stated she would like to
see some schools in the Bond, McCoy and Bums area. She stated she is not a supporter of raising taxes per say but
knows the schools have a problem. Our school system is very important and children are our future.

Jim Fritze stated he has a problem with condition number 10, showing the split flow will not occur during
this process, Number two, revises the plan to fit. He stated the Board can approve up to the word or, but if it is
going to be a different plan that the Board has not seen the applicant will have to come back.
Steve 1som stated when the CLOMR was submitted it was a very small area not in the flood way of the
Colorado River. He stated the engineers came back with this area is not impacted, What the Board is seeing today
is what is being approved.
Mr, Fritze asked if there is a different plan the applicant should come back.
Michael Aery, Wright Water Engineers, spoke to the cross sections and split flows. He stated there are a
number of cross sections spaced about 100 to 200 feet apart. This application had been modeled to span the cross
sections and took the split flow across those sections, He stated this approach was fine and the accuracy is within
the ball park. He stated the question is there may be a difference in the split flow process but will not affect the
application, This issue will be clarified. The model will remain as is or the structure will be changed and there will
be individual splits,
Jim Curtis, representing the applicant, stated if the Board will look at the letter it states upon completion of
the project. He stated the reason FEMA asked upon completion of the project is that until you see the project that
determination cannot be made. He agreed with Mr. Fritze in that this application is asking the Board to approve
something they have not seen.
Mr. Fritze stated the letter also says may and not shall. The other issue is the County does not have the
power to require anything of a metro district, but definitely not of one that is in or in existence at this time, He
stated the applicant can enter into an agreement with the metro district. Until a metro district is formed and has an
election, that cannot happen and the County will have the obligation.
Mr, 1som spoke to the aerial photograph and the three lakes as exist today, He showed the 100 year
floodplain and the reinforcements that must be made, He stated they thought about filling in lake number three
which does not affect the movement ofthe Colorado River, Mr. 1som continued to show maps ofthe proposed
project. He stated they would like to be able to start some of the work on this project if approved,
Mr. Fritze suggested they stick to discussion on the other issues until they are resolved, He clarified his
earlier remarks concerning the metro district,
Mr. 1som stated as far as the staffs recommendations, they have agreed to one, two and three, four he would
like to discuss with the Board. He stated they believe number four should be required by final plat, but would like
to start grading on the project. He stated condition number five is the same as number ten, Numbers 5, 6 and 7
have been addressed. Eight is okay as no basement will be allowed in that area. Number nine, if the project is
raised out of the 100 year floodplain, there is no reason to have a plat note. He stated as before number ten is the
same as number five.
Chairman Pro-tern Gates asked about five through ten.
Mr. 1som stated they agree with one, two and three. He stated five, six and seven are the same as listed by
FEMA, eight they have no problem with and nine they do not agree with.
Mr. Fritze stated it appears to be a condition of final plat. He stated he believes most plans are not done in a
100 year floodplain.
Mr. Vengrin stated this condition came from a letter from CWBC, indicating potential homeowners should
be notified. He stated it was his idea for the plat note to be the notification.
Mr. Fritze stated legally the applicant does not have to do it but there is nothing that prevents the Board
from having it as a condition. He stated that information could be submitted at a later time.
Commissioner Phillips stated if other applications do not have a plat note then she does not see why this
application should have the note if they are raising the property out of the floodplain. She asked if there would be
any basements.
Mr. 1som stated no.
Commissioner Phillips asked for collateral for grading permits.
Mr. Fritze stated in other applications collateral was required to restore the ground. He stated a grading
permit is a different from this application.
Mr. Curtis spoke to affordable housing and raising the property out of the floodplain. He stated every time
something else is added, it takes the affordability up higher in price,
Mr, Fritze stated when things are done ahead of final plat approval, some items come into play.

Mr. Isom stated they were short 14 acre feet of water and have filed for that amount from Green Mountain
water rights. He stated the water for agriculture will be used from the lakes.
Commissioner Phillips asked about hooking to the Gypsum water lines.
Mr. Isom stated it is not financially feasibility to hook to the Town of Gypsum right now,
Mr. Clarkson stated at sketch plan approval there were some conditions which most have been addressed.
He extended his compliments to the applicant for addressing these issues, He stated 50% will be owner occupancy,
There will be a 5,000 square foot building for various commercial activities and have allowed for additional day
care space if needed. He stated mail boxes will be provided and the Sheriff s Office and Health and Human
Services annex office space will be provided for lease. He stated the ambulance will be able to use the site. The
applicant will allow for space for the RV's for the construction workers, which will be phased out after
construction, This item was not added to the PUD Guide and he suggested this be added. He stated condition
number sixteen suggested a market study be prepared. He stated Ford Frick did this study and spoke to office
development, restaurant and commercial space. He stated an 87% reduction in commercial is appropriate. He
stated if this plan goes as planned, it could stay vacant for a number of years to which the applicant has responded
that Gallegos will be relocating their offices to this area. The rest of the lot will remain park land until time for the
commercial business is warranted. He reviewed the Sheriff did send a report concerning crime prevention through
development, which will be discussed later. He stated the Planning Commission did not agree with the study and
that 60,000 square feet of commercial is not too much for this proposal. Mr, Clarkson continued to review the
proposal and previous conditions from sketch plan. Mr. Clarkson stated the report was received after the submittal
of the sketch plan, He stated they sent the application out to all referral agencies, This document covers concerns
with various issues, It is a thought provoking document and components incorporate various aspects ofthe
planning process, The main suggestion of this document is a complete redesign of the project shifting the
recreational to the far west end, centering it where the commercial component is. He stated the west end
recreational component causes a security concern, He stated staffs point of view in moving the recreational to the
commercial is to place the park at the center of the community not at the far end. Mr. Clarkson stated all ofthe
residents could then feel the park is their own. The applicant indicates the commercial portion will be park until
developed, He stated the residents will become accustomed to the park. Mr, Clarkson stated that staff does
recommend approval with conditions and there are two motions required. The motion for the preliminary plan has
eleven conditions and the Planning Commission has added two additional conditions. The Planning Commission
deliberated on this project over five hearing days. They did recommend approval by a 6 to 1 vote.
Chairman Pro-tern Gates asked about the commercial area.
Mr. Isom stated they are planning for the next twenty years and this allows for flexibility. He stated it is not
a passive park, it is a landscaped area.
Commissioner Phillips asked about phasing and asked if they are going to bring in a certain number and
then recreational vehicles, She asked about those living here and working that will bring in their trailers, She
suggested leaving some place for recreational use will be warranted,
Mr. Isom stated the owner occupied will be to the south, They will allow for recreational use and then phase
that out. He explained the corporate use stating they have changed their maintenance fee to cover the cost. Owner
occupied will have the right to maintain themselves or pay to have it maintained, He stated at the commercial phase
they will complete as the time allows. The recreational facility is part of the first phase of the development as well
as the single family lots.
Commissioner Phillips stated this is going to be a community and she feels there needs to be a separate the
area where people are going to be coming and going. Mr. Isom explained the restricted access and the manager
who will be able to control all access into the park.
Commissioner Phillips stated the areas she is familiar with have it all together in one location,

the fields be moved and the storage be moved to where the fields are currently located. He questioned the removal
of vehicles.
Mr. Isom stated the metro district will be responsible, He stated maybe it makes sense to allow for a
caretakers unit in the storage area.
Sue Dugal, resident of Vail and Realtor, stated this is a much needed project and she believes the 11th hour
is not the time to make changes. She urged the Board to approve this project as it is much needed.
Dick Burk, Gypsum resident and Planning Commission member, stated if you want to do a mobile home
park and this land is suitable for that you are going to get a mobile home park. He stated there is a five foot set
back, there are no view corridors to the lake, no on-site parking, trees will not survive in the five feet. He stated this
project will look like a parking lot. He asked this project be redesigned and be sensible to the people who will live
there. He stated this will end up a great big trailer park. He believes there are too many residents packed into this
area. He urged the Board to have the plan reworked.
Commissioner Phillips asked if Mr. Burk was the dissenting vote at the Planning Commission,
Mr, Burk answered yes, He stated he does not believe this project was thoroughly reviewed.
Mr, Isom stated they provided walkways and opened the lots so there are views,
Mr, Fritze recommended the Board proceed with the 1041 first,
Mr. Katieb stated staff has no further comments.
Commissioner Phillips moved to approve file number 1041-0013, Two Rivers Village, incorporating Staff
findings.
Chairman Pro-tem Gates seconded the motion, Of the two voting Commissioners the vote was declared
unammous,
Commissioner Phillips moved to approve file number SSA-0003, Two Rivers Village, incorporating staff
findings. The Chairman Pro-tem shall be authorized to sign with any comments regarding water quality,

Mr. Isom stated on file number PDP-0008 and ZC-00023, Two Rivers Village, he spoke to the proposed
conditions. He stated they did not agree with condition number three,
John Vengrin stated all the engineers concerns have not been addressed. He stated there are still concerns
with using the PUD process to circumvent the road standards,
Commissioner Phillips stated if safety issues are addressed it is her understanding the roads are better than
standard,
Mr. Vengrin stated the streets are designed to drain in the center rather than the side,. He stated they still
have concerns with how those roads and the sewer systems will work. He stated they would like to see those things
addressed before final approval.
Mr. Isom stated the Planning Commission agreed those concerns had been addressed.
Commissioner Phillips stated on page four are all the conditions or concerns of the County Engineer.
Mr. Vengrin stated he would have to review that list one by one, He stated there are still are some issues to
be addressed.
Commissioner Phillips stated she would like to know which ones have not been addressed.
Mr. Fritze stated ifthe Board is going to act they need a list of what needs to be addressed and in what
fashion.
Mr. Isom reported on the suggestions from the engineer. He stated he did not want to get into changing the
roads.
Mr. Fritze suggested the Engineers concerns be taken one by one,
Mr. Isom quickly reviewed some of the concerns.
Mr. Vengrin stated in looking at page four, number one has been taken care of, number two has been taken
care of, number three has been taken care of, number four has been taken care of, number five has been taken care
of, number six has been taken care of, number seven is not applicable.
Commissioner Phillips stated she could put in those items number five, six and seven at that time.
Mr, Vengrin stated number eight is a final plat issue, number nine, he is confused on how the metro district
is going to work, should stay in the condition, number ten, the engineering office needs a full design of their
construction and engineering plans, which is a valid item, number eleven, there are no agreements at this time so
this is a valid condition.
Mr. Isom stated they are no longer in the CD aT right-of-way.

stated if they do not want use after 6:00 p.m. they may do so. He stated just because a street is straight it does not
mean everyone will speed.
Chairman Pro-tern Gates stated just the traffic within your development will be sufficient for speeders,
Mr. Curtis stated it is all an element of the community.
A. J. Johnson, Eagle County Sheriff, stated their interest is not in making this a police community, He
stated there have been some good changes made. A straight road assures there will be speeding, He stated there are
some things that can be done to assure there are fewer problems. He stated private security cannot handle all the
security issues. He stated there will be crime in this area. He stated they are not going to back off and not come
forward with comments and suggestions, He stated his office is the one that will have to service this area, He
stated it is a viable project for employee housing,
Commissioner Phillips questioned this application not meeting the County Regulations.
Mr. Clarkson stated the proposal was considered to not meet with the master plan but the employee housing
out weighs the master plan,
Mr. Fritze explained. He stated some ofthe issues brought up today are sketch plan issues and not for
consideration today.

Terrill Knight, Knight Planning, stated this is the fifth meeting held on this, He stated they will try not to be
redundant but give a brief overview of the project. He stated the application is being made by the Crawford family.
Terrill introduced himself, Tom Boni, Dan Kerst, and Carolyn Strackben. He stated they have previously had other
presenters speak to specifics. He stated this is the first round of sketch plan, They will then return with a
preliminary plan.
Mr. Knight spoke to the Crawford ownership of the property since the early sixties, He spoke to the history
of the public. He stated the Crawfords have been asked to do an overall master plan that would ensure the services
could be provided, He stated they have been working with Eagle County on that for the last five years. They are
using a theme of neighborhood around a small town. He stated this is a more comprehensive way. He spoke to the
zoning and the uses within the property. He spoke to the fire station and the desire to make this a small western

Mr. Knight spoke to the impacts, the dedication of land, The Crawfords are proposing to do that and add
area to it. The school district builds the schools, therefore the taxes, He stated the Crawford's are going beyond the
regulation by making additional property available, 3 or 4 acres is that which would be required using the numbers
in the sketch plan.
Ms. Morrison asked about the land at the tree farm and them getting land for recreational. She suggested the
schools are going to be using them. She stated she wants them to build the school. She suggested they get impacted
in the classrooms get overcrowded,
Bob Richardson stated it is nice they use the commercial core of El Jebel but most of the commercial
development has been in the Town of Basalt. That is where it should stay, those are the things people do, Keep it
on that side, The density for residential is outrageously too dense.
Geri Briggs, area resident, stated she is concerned about everything that is happening. She spoke to open
space, the garbage dump. She spoke to a recreational center, CMC could support it. She spoke to the unused
commercial. She spoke to the school and the traffic on El Jebel road, She spoke to six new developments in
Missouri Heights, the traffic merger on El Jebel road. They need a new school. Coming off the hill, the pollution is
terrible, That will only get worse, Crime will come with the development. She stated an average hour is needed to
get to Aspen, She'd like to see less density and more recreation,
Royal Laybourn, area resident, thanked the Commission and the residents that came out tonight to
participate in government. He stated this proposal draws out of the community, They recognize some of the points
where they need help. The amount of commercial development and the way it has been presented to the community
is not taking into consideration the commercial development that has already been approved and the impact over the
long term on traffic, He spoke to the bisection by the highway, He suggested they need to reduce the amount of
traffic that goes by there. He spoke to the existing grocery store, He spoke to the tremendous respect that they have
for the Crawfords and their commitment to the community, He spoke to the deficiencies, its too big, too intense.
The feeling is they are trying to get this vote through the commission to get the maximization out of the property,
They are asking the Commissioners to take a long look across the street where the people will have to pay for the
terrible intersection, There is no place for pedestrians. He stated the schools are a tremendous aspect. He asked
that the Crawfords focus on housing and leave the commercial development where it belongs and where it has been
approved.
Grace Newhart, area resident, thanked the Board for the opportunity to speak, She stated it is a pretty good
plan, but she is concerned with the traffic overall, She has to cross El Jebel road, She spoke to the development in
Willits Lane and the housing development. She wonders where the people will come from to buy the homes. She
spoke to the esthetic quality.
Michelle Garrett, area resident, asked about the radius from the center of town.
Mr. Boni stated the center was the intersection of El Jebel Road and Highway 82,
Ms. Garrett suggested the center moves with each application. She spoke to Orchard Plaza and the snowball
of the radius, She suggested that is a vague and shifting mark. She spoke to the currently approved residential and
commercial in the El Jebel area. She asked for guesstimate numbers,
Ms. Garren suggested there is over a 1,00,000 square feet approved, 750,000 approved, not built. Ms.
Garren spoke to additional numbers that will come out soon. Between Basalt and Carbondale the is over 1,000,000,
She spoke to moving here from Colorado Springs and the construction overbuild. She stated it took nearly ten years
for properties to recapture the values. She spoke to HUD houses being dumped on the market. She spoke to
something this small and the commercial that this will happen as well. She spoke to needing to have firm
regulations in place to remove the sewer ponds. She suggested the school is there this has to be taken care of. She
spoke to the traffic study that was done which was one day in the middle of March. The volume brings the El Jebel
road up to the Highway 82 volume, She suggested there is no way the trailer park community can cross over, they
can't cross over for recreation. She stated there is a current need in the El Jebel area. Pocket parks, sidewalks,
pathways, before they create more development. She sees a lot of major concern but the primary one is traffic and
safety.
Leslie Estes, area resident, thanked the Board, She stated the first point is that this is an all or nothing
decision. Once the decision is made to approve the zoning changes they have no recourse. She suggested that
would include the lagoons, She spoke to the phases and if the zoning approved, there is nothing to say things would
not be done. She questioned the documentation on community need. She suggested they must show the advantages
outweigh the disadvantages. She spoke to more public recreation, parks, playgrounds, a recreation center. Then the
community would have some advantages, She stated the last Board disapproved everything based on the conceptual
evidence did not exist for adequate access and appropriate water and sewer, She suggested it was disapproved

commercial space and the vacant houses. She encourages the developer and the planner and asked them to use
imagination and commitment to creating a local community plan, She spoke to the bad air quality and the air at
8:00 a.m. She asked about the water augmentation study.
Mr. Knight stated there is one in place but they will need to do a different study.
Ms. Fathergill stated she understood that there is not enough water in the EI Jebel area and Mid-Valley has
not come through.
Mr. Knight stated the final augmentation is not in place.
Kathleen Keomp, area resident, stated the water attorney will be at the next meeting and will speak to that.
Ms. Fathergill suggested they are on water restrictions now.
Deputy Lawson, a resident who was born and raised here and lives in the EI Jebel area, spoke to the
problems with the EI Jebel intersection, He thinks third street will be used, He spoke to Blue Ridge Road and the
exit out of that area. That will give three traffic routes out of the area, Increased crime is a wait and see. He spoke
to the old buildings that now exist and the lack of lighting, He suggested with redevelopment there will be open
spaces and pedestrian areas. He stated that will be a plus in the crime sense. He stated he is not for big box
development.
Commissioner Phillips spoke to the hearing today regarding a new development and two deputies attending.
She asked if Deputy Lawson will talk to the Sheriff and the addressing of the concerns. She stated you can't work
with the developers once it is done. She spoke to the studies they can do,
Bob Schultz, from the Planning Commission, spoke saying he thinks of zoning like virginity, you can only
give it up once. He stated they can't say enough about the Crawfords, they are very nice people, He spoke to the
master plan and suggests it doesn't comply because of the talk of neighborhood commercial. The second thing it
talks about is not proposing accesses within one mile, He spoke to the access off the four lane and the lights that go
down the valley, He stated when you get into the area with the sewer lagoons it is a puzzle. He spoke to the mid-
valley plan and the future of the sewer lagoon. Until that is straightened out, if they change the zoning, the
commercial is inappropriate with the scale. The things they did talk about, for the neighbors not to think they area
is not going to develop, it will. He spoke to the need and it working against the project. He stated the Crawfords
have been patient while other commercial has been approved. The commercial zoning is really not relevant. He
spoke to the green space and the desire to use every inch instead of clustering and developing and area that will be
neighborhood friendly, He stated they need to get their questions answered before they change zoning.
Marilynn Bloomer, area resident, spoke to the schools and the fact she has two properties one on JW Drive
and one at Blue Lake. She is concerned about both places, She stated she doesn't want increase of RFT A on JW
Drive, She stated it is terrible, She stated they need to have, coming out on third you must have an access to 82.
She stated she doesn't want to see a Basalt round-about. She stated she would like to see speed bumps through the
Blue Lake subdivision. She spoke to the kids in the neighborhood, She suggested they should have approved the
trailer park. She stated they don't need a golf course. She spoke to mid valley water and the politics. She suggested
they are pretty tapped out. She spoke to the water restrictions and the increase in water costs. She stated she is
concerned about the trailer park and Circle Drive. She spoke to Bonnie and Adele being extremely hard working
women. She hopes it will never come a time when they are asked to move out for future development. She stated
this doesn't look rural.
Peter Jacox, area resident, asked about the sales, use or development for the units. He spoke to the
homeowners organizations. He asked about the commercial area and who would be responsible.
Mr. Knight stated the Crawfords will continue to manage the commercial area, He stated there would be a
homeowners group developed. He stated this is sketch plan and some of those detailed functions have not been
discussed, Areas the Crawfords own, they will continue to maintain.
Mr, Jacox spoke to a ton of commercial, Orchard Plaza, Basalt. He spoke to a Wal-Mart and future
development. He stated there is just too much,
Commissioner Gates stated they did turn down the EI Jebel Junction proposal. He stated the County does
turn down something.
Bob Jacobson, Blue Lake resident, stated he is trying to avoid the NIMBY. He stated this isn't good. He
stated he'd like to see a picture that includes Willits, the area behind Summit Vista, This is too many homes, it must
be scaled down.
Peter Delaney asked for clarification, He spoke to the Blue Lake Board and the desire for them to speak in
opposition to the project. He stated they have not taken a position nor tried to represent people. He spoke to the
roads and the reliance on Blue Ridge Road going to Highway 82, He stated that road isn't in place and depends on
two projects coming together to get the road built. He spoke to the third street access and the fact it hasn't been
