Commissioners for their consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of August 3, 1998, subject to review by County Administrator
B) Approval ofthe minutes ofthe Board of County Commissioners meetings for July 6 & 13, 1998
C) Contract between Eagle County and Department of Human Services, Division of Child Care to
improve the availability of quality and affordable early childhood care and education services to Eagle County
children
D) Change Order No, 3 to the contract between Eagle County and Elam Construction, Inc, to add
paving of the bike lanes in the Singletree Subdivision,
Commissioner Phillips moved to approve the consent calendar as presented,
Commissioner Gates seconded the motion, The vote was declared unanimous,
Plat & Resolution Signing
Scot Hunn, Planner, stated there are no plats or resolutions for today's hearing,
Resolution 98-92, Lake Creek Affordable Housing Bonds
David Carter, Housing Director, deferred to Bond Council, Susan Bonnet, representing the applicant, and
she presented Resolution 98-92, refinancing Lake Creek Affordable Housing Corporation Bonds, approving the
issuance by Lake Creek Affordable Housing Corporation of multifamily housing project revenue refunding bonds,
series 1998, in an aggregate principal amount not to exceed $28,195,000, and authorizing an amended and restated
project agreement and authorizing incidental action. She explained the resolution to the Board, She also introduced
the amended and restated project agreement for the refinancing ofthe Lake Creek Affordable Housing Corporation
Bonds. She explained the agreement to the Board,
Chairman Johnson asked why they are doing this,
Ms. Bonnet stated it is because ofthe tax rules. The bonds were understated for the benefit of the County,
Gerry Flynn, Coran Financing and a consultant to Lake Creek Affordable Housing stated during the five
year history of the project they have not generated any excess cash flow, With the refinancing they can take the
pressure off having to increase rents, They will have a lower finance rate. The debt service payments will be
$100,000 lower than they are now. Currently the cash flow is mainly for operations. The benefit is to use the
excess cash flow for other purposes allowed by the non-profit-status.
Chairman Johnson suggested they will be able to use the monies for other financing,
Commissioner Phillips moved to approve Resolution 98-92, Lake Creek Affordable Housing Corporation
Bonds to approve the amended and restated agreement regarding the refinancing of the Lake Creek Affordable
Housing Corporation Bonds,
Commissioner Gates seconded the motion. The vote was declared unanimous.
Commissioner Phillips asked if there was another motion to be made.
Jim Fritze, County Attorney, stated they have approved the Resolution, Project Agreement and the amended
and restated agreement regarding the refinancing of the Lake Creek Affordable Housing Corporation Bonds,
Board of Equalization
Renee Black, Asst. County Attorney, presented petitions to the Eagle County Board of County
Commissioners, She recommended the petitions be approved,
Commissioner Gates spoke to the adjustment schedule and the fact there were many, He specifically asked
about 021166,
Mr. Pierce, referee for the County Board of Equalization, explained the file saying it had leases previously,
Last year they were valued agricultural and then returned to vacant land, The petitioner has converted back to
agricultural.

Mr. Chapin explained this is a parking area next to Avon Center. It is owned by Shapiro and being
developed by them as well, He explained the owner had suggested the property was non-developable, He stated
they have now begun procedures to develop it. The value has now been adjusted upward nearly three times.
Commissioner Phillips moved to approve the Resolution for the Equalization throughout Eagle County,
Commissioner Gates seconded the motion. The vote was declared unanimous,
AFP-00045, Beaver Creek Subdivision
Eric McCafferty, Planner, presented file number AFP-00045, Amended Final Plat for Beaver Creek
Subdivision, Second Filing, Lot 8, Tract F, He stated this is a request for final plat. Mr, McCafferty explained the
building envelope amendment stating the existing structure was constructed outside the approved building envelope
necessitating this application. Staff recommended approval.
Commissioner Gates moved to approve the amended final plat file number AFP-00045, Beaver Creek
Subdivision, Second Filing, Lot 8, Tract F. The Chairman shall be authorized to sign the plat,
Commissioner Phillips seconded the motion,
In discussion, Commissioner Phillips asked if anyone was representing Mr, Rosen on this matter, There was
no one in the audience,
Paul Clarkson explained that this application is different than the previous one and they have received
written confirmation there are no objections,

AFP-00024, Edwards Medical Center
Paul Clarkson, Planner, presented file number AFP-00024, amended final plat for Edwards Medical Center,
changing the name ofthe project and revising building and easement locations, This amended final plat is the
companion application to PDA-0006 which performed two major functions: 1) Made adjustments to the approved
site design and, 2) Rename the site from the Eagle Valley Health Center to the Edwards Medical Center. That PUD
Amendment was approved by the Board last November, Staff recommended approval.
Commissioner Phillips moved to approve the amended final plat, file number AFP-00024, Edwards Medical
Center to change the name of the project and revise the building and easement locations, The Chairman shall be
authorized to sign the plat.
Commissioner Gates seconded the motion. The vote was declared unanimous.
PDF-00025, Arrowhead at Vail
Jean Garren, Planner, presented file number PDF-00025, resubdivision of Lot 30, Filing 13, Arrowhead at
Vail, 11th Amendment. She stated this was a request to divide Lot 30 into six lots to be built out in accordance
with the eleven restrictions for Development Area A (village/Ski Area Development Zone), including single, two-
family and multiple-family dwelling units; commercial space; outdoor recreation improvements and activities;
resort services; parking; community services; and warehouse or storage accessory to another use, She stated there
has been one opposition to this by a Mr. Moore, Ms, Garren stated in reviewing the opposition, they have found
that his concerns were really with easements on previous development. Staff recommended approval.
Terrill Knight, Knight Planning, representing Mr. Moore, stated this plat retains the easement and they have
no objections,
Commissioner Gates moved to approve final plat file number PDF-00025, resubdivision of Lot 30, Filing
13, Arrowhead at Vail, 11 th Amendment. The Chairman shall be authorized to sign the plat,

Basalt Sanitation District
Ray Merry, Environmental Health Officer, stated the next item on the agenda was the 1041 Permit
application for the expansion of the Basalt Wastewater Treatment Facility, He stated this would double the capacity
of the plant. They have tentatively set hearing dates of September 17 and 21, He recommended the Board find the
application complete and set the estimated fees at $1,810,00,

train workers are doing, He stated the trains they are driving are quite heavy, He stated additionally someone who
chooses to have a job in Vail and live in Gypsum have made that choice, The rail workers are required to stay
where the lodging facilities are provided. His client believes they are doing their best by trying to locate the
workers as close to their work location as is allowed by the federal regulations.
Mr. Lindahl stated his client is willing to live with further restrictions such as the hotel be limited only to
railroad use and not be open to the public. His client would be wiling to agree to that today, He stated they can not
locate this facility in Bond, If it is denied, they need direction as to where the Board would more favor a location,
He suggested they modify the Resource Zone District to allow for a pertinent facility for employee housing and
dining. Ifthe County is not willing to favorably look at the proposal today, perhaps they could apply for this use
under the special use permit. That would allow them to not change the zone district.
Mr, Fox added while it may be okay to continue a situation with a long commute, it is intended to avoid
future land use decisions that have caused further commute, Mr. Fox suggested the difficulty is the master plan
does encourage employment and housing to occur in rural centers, They have explained why that is not acceptable,
it improves the situation over the existing need to commute that distance.
Commissioner Phillips asked if the business that was there had proper zoning,
Ms, Garren suggested the zoning hasn't gone away,
Mr, Clarkson stated they don't believe it was ever zoned commercial. Had they known the business was
taking place there, they would have considered it as non-conforming.
Peter Jamar, a resident ofthe McCoy area and adjacent property owner, stated he believes in regard to the
federal regulation, they don't feel that the exception that is clearly allowed would be approved, One of the key
points those of them who are supportive ofthe rail and the workers have felt that this location ought to be the last
resort rather than the first resort, He suggested they haven't gone through the process that might allow them to
build in Bond,
Merrill Hastings spoke to the sheet handed out by the applicant and suggested a change from public facility
to a private facility has changed the application considerably. He stated it is greatly modified and they haven't had
a chance to review it, He referred to the CFR and the extraordinary consideration to be less than 1/3 mile. He
recommends the Board deny the permit and go back to ask for permission to locate this hotel in Bond, They even
own property in Bond, There are a lot of considerations in light of this revision and makes this application mute.
He stated none of them are against the railroad or the hotel, it is the location they are against, There is land in
Bond,
Chairman Johnson asked for further questions,
Commissioner Phillips asked if the Board is interested in reconsidering the application and the request for
the PUD.
Mr. Lindahl stated they are not asking to change their application. They are stating there are conditions that
they are agreeable to, He stated there are ways to mitigate the concerns of this application much like other
proposals, He stated this is a sketch plan application. After meeting with the public, the Planning Commission and
the Board, they are willing to address those, This is not a new application,
Chairman Johnson stated the conditions put before them do not substantially change the application,
Commissioner Gates stated he is ready to make a motion,
Chairman Johnson suggested there is an opportunity for the applicant to make application for exemption
from the federal requirements, He stated they have the land use regulations which specify the areas most
appropriate for these types of uses. He read the definition of resort recreation and stated he does not believe this
proposal fits into that definition, He spoke to people living 35 miles or more from work. He stated most people
live down valley because they can't afford to live in Vail.
Commissioner Gates moved to deny file number PDF-00013, Oak Tree InnlPenny's Diner, incorporating
Staff findings,
Commissioner Phillips seconded the motion,
In discussion, Commissioner Phillips stated it is unfortunate it can't be worked out because there is a need
for that place for people to be able to stay, It is part of a need to find a place to change and spend the night there. It
is unfortunate that they can't come up with a solution, She spoke to the hotel in McCoy, She agreed it should be
within the town centers, She suggested nobody complained about the business that was there before, She
suggested the business and economic revenue would be helpful to that area,

Mr. Montag suggested they create another use to put in the use table, Then they would have to define what
zone districts would allow that.
Commissioner Philips stated they have reached that point. She asked if they need a definition that says how
many people can live in a dormitory type housing.
Chairman Johnson suggested it fits into the residential zones, He suggested it can be included there and
there are very few zone districts that could not accommodate it.
Mr. Montag stated a dormitory housing facility would be multi-family and would be RSL. You would still
only be allowed the density by that zone, You are still looking at rooms per kitchen,
Chairman Johnson stated the project Mr. Flynn is involved in is dormitory style,

Mr. Montag stated that is the definition of both the Planning Commissions,
Commissioner Gates stated it is okay by him,
Commissioner Phillips asked what are the set backs of the Eagle River Plan.
Mr. Montag stated he believes it is a 75 foot set back in the rural areas and 50 in the urban areas,
Chairman Johnson spoke to the specific set backs in the land use regulations.
Mr. Montag stated 50 foot from high water or the 100 year flood plane whichever is greater. He stated the
Planning Commission is asking for 75 for the Eagle and Colorado rivers,
Commissioner Phillips suggested there would be a conflict with the task force who propose 50 feet.
Mr. Loeffler stated we can't use the regulations to define the master plan, He suggested this was adopted as
part of the master plan, You can't un-master plan it.
Commissioner Phillips stated it is not in the master plan at this time,
Chairman Johnson stated as the Eagle River Water Plan has been adopted it is part of the master plan
whether listed or not.
Commissioner Gates talked about all the recommendations,
Commissioner Phillips suggested forty people came to agreement on this and now the three of them are
changing it all.
Chairman Johnson spoke to the time lines and the desires to just get it over and get it done. He believes this
further strengthens the regulations.
Mr, Montag asked if they should reference the Eagle River Water Shed Plan.
Tom Boni mentioned at the last hearing he thought they were going section by section. He does have a
question about developable land, He stated he's written a letter about this, Developable land is the basis for all the
calculations, He asked about revising the section and believes it is very drastic. He spoke to the meeting in the
Roaring Fork Valley and discussion was the land use regulations don't regulate the master plan. He spoke to the
need to leave judgement in when reviewing individual applications. He stated in terms of what is missing are
platted and unplatted property, He stated the term is referenced earlier.
Commissioner Phillips stated they have not responded to Mr. Bob Schultz and his concerns about the Board
not addressing his concerns, She spoke to the road impact fees and the consultant hired to deal with those, She
spoke to the committee appointed to review the wildlife mitigation, etc, She stated they agreed to remove some of
issues, She stated Mr. Schultz has not attended the meetings, been part of the committee, and not been present to
review these issues. She stated she has a major problem with that because of all the hours they have met. She
spoke to the housing plan that has been approved,
Tom Harned, area resident, spoke as a real estate broker and property owner to changing the value of a plan
it would be wiser not to go there, He stated the overlays should stay off the table as they represent the takings. He
stated when you get into takings it needs to be judged on a case by case basis. You should not have an iron clad
regulation. He asked they not do things with the land use regulations that can be perceived as takings,
