BOARD OF COUNTY COMMISSIONERS
EAGLE, COLORADO
RECORD OF PROCEEDINGS
FORM 50 HOECKE!:S 387869
district as well. He explained.
Commissioner Phillips agreed,
Mr. Montag asked if it is limited review in all three categories,
Mr, Loeffler asked if that includes community buildings and schools,
Mr, Montag stated they would all be put in the limited review category,
Tom Boni spoke regarding the community building and education facility, He stated in the RSM they are
allowing the educational facility. Mr. Boni spoke to Fulford and the fact there may be some citizen concern over a
school being placed in that community,
Bob Loeffler spoke to the definition of an educational facility being rather liberal. He states it can include
any private schools as well.
Chairman Johnson stated he doesn't have a problem with it being special use,
Ron Brave suggested they are looking to include church, but when you start looking at the definition of
community building it is a wide door, He spoke to the issue of community center which hasn't been included, He
thinks the church is a great idea under limited review. The community building and community center has a wider
impact,
Chairman Johnson suggested the community center is not a facility.
Commissioner Phillips suggested Fulford is probably never going to change from what it is right now.
Mr. Montag spoke to the Roaring Fork Planning Commission encouraging the use of a church within the
larger zone districts. Mr. Montag stated they will have to develop the standards to review it against,
Chairman Johnson suggested major facilities could be built by a non-profit organization under limited
review, He suggested within the three zone districts they talked about to have only the churches come under limited
reVIew,
The Board concurred to have Community buildings left as special uses as will educational facilities.
Chairman Johnson spoke to group homes under the RFM and that it should be allowed as a special use as
well. And that home business be special use in RMF and RSM. He spoke to park, open space, and green belt and
the separation of definitions. He stated as you move to the back country zone district and the use by right. He
suggested with some of what is allowed within the definitions it needs to be a special. He suggested they don't
want swimming pools, tennis courts, etc as the definition is that of park. He suggested that is not what they want.
Commissioner Gates asked about a little community that wants to have play fields.
Mr. Montag stated they are in the back country zone,
Chairman Johnson stated that use would be taken out oflands such as Bud's, but would be in holdings in the
back country and not connected to anything. He suggested once they break out the definition under parks it would
be in or remain as knowing they would not allow the development of an aquatic center,
On page 3-11 as far as the sanitary landfill they have the only place for one is in a resource zone district. He
spoke to the Vail area and those being in the back country zone district.
Mr. Montag stated they would not want to do that.
On Convenience or Grocery Store he suggests it be a special use in the RSL, RR, all the way up to back
country zone district but not in the BCZD.
Mr. Montag suggested they would be allowing for a convenience store in all ofthe zone districts except
Fulford and back country with no size distinction.
Mr. Boni suggested in footnote four there is a lack of a size restriction. He suggested they put a limitation
on size and set some parameters,
Commissioner Gates suggested the demand would be the requirement.
Mr, Loeffler asked if they should develop a standard,
Chairman Johnson stated yes for the convenience store and for gas pumps,
Commissioner Gates spoke to state regulations and the cost determining a lot of it. He suggested they
sometimes try to regulate what regulates itself.
Mr, Montag stated he is hearing special use except for Fulford and back country with some standards,
Chairman Johnson suggested they include the self service laundromat with size limitation.
The Board concurred.
Chairman Johnson stated in the RL zone district and the application on 3-11 under land application of
domestic or industrial sludge.
Mr. Montag stated it is substantial in its standards and covers the concerns.

BOARD OF COUNTY COMMISSIONERS
EAGLE, COLORADO
RECORD OF PROCEEDINGS
FORM 50 HOECKEL'S 387869
Chairman Johnson questioned having a cottage type unit and it having to be attached to a garage or
something else,
Mr. Montag stated that is the way it reads. They agreed to strike it form the comma after structure.
Commissioner Gates suggested if it is not consistent you'll start having problems,
Mr. Brave stated it doesn't create a problem the way it is.
Chairman Johnson suggested with a larger parcel you shouldn't have to attach it. They agreed to allow for
detached from another accessory unit in R, RL, AR,
On 3-15 and first class postage he asked if the postage is paid by the applicant.
Mr. Montag stated it is paid as part ofthe fee. He suggested the notice be listed in the official Eagle County
Newspaper.
Mr. Loeffler stated it says that in 5-210,
Commissioner Gates asked about the proposal in the cluster development.
Chairman Johnson suggested there is a lot of integration that still needs to be done.
Mr. Boni voiced concern with dropping it but asked it be left in the new regulations and then adopt revised
regulations at a later time.
Chairman Johnson stated they can leave it in and then revisit it.
The Board concurred.
On 3-21 and the drop off/pick up area in day care center, He asked they not allow the area to be used as a
parking space. They don't want the drop off area to be used as a parking space,
Mr. Loeffler stated it won't be counted as a parking space but be in lieu of parking space.
Under play areas Chairman Johnson suggested the day are center play area shall meet all the State standards
and eliminate the rest of the verbiage,
The Board concurred,
On 3-22 under group homes #2 Chairman Johnson asked why it is that group home should not be located
within 750 feet of another group home.
Mr. Montag stated that may come out of statute.
Mr. Loeffler stated they would have to review this. The definition comes out of statute.
Chairman Johnson stated the way it is written it is an absolute,
Mr. Brave suggested they change shall to should.
The Board concurred.
Mr. Brave asked for clarification on the parking off premises on at home business. He suggested the
employee has to be working at the house. He stated there could be confusion.
Mr, Loeffler stated this refers to the employee residing off premises,
Mr. Montag asked for clarification that it be for an employee working on site,
The Board concurred.
On page 24 he asked if they are substituting the airport commission instead of the Planning Commission.
There is no airport commission.
Mr, Loeffler stated it must be referring to the Planing Commission or the Board,
Mr, Montag stated the intent is to make sure the FAA and the airport referral agency.
Mr. Loeffler stated it isn't a use be right and has to come to the Planning Commission anyway,
Mr, Montag stated they would send referral.
The Board agreed to delete #2,
On page 3-25 under reservoirs and dams it says not create hazard. The dams or reservoirs should not be
placed near existing public roadways.
Commissioner Gates suggested they can't accomplish all of that.
Chairman Johnson questioned it being there and that they end it after the period,
They agreed to strike the last sentence after, afterwards,
Ron Brave suggested the whole paragraph adds nothing. If you do want to create a reservoir it is going to be
built correctly.
Mr. Loeffler stated this is to set forth the criteria in reviewing the application, It may be difficult to
determine if something will be a hazard in 50 years, the design engineer should be able to make those
recommendations.
Commissioner Gates asked how you define hazard.

BOARD OF COUNTY COMMISSIONERS
EAGLE, COLORADO
RECORD OF PROCEEDINGS
FORM 50 HOECKEL'S 387869
Mr, Montag agreed.
Commissioner Phillips spoke to the previous discussion.
The Board agreed there doesn't need to be a minimum, They agreed to delete #4,
Chairman Johnson spoke to a requirement for open space/park within a mobile home park. He spoke to the
physical separation within a park that makes if feel like two different parks.

wording is put together is confusing,
Chairman Johnson suggested they would say from the property line allowing for condominiumizing.
Chairman Johnson asked if 8 and 9 are absolute requirements and asked if gravel can be used in leu 0
pavmg.
Mr, Boni stated it makes sense when it is sizeable. When you define it as anything more than one mobile
home he would like to leave the parking lot up to the discretion of the County. It can become burdensome.
The Board agreed to determine on a case by case basis,
They agreed to strike the last sentence.
On 3-38 and the set backs the Roaring Fork Planning Commission addressed setbacks,
Mr. Loeffler suggested Mr. Boni was speaking about cumulative setbacks plus the lot line set back. Mr,
Loeffler suggested this is a different subject in respect to side setbacks.
Mr, Boni said he was referring to 5B. They agreed to change the front set back from 20 to 25 and the rear
from 10 to 5.
Commissioner Phillips suggested that they leave it as is.
Mr. Boni stated Mrs. Hubbel appeared before the Roaring Fork Planning Commission and they were
comfortable with Mrs. Hubbel' s recommendations, They agreed to five feet as long as there is twenty feet between
mobile homes,
They agreed to change in 5-A the rear to read (5),
Ron Brave spoke to 3-41 5d and fire protection for mobile home parks. He stated this needs to be reviewed
and can't apply equally to three trailer mobile home parks and 200 trailer mobile home parks.
On page 3-44 and the refuse handling, he would like a comma on the end of the section after the word site
and add minimum once per week. On #4 strike the second to last line and substitute the word office for manager.
Mr. Brave spoke to the adequacy of3000 square feet and questioned the 3800 square feet.
Mr. Clarkson stated Two Rivers is coming in on a PUD.
