This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of March 30, 1998, subject to review by County Administrator
B) Approval of the minutes of the Board of County Commissioner meetings for March 16 & 17,
1998
C) Memorandum of Understanding between Eagle County and Eagle Computer Systems, Inc, And
UGC Consulting concerning implementation of a GIS System within the Eagle County computer system
D) Agreement between Eagle County and Eagle Computer Systems, Inc, to provide system software
support agreement, AIMS
E) Agreement between Eagle County and Eagle Computer Systems, Inc, to provide system software
support agreement, CAMA
F) Sales Agreement between Eagle County and Eagle Computer Systems, Inc. for a software sub-
license and ECS software sub-license, CAMA
G) Sales Agreement between Eagle County and Eagle Computer Systems, Inc. for a software sub-

Commissioner Phillips stated she does have corrections on the minutes that she will submit to the clerk.
Bob Loeffler, Deputy County Attorney, stated item H has some questions and he wonders if that should be
pulled,
Chairman Johnson stated on C, D, E, and M he has questions, On items C, D, and E he asked if these are
automatic annual renewals on these contracts and asked about the vendor sending a letter about price changes,
Allen Black, Eagle County Assessor, explained that on D and E as long as payments are made, they have a
contract, He spoke to the Memorandum of Understanding between ECS and UGC and the GIS computer.
Chairman Johnson stated on C it was not the renewal but the price of the hourly work. He questioned them
providing information and not giving technical assistance,
Mr. Black stated there will be some technical interpretation included, He stated on the contracts in his office
there should be no costs, There will be some minor costs on the ADAPT system,
Mr. Loeffler stated this is engaging ECS and UGC in conversation for UGC to get what is needed for

Chairman Johnson asked if any claims were made.
Ms. Black responded no,
Commissioner Phillips moved to approve final settlement between Eagle County and Hyder Construction
Company for the Old Courthouse Project.
Commissioner Gates seconded the motion, The vote was declared unanimous.
1041 Permit Completeness Hearing, Eagle Park Reservoir
Ray Merry, Environmental Health, presented the 1041 completeness hearing for Eagle Park Reservoir for
the delivery of water to municipal, commercial and irrigation water users in Eagle County and the Colorado River
Basin, He requested the Board find the application complete and set the estimated fees at $1,682.50, He stated the
applicant has asked for a waiver for the special use permit.
Commissioner Gates asked if they raise the height do they have to come back for a new application with the
spillways,
Mr, Merry stated it was not taken into consideration with the application submitted, That was the existing
reservOIr.
Commissioner Gates moved to find the 1041 application complete for the Eagle Park Reservoir, for the
delivery of water to municipal, commercial and irrigation water users in Eagle County and the Colorado River
Basin, The estimated fees shall be set at $1,682.50.
Commissioner Phillips seconded the motion. The vote was declared unanimous,
Commissioner Phillips moved to waive the special use permit,
Commissioner Gates asked if this is consistent with what has been done previously,
Mr, Merry stated it has been done in the past,
Commissioner Gates seconded the motion, The vote was declared unanimous,
Acceptance of Road, Gates Ranch
Commissioner Gates suggested this application may look like a conflict of interest. He spoke to the gravel
pit that is up on the mesa and was owned by his family, In lieu of payment for gravel, the county agreed to gravel
the main road and his road, The main road was graveled but not his, He stated the pit was used, He also used the
pit and hired a truck to get gravel because the County refused to load him. He spoke to an agreement with Routt
County and the County objected to him getting gravel from the pit. He stated the last two loads of gravel he has
gotten, he has had to come to Eagle. He stated his road is the only road up there that is not maintained by the
County.
Don Fessler, Road & Bridge Department, stated this was way before his time, Mr. Gates has approached
him about his driveway. He stated as far as he is concerned Eagle County can not expend monies to upgrade his
road, He stated he has attempted to get unprocessed materials from the pit. It is a very expensive proposition and
not knowing the standard, he figured with materials being provided and trucks from the Eagle/Gypsum area as the
BLM pit is the only one up there, He stated it has been closed and unused for nine to ten years, It was previously
permitted by Nottingham, He stated the costs are based on coming out of Eagle 21,020 feet by 20 feet wide. These
are based on contractor costs and with no monies budgeted, Costs for maintaining are included as well. Those
average $60.00 per hour and approximately 250 hours per year. He stated this is a unique situation,
Chairman Johnson referred to everyone else's road being done by the County.
Mr, Fessler stated it serves only the Gates Ranch but may cross the Nottingham property, He related he
hasn't seen anything in writing, He stated they do maintain the other roads up there and they have been since he
came on,
Chairman Johnson asked ifthey are roads or driveways,
Mr. Fessler stated it's tough but they may access forest service area,
Commissioner Gates suggested they don't go anywhere but to the ranch houses,
Commissioner Phillip spoke to many of the ranch driveways taken off in the past. She asked about the
length,
Brad Higgins, Road & Bridge, stated it is 4/1 0 of a mile,
Mr, Fessler stated they have other areas like this but they are clearly access roads to other areas,

Tambi Katieb presented file number PDF-000I4, Webb Crane. He stated this was a request to final plat the
Webb Crane minor PUD to include heavy truck and equipment storage, sales, rental and maintenance, Staff
recommended approval. He explained the site to the Board. Water will be provided by the Town of Gypsum,
Tom Boni, Knight Planning, stated this is a PUD and the zoning was placed on the property last August.
Commissioner Gates asked if this was five acres from a 40 acre parcel.
Mr, Boni answered yes,
Commissioner Phillips moved to approve file number PDF-00014, Webb Crane, incorporating Staff
findings and conditions,
Commissioner Gates seconded the motion.
In discussion, Tracey Cameron, area resident, stated she is concerned improvements of Spring Creek Road
are not being addressed, She stated there is a lot of heavy equipment using this road, She stated residents cannot
pass at the current time as the road is not wide enough, She stated this is a dirt road.
Mr. Boni stated the applicant met with the County Engineer and it was concluded $1,000,00 would be the
contribution for those improvements,
Commissioner Gates stated $1,000.00 will not be sufficient.
Mr. Boni stated when the process was started with the County is was for 35 acres, including improvements
to the road.
Chairman Johnson stated the reason only $1,000,00 is being collected is that is the amount allowed by
County Regulations, He stated the Board will note there are concerns with the residents,
Mr. Boni stated they have prepared a plan in conjunction with the other property owners and the Town of
Gypsum concerning improvements of the road and an upgrade of utilities.
Commissioner Phillips asked Ms, Cameron is she lived beyond this applicant.
Ms, Cameron stated yes she does,
Commissioner Gates asked if the mitigation plan was still in effect.
Chairman Johnson stated the mitigation is within the Land Use Regulations and was adopted by the Board,
He stated many developers have decided to pay the DOW rather than draft a wildlife mitigation plan. He stated
there are no wildlife that will be affected.

Tambi Katieb presented file number PDF-00018, Nottingham Cottages. He stated this was a request for
final plat for Nottingham Cottages PUD to include 5 short term occupancy cottages, 1 primary/secondary and 1
existing single family be converted into an antique/craft store on 2,85 acres. He stated the zone change was
approved by this Board on April 2, 1996, Staff recommended approval.
Chairman Johnson stated he does not remember the recreational vehicles being included in the original plan,
Mr. Katieb stated those were in the PUD Guide.

Commissioner Phillips asked about the pad,
Mr, Boni stated it is included in the PUD Guide.

hydrologic/hydraulic studies of the area, He stated they agree to submit those prior to reclamation, They have
various plans to consider. Western Mobile is willing to work with the County to come out with an end result that
works for everyone. They agree with the other two conditions,
Chairman Johnson asked why they would leave the special use permit over the rest of the land. They would
not be taking away the mining rights. This Board has held gravel operations to a much higher standard than in the
past. He asked why they would not bring it in under the present requirements,
Mr, Knight stated it would be easier to amend a permit than not. They, as applicants, chose not to effect
County property. They would like to negotiate an arrangement, He feels it would be in their best interest to leave
the permit in place,
Commissioner Phillips suggested this was brought to light when a study of all gravel pits was done, She
suggested they were to only have five acres being mined at one time.
Chairman Johnson suggested they are asking that six times the five acres be mined,
Mr. Long stated back in 1980 the original permit was for five acres but they were mining far less all over.
He stated they actually need 30 acres of mining at one time.
Commissioner Phillips asked about the operation of asphalt and concrete.
Mr. Long stated the only change they are requesting is increasing the mining acreage, The concrete and
asphalt are in and they have been operating for the last ten years, He said a local family operation for Glenwood
runs the asphalt plant and have for the last four years,
Commissioner Phillips questioned the lake and promotion of water and foul habitat. She questions how the
applicant can do that and thinks it is beyond a needed request from the County,
Chairman Johnson stated that is not a recommendation from staff, They have made three recommendations.

Commissioner Gates questioned the costs and feasibility of doing a lake,
Mr, Knight stated that is why the lake is only an option after further studies. Their number one plan is to
leave it flat and reseed it. He stated there is one issue they are changing and that is to have larger than five acres
disturbed, They are trying to make this a workable operation consolidating as much as possible. Mr. Knight stated
at the Planning Commission hearing it was pointed out that Western Mobile have been good neighbors,
Chairman Johnson asked what the allowance is in Edwards for a disturbed area,
Commissioner Gates asked about phase one,
Mr. Long stated they will be completing that.
Mr, Katieb spoke to the resource mining operations and said Edwards is not listed but the other comparisons
are 25 to 40 acres at anyone time,
Commissioner Phillips moved to approve file number ZS-00027 , Western Mobile, incorporating Staff
findings retaining the fifty acres not the 149 acres.
Commissioner Gates seconded the motion, The vote was declared unanimous.
