Commissioner Phillips seconded the motion. The vote was declared unanimous,
Plat & Resolution Signing
Scot Hunn, Planner, presented the following plats and resolutions for the Board's consideration,
5MB-00118. Lot 11, Block 2, Berry Creek Ranch. Filing No.4 He stated this was a Minor "Type
B" Subdivision, a resubdivision of Lot II to create two lots, Lot 11 A and 11 B. This plat does contain a duplex
split caveat stating that only one two family residence may be built on the combined area the two lots.
Commissioner Phillips moved to approve final plat file number 5MB-OO 118, Lot 11, Block 2, Berry Creek
Ranch, Filing No, 4, incorporating staff findings.
Commissioner Gates seconded the motion. The vote was declared unanimous,
5MB-00119. Lot 18, Block 16, The Homestead. Filing No.2 He stated this was a Minor "Type
B" Subdivision, a resubdivision of Lot 18 to create two lots, Lot 18 E and 18 W, This plat does contain a duplex
split caveat stating that only one two family residence may be built on the combined area the two lots,

Commissioner Phillips seconded the motion, The vote was declared unanimous,
Resolution 98-86. ZS-00037. Camp Jeep 1998 Special Use Permit. He stated this was a resolution
to approve the Special Use Permit for Camp Jeep 1998 event. This Board considered this file on July 13, 1998,
Commissioner Phillips moved to approve Resolution 98-86, file number 28-00037, Camp Jeep 1998
Special Use Permit, incorporating staff findings.
Commissioner Gates seconded the motion, The vote was declared unanimous,
Resolution 98-87.1041-0014. Cordillera Mountain Tract and Territories PUD, He stated this
was a resolution to approve the permit to construct a major extension of existing domestic water treatment, storage,
and distribution systems and for the efficient utilization of a municipal water project for Cordillera PUD, Mountain
Tract and Territories. The Board considered this file on July 13, 1998.
Commissioner Gates moved to approve Resolution 98-87, file number 1041-0014, Cordillera Mountain
Tract and Territories PUD, incorporating staff findings.
Commissioner Phillips seconded the motion. The vote was declared unanimous,
Resolution 98-88.1041-0015. Eagle Park Reservoir, He stated this was a resolution to approve the
permit for the efficient utilization of a municipal and industrial water project for the Eagle Park Reservoir, The
Board considered this file on July 13, 1998.
Commissioner Phillips moved to approve Resolution 98-88, file number 1041-0015, Eagle Park Reservoir,
incorporating staff findings,
Commissioner Gates seconded the motion, Commissioner Phillips and Gates voted aye, Commissioner
Johnson voted no,
Award of Contract, RNL Design
Jim Shrum, Regional Transportation Authority, stated the next item on the agenda was the Award of
Contract to RNL Design for the design services for the Eagle County Maintenance Service Center. He eXplained
the process to the Board stating it is a culmination of a two year project in trying to find a maintenance storage
facility, He stated this will allow them to begin the project which is slated to be on 20 acres on the west end ofthe
airport, They will continue to work with the Town of Gypsum on Jules Drive,
Chairman Johnson asked about the project award,
Mr. Shrum explained the process and RNL was selected by unanimous decision, He feels the process was
quite extensive,
Commissioner Gates asked if the design is just for busses or for Road and Bridge,
Jim Hartmann explained this concentrates phase one mId will look at the use of the facility both for road and

Commissioner Gates seconded the motion. The vote was declared unanimous,
ZS-00036, EI Jebel Mobile Home Park
Terri Bernath, Planner, presented file number ZS-00036, El Jebel Mobile Home Park, Lava Hill Expansion,
Phase II. She stated this was a request to consider six additional mobile home spaces, She explained the creation of
a loop drive and the placement of 15 mobile home lots. 285 are already permitted, 9 which exist and 7 transferred
from elsewhere in the park.
Tom Boni, Knight Planning, representing the Crawford family spoke to the conditions ofthe step I,
including a grading permit study and a traffic and water study. He stated the system was upgraded by studying the
piping of the system, Those pipes were replaced and water meters established on each mobile home, The
combined effect reduced the flow into the plant by approximately 40%, Basalt Rural Fire Protection has reviewed
the plans and help design the small cul-de-sac, They feel comfortable with it. Mr. Boni referred to a map showing
the entrance into the park. He pointed out the hill. He spoke to the runoff on 1995/96 and the shoring material
taken from the site. They need the grading permit to regrade the property and make the 15 mobile home spaces,
Mr. Boni spoke to the spaces and their locations, He explained the numbering,
Sara Fisher spoke to the addresses within the mobile home park.
Bonnie Williams, applicant, spoke to the use of the 0900 El Jebel Road and the people living within the park
not knowing the street names,
Mr. Boni went on to explain the lot locations and their desire to disturb as little of the hillside as possible,
Commissioner Gates suggested they are not increasing the density overall.
Mr. Boni stated they are increasing the park by six net spaces.
Teri Bernath stated staff recommended approval. The Planning Commission did approve this application
with one condition being the applicant should provide a map of the mobile home park after the expansion and that it
be adopted as the official map of the mobile home park.

PDP-OOOll, Cordillera, Phase I, Southern Parcel
Scot Hunn presented file number PDP-00011, Cordillera, Phase I, Southern Parcel. He stated this was a
request for preliminary plan to create 12 single family lots, open space and ROW for El Mirador Road,
Lance Badger, representing Cordillera, stated the plan is preliminary for the southern parcel. He showed the
location on the map and explained, Mr. Badger suggested to better understand the plan he reviewed the history, He
stated the current plan is made up of two phases. He showed them on the map. He spoke to homeowners concern
regarding visibility in phase two. They have agreed to withdraw that portion of the file and are only seeking
approval of the phase one segment.
Chairman Johnson asked if phase two is also referred to as tract 33,
Commissioner Gates spoke to the exclusion/inclusion.
Mr. Badger spoke to the processes they have taken and the phasing of the application, They are
withdrawing the phase two portion of the application,
Commissioner Gates asked about clustering,
Mr. Bader stated the plan has been in existence since 1992 and the plan is very consistent. The original
density was for 36 units and they are only planning on 35 in total with 12 being in consideration at this time, Mr,
Badger stated the zoning is in place,
Commissioner Gates spoke to the ridge line building, He suggested the biggest objection from the adjacent
homeowners is the ridge line homes.
Mr. Badger stated the current plan is consistent with all the criteria set forth in the PUD Guide, He stated
they sit within the Squaw Creek Corridor. He stated they have proposed height restrictions and fixed elevations,
Commissioner Phillips asked if each lot has a specific building envelop.
Mr, Badger explained they do and further explained how that works.
Scot Hunn reviewed staff findings and that staff recommended approval with conditions, He review two of

She stated she has not but part of it is on Cordillera and part is BLM,
Mr, Badger asked about the trespass route,
Ms, Caryl suggested they would like to work something out with the developer as people have been using
this route for years,
Commissioner Gates stated it was never designed as a public trail but that people have gotten used to using
it.
Ms, Caryl suggested ifthere is anyway they can work with Cordillera they would like to see this managed
accordingly,
Steve Hill, homeowner in Colorow and treasurer of the homeowner's association, stated they have been left
in the dark about this. He spoke to Peter and Les' comments, He stated it is a big impact and he is surprised at the
lack of communication. He stated his big concern is the driveway and the steepness, He asked how that will be
accessible.
Mr, Badger stated they have generated engineering plans that have met the County standards. Mr. Badger
stated it doesn't follow the line of the trial. He stated they had their engineer research the adjoining owners to the
property, That list came from the tax records, Address labels were provided to the County for notification and it
was posted in the newspaper,
Mr, Hill suggested a phone call to the neighbors would have been appropriate,
Chairman Johnson spoke to the letters received about the right of way ifit is filing 32 or filing 33,
Mr, Hunn stated filing 33,
Commissioner Gates suggested the Board might want to take a site visit to clarify a lot of the issues,
Chairman Johnson suggested a site visit for phase two would be appropriate and perhaps they should do so
at that time,
Commissioner Gates clarified that the public were not concerned about phase one, The public agreed,
Guy Parker, a Lake Creek resident, asked about the open space.
Mr, Badger showed the location on the map and the boundary of phase two.

Mr, Hunn stated there are about 6 acres of open space in phase one,

Renee Black, Asst, County Attorney, presented petitions to the Eagle County Board of Equalization, She
introduced Larry Pierce, stating he was a naval aviator and from 1987 - 1997 was the Montrose County Assessor.
She stated they met a record this year by doing the hearings in one week.
Chairman Johnson stated he questions #98-18.
Mr, Pierce stated the petition did show up late but the assessor's office had provided him with the valuation
reduction from 4,1 mil to 3,1 million,
Chairman Johnson asked which property it is,
Mr. Pierce stated it is City Market in Eagle,
Chairman Johnson spoke to #59 and the reduction of almost 48%,
Mr, Pierce stated this was by recommendation from the Assessor's office, He spoke to the appraisal and it
not including the second floor. Mr, Pierce stated this was Steven Francis which is north east of Eagle,

Mr. Collins stated the Title 32 districts are those who can't overlap,
Bob Loeffler, Deputy County Attorney, asked if they can reach a finding there is evidence of the projected
need for the service.
Mr. Collins stated a need does exist, they don't know the magnitude, There is a transportation problem but
they won't know what will be needed at this time, He stated service plan amendments are expensive when you
have more property owners,
Chairman Johnson spoke to the last three needs that are listed,
Mr. Collins requested they eliminate those three services and amend the service plan accordingly,
Chairman Johnson suggested they note that paragraphs two and three are named water service that it be
water system and that sewer service be sewer system,
Mr. Collins stated they are following the words of the statute,
Commissioner Phillips asked if they are taking out the three because she sees them having a need for
mosquito control. The same is with transportation,
Chairman Johnson stated the statute states there must be evidence of need,
Mr. Collins stated they can offer testimony, but they don't know at this date what the extent of the need will
be, He stated it is possible to find that they have shown a projected need,
Mr, Wright stated they were included because there might be things they need down the road as
development continues, He stated they talked with the Town, With TV and Transportation there may be a need
down the road. They would be working with the Town of Eagle.
Bob Loeffler stated there isn't any direct evidence of the projected need with respect to the services nor that
the services would be inadequate for the projected needs, or that the district would be capable of funding the
serVIce,
Mr. Collins suggested they leave mosquito control as something they might be able to assist with or
supplement the Town's efforts, but take out the TV relay and Transportation, They would formally withdraw the
request for those two services and leave mosquito control.
Chairman Johnson stated the statute was written to allow the tax payers the right to make the decision, He
stated there is sufficient evidence as presented today and with the testimony that mosquito elimination and control
should be provided,
Mr. Loeffler stated he has not seen the Town of Eagle's Resolution, He stated the Planning Commission
had some concerns.
Willy Powell stated prior to the applicant submitting the service plan to the County they reviewed the
service plan with the applicant, Many of their concerns were satisfied during that time but it was a staff review, In
recent weeks the Board has reviewed it. They asked for one additional change being Exhibit 1 which calls for a
disillusionment of the Resolution if full payment of all outstanding indebtedness occurs and upon a finding by the
Town of Eagle that no significant ongoing municipal services are being provided to District residents by the
District, the Eagle Ranch Metro District shall initiate and complete dissolution proceedings,
Chairman Johnson asked if it should be contingent on it being annexed into the town or a development plan
approved by the County,
Willy Powell stated they understand the special district is of no effect should the annexation not occur,
Mr. Collins stated that either conditioned upon annexation into the town or the service plan would be
rescinded and the district collapse. Or an approved development plan applied for.
Mr. Collins stated they have a November election they are trying to make and must be out of district court
by September 8. They have no concern with them conditioning approval. It is possible to approve a district
without a development plan,
Mr. Collins asked they close their presentation with a request the resolution be passed as amended at this
hearing,
Eric McCafferty stated there should be a condition attached relative to the approval of the property into the
Town of Eagle and that a date be specified, He also asked that Exhibit 1 to the Town's resolution be adopted, Staff
recommended approval.
Chairman Johnson stated the new legal will be referred to as exhibit A and be attached to the resolution, He
spoke to the three resolutions, The Town of Eagle, the Fire District and WECMRD should be attached to the
resolution they adopt, They can be listed as exhibit B,

He has not inflated the expenditures or the revenues. He believes it is less misleading to not include inflation, He
spoke to the capital replacement fund, He stated they plan to operate two activities, water and sewer, He stated
exhibit 1 includes an annual capital equipment fund which exceeds Ms. Sasses suggestion, He stated it is the intent
of the financial plan to fund landscape including parks and recreation type expenditures, He stated they have not
included any activities that will be funded by user fees. He spoke to the mention of fire protection, Mr, Bernstein
stated they are within the boundaries of the Gypsum Fire Protection District and would therefore not need to
provide fire protection services.
Mr. Isom stated they are stuck on a time schedule to meet the deadlines for a November 1998 election, In
meetings with the Board, they could not proceed without the CLOMAR in place. In reviewing staff's
recommendations they have no problem with #1. Mr. Isom spoke to the land use issues.
Bob Loeffler suggested in respect with the clauses of#5, he is not sure it is land use as it relates to the
building and maintenance of the water control facilities,
Chairman Johnson asked which specific power would the first portion of#5 be considered,
Mr. Collins stated drainage is the primary one with the expansion ofthe drainage power. He suggested
recreation and landscaping could be under that.
Mr. Isom stated the berm was built by CDOT when they built I-70, They have to do some work on the rip-
rap, He defined that as south ofI-70 where the river changes course to meet the Eagle River,
Mr, Collins asked ifthere is other maintenance,
Mr. Clarkson stated there are two items in the service plan. One being storm sewer drainage as well as
maintenance of the 100 year flood control dykes, The concern staff is raising is the liability the County assumes in
placing a housing development behind a flood control structure, built by another agency and maintained by a
special district. The suggestion is if this is being created as a public entity, perhaps they should also be responsible
for any liability,
Mr, Collins stated they are willing to enter into an agreement as such, They are planning on doing this and
maintaining it. It is one of the reasons for the district.
Mr, Collins stated it comes in under storm drainage and control. He stated it is much like fences,
Chairman Johnson stated because of staffs recommendation it specifically needs to be enumerated,
Mr. Collins asked if an IGA would be appropriate to do. He asked ifthere is anything more he can do,
Mr, Loeffler stated he would like to see the actual statement of the service authority that includes the
maintenance,
Mr. Collins stated they will revise the service plan accordingly. He stated an approval with a condition of
an addendum would solve this particular problem,
Chairman Johnson suggested if there were an event, the special district would have only limited monies,
Mr, Collins stated they will provide insurance behind the responsibility.
Mr, Loeffler stated he's not sure ofthe extent ofthe liability,
Mr. Collins stated they would insure against negligence,
Chairman Johnson stated ifit floods, they may not be held negligent.
Mr, Isom showed the location of the improvements and the area they would be maintaining, Mr, Isom
stated it is nothing more than a walking trial.
Mr, Loeffler stated if they agree to provide insurance, he is not sure that and IGA would provide anything
for either party,
Chairman Johnson asked about a letter from WECMRD,
Mr. Collins stated they do not have one yet but it is forthcoming. He stated approval should be conditioned
on that. He stated he must have it before he has a hearing in district court,
Chairman Johnson asked about evidence of the TV Relay and Transportation? He asked about the park and
recreation powers he asked if that includes all powers?
Mr, Collins stated yes.
Chairman Johnson quoted from the statute,
Mr, Collins stated he believes it should be listed separately because they are only doing certain park and
recreation functions, He stated it is fairer to everyone to be open to what they are planning,
Mr, Collins asked Mr, Isom of the projected need for organized services. He asked if all the services are real
projected needs and will they be met by the district.
Mr. Isom responded yes.

Chairman Johnson stated on page 1-7 and the removal of verbage that it is substantially commenced,
Commissioner Phillips stated if they have commenced it has begun, Substantially commenced means they
have infrastructure in place,
Commissioner Gates stated that is his interpretation,
Mr, Montag stated initially they were going to take out the last sentence, but they agreed to leave it in as
substantially completed. He referred to C-1, the first paragraph, He suggested if someone had begun a special use
permit, it would not apply, He questions what is substantially,
Commissioner Phillips stated she would like to see it remain as is,
Mr, Montag stated they agreed to strike out substantially completed and insert commenced.
Chairman Johnson suggested if he had a special use permit and started grading that he could stop the clock.
Mr, Montag suggested they would have to show diligence,
Mr. Loeffler stated it has to be read with the provision the developer has diligently pursued.
Mr. Montag stated his game plan is to get specific direction from the Board on any outstanding issues, The
Board can either approve the regulations subject to the changes, or they could table or continue the hearing allowing
staff an opportunity to make the changes,
Commissioner Gates stated things that were approved years ago where nothing has happened should be
dealt with,
Article 2 - Definitions - One definition that created discussion was the critical wildlife habitat. They asked
to reinstate the definition back into the LUR's. That definition is used elsewhere within the code and it was felt
important to list it. Both Roaring Fork and Eagle County agree with that request.
The definition of riparian should also be reinstated, They are suggesting it be called the riparian area,
Commissioner Gates stated when they voted to eliminate the wildlife maps it was with the understanding
they would come back at a later time.
Mr. Montag stated as they continue to review and insert items into the regulations they will develop a task
force to study it before coming back to the hearing process,
Commissioner Phillips asked why they agreed to eliminate this when the committees met.
Mr. Montag stated when they removed it, they made a broad sweep without thinking that there are other
areas within the code that refers to the definitions, Therefore there was a need to reinsert it back into the code,
Chairman Johnson suggested they eliminated the overlays not specifically about the definitions,
Ron Brave stated they did not go into the definitions specifically but there are areas within the regs that do
need a wildlife definition,
Commissioner Gates suggested if they redefine the definitions they will need additional input.
Mr. Montag agreed,
Chairman Johnson suggested that some word smithing might be needed. He spoke to agricultural structure
definition and the need for a period after the word human habitation and then strike the rest of the words, This
would allow them to have a barn dance.
Bob Loeffler stated part of that is a place for agricultural products to be processed, treated or packaged, He
stated that is more commercial.
Commissioner Gates suggested just because they are agricultural doesn't mean they are commercial.
Chairman Johnson stated under Campground he would like to strike the word 'space' on the last line, He
suggested he doesn't want someone moving from space to space and comply with the definition,
Mr. Loeffler stated the word "of' would be changed to "in",
Chairman Johnson spoke to group homes and asked if Echo Ranch is considered a group home, He stated it
doesn't fit into any of the explanations, He suggested something should be placed into the definition that would
accommodate something like Echo Ranch, He stated in the last line on 2-20 he asked if they can make this
determination,
Mr. Loeffler stated this is lifted out of 30-28-115 which expressed the legislatures desire that certain types of
group homes not be prohibited from being in various zones by zoning codes, He stated it's the laws attempt to
prevent local jurisdictions from prohibiting group homes. He stated it bears review,
Chairman Johnson stated under hospital definition - should it be health services, medical, or surgical care?
Mr, Montag asked how that will change the meaning of the sentence,
Chairman Johnson stated it allows them to provide only one of the services. He stated under hotels - they
equate 3 hotel rooms as one single family dwelling unit. He asked if they carry the same requirements for parking?

Chairman Johnson suggested it is in there so that it is not so liberally construed,
Commissioner Gates stated that is a subjective call,
Chairman Johnson stated you can not regulate through the definitions,
Tom Boni stated he doesn't see the difficulty presented as is, This says lynx occupied habitat with a history
of lynx tracks,
Chairman Johnson suggested that is why he would like to have it stricken,
Mr. Boni explained the discussion at the meetings.
Steve Isom asked if they will discuss public comment or wait.
Chairman Johnson invited him down.
Steve Isom spoke to 1-9 Single Phase - Subdivision or PUD Process be changed to say the proposed
development has received either planning commission approval or sketch plan approval. He stated based on a
sketch plan they have spent considerable money to secure approval.
Mr, Loeffler stated that would be quite a major change as there is no vested right until the preliminary plan,
That is the law of Colorado, He suggested it hadn't been discussed at the sessions he has participated in and
questions if they can do that,
Mr. Isom stated it is a substantial hardship.
Commissioner Phillips suggested a decision will need to me made whether these new regulations will apply
to projects in the works now,
Mr. Isom expressed his concerns.
Commissioner Philips asked about the grand fathering,
Mr, Loeffler stated the "grand fathering" is within their discretion but the concept here is whether a vested
right attaches to the sketch plan. He stated there is no vested right at the sketch plan stag according to Colorado
law.
Mr. Loeffler stated Two Rivers does have sketch plan approval and they would not have to start over. If
there were new regulations adopted before the preliminary plan, they would have to adopt the new regulations,
Mr. Brave pointed out they have six months as it is written,
Mr. Isom stated they have not received planning commission approval or disapproval.
Bob Gallegos suggested they agreed to table this as the planning commission till August 5, Mr, Gallegos
suggested they have been given approval to move forward.
Chairman Johnson stated it would only allow those that are already submitted to the planning commission
they can move through the process even if they have been tabled or continued,
Mr. Isom spoke to Major New Domestic Water Systems or Sewage Systems, He stated he feels the number
should be lifted form ten to fifty.
Mr, Loeffler stated right now it conforms to the 1041 regulations but they may want to visit it.
Mr. Montag stated the planning commission stated the same and it is something they would have to come
back and amend along with the 1041 regulations.
Ann Nelson, Colorado River Land Owners, stated under feed lot they understand the last sentence was
eliminated, They would like it reinserted, She spoke to incidental and subordinate locations. They would like to
have a definition of a true/commercial feed lot.
Chairman Johnson suggested they may not have the authority but it may be an amendment on the ballot this
year. He stated the last sentence was put back in,
Mr, Montag stated they are addressing feedlot in the land use table itself. He stated the concern was to
control the large confinement type operations and that was the discussion they had,
Chairman Johnson stated in Colorado we don't currently have that right.
Ms. Nelson asked for clarification of "open space" stating that any land area specifically designated or
dedicated as open space be used for park.,..
Chairman Johnson spoke to natural open space, park lands, or recreation/conservation areas, They are
talking about dedicated open space not something that hasn't yet been developed,
Ms, Nelson spoke to the riparian areas and asked if it has been reinstated, After that, they would like to add
man made structures such as ditches, dams, ponds, sprinklers, and anything not created by these not be included in a
riparian area.
Mr. Brave stated the planning commission did agree with that and asked it be included under agricultural
purposes, They defined it by agriculture ditches, ponds, etc,

PDS-00013, Oak Tree Inn/Penny's Diner
Jean Garren, Planner, presented file number PDS-00013, Oak Tree Inn/Penny's Diner, She stated this was a
request to consider a 39 room motel, catering to railroad employees and a separate 54 seat diner. Staff
recommended denial. She stated that within a 1 acre building envelope on a 26 + acre site on the east side of SH-
131, the applicant is proposing a 39 room motel, separate 54 seat restaurant (no liquor service), and parking for 55
vehicles, The balance of the property is to remain open space, Railroad employees are the primary clientele of this
facility, transported by van to the site approximately 18 times per day as shifts end and start, Most rooms will be
reserved for railroad use; the remainder (as well as the diner and unused railroad rooms) will be available to the
public, Both motel and restaurant will be open 24 hours a day, Staff is recommending denial of this application for
several reasons, the most specific is the conflict with the master plan, Rural Centers are considered small rural
areas that are not appropriate for commercial uses, The open space plan encourages the open space to occur in and
around existing development,
Other reasons for staffs recommendation for denial would be the impacts of the changed use, The applicant
does not believe the intensity of the use would have significant impacts, Staff is also concerned with the issue of
spot zoning if this is approve, They have some architectural and site design concerns, Employee housing is an
interesting concern. This would be providing housing for the railroad workers however additional employee
housing would be required to staff the location, This is a commercial operation and should be considered as any
other motel or restaurant. The restaurant would be open 24 hours a day, The planning commission unanimously
recommended denial because of its nonconformance to the master plan and that the applicant had not explored all
viable alternatives, They have received no written confirmation from the railroad as to the exploration of other
alternatives,
Chairman Johnson introduced Bob Loeffler, Sara Fisher, Johnnette Phillips, Bud Gates, Jean Garren and
himself.
Sid Fox representing the applicant, Lodging Enterprises, stated there are several members of the team
making presentations, He stated he would give an overview, introduce Bill Burgess, the applicant, representatives
from Union Pacific Railroad, Dave Smith and Mike Berceitis who deals with crew lodging for Union Pacific, Tom
Zancanella who specializes in water and sewage systems and Kevin Lindahl to provide summary comments,
Mr. Fox stated the request is a concept plan and application for a PUD approval. He spoke to the
background of the proposal. He stated a large part of the applicant's business is providing lodging for Union Pacific
Railroad workers. The Bond rail yard is a crew change point between Denver and Grand Junction, The need for
this type of facility led to the site analysis that led them to this site, Mr. Fox showed photos of the site and
explained the site location, He stated it is 3 miles north of Bond and one mile south of McCoy, It is a 26 acre site
but the building envelope would be approximately one acre, The building envelope area is topographically
separated from the larger area, Some of the referral comments and staff comments spoke to winter range for deer
and elk. He stated it is a hugh area and most of the site will not be disturbed, There will be minimal impact to
animal habitat. Geologists identified potential rock fall area and they believe they can minimize that, The large
green building has been used more as a garage and storage facility, There has been a plumbing business in there
and prior to that a towing business that actually functioned out of Avon.
The site also provides access to the cemetery and it is the intent of the applicant to maintain that access, A
well has been drilled on the site. Water storage will be required and they are looking at options for that and fire
protection, He stated the water supply and the waste water system is intended to serve the public and is classified a
community system, That requires regulatory oversight and will be under the jurisdiction of the State and require
engineer design, Mr. Fox showed a concept drawing ofthe hotel with a diner of 54 seats, He stated the operation
of the hotel is different in that the lodge will have 35 rooms committed to the Union Pacific Railroad, The proposal
is a response to employee housing and they are committing to designate one of the hotel rooms for an on site
employee,
Commissioner Gates questioned one room for employees.
Mr. Fox stated they are designating one room on site for the employees,

the homesteading family of John Payne who provided food service to the railroad, He suggested it is surprising
how little has changed, He stated there has always been railroad lodging here, He stated the people here don't want
anything else built here, He spoke of articles in the paper such as Avon Center and those in Minturn, He suggested
it is hard for him to explain he is not here to open the door for the condos or the public hotels, He has no control
and would have to ask permission even ifhe was building in the Town of Bond, He suggested they not tell him it
won't happen by throwing him out and the railroad as well, He stated he usually goes to a small town and offers to
build a hotel and the public would be delighted, He doesn't want to destroy the area, He suggested they need to be
within three or four miles from the Town of Bond. They could move it, reduce the parking, bury some of it inside
the wall. There are concerns about the restaurant being open to the pubic 24 hours a day, They can close form 10
to 6 and only feed the railroad workers during the night. They could close to the public, He spoke to the drain field
in front of the area, He suggested they lease the acreage, turn it into a hay field and have partial agricultural use,
He suggested they could dedicate the land to a conservation easement. They have offered to dedicate the road to the
County, They have no intention in interfering with the cemetery, They need to put a facility somewhere close to
Bond but not in Bond.
Chairman Johnson asked if the contract with UP is number of rooms or number of beds,
Mr. Burgess stated there will be approximately 34 rooms occupied in a day, He stated train movements are
affected by different things and it may change the plan,
Dave Smith with the Union Pacific stated he is the operations manager from Craig to Glenwood Springs,
He explained the maps and handed out a map showing the whole system for Utah, Colorado and Wyoming, He
showed a second map with the Craig Branch and the train staging, Mr, Smith explained the trains running from
Grand Junction to Denver and then some of those that would just work within the area, They are running eighteen
trains a day and all crews are changing in Bond and were sleeping in Minturn. They are now taking all the crews to
Phippsburg, They have three limousines running from Phippsburg to Bond, running fifteen trips a day, It is 34
miles to Phippsburg and travel in the winter is more difficult. They would have one limo per shift which is a safety
factor, Staging the trains at Bond happens daily, It is the type of train that has to be switched in Denver, The
derailment in Green River caused more traffic, When the crews come in they will be there for eight hours, Where
the existing hotel is in Bond, is very noisy, It is a two percent grade coming in and there is tremendous noise, He
stated he was an engineer before going into management and explained some of the troubles with housing on a rail
site,
Chairman Johnson asked for the specific criteria they look at if they can develop within a half mile of the
track.
Mr. Smith stated the proper rest concern is a major issue, Mr, Smith stated Monday is no different than
Sunday and they are on call seven days a week. He stated they are hauling them 1 and ~ hours each day to
Phipps burg. He stated they can't make the trip from Denver to Grand Junction in one shift. It is a busy track.
Chairman Johnson asked what they would look at if you want to place a facility within the ~ mile,
Commissioner Gates asked about any discussions with BLM about exchange for a site,
Mr, Burgess responded he has not. He suggested he has been thinking about it,
Michael Berceitis handles crew management. He thanked the Board and the public for meeting here tonight.
Mr, Berceitis stated there is a specific process to go through when you are within a ~ area ofthe switching yard,
He spoke to the noise levels, the cars, trains, number of crews. He spoke of a gentleman named Dan Norris in
Washington and suggested with the very strict compliance with safety process the unions, they are looking at
lodging, pick up crews and safety of the whole railroad, He spoke to a similar situation in Clinton, Iowa and even
though they passed the tests, with the pressure from the unions and safety concerns, they moved to a different area,
He stated they would have to petition the government for the waiver and Mr. Norris suggested that would probably
not be approved, He spoke to the quality of life, He suggested they have about 24 dorm facilities left on the
railroad, He stated they are moving from those. He stated it is very important to be close because of safety, in
weather and with wildlife, He spoke to them commuting to their dorming facilities, Mr, Berceitis stated the biggest
issue is safety and going to Phipps burg is not something they want to do,
Ms, Garren stated it takes about 35 miles to drive each way,
Mr, Berceitis stated anything over 30 minutes, they are still on duty, Their concern is that these guys have
been on duty for twelve hours then have to commute to sleep. It is taxing, He stated they recently received a
document from the AAR, their lobbying organization, and the grand fathering of quarters within a rail yard, He
stated that part of the law will be repealed, What they are trying to do by relocating the sleeping quarters is just the

Mr. Hastings spoke to the commute time to Phipps burg. He suggested they look south and consider travel
to the landfill where it is zoned industrial. He stated they are sixteen miles from I70 and another hotel would hardly
be noticed, There are already plenty of restaurants down there. The promotion of the railroad safety is nothing but
a smokescreen. He reminded the Board they have already spend the $300,000,
Staff denied this, as did the planning commission. The community believes their wishes have been met.
They brought in the railroad, this is not a railroad hotel. Mr. Hastings challenged Mr. Burgess and his statement it
is unlawful to build within Y2 mile, He stated that is not true, He asked this not be made into a Denver Colfax,
They will have 54 seats in the diner, twenty four hours a day, That requires around the clock staff, This
commercial facility does not belong here. If they want to put it in Bond, put it in Bond. They may be looking for a
denial so that they can in fact go to Bond and work it out.
R, B. "Old Dog" Galloway stated his primary concern is they are going against the master plan and against
the zoning. Why do think they can come in and turn this upside down. He stated he lived across from the
Turntable for twenty four years and they never rented a room to a public person. This is a private venture in an
area it has no business being.
Charlotte Wolf stated she is as sociologist and thinks it is a pity to destroy this and that is what will happen,
She indicated it opens the flood gate.
John Comer, a resident who lives a stones throw from the site stated he plans on living there for quite
sometime as well as his sons and grandsons. Mr. Comer spoke to the petition, He stated he was the recipient of 70
signatures and 40 of those folks live in the McCoy area, He suggested those that seek equity deserve equity, He
does not believe that these people have been up-front from the beginning, He thinks people have been misled and
he is disappointed in them,
Clark Ewing thanked the Board for holding the meeting here and he thanked staff for their report, Mr,
Ewing stated he wrote a book about McCoy in 1976 and thought it was copyrighted, He stated he participated in
the first land use regulations, the master plan and now the new building regulation, He stated he thinks they need to
adhere to the master plan and the regulations they worked hard on and put together. The zoning is in place, He
hopes they can keep it the way it is and that those who want to build can look at the rural resource areas, That
would be a time they could develop for commercial use, He spoke to the closing of the Beanery, Who can say
what the railroads decision will be in five to ten years, He feels that Bond has been the practical, suitable area and
he would hate to see a facility of this type be built, over following the master plan regulations,
Peter Jamar, a resident ofthe area and owner of the land just to the south of this proposal stated he is not
anti development, anti growth. He is pro-growth, pro-development. He suggested the people who don't want this
aren't necessarily anti growth or anti railroad, He owns about 150 acres south of this property and is sure people are
curious why he wouldn't develop the property, For any land owner to show there has been a substantial change in
their neighborhoods and surroundings would open the door for development. He spoke to the river raft dorm
rooms, He suggested there are rural centers in Bond and McCoy and he believes they are all pretty much in
agreement that this is not the right place for this proposal. This is not railroad housing and they have heard very
little about the impacts, Mr, Jamar quoted Mr, Burgess in saying it is unlawful to build this facility within Y2 mile
of the railroad, In addition there are three criteria, one that natural or other barriers exist or will be created
adequatey to shield the facility, that the topography is such that it is unlikely to cause hazardous materials, ensuring
employee safety from noxious fumes and explosions. He suggested that they could mitigate those concerns in
Bond. These guys bought this property assuming it would be useable, They paid too much and they are now trying
to justify the building, He was encouraged to hear they may approach the BLM. He stated the railroad owns
substantial land in Bond. They have leased the residences to people to live, He suggested how great it would be to
walk to and from the restaurant next door, He stated this probably ought to be the last choice, He suggested this is
a case of spot zoning, it is not the right use in the right place and is not compatible. He stated the unanimous denial
by the planning commission is not common. He stated they are willing to work with these folks to find the right
site, Mr, Jamar spoke to the historical component but stated this facility is not in the town, He urged the Board to
deny the application.
Rene Wolf thanked the Board for allowing them to be here tonight. Mr, Wolf spoke to the historical aspect.
He reminded the Board the hotel was in McCoy and the Beanery in Bond, Another point Mr, Burgess brought up
was that their property has the road to the cemetery and they won't be able to block that road. He questioned the
trainmaster saying that they stop more trains here when that didn't happen before, He suggested the road to Craig
and their trains stop there which denies access up that way. He agreed with Peter if this is so dangerous and noisy,
