This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of March 16, 1998, subject to review by County Administrator
B) Approval of the minutes of the Board of County Commissioners meeting for February 17, 1998
C) Resolution and Power of Attorney conferring authority on the Attorney's Office to draw on Letter
of Credit for Ute Creek Subdivision LOC No, 2400, on account of Chris p, Jouflas, drawn on Alpine Bank Brand
Junction, in the amount of$28,576,93, to expire March 22, 1998
D) Resolution 98-35 and Power of Attorney conferring authority on the Attorney's Office to draw

expire the same date this year. Mr. Clarkson stated the applicant is requesting a three year extension. He explained
the information in the Commissioner's packets,
Steve Isom and Kevin and Tammy Tucker were present for the hearing, Mr. Isom explained the location of
the property and the zoning being appropriate for mixed and commercial use, He showed another map and the road
through the property, Mr. 1som stated Ace Lane has refused to participate in an extension of Willits Lane, He
showed a blow up of the residential units and the commercial area. What they have requested is an extension of the
preliminary plan for a period of three years, They have people very interested in doing the project and won't need
the extension until traffic warrants. At that time, if Ace Lane hasn't done something, they will condemn the area
through his property to finish the road. Mr. Isom stated they can submit a final plat but not within the time period
of the restriction.
Glen Alt was also present for the hearing, Mr, Alt stated he runs a real estate office in Basalt and has been
interested in Kevins project for some time, He has been looking to find partners interested in the residential, multi-
family development. They would like to start as soon as they can, Residential is their main intention, If the
approval goes away, they can't do anything, He stated his partners are Chaffin and Light. He spoke oftheir other
developments, They would like to get started if they can.
Steve Isom stated the hardship is it is approximately $30,000 to resubmit this project which is a tremendous
cost to resubmit what is present today. He stated the time period has also been a hardship as this is a sizeable
project. The difficulties they have had in working with Ace Lane is also a hardship, He compliments Kevin and
Tammy on the Wendy's development.
Kevin Tucker, applicant, stated after last years extension they worked on this for six months and were
getting nowhere. He stated they are ready to go with final plat, have the bid sheets ready to go, but that he doesn't
have time to get the final plat in before the restrictions of the PUD, He stated it has just been him and Tammy
working on this so they have been moving as fast as they could,
Chairman Johnson asked if they got approval for this after the Wendy's project.
Commissioner Gates stated in reviewing the minutes, time was the issue for the first extension.
Mr. Tucker stated they have been working as diligently on this as they could.
Commissioner Gates asked if this is the last extension,
Chairman Johnson stated there is no cap,
Mr. Tucker stated they are starting the final plat now,
Commissioner Phillips asked how much time they will need,
Mr. Tucker stated his main barrier is the scope ofthe project. Working with Mr, Alt will be a considerable
help,
Chairman Johnson questioned a couple of the issues as to being a hardship, He stated the reason should be
for good cause, He stated this was approved in 1994, they came back in 1996 and spoke to the road, but since then,
nothing has happened until this year,
Mr, Tucker stated they needed to have the road through Ace's project for him to work with the bank, He
stated those investors coming in now don't have to have the road, He had to have the financial support.
Chairman Johnson stated they may be setting a precedent if the good cause is that the applicant doesn't have
the financial resources, He stated he is having problems with the fact they had three years initially. He stated there
was no need for access through the property,
Mr. Isom stated the investors now don't need the access,
Commissioner Gates stated they not only needed the money but the expertise,
Mr. Tucker stated they moved as fast as they could,
Chairman Johnson asked what they will do if they come in again, He asked how much time they will need,
Mr. Tucker stated they won't be back.
Mr, 1som stated he would like to have at least two years,
Commissioner Gates stated he would hate to see it lost.
Commissioner Phillips moved to approve the extension of Preliminary Plan for Blue Ridge PUD Extension,
for a two year period,
Commissioner Gates seconded the motion,
In discussion, Chairman Johnson suggested whether or not the plan will still fit with a community is why
they have the time limits, He stated if there was good cause he would be able to vote for this,
Commissioner Gates stated Kevin is not a developer per say nor does he have unlimited funds, He hates to

Mr, Powell stated they have the water rights to serve those as they exist today, As further development
takes place, they will need to bring their rights along with them.
Commissioner Gates clarified the term wet water.
Mr. Currier stated it is a two prong approach, Having the physical rights is important.
Commissioner Phillips spoke to spreading the tanks throughout the development and let them pay for them
keeping a big tank off Brush Creek Road,
Mr. Currier stated they have looked at that but are asking approval of the 2,000,000 tank, He spoke to
discussions with Fred Kummer and Planning and Zoning about down zoning, They, Adam's Rib, proposed a site
within their development. The Town suggested if they could make that work they would downsize along with a
commitment for a tank on their development.
Chairman Johnson asked how much smaller a 1,000,000 tank is.
Mr. Currier stated a million gallon tank would take it down to the level of the transformer in the picture. He
stated the tank would be fourteen feet lower.
Mr. Powell stated it is 14 out of 35 feet leaving it 21 feet tall,
Mr. Walls stated the proposed tank is 116 x 35 feet.
Mr, Powell stated they spent all last summer with Adam's Rib in discussion. One ofthe things he would
like to remind them is the recommendation from the people who own and will operate the system for now and in the
future,
Commissioner Phillips stated her living room faces the tank in Upper Kaibab, She stated she likes the water
pressure and the fact there is always a supply up there, She spoke to the other water tanks and there being three at
this time, four in total. What she wonders if the smaller tanks won't work better. She spoke to their tank breaking
down. She suggested smaller tanks should be considered,
Commissioner Gates asked about drought years and the need for storage.
Chairman Johnson stated Commissioner Gates comment goes to what Commissioner Phillips was saying
about using smaller tanks and having them in the subdivisions as they come on line,
Mr. Currier stated the town has six storage tanks in reality now, He listed where they are. He stated the
tanks are integrated for the most part, Additional tanks mayor may not work depending on build out. In some
areas they may have to pump up into a tank. He stated the two million has some advantages in a stream flow
concern.
Commissioner Gates spoke to the extremely hot years.
Chairman Johnson asked Mr. Katieb to review the conditions.
Mr. Katieb reviewed those for the record as follows:
1) The tank and the existing building will be landscaped from all sides by undulating tree and shrub
planted berms, thus reducing it's overall visual impact. Trees will be a minimum of 15 feet high, with spacing of
15 feet. A landscape plan shall be submitted and approved by the Eagle County Community Development staff
prior to the issuance of any building permits,
Chairman Johnson asked about landscaping the whole tank,
Mr. Powell stated they will put their energies into the current properties and then to the rest. He questions
the undulating berms, but they plan to bring back a full landscape plan prior to building permits,
Chairman Johnson asked if it could come back before going to the Planning Commission,
Commissioner Philips spoke to putting the trees closer to the road.
Mr. Powell stated the pictures portray the area with no landscaping,
Chairman Johnson asked if the Board agreed to review this prior to it going back before the Planning
Commission,
2) All new lighting on the site will be downcast and not produce glare beyond the lot line,
Mr. Powell stated they will do that and on all existing buildings as well, The applicant agreed to #3, He
spoke to #4 saying they are well into that plan,
Commissioner Gates stated he would like to see that they are planning ahead.
On #5 Chairman Johnson asked why they are asking the corrective actions being implemented by the third
year.
Mr. Katieb explained as staffthey requested they be implemented in the first year, the applicant requested
five years, and the Planning Commission settled on three years,
