This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Chairman Johnson opened the meeting stating this was a work session concerning the Land Use Regulations
and County Moratorium. He stated Merv Lapin from the Vail Valley Exchange is here today and would like to
introduce visitors from Australia, He stated he is pleased as a member of the Vail Valley Exchange to welcome as
guests this week from Delatite Shire, He explained the commonalities between the two areas and the Youth
Exchange program, He stated another aspect of the program is an employee exchange program offering
approximated 300 young men and women that come and work here under special work visas, He spoke to the
advantages of that program and the differences in the seasons,
Mr. Lapin introduced Mayor Bill Hill, mayor of the municipality of Delatite Shire, He explained it is a
seven person council. He introduced Graham Nickless and Michael Ray, He stated they have spent the week
educating those of Eagle County to their procedures and vice versa, He explained this might be a great time for
them to see the relationships between County government and the communities,
Mr, Hill thanked the Board and explained they have many of the same problems we have, He stated he
would like to make a presentation and asked the Chairman to come forward, He spoke to Bill Gates visiting
Australia recently he received the same gift, He presented the same to Commissioner Johnson and hoped it will
solve some of the problems, He presented Chairman Johnson with a bull whip,
Commissioner Gates spoke to The Man From Snowy River which was filmed in their area,
Chairman Johnson introduced Karen Phillips director of the Vail Valley Exchange.
Mr. Lapin introduced Michael Ray and Ran Nichols the head of the Economic advisory committee,
Jim Hartmann introduced himself, Keith Montag and George Roussos stating they have spent a lot of time
together over the past week putting together realistic schedules about what the steps might be, He stated they were
given direction to develop a schedule, assess the resources and look for a schedule for a moratorium adoption. He
stated they have tried not to over or under state the conclusions. He stated there are a number of variables that
could effect any schedule, Mr. Hartmann showed the overheads, The first he showed was Land Use Regulations,
He spoke to the second draft of the Land Use Regs, He stated the drafts are out there, They are in the comment
period and waiting on one more component. They are compiling the public comment report. In last weeks meeting
and in previous discussions a number of other components are included. One of those is the housing plan,
Commissioner Gates asked ifthey will have the information to make a decision today,
Mr, Hartmann suggested they should be able to make some sort of decision today.
Commissioner Gates suggested the public wants that.
Housing Plan - there will be other regulations and the implementing actions will result in further regulations.
2010 Road Capital improvement Plan - Impact Fees and Regulations
George Roussos stated in 1995 with the assistance of Community Development, they have gotten a very
good handle in the County on demographics, where the populations lives, housing units, Over the last two years
they have divided the County into 70 some traffic analysis zones to monitor winter and summer traffic, They have
found in the year 2010 a $56,000,000 infrastructure investments needs to be made, There are approximately
$8,000,000 in improvements right now, About $52 are on State roads, $2 are strictly County and $2 of future
impacts are in the Town of Vail. They have recently completed the capital improvement plan and the next step is to
get it adopted by the Planning Commission and by the Board, The vast majority of these improvements are in
incorporated areas in Eagle County, They have identified those and that effort will take approximately six
additional months now that the plan is complete.

Minor Type A Subdivision - simpler subdivision process,
He stated absent form the list is a minor type B which is to split a duplex, Those are things that should not
be considered as part of a moratorium, Special Districts and associated files are not on the lists, The Exceptions
were then reviewed being - certain types of applications and projects that should e allowed to move forward: 1
public works projects such as roads, bridges, rail, water/sewer infrastructure, etc, 2. Public events/special
community events,
He explained those are the applications and the types of exceptions. He stated these are not necessarily a
recommendation but need to be included for discussion purposes,
Chairman Johnson asked which processes can be exempt from a moratorium if they are to meet the
objectives set out of implementing impact fees and the Land Use Regulations, He suggested the final plat process
just ensures that everything that has been conditioned has been taken care of and that the SIA's have been
negotiated,
Mr. Montag stated if they are talking about upzoning, the zoning is already in place, The final plat is a
finalization of previous agreements. He stated that could be considered to be removed from the list, He stated that
would be true of PUD and final subdivision plat.
Chairman Johnson stated he would like to see that come offthe list and not have any further discussion,
Commissioner Phillips stated she believes any application that has been submitted and is in the process shall
remain in the process and be given due process. She stated anything that doesn't need to be up zoned could be
exempt. She believes anything in process at this time should continue through the process as submitted,
Commissioner Gates asked what that means,
Commissioner Phillips stated those that have been submitted at this time, She stated if any are stopped there
are problems that arise,
Commissioner Gates asked if that is what they anticipated.
Mr. Montag stated they are looking for that direction but it could be something that has been submitted and
is deemed complete. He stated some things are in the office but have yet to be reviewed,
Commissioner Phillips stated she would like to speak to commercial and accepting it during a moratorium,
Chairman Johnson stated he agrees if it is in the process and has been submitted it should continue, He
wants to be sure that it is deemed complete. If there are any that are deemed incomplete, he would like to see those
continue through the process if they have been submitted even if there are things that have to be completed,
The Board concurred they would not want to see those kicked out of the process.
Commissioner Phillips suggested first they have to define if they are going to have a moratorium.
Commissioner Gates suggested they are compiling information to make the decision,
Chairman Johnson asked if Commissioner Gates agrees with he and Commissioner Phillips.
Commissioner Gates stated you have no choice,
Mr. Montag stated any application that is in the office of Community Development as of the date selected
would continue to be processed, It does not mean that it has to be deemed completed and there may be items that
have to be addressed,
Jim Fritze, County Attorney, questioned if that means they stop with that application, i,e, they have
completed sketch plan but not gone forward for preliminary plan,
Chairman Johnson stated they would go through the sketch plan and that would be completed but the
preliminary plan, as it has not be submitted, would not go forward.
Commissioner Phillips stated each plan should stand on its own merits and that it should not be stopped in
the middle of any process.
Commissioner Gates stated he is on the same frequency.
Chairman Johnson suggested it doesn't make any sense to go through the process, They are trying to ensure
the development pays its way along the way, He stated the reason for considering this moratorium then goes away,
Commissioner Phillips stated they can always say no and they require all kinds of fees, She thinks they can
make sure those that are in the works do pay their way,
Chairman Johnson suggested they have talked about the fees and whether they are appropriate or not, They
also spoke to the school land dedication fees and found those are not appropriate. He stated they have found those
to be lacking,
Commissioner Phillips stated they can always say no,
Commissioner Gates stated they haven't set any effective date.

Commissioner Gates stated just because there is a special use, it does not require upzoning,
The Board agreed that if the special use changes the intensity of the land it should fall under a moratorium,
Mr. Hartmann asked if the minor type A and final plat should be excluded,
The Board agreed,
Chairman Johnson suggested once the drop dead date is determined they will not allow for submission of
applications unless they are in the process.
Commissioner Phillips again spoke to the upzoning and the restriction of any upzoning during the
moratorium,
Commissioner Gates suggested they have a different form,
Mr. Hartmann asked if they are clear on everything else being included, excluding certain special use, final
plat and minor type A,
Mr. Hartmann spoke to the public works projects of a temporary nature, like the asphalt plant in Wolcott,
Chairman Johnson stated if you are talking about upgrading the infrastructure then they should be excluded,
Commissioner Phillips questioned how they can accept County projects and still go forward with the
moratorium,
Chairman Johnson asked for clarification.
Commissioner Phillips spoke to road and bridge buildings, etc.
Chairman Johnson clarified the batch plant for infrastructure improvements was for improvements to 1-70,
He stated they are not talking about maintenance facilities and if those weren't in the works they wouldn't be
completed.
Chairman Johnson stated they need to go forward with roads, bridges, water and sewer needs,
Commissioner Gates seconded that.
Chairman Johnson spoke to the public and special community events and asked ifthey are of the non-profit
nature.
Mr. Montag spoke to Camp Jeep and asked if that will fall into a moratorium, Because it is temporary in
nature would it not be included even though it is an annual event.
Chairman Johnson spoke to the environmental concern of public use on government lands,
Commissioner Gates stated they still need to be aware of the environmental concerns,
Chairman Johnson stated this Board can not make a decision as to whether it goes forward,
Jim Fritze stated it is a temporary event and applies each year, It is not a permanent special use,
Chairman Johnson asked if both under #2 would be special use,
Mr. Montag responded typically,
Mr. Hartmann asked where to go next.
Commissioner Gates suggested they review the adoption /procedure.
Mr. Montag referred to the overhead and the procedure set forth to implement the moratorium, There are
critical dates involved, They would be amending the current land use regulations and would have to meet the
public requirements, He referred to the aggressive and proposed schedule. He reviewed the sequence of events and
that those are based on the requirement for public notice. He stated the implementation date and the effective date
is the next big question, It could occur on the date of publication, it could be today's date. He suggested the Board
can choose any date the wish,
Commissioner Gates spoke to sending items to the Planning Commission and following process,
Mr. Fritze stated the Board is talking about direction to staff about the proposed regulations, They are
asking for direction as to a proposed date. They have drafted proposed notices that will incorporate the date and the
direction given by the Board, He stated that will be something that the Board has to give direction on,
Chairman Johnson stated his preference would be that the publication date would be the date, If they decide
they are going to set a date of October 14, it doesn't make a lot of sense,
Commissioner Phillips suggested if a moratorium is called it should start on the published notice date,
Chairman Johnson concurred,
IGA's with the towns are another consideration, Discussions with the towns can occur concurrently, The
operative question is one of schedule and the effective date,
Commissioner Gates stated he would like to see that the towns join in with this for if they don't they will go
around the fence, He suggested Basalt has discussed it, the town of Gypsum has looked at it.
Kent Mueller, Town manager of Basalt stated he thinks it is important to look at the reason, He stated they

Chairman Johnson stated they didn't cut six months off the process but rather two months,
Mr, Fielder suggested they would get done by the end of July.
Chairman Johnson stated they are taking it eight months to six months.

Chairman Johnson suggested the jobs will not go away with the moratorium,
Mr. Fiedler suggested if the developers know it is more difficult to get projects approved, jobs will leave
this County, Construction and every related trade will be effected ifthere is less construction going on,
Mr, Fiedler suggested the remaining number of units is in fact 2775 vs 5600 as stated in the master plan, He
stated he would make that available,
Pete Feistmann, area resident, stated some of the issues have be clarified, He agreed if there is a moratorium
it will slow things down, He suggested we are right in the middle of another boom/bust cycle, He stated it is much
like the Titanic, He believes if we continue to allow development at the present pace he is concerned that people
will find this a less attractive place than the places we compete with. He suggested at some point the balance will
swing. Just Adam's Rib and Vail Valley Center alone are significantly more than the 2775. One million square
feet of commercial feet is bigger than Cherry Creek Mall. He spoke to the stopping of a project in the middle and
the right to due process, He suggested upzoning is a privilege unless they believe it is the interest of the community,
When the developer bought the land, they knew what was there, You don't have to say yes, He believes they gave
Kummer too much, That was an opportunity lost. He hopes they will think hard about the big projects, He stated
when a developer comes to them, they have a bottom line and they won't know it until they push really, really hard,
Annie Egan, area resident, stated she hopes in making their decision that they will look at what benefits the
majority of the constituents verses what benefits the development community. They will continue to make
hundreds of thousands of millions of dollars, She spoke to the benefits to the construction workers, It will slow us
down, briefly and for a bit. It will make the growth more gradual thus sustaining jobs of many more years, It will
support the majority of the constituency not only to get the land use regs in order. It will help to evaluate the
infrastructure before more is approved. Development must pay its own way. She feels that in making decisions as
important as this that they consider deliberating as a jury does to give their concerns careful consideration,
Kelly Bonser, area resident, stated she agrees with both Annie and Peter and that a moratorium means
responsibility, She doesn't know that six months is long enough. She spoke to the workers being effected and the
percentage of workers coming from out of county and that this will improve the workings for those here, She spoke
to Commissioner Gates saying the County is in a crisis. She suggested if an elected official will say we are in crisis
it is a concern,
Commissioner Gates tried to explain that he was speaking to pitting neighbors against neighbors,
Clark Ewing, McCoy, reiterated there is more to Eagle county than real estate. He thinks we need a break, a
chance to catch our breath, Look at the resources, human, natural, etc. and look at ways to use the resources
properly. A six month time period with everything that has been submitted, he doesn't see how much will be
accomplished. He asked if six months is a rational time period to look at the impacts, The impacts are serious,
such as with the schools, He spoke to the bond issue and feels the school people have not had an opportunity to
look at where development is going to go. He spoke to the enhancement of our society and education networks,
Rather than then intensity of high dollar real estate turn over that is feeding this dynamic, The moratorium will give
the County time to evaluate where they are, He hopes it will be for more than six months,
Howard Leavitt, Avon, thanked the Board for being able to participate, He asked if a moratorium is put in
place if they would not accept any more applications for projects that fall outside the moratorium.
Chairman Johnson stated they would set a date certain and that any application that came in after that time
would be applicable to the moratorium. If it was outside of upzoning it would be okay to submit, Existing permits
would continue. Summarizing, construction will continue, He understands what they are considering here is the
possibility of taking a step back for six months allowing the County to get caught up. He suggested they would
continue to reap the benefits, He spoke to the two and one half year moratorium and had two record years of
construction, He stated all they want to do is slow the train down, not stop it. He would like to see the developers
give the time for this to happen properly, He suggested they compromise and seek coordination with Community
Development to make sure this gets done right the first time, He stated he is not proposing to close the door but for
the last couple of years unbridled development has gone on, He believes this economy is driven by development.
He named the food change, He agrees there are plenty of jobs to be had and they don't risk loosing the jobs when
there are plenty to come. He spoke to a different type of person moving to the valley. People were here because

moratorium because the Board isn't doing their job, He suggested they may not have said no to things he's brought
forward, but they have changed the scope, Land use is fine tuning and doing the best. Self imposed moratorium
means they don't trust themselves,
Chairman Johnson asked when the last time was he tried a case in court, He asked how many ghost units
they have,
Mr. Mandel stated they started looking at that today and he is not sure of the answer, In looking at Beaver
Creek and Arrowhead at this point, compared to what was shown on the master plan, it is in excess of one thousand,
He spoke to errors in their plan, It is not running out of real estate, They are trading calls, There are errors in
math in the master plan. He feels it is half the 5600 shown on staffs report,
Chairman Johnson spoke to the units approved on PUDs that are vested.
Mr. Mandel stated they are vested where the usage of the units are subject to rules,
Chairman Johnson suggested they had run out of real estate. Without them coming in and saying they won't
build them they will continue to be counted, He suggested zoned units in the County will remain unless they can't
be built.
Commissioner Gates suggested they are zoned for so many units providing they can come up with the land
to do so, The figure mayor may not come to fruition,
Mr, Mandel spoke to the timing of the units, He stated the units may not be ripe for immediate
development. They may not get developed for many years. He stated most of the real estate is in the hands of the
ultimate user,
Jim Wear, an attorney in the valley representing many people involved in real estate large and small, stated
he is concerned about specific issues and asks why they are having a moratorium, He doesn't know of any huge
projects waiting in the wings that aren't being dealt with. He thinks this will tie up individual small land users, He
is concerned with the special use permits and those that may technically increase the intensity, He suggested the
perception that it will increase intensity is vitally important. He urged the Board to use as much specificity as
possible, He stated a lot of innocent voters will get caught up in this. He spoke to PUD amendments and approval
that goes years back. He suggested it is creating a bureaucratic nightmare, He cautioned the Board to be specific
about the reasons, He suggested it is the projects that are in here that have caused the concern,
Chairman Johnson stated they do need to be very specific with the special use permits and doesn't believe
those will be restricted. He spoke to the PUD and the movement of density not being part of it.
Chris Jouflas, area resident, thanked the Board and stated he appreciates the job they are doing, He stated
the affordable housing, if it comes down the pike, would be very bad, He stated they would be compressing the
needs, He is not in favor ofthe moratorium but he doesn't want to see them get in a catch 22, He stated a
moratorium is like martial law and developers create jobs, He suggested if they have one that it be a "lite"
moratorium.
Kathy Langewalter, area resident, stated she in favor or the moratorium, She spoke to the ghost units and
those being caretaker units in many cases, She suggested that someday somebody may build those and that those
are they types of units that need to get built. What she understands is a moratorium will be on the increase of
density or and increase of intensity. She suggests they will not stop construction in this valley, She is in
architecture and sees the onslaught of business and opportunity and things happening, It is nice to have a breather
and allow the Planning Commission, the Commissioners, and County Staff to finish their land use regulations, She
believes it is important to have the time to spend on the big projects that are coming through the process, She stated
she would like to see a six month moratorium with a six month extension, She would like to see an exception on
affordable housing. She spoke to the community and bringing people in and absorbing people slowly, She stated
she has seen the community being increased so rapidly it doesn't give new comers a chance to be absorbed.
Commissioner Gates spoke to his dream of affordable housing and doesn't believe there is any such thing in
Eagle County, He spoke to buying lumber at the lumber yard and buying an eight feet long board, It was $25,79,
Talk about affordable housing, it won't happen,
Dick Cleveland, area resident, stated he is happy to be here today to discuss this, He stated it is reasonable
to look at the impacts and to plan accordingly, He doesn't feel its unreasonable to wait six to nine months, What
really are the impacts when you add those not built yet to those that really are. He endorsed the idea of starting the
moratorium today. He feels that six months in unreasonable. It will take two months even to set the guidelines for
the moratorium and effectively do anything else, He suggested a nine month period or a six month period with a
three month extension, The impact on this community is minimal. Lets take a breath and see what can be done,

stated in both instances the results were drastically increased real estate prices, A vote for a moratorium is a vote
for increase in prices, He spoke to the Sundridge units. We do have problems in the County but most efforts are
spent dwelling on the problems not on the solutions, He spoke to the need to work on the solutions, He talked
about the costs being passed on to the consumers, He spoke to the rewards to developers for good projects and
rewarding them with density. A decrease in density decreases the cost in housing, Take advantage of the resources
available, Hard work, long hours and lots of people will be required, Ifwe don't have the staff, get more,

He spoke to a township wanting to tax building materials that come in from the outside, He stated what they are
talking about is a moratorium and the only reason they have so much on their plate is that a year ago, a month ago,
moratorium was a whisper. He spoke to Avon and the whispered word of moratorium, He stated the housing issue
has to be addressed and it has to be addressed in this administration. He stated the reason this is no longer a
community is that most parents are working two jobs, Most don't want to leave here but to keep up they must work
two jobs, He stated if we increase the staff and take the load off of them then they demand a developer come
forward with a perfect plan, A moratorium is not the answer, it is to take a little more time,

them catch up if they are behind, They have the ability to look at the project and see if it is good for the county or
not good, if its not good they can turn it down. Impact fees, when they started this they asked all the departments of

Commissioner Gates moved for a five minute executive session to discuss the moratorium,
Commissioner Phillips seconded the motion. The vote was declared unanimous,
The Board returned and stated they discussed the legal procedures regarding the moratorium and other
specific cases of moratoriums.
Commissioner Phillips stating that those representing the Towns left but it was unfortunate because she
wanted to ask if they would join in. She stated last week they listened to the people that spoke, She does not
believe that last week made a decision for them, Tonight was the night to discuss what it would take to put a
moratorium in place. She believes there are reasons they need to look at a moratorium, A specific reason is getting
the land use regulations in place. Six months has been discussed, She needs to think about if a moratorium is
relative, She feels with what is in the process it might be time to stop and look at the reasons, She questions
whether having a moratorium will cause them to have an attainable goal. She spoke to the infrastructure and the
water and sewer impacts being addressed by the special districts, The schools are a concern and the population
increasing those, The schools also have a right to make a decision on building affordable housing for people on
school district land, Affordable housing is an issue to address, She stated there are housing projects in the process
but asks if they will exempt affordable housing because of the need here, The County is being asked to approve
urban housing that is in unincorporated Eagle County, One has to look at the length of a moratorium and she feels
six months is sufficient. These are the issues in her mind, the specific reasons, the time line and whether the goal
is obtainable,
Commissioner Gates stated he has flip flopped four different ways. Whether a moratorium is right or wrong
he is not sure. He would be willing to do a moratorium for six months. He doesn't' think it is right but he will let
those who want it try to figure it out.
Chairman Johnson stated when they looked at Edwards and the $18,000,000 impact on the roads that is
when he decided they needed to look at the moratorium. He suggested that these things need mitigation. When
