This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of August 31, 1998, subject to review by County Administrator
B) Approval of the minutes of the Board of County Commissioner meetings of August 3 & 10, 1998
C) Agreement between Eagle County and Mid-Valley Metropolitan District for a water line
easement to be granted to the Mid-Valley Metropolitan District
D) Resolution 98-100, adopting rules and procedures for arbitration and appointment arbitrators for
appeals from decisions for the 1998 Board of Equalization
E) Intergovernmental Agreements between Eagle County and the Political Subdivision for
coordination of election procedures for the November 3, 1998 General Election
F) Lease Agreement between Eagle County and Brigette Malessa for the rental house located at
30265 Colorado River Road
G) Lease Agreement between Eagle County and Dora Prince for the rental house located at 19214
Colorado River Road
H) Change Order Number One to the contract between Eagle county and Warning Lites and
Equipment, Inc. For the 1998 centerline marking contract to increase price to $41,533.00
I) Resolution 98-104-Final Release of Collateral and termination of the warranty period for Ute
Creek Planned Unit Development
J) Resolution 98-102-Final Release of Collateral and termination ofthe warranty period for western
Slope Utilities, Inc. CD #100000592 for $6,250.00 for Road Cut Permit No. 2343
K) Assignment of Certificate of Deposit for Mark Harrison, CD No. 303-682-0042 for road cut

L) Resolution 98-101, specifying an established compensation for the Coroner of Eagle County.
Commissioner Gates spoke to an August 3 minute concern. He asked Board of Equalization schedule
021166 be clarified.
Chairman Johnson asked how the arbiters were chosen on item D. He asked what standard they use to
determine if someone is indigent or not.
Bob Loeffler, Deputy County Attorney, stated they are selected for their experience with valuing property.
He stated Joyce Reeves has done it for years and for the Board previously. Carl Koates was with the Forest Service
previously and has a good manner. Mr. Boyin is new. He volunteered last year and again this year. He is trained
in valuation and he has acted as a mediator in securities matters. He has the experience of serving in that role.
Bob Loeffler suggested those qualifying as indigent would be compared to the current standing in court.
Commissioner Phillips asked about the change order for $366.00.
Brad Higgins, Road & Bridge Director, stated there were highway markings done by the State where it came
off of Highway 6 and Edwards Village Blvd. The states mark had to be erased.
Chairman Johnson spoke to item L and the conversation they had with Donna Barnes. They discussed the
compensation of other Counties in the State and Eagle County was much lower. The compensation will not take
place until the swearing in of the Coroner elected November 3. That amount will be $15,000.00 per year.
Commissioner Gates moved to approve the consent calendar as discussed.

difficulty speaking and smelled of alcohol. He stated his knees were wet as was the surrounding grass,
Mr, Carter asked how far he was from Willits Lane.
Mr, Lawson stated about ten feet.
Mr. Carter asked if he knew Mr, Stowe,
Mr. Lawson stated he has picked him up previously and he is known to be a drinker who often tries to walk
home,
Mr. Carter asked ifhe was breaking any laws,
Mr, Lawson stated he was not because he was not on a State highway,
Mr. Carter asked about Mr, Lawsons background,
Mr. Lawson explained.
Mr, Carter asked if Mr, Stowe was intoxicated.
Mr. Lawson stated he used two different means to determine this he stated he is a known person who drinks
too much and he would have tested positive for alcohol.
Mr. Lawson further explained Mr. Stowe's condition,
Mr. Carter asked if anyone even without training could tell he was intoxicated,
Mr. Lawson stated he placed Mr, Stowe in the vehicle in the front seat to transport him home, During the
one mile drive Mr. Stowe stated he had been drinking around,
Mr, Carter asked for clarification,
Mr, Lawson indicated Mr. Stowe stated he was at the Shortstop, He did take him to his home and his wife
was present at the house,
Mr, Carter asked ifMr, Lawson had made it halfway home.
Mr. Lawson stated he had, Mr, Lawson stated he then went to the Shortstop and contacted Mr, Allen Cotton
the bartender on duty, Mr. Cotton stated he was aware ofthe individual and that Mr, Stowe had been in the bar. He
stated Mr, Cotton had cut him off at approximately 7:00 p.m that night according to the other bartender on duty, He
stated he is usually served him tomato juice after he is cut off, He stated he came back at 8:00 and was served a
beer which he did not finish, Mr. Lawson stated he advised Mr, Cotton of his concerns with serving him after he
had been cut off. Mr, Lawson stated Mr, Cotton became irritated and belligerent when he served him with a
citation, Mr. Lawson stated Mr. Cotton called Mr, Stascavage who called Mr, Lawson. Mr. Stascavage stated Mr,
Stowe had gone into the El Jebowl. The owner of the El Jebowl has signed a sworn statement saying that Mr.
Stowe had not been in the bowling alley that night. Mr, Stowe stated he drank at no other location than the
Shortstop.
Mr, Carter asked ifMr, Stowe's level of intoxication would have changed from the time he was last seen in
the bar until he was picked up.
Mr, Stascavage asked if the ticket was written to a person who was visibly intoxicated.
Mr, Lawson stated he did not see Mr. Stowe in the bar,
Mr, Stascavage asked if the officer was not mistaken about Mr, Stowe being cut off at 7:00. He believes it
was a misunderstanding in the police report, He suggested the day bartender did not cut him off nor did Mr, Cotton,
He stated Mr. Cotton had not seen him, Mr, Stascavage stated the weather was terribly hot. He stated Mr, Stowe
was not in the bar between 7 and 9,
Commissioner Gates asked if the bar slip would be entered in as evidence,
Mr. Stascavage stated yes.
Mr, Carter stated this witness has no knowledge as to the cash tickets in the bar. It can be entered as
evidence,
Mr. Stascavage stated from Mr. Lawson's testimony Mr. Stowe left and was gone for a time period.
Mr, Stascavage suggested he left and then was served one additional beer. He asked ifhe left at 7:00 and
then was severed one beer would that result in the degree of intoxication,
Mr, Lawson stated there is the possibility that there is one hour that is unknown, Mr, Lawson stated that is
not the point even if he was served alcohol elsewhere, he was served a beer at the Shortstop.
Mr. Stascavage spoke to a conversation he had with Mr. Lawson a week ago, He stated the ticket was
dismissed, Mr, Stascavage stated they discussed the issue and he reviewed the police report, He spoke to their
discussion about Shortstop being one of the toughest bars in the area in implementing the rules of the liquor code.
He stated what they discussed is that when Mike or Frank are present the bars run well. He stated when the owner
is not present the bar does not run so well, Mr, Lawson stated the evening after this situation occurred another

Mr, Cotton stated he has had bartending training and has worked at several bars that have had programs
similar to TIPS that he has attended. He spoke to his bartending background and a total of four times of similar
training and six years of bartending experience,
Mr. Stascavage asked if since the incident he has heard of any other possible way Mr. Stowe could have
become intoxicated,
Mr, Cotton stated that two others had come to him and have stated that Crow often carries a bottle in his
boot and that he has bottles of Schnaps hidden along his route into town. He stated he is a good bartender and he
takes his responsibility seriously, He has never been in court for this reason and stated at the time he served Crow
he did not show the behaviors of someone who was intoxicated.
Mr, Carter asked what time Mr, Cotton came on duty.
Mr. Cotton stated he came in at 6:30 p.m, and started serving at 7:00 p,m..
Mr. Carter asked when detective Lawson came in at 9:00 p.m, if he had told him he had cut Stowe off
earlier,
Mr, Cotton stated he had not served Mr. Crow and he was not informed if he had been cut off,
Mr, Carter asked ifMr. Cotton knows ifMr. Stowe was in the bar earlier,
Mr. Cotton stated he was there when he got there at 6:30 p,m.. He stated he asked the day bartender if he
had been cut off and the answer was no,
Mr. Carter asked about the sheet turned in as evidence,
Mr, Cotton stated it is a tally sheet and they use it to bring attention to concerns. That form was filled out at
the closing of the night.
Commissioner Gates questioned ifMr. Stowe was sober at 8:00 p,m" how can he become that inebriated in
50 minutes.
Mr, Cotton stated that is an age old question. He stated it is hard for a bar to establish if this beer is the one
that will put them over, He stated some can drink three drinks and be sober. Others walk out to their trucks and
drink, He doesn't know if a person has eaten. He suggested everyone is different and he does the best he can in
making that judgement call, He stated after the facts he learned that Mr. Stowe was an alcoholic, He stated he
didn't know that before this, He stated Crow was not to the point that he should have been cut off, Mr, Cotton
stated ifthe gentleman is an alcoholic, has booze stashed and or a boot bottle, he can't be responsible, He stated he
believes he used his best judgement.
Chairman Johnson asked how often Mr. Cotton cuts Mr. Stow off,
Mr. Cotton stated three times a month and that he comes in a about ten times a month.
Chairman Johnson stated thirty percent ofthe time he serves him he either gives him tomato juice or cuts
him off, He questioned ifMr, Cotton would be more likely to cut him offthan others. Chairman Johnson asked
how often does Mr, Stowe leave a drink unfinished,
Mr. Cotton stated 50% of the time but then suggested he doesn't really know.
Chairman Johnson asked if Mr. Cotton has ever talked to Mike about 86ing him,
Mr, Cotton stated he has never said they need to kick him out.
Chairman Johnson suggested he is having a problem with the fact that Mr. Cotton stated he didn't know Mr.
Stowe was an alcoholic but he was quoted as saying such in the report, Chairman Johnson asked how much Mr.
Stowe spends in the bar in a month.
Mr, Cotton stated he spends approximately $10,00 a visit.
Chairman Johnson asked what he drinks,
Mr. Cotton stated he drinks only draft beer, He stated he might have four beer in two hours.
Mr, Stascavage called Mr. Stowe to the stand, He was sworn to testify. He asked ifMr. Stowe had been in
the bar earlier and ifhe left on his own accord.
Mr, Stowe stated he went home, ate two hamburgers and had four beers, had a discussion with his wife,
walked down to the Shortstop, sat for an hour and drank ~ beer. He stated he went home under the tunnel. It was
hot out and he didn't feel very good, He took the back walkway to Willits lane, walked down the side of the
roadway about 1/4 mile, tripped in the ditch, lost his hat, and the officer came.
Mr. Stascavage asked if Mr, Stowe was visibly intoxicated when served the one beer,
Mr. Stowe stated he was intoxicated when the Mr. Lawson stopped him.
Mr. Stascavage asked if Mr. Stowe carries a boot bottle,
Mr, Stowe stated he does not carry a boot bottle and he doesn't keep a stash, He stated he came from home

Commissioner Phillips stated since it was dismissed by the DA's office and Mr. Stowe admitted there were
four beers drunk at home she has a problem suspending this applicant. It was admitted that the person was not
drunk at the time he was served. She stated it is unclear to her where he became intoxicated and there is not proof
that it was done in this bar, He didn't appear to be drunk when served. They have admitted he often comes in and
drinks a lot. He has been cut off in the past. At this time and in this particular case, she doesn't believe he was over
served in the bar that day,
Commissioner Gates stated regardless of where he got drunk at home he was served the last beer in the bar,
Commissioner Gates moved to find that the Shortstop is in violation of state statute for over service,
Commissioner Phillips stated she can not second the motion,
Chairman Johnson seconded the motion. Commissioners Gates and Johnson voting aye and Commissioner
Phillips voting no.
Commissioner Gates moved to suspend the liquor license for four days with two days being served and two
days held in abeyance for one year.
Chairman Johnson seconded the motion. Commissioners Gates and Johnson voting aye and Commissioner
Phillips voting no,
Commissioner Gates moved to adjourn as the Local Liquor Licensing Authority and reconvene as the Board
of County Commissioners,
Commissioner Phillips seconded the motion, The vote was declared unanimous.
Abatements
Allen Black presented a petition for abatement for Ben Rose, schedule number 017357. The Assessor
recommended denial.
Mr, Rose was here for the hearing, He reviewed his history in Eagle County having been a resident for 23
years, He is a real estate broker and educator, He stated how helpful Mark Chapin has been and others in the
Assessor's Office. He stated when he looks at his piece of property and compares it to other pieces of property he
feels that he has been in a blanketed hearing.
Allen Black stated he believes what Mr. Rose wants to do is argue the equity issue.
Renee Black, Asst. County Attorney, stated the Board is restricted to look at the comparables of the
property.
Mr. Rose stated he has taken all ofthe sales taken from January 1993 all the way through, He showed
photos of the town homes, both his and the two adjacent units, He showed the views from his unit. He stated the
units are in Ridgepoint in Beaver Creek. He showed the units on a map as well. He stated he took the sales during
the period and units that face towards the east and south and disallowed those because they are a different unit. All
the interior units are the same size and all the exterior units are the same size, He stated the price has varied so
much during the time period,
Mr, Black asked what time period they are looking at.
Mr. Rose stated January 1, 1995 to June 30, 1996, for the 1997 tax year, He stated he used every unit sold
within the complex, He stated he looked at the square footage, the view orientation of the units, the date sold and
found the average square footage price of$166,36, The unit with the next best view, unit 165 and 181 $192,75 and
those with the view towards the east, $207,76 and the one with the best view $215.21. As the view gets better, the
value of the unit gets better, He took the tax amount for 1997 and for 1996 and used a percentage ofthat and made
calculations accordingly, For 1996 he believes the abatement should be $451.46 and for 1997 $475,05,
Commissioner Gates questioned the reduction in price because of the view,
Mr, Rose stated it was the price paid for the units, He explained further saying the view is what increases
the price,
Chairman Johnson asked if the picture with the foliage faces south.
Mr, Rose stated that is the view out of his living room, He stated his unit looks straight across to the
buildings across the way.
Commissioner Phillips asked what type oftrees there are and suggested that in the winter they won't have
leaves.

$425,000 which is not very buildable, He stated the pictures attest to the view. He stated this is a moderately
sloping property that has natural foliage, It is a beautiful site, He can see the ski area from the building envelope.
He stated there is a gorgeous view to the east and north. The lots sold in 1997 would indicate a minimum value of
$428,000, Mr, Chapin further explained.
Chairman Johnson stated in looking at the appraisal it doesn't say how much should be added in because of
the ski assessability,
Mr, Rose stated you could have ski in but there is no trail there, Mr, Rose spoke to the ski run that could
make it assessable,
Chairman Johnson spoke to the line that it does have advantage of ski assessability,
Commissioner Phillips moved to deny schedule number 001619, Ben Rose, as recommended by the
Assessor be denied for tax years 1996 and 1997.
Commissioner Gates seconded the motion. The vote was declared unanimous.
Allen Black presented a petition for abatement for Paul & Ann Krouse, schedule number 011507, The
Assessor recommended denial. He stated the entire complex was not measured accurately, They have since
remeasured and all of the adjustments are taken into consideration, He stated the filing was outside of the time
frame.
Kevin Lindahl, Attorney representing the petitioner, stated they would concede that the 1995 tax abatement
is no longer available, With regard to the 1996 abatement he thinks it is absurd they are using the values $240 to
$280 range not $179,28, He stated what they did was not change the per square foot value, They left the value at
$181.09 and multiplied by the proper square footage. He stated that seems reasonable. They are asking for a
correction in square footage,
Chairman Johnson used a hypothetical.
Mr, Lindahl stated the units they use as comparables averages at $179.28, In the abatement they asked for
$181,00, He stated that is the average after all the adjustments have been made per unit. He suggested it is unfair
to say they made a mistake and are not adjusting the value but adjusting the price per square foot.
Commissioner Gates asked about the adjustment in square footage,
Mr, Black stated the proportional adjustments are the same but they only apply to the Creek Side units.
Commissioner Phillips asked what they are looking for.
Mr, Lindahl stated they determined a per foot price was incorrect. They were then assessed a higher per
square foot dollar amount as a result of the measurement being wrong, He stated they didn't use the comparables in
valuing the units, He stated when they valued the seven units they used the new square footage.
Chairman Johnson asked if they could work on the numbers.
Mr, Black suggested they are talking about an equity issue again.
Chairman Johnson stated the price per square foot went up because the square footage went up, They are
not adjusting the equity, Is the $241.70 the correct price per square foot.
Mr, Lindahl is talking about the assessed price not the sale price and that makes it an equity issue,
Mr. Lindahl suggested they are using sale prices that he didn't even use on the comparables,
Commissioner Phillips asked why it changed when the square footage changed,
Mr, Black explained,
Chairman Johnson suggested when talking about the assessed value versus sales price is like apples and
oranges,
Mr, Lindahl stated they haven't provided anything substantial to show how they made the determinations
they did, He spoke to a 7% increase in size, It went up from $181.00 to $241.00 a square foot. The square footage
was adjusted 15%.
Chairman Johnson suggested they have appendix one with the adjusted price per square foot, He stated he
doesn't know how they did the math to get where they are,
Mr. Black suggested it is an equity issue,
Chairman Johnson questioned how they came to the figure, The value of the subject property is $241,00 per
square foot. The top six properties were adjusted,
Mr, Black stated he will go back and provide the documentation for the Board,
Mr. Lindahl stated he would like it dealt with today,
Commissioner Phillips spoke to the comparable sales and asked what the difference is in the adjusted prices.

PDA-00012, Edwards Nursery PUD
Scot Hunn presented file number PDA-00012, Edwards Nursery PUD, He stated this was a request to
change the site plan/site layout, increase and decrease certain square footage of buildings, impervious cover and
outside storage areas and change architecture of future retail structures, Staff recommended approval with
conditions.
Marty Jones, applicant, was present for the hearing and explained the new site plan, Mr. Jones stated what
they are trying to do is make the site look a little better by turning the building and the parking lot. The have
separated the green house from the retail building, The change helps them anticipate a change in access, CDOT
would rather see their entrance line up with Edwards Building Center. With those things in mind and further
thought and comments from his wife they have come up with a plan that better utilizes the property, One of the
primary concerns has been the permanent public sanitation service, The utilities are in place and the sewer line is
there but has not been connected, The date they have to have that completed is an issue with some on the Planning
Commission. They would have liked to have built this fall, but because of financing it will put them back to the
end of July of next year, The November 15 date is borderline. He would like to put a trailer in there over the next
year that has a self contained bathroom if the porta-potties are not acceptable.
Commissioner Gates asked how many porta-potties are on there now,
Mr. Jones stated they have one,
Mr, Hunn stated the original request was for June 30, 2000, Staff recommend June 30, 1999, The ultimate
date would be November 15, 1999,
Mr. Jones stated they hope to be open by Thanksgiving but would like until the end ofthe year, He stated
being a PUD and due to the nature of the site, the resale is limited, There are documentation requirements that are
more conservative,
Commissioner Phillips stated since staff recommendation is to have this completed by September 30, 2000,
She suggested the request to extend it to December 31, 1999 she doesn't have a problem with,
Chairman Johnson asked for any further presentation,
Mr, Jones stated the ability to obtain financing to get the building up is his main concern, The major road
block is the PUD, He asked about staffs concern with the sanitation service,
Mr, Hunn explained he did not want to see this dragging out forever. As far as a temporary trailer structure,
he would have to review the site coverage and the lot coverage. He would want to maintain as much "open space"
as he can,
Commissioner Phillips asked if the retail facility contains restroom facilities, will that be sufficient.
Mr. Hunn stated it will and that is his point, He would like to see the project progress and get done. Phase
II is supposed to have the building finished, which is why there was a phasing plan in the first place,
Mr. Jones stated in the phasing plan they submitted, they originally requested to June 30, 2000. Mr, Jones
believes the schedule seems to be driven by the bathroom issue,
Chairman Johnson stated it does make sense that if they are going to build a building to house office and
retail that the restroom facility be in there, It doesn't make much sense to say you have to build a toilet even if you
aren't building, He thinks that it being done no later than June 30, 2000 along with the rest of the building, He
stated he would take the compromise of putting a trailer with a restroom that will be useable,
Mr. Fritze questioned ifthey will have an ADA issue,
Mr, Hunn agreed this is a good solution.
Commissioner Phillips moved to approve file number PDA-00012, Edwards Nursery PUD, incorporating
staff findings and condition number 2.
Commissioner Gates seconded the motion. The vote was declared unanimous.

Scot Hunnpresented file numbers PDSP-00006 and ZC-00021, RMN Ranch Minor PUD. He stated this
was a request to rezone Parcel P and PUD to allow for creation of one additional dwelling unit and preserve open
space. Staff recommended approval with conditions,
Sid Fox representing Richard A. Nelson, stated this is a minor PUD, He sated the purpose is to gain one

so closely at density,
Chairman Johnson spoke to condition #5 and that the roofing material be of non-flammable, non-
combustible roofing material.
Adrian Van't Hoff stated he has been in the valley 23 years but this is his first visit to the Board, He stated
the roofing materials will be in the covenants and be required to be non-flammable,
Commissioner Phillips moved to approve file number ZC-00025, Valley View Homes, incorporating Staff
findings.
Commissioner Gates seconded the motion, The vote was declared unanimous.
Commissioner Gates moved to approve file number SUS-00005, Valley View Homes, incorporating Staff
findings and conditions number 5 being amended to read the protective covenants shall require the roofing material

Mr. McCafferty reviewed the application and the fees submitted. He reminded the Board ofthe IGA with
Garfield County, He spoke to the easement for the central ranch having been signed, There should be a completion
date set for this application as the letter of credit is set to expire August 31, 1999, Staff recommended approval
with conditions,
Mr, Fritze corrected the SIA expiration date to the year 2000,
Mr. Knight stated he will bring down the original document, the conservation easement, will be recorded
hand in hand,
Mr. McCafferty asked in what order they should be recorded,
Mr, Fritze suggested the conservation easement might refer to the plat or vice versa,

PDP-00009, PDA-00009, ZC-00024, Cordillera Mountain Tract
Jean Garren presented file numbers PDP-00009, PDA-00009 and ZC-00024, Cordillera Mountain Tract.
She stated this was a request to incorporate the Mountain Tract into the existing Cordillera PUD. The Preliminary
Plan and Zone Change requested are for the 2,542+/- acres known as the "Mountain Tract," presently zoned "R" in
order that it may be brought under the Cordillera PUD umbrella, West of their existing development through
roughly the center of the Mountain Tract are 135 smaller lots, most of which are grouped close to the road network
extending along topographic "fingers" of land and between wildlife migration corridors. Roughly the western half
of the Mountain Tract is comprised of "The Territories," a 35 acre subdivision of20 lots, previously created and
sold under the authority of Senate Bill 35. Density form existing Cordillera approvals has been transferred to the
Mountain Tract, primarily from the Village,
The applicant wishes also to amend the existing Cordillera Subdivision PUD Control Document the reasons
for such as outlined in Staff's presentation, Staff recommended approval with conditions.
